00:01:37.000 Look, one of the best things you could do to improve your health is get at least seven hours of quality sleep every night.
00:01:42.000 I know, it's hard to get that much sleep, but in your mind, it can keep you awake, and you just can't seem to get comfortable.
00:01:49.000 Some people wake up early and can't fall asleep again.
00:01:52.000 There are hundreds of reasons why you can't get seven hours of quality sleep.
00:01:55.000 But listen, it's very important because your body heals itself when you sleep.
00:01:59.000 And if you're not getting enough quality sleep, you're increasing your risk of disease, making it harder to lose weight.
00:02:05.000 Would you like to know about a way to get better sleep?
00:02:08.000 Well, look, you need to take magnesium every night.
00:02:11.000 Look, I take magnesium before bed.
00:02:14.000 It is a game changer.
00:02:16.000 No joke, before I even started a partner with the amazing people with magnesium breakthrough bioptimizers, I was a believer in magnesium, but their magnesium is actually better than what I was using.
00:02:25.000 Believe it or not, around 75% of people do not have enough magnesium.
00:02:29.000 They have a magnesium deficiency, which helps explain why so many people have sleep problems.
00:02:34.000 As soon as I started taking magnesium seriously, boom, out in five minutes.
00:02:37.000 Doesn't matter if I had a stressful day.
00:02:39.000 Doesn't matter if I worked out a lot.
00:02:40.000 By the way, magnesium is great for workout recovery, but it's as if magnesium is a magic potion from the heavens to get you to be able to fall asleep.
00:02:49.000 I'm telling you, it's the real deal.
00:02:50.000 Read about it online, you'll find out.
00:02:52.000 But there's actually seven unique forms of magnesium, and you have to get them all if you want to experience its calming sleep-enhancing effects.
00:02:58.000 I learned this the hard way.
00:02:59.000 So that's why I recommend magnesium breakthroughs by buy optimizers.
00:03:04.000 Simply take two capsules before you go to bed, and you'll be amazed at how much better you sleep and how much more rested you feel when you wake up.
00:03:11.000 For an exclusive offer for my listeners, go to magbreakthrough.com slash Kirk to save up to 42%.
00:03:17.000 Again, you can save up to 42% on magnesium breakthrough when you go to magbreakthrough.com slash kirk.
00:03:23.000 That is magbreakthrough.com slash kirk.
00:03:26.000 Get magnesium in your body today.
00:03:31.000 There's a lot of different races that are coming up that we need to keep our eyes on.
00:03:35.000 And I understand there is a concern.
00:03:38.000 There's a concern by some of you that Roe v. Wade, the gun issue, that it's going to mess up our chances coming into November.
00:03:48.000 And you might be right.
00:03:49.000 I share some of that concern.
00:03:51.000 However, I still believe, as I look at things as they are, it actually might be a net positive.
00:03:57.000 I want you to try to entertain that for a second.
00:03:59.000 And by the way, right is right regardless of political viability.
00:04:03.000 But I know some people are emailing us, freedom at charliekirk.com.
00:04:06.000 Charlie, I'm really worried that we're going to get off kind of the focus on gas prices and the border and all of this.
00:04:14.000 Could it be that the media is misleading us, that this actually might be a good thing for Republicans and a difficult thing for Democrats?
00:04:26.000 Help us unpack this is the great Jack Pasobic from Human Events Daily does a great job and is a common guest on this program and promotes Turning Point USA quite a lot, which I deeply appreciate.
00:04:38.000 Jack, welcome back to the program.
00:04:39.000 Charlie, I'm excited not only to be on with you, but also excited that we just announced that we are all going to be sharing a huge celebration of all the victories that we've had, right?
00:04:49.000 From the Supreme Court to the New York State Supreme Court the other day.
00:04:53.000 We're all going to be celebrating together down at Tampa, Florida for the Student Action Summit.
00:04:58.000 Can you believe it?
00:04:59.000 It's going to be amazing.
00:05:00.000 Thousands and thousands of people, Student Action Summit, and then Turning Point Action will be hosting Trump and DeSantis there.
00:05:05.000 It's going to be amazing.
00:05:06.000 We got the biggest speakers.
00:05:08.000 Wait, wait, wait, wait.
00:05:08.000 Trump and DeSantis together.
00:05:10.000 And both.
00:05:10.000 Together.
00:05:11.000 And we have a straw poll.
00:05:13.000 Believe it or not, we have a straw poll.
00:05:14.000 So we'll see who wins.
00:05:16.000 Uh-oh.
00:05:16.000 Uh-oh.
00:05:17.000 It's spicy.
00:05:18.000 It's going to be interesting.
00:05:19.000 So, Jack, the conventional wisdom in the media is that this is going to help Democrats.
00:05:25.000 In fact, let me play a piece of tape here from SC Cup cut two here, where she says that because of the overturning of Roe, it's hard to imagine the Republican Party surviving this.
00:05:38.000 Play cut two.
00:05:39.000 The question that Brianna asked, I think, is the right one.
00:05:41.000 It's sort of now what?
00:05:43.000 What are now that anti-abortion activists got what they wanted, right, which is to overturn Roe versus Wade, what happens now politically, do you think?
00:05:52.000 It's hard to imagine the Republican Party surviving this.
00:05:57.000 Between anti-abortion, anti-LGBTQ, book banning, anti-democracy, I mean, add all the regressive bullshit to this.
00:06:06.000 Add it all together.
00:06:08.000 And I don't know who's left in the future and future generations to be drawn to this party.
00:06:14.000 Jack, is this a death sentence for the conservative movement?
00:06:18.000 A death sentence?
00:06:19.000 No, this is more like a new lease on life, because as people have been saying, I think rightly so, that the old conservative movement is dead.
00:06:27.000 Welcome to the new right.
00:06:29.000 So the difference is, if this were the old conservative movement, if this were the 1990s, if this were even the early 2000s, right?
00:06:36.000 What was the status quo on abortion, right?
00:06:38.000 And let's just talk politics right now.
00:06:40.000 Let's talk about where things were in the country back then.
00:06:43.000 The status quo was safe, legal, and rare, right?
00:06:47.000 Remember that safe, legal, and rare?
00:06:48.000 And it was sort of this entrenched battle where people really couldn't get any traction along the edges on this issue.
00:06:54.000 But then what happened?
00:06:55.000 The progressive woke left went completely crazy with it.
00:06:59.000 You had President Trump there on the debate stage with Hillary asking her about late-term abortion, and she won't even deny that she supports it.
00:07:09.000 She won't say that that's completely crazy.
00:07:11.000 So when we've got the technology on our side, when we've got science on our side, when we've got right on our side, because we know obviously individual DNA means an individual embryo individual person, right?
00:07:22.000 They went so far with it that they gave us an inch and then we were able to swing the massive people in the middle.
00:07:29.000 Then they start launching culture wars on, you know, teaching our kids there's 85 genders, that you can be whatever gender you want, that it's, you know, it's pick your own gender of the week kind of thing.
00:07:40.000 They started going completely crazy.
00:07:42.000 So I think the context of what is what SE Cup fails to realize, the context is we are in the culture wars, whether you like it or not.
00:07:50.000 And if you're putting up vote or if you're putting up points on the board for the culture of wars, if you're showing that you're part of the movement that is going to bring the great ship that is the United States, trying to, you know, like, it's like when I was in the Navy, right?
00:08:03.000 You know, an aircraft carrier, it doesn't turn on a dime, right?
00:08:06.000 It turns very slowly, but you've got to move inch by inch by inch.
00:08:11.000 So, in order to do that, it's not that America is lurching, you know, to the far right or something.
00:08:16.000 It's that America, yeah, sure, it's moving right, but it's moving back to the center right.
00:08:20.000 And that's where this country always was.
00:08:23.000 That's why you're seeing wins like this.
00:08:25.000 And people are going to get on board with the side that's showing actual tactical gains on the political battlefield in terms of this, right?
00:08:34.000 Roe v. Wade was a sacred cow for the left for a generation, and now it is gone.
00:08:41.000 That never would have happened if you weren't in this culture war environment that we are now with the new coalition of the new right.
00:08:47.000 That's well said.
00:08:48.000 Rasmussen reports that half of voters approve of the Supreme Court decisions ruling on abortion.
00:08:55.000 Approved 50%, disapprove 45%.
00:08:58.000 Even though most voters identify as pro-choice than pro-life, a full half of them approve of the recent Supreme Court ruling that overturned the 1973 Roe versus Wade decision.
00:09:10.000 And so, look, Jack, we're both pro-life and we're outspokenly pro-life.
00:09:14.000 But you and I both know that in our broad coalition of trying to win elections, there are people that will not share the same life views that we have.
00:09:22.000 And with that being said, though, it looks like this decision is, I believe, actually a moderate decision.
00:09:28.000 Send it back down to the states.
00:09:30.000 Let the states decide however they want.
00:09:32.000 You and I would both love to see national abortion bans come through, obviously.
00:09:37.000 But letting the states decide, it seems as if, believe it or not, according to Rasmussen, 50% of Americans agree.
00:09:45.000 It's remarkable, isn't it?
00:09:47.000 Well, and it's also because you have to go in and look at the methodology.
00:09:50.000 So I did check this out.
00:09:51.000 I check it out whenever I see any of the legacy media polls on pro-life as well.
00:09:55.000 Whenever you see the legacy media, whether it be CNN or MSNBC, et cetera, youGov even will do this.
00:10:00.000 They'll say, has stripped the constitutional right to abortion, right?
00:10:05.000 Or they'll say something like this: Do you agree?
00:10:06.000 And they get these, you know, they get these huge, huge majorities.
00:10:10.000 But the way Rasmussen asked the question was: do you agree with allowing states to decide and to set their own policy on abortion?
00:10:19.000 Well, that's where you get this huge 50% number because, well, hold on a second.
00:10:23.000 Wait a minute.
00:10:24.000 I thought that we were supposed to be the ones that defend democracy.
00:10:28.000 And all of this is about defense.
00:10:31.000 We hear from the January 6th committee every single day that we have to defend democracy and these horrible far-right conservatives, or what did Wanda Sykes say that that middle part of the country is just telling everybody what to do?
00:10:43.000 No, that's not how it works, right?
00:10:45.000 It's actually going back to the states.
00:10:47.000 It is going to be a more democratic view.
00:10:49.000 There are states right now that already have the trigger laws on the board, on the books.
00:10:49.000 There will be states.
00:10:53.000 States like Arizona, which, by the way, interesting case, never repealed their abortion laws.
00:10:58.000 That's still on the board.
00:10:59.000 No one really knows what's going to be happening here.
00:11:01.000 It's going to happen in those other states.
00:11:03.000 I want to play Cut 52.
00:11:04.000 Wanda Sykes, quote: The problem is the middle stuff.
00:11:07.000 I mean, come on, it's the states in the middle, that red stuff.
00:11:10.000 Why do they tell you they get, why do they get to tell us what to do?
00:11:14.000 Or the majority of us live out in New York and California, and we're paying for all this crap, really.
00:11:18.000 I've said it for a while, Jack.
00:11:20.000 Tragically, we are stumbling towards a national divorce.
00:11:23.000 It's going to happen.
00:11:25.000 If this does not get interrupted by leadership, the country is going to tear apart.
00:11:30.000 It's just going to happen.
00:11:31.000 They don't want to live with us, and it's becoming a mutual feeling.
00:11:37.000 I think it's tragic.
00:11:38.000 I don't want to see that happen, but you cannot talk the way Wanda Sykes is talking and have a country play Cut 52.
00:11:44.000 The country, it's no longer a democracy, right?
00:11:47.000 I mean, it's no longer majority rule.
00:11:50.000 The problem is that middle stuff.
00:11:52.000 It's those states in the middle, that red stuff.
00:11:56.000 Why do they get to tell us what to do when the majority of us live out, you know, New York, California, and we're paying for all this crap, really?
00:12:06.000 I mean, right?
00:12:08.000 Yeah, really insightful constitutional wisdom from Wanda Sykes.
00:12:12.000 I don't even know who she is, to be perfectly honest, which goes to show, I don't know what constituency is.
00:12:17.000 Interesting facts about Wanda Sykes, Charlie.
00:12:19.000 Not only is she a comedian, but is a former NSA analyst.
00:12:23.000 Not everybody knows that about Wanda Sykes, former NSA analyst.
00:12:26.000 Very interesting.
00:12:27.000 So, Jack, to piggyback kind of off the point and to reinforce it, there is this arrogance of kind of this is the middle stuff, this is the red stuff.
00:12:36.000 Do you think this is sustainable?
00:12:37.000 I know I kind of riffed on that a little bit.
00:12:39.000 I want the country to remain together.
00:12:41.000 It's my heart for America to remain as whole.
00:12:43.000 But it seems if they're like, they're calling for a national divorce.
00:12:47.000 What are your thoughts on that?
00:12:49.000 Well, yeah, actually, at the end of that clip, I watched that earlier, and she says something about like, she says, we're paying for everything.
00:12:57.000 And so it's like when you take someone out to dinner and you're footing the bill, she says, fitting the bill, it's actually footing the bill, Wanda, that you get to decide what you're eating.
00:13:07.000 So just shut up and eat.
00:13:09.000 And so that's how they look at you.
00:13:11.000 That's how they look at the people in the great middle of this country.
00:13:16.000 But I do think it's very interesting, Charlie, that she mentioned food, because whenever I hear the bicoastal elites talk about and demonize and ridicule and mock people that live on the inside of our country, I know what you're going to say.
00:13:28.000 Yeah, that's where your food comes from.
00:13:30.000 It's the breadbasket of your entire civilization.
00:13:33.000 You haven't ever actually thought this one through, have you?
00:13:35.000 No, and I mean, all the kind of vegan food trends, good luck without an agricultural base in Malibu and in Manhattan.
00:13:45.000 I want to play another piece of tape here, Jack, for you, and I want to get your feedback.
00:13:50.000 So I want to go to this one right here, which is Whoopi Goldberg suggesting the Supreme Court will bring back slavery based on the decision that overturns Roe versus Wade, play cut 53.
00:14:07.000 We were not in the Constitution either.
00:14:09.000 We were not even people nothing is pressing anymore.
00:14:13.000 Well, you better hope that they don't come for you, Clarence, and saying you should not be married to your wife who happens to be white because they will move back.
00:14:23.000 And you better hope that if nobody says, you know, well, you're not in the Constitution, you're back to being a corner.
00:14:28.000 Back to the 50s.
00:14:29.000 That's not going to work either.
00:14:31.000 Mass constitutional literacy.
00:14:33.000 And this all kind of comes into the midterm elections where they're going to try to make this a major issue.
00:14:38.000 So, Jack, your thoughts on Whoopi Goldberg and then what states do we keep our eyes on as we head through primary season and a general election season?
00:14:45.000 Well, I look at this and you're absolutely right, right?
00:14:48.000 She's obviously doing everything she can to drive out Democrat voters to the polls over this issue.
00:14:54.000 And so Ras Newsen looked at that.
00:14:57.000 They put it around, it's top 10, but it's not top five, right?
00:15:01.000 It's top 10, but it's not top five.
00:15:02.000 Why is that?
00:15:04.000 Because everything else is falling apart around us, right?
00:15:08.000 It's not just the president that's collapsing on a bicycle.
00:15:11.000 It's the economy that's collapsing.
00:15:12.000 It's our foreign policy that's collapsing, right?
00:15:15.000 And it's the prices when you go to purchase something.
00:15:20.000 Charlie, I was saying earlier that we need to call this like, I don't know what we're going to call it.
00:15:24.000 We need to come up with an index, right?
00:15:26.000 Because Biden said when he talked about inflation, he said you can remove fuel and food from the inflation numbers.
00:15:33.000 Remember him saying that?
00:15:34.000 And I still haven't gotten past that moment to say, we need to come up with like a turning point Middle America index, right?
00:15:41.000 Where the only thing we track in that inflation is food and fuel.
00:15:46.000 Because guess what?
00:15:47.000 That's what's going to run the Democrats out of office.
00:15:50.000 That's what's going to run Joe Biden out of office because that's what people vote on.
00:15:54.000 This other stuff, the social stuff, that's important.
00:15:56.000 The culture war stuff is there, but I guarantee you for those people in the great middle of America, they care a lot more about that.
00:16:02.000 I think the social stuff is going to be awash, right?
00:16:05.000 So I think you're going to get people that want to confiscate guns, people that like guns.
00:16:09.000 I think it basically balances itself out.
00:16:12.000 I think you're going to get very motivated pro-life voters finally saying, wow, we can give political power and get meaningful gains on abortion.
00:16:19.000 And then some very motivated abortion fanatics.
00:16:22.000 But where the elections are going to be won are at the gas pump and in cost of living and the border as well.
00:16:30.000 We cannot forget the border.
00:16:31.000 The border, I do not consider to be a social issue.
00:16:34.000 I think the border is an 80 to 90% issue.
00:16:37.000 And at SAS, we're going to be revealing just a short snippet of our border battle documentary that we've been doing, where we sent a whole team to embed with Border Patrol, immigration's custom enforcement.
00:16:48.000 It will blow people's minds.
00:16:50.000 I've got to see part of this.
00:16:52.000 And I was actually on set for a little bit of it.
00:16:54.000 And it's amazing.
00:16:56.000 It will blow your mind.
00:16:57.000 I think it's one of the best pieces of exposing what's happened on the border that I've come across.
00:17:02.000 Obviously, I'm biased.
00:17:04.000 Jack Pesobic, everyone, subscribe to his podcast.
00:17:06.000 Jack does a wonderful job.
00:17:08.000 Jack, thanks for your commentary as always.
00:17:09.000 Appreciate it, Charlie.
00:17:10.000 Thank you.
00:17:13.000 Hey, everybody.
00:17:14.000 This common sense is brought to you by the folks at secondvote.com, amazing people who are fighting back against woke corporations.

00:17:24.000 Good afternoon.
00:17:25.000 I'm Rebecca Hatfield, president of Second Vote.
00:17:27.000 We've had uniquely American common sense since 1776, but now we're in the age of common nonsense.
00:17:33.000 Today's nonsense comes from the pro-abortion extremists protesting outside the home of Supreme Court Justice Amy Coney Barrett.
00:17:40.000 They were wearing clothes covered in fake blood and holding baby dolls.
00:17:43.000 It's not just nonsense.
00:17:45.000 It's downright disgusting and illegal if they hope to persuade Justice Barrett.
00:17:48.000 But woke corporations are getting ready to use the dollars you spend to fund these extremists if the Supreme Court overturns Roe versus Wade.
00:17:56.000 If you shop at places like Starbucks and Target, you can be sure they are giving your money to planned parenthood.
00:18:02.000 So is it any wonder the new Gallup poll shows that the record-breaking 50% of Americans say that the U.S. has poor moral values?
00:18:09.000 The poll also showed that the number of Americans who believe in God is at a historic low.
00:18:14.000 Common sense tells us that these things are connected.
00:18:16.000 The lies pushed by big tech, woke corporations, and our far-left government have begun to erode the morals and values of Americans by contradicting and assaulting what we know to be truth.
00:18:28.000 They censor conservative voices and push views inconsistent with the long-held religious beliefs and eternal truth.
00:18:34.000 That's why Second Vote is helping you to push back.
00:18:36.000 At Second Vote, we do the research to expose big corporations by scoring hundreds of companies on traditional American and Judeo-Christian values.
00:18:44.000 And Second Vote has been around for 10 years with the mission of empowering you with the research to make better choices with your money.
00:18:50.000 So please make sure to arm yourselves every day with the knowledge you need to shop smart and stop funding the left.
00:18:55.000 All the research you need is available at secondvote.com.
00:18:58.000 I'm Rebecca Hatfield, president of Second Vote, reminding you that your first vote is at the ballot box, but your second vote is with your wallet.

00:19:11.000 That's secondvote.com, promo code Charlie.
00:19:16.000 With us right now is Mike Davis, formerly chief counsel for nominations for the U.S. Senate Committee on the Judiciary and a Law Clerk, formerly and also helped Justice Gorsuch get on the U.S. Supreme Court.
00:19:28.000 Mike, welcome back to the program.
00:19:30.000 Thank you for having me, Charlie.
00:19:32.000 I always love when you do our interviews.
00:19:33.000 You have that beautiful picture behind you.
00:19:36.000 It's just, it's incredible.
00:19:37.000 So Washington Crossing the Delaware, if I'm not mistaken.
00:19:41.000 It is.
00:19:41.000 Yeah.
00:19:41.000 And I'm big, big, big admirer of that painting and what it actually means.
00:19:46.000 So, Mike, 10 years ago, I got my start in politics, and I was pro-life then as I am now, but I was told by people that Roe versus Wade would never be overturned.
00:19:55.000 10 years ago, Justice Scalia was lamenting that the court had gone off the rails.
00:19:59.000 What happened in a decade where we went from a court that was insane and dominated by Sutta Mayor and Kagan and upheld Obamacare as merely a tax, even though we know simply that that was an insane decision?
00:20:10.000 Where 10 years later, we now have restored constitutional sanity.
00:20:13.000 What do you attribute the success to?
00:20:16.000 I attributed this success to President Donald J. Trump and Senate Republicans.
00:20:21.000 President Trump in 2016 won an upset victory against Hillary Clinton in big part because he promised he would appoint constitutionalist Supreme Court justices and federal judges who would follow the law instead of rewrite the law.
00:20:38.000 And what we saw with this Dobbs decision coming out was the culmination of that.
00:20:43.000 It was because President Trump transformed the 5-4 John Roberts court to the 5-4 Clarence Thomas Court with the appointments of Justices Gorsuch, my former boss, Justice Kavanaugh, who I helped lead through the Senate confirmation, and then Justice Amy Coney Barrett.
00:20:59.000 So it is a fundamental transformation of the federal judiciary back to its constitutionalist origins, what it's supposed to be before the liberals hijacked the Supreme Court nearly 90 years ago.
00:21:12.000 So they're calling this court illegitimate, which basically is them saying, we don't like how they rule, therefore we're going to try to undermine everything they're doing.
00:21:21.000 So without going too deep into this, but we've talked quite a lot about this.
00:21:25.000 Just what are your immediate thoughts at the continued smear and character assassination of the brilliant Clarence Thomas?
00:21:32.000 It's a radical, radical assault on judicial independence.
00:21:35.000 They hate Clarence Thomas because he is a conservative black man who escaped.
00:21:43.000 He escaped the Democrats' plantation long, long, long ago.
00:21:47.000 They're even attacking his wife, Jenny, who's been a lifelong political activist, and she never worked in the Democrats' kitchen.
00:21:54.000 She's always been a conservative.
00:21:56.000 And so I think Clarence Thomas and Jenny Thomas should tell these Democrats to go to hell.
00:22:01.000 I think they do in their own way, but it's just the character assassination and the smear is so revealing of the American left and of the Democrat Party.
00:22:12.000 So let's talk about impeachment.
00:22:13.000 This is something that is now being talked more and more.
00:22:16.000 AOC calling, saying Kavanaugh, Barrett, and Thomas committed impeachable offenses.
00:22:22.000 Is there any hope that they will remove Supreme Court justices with impeachment?
00:22:25.000 Has this ever happened before in American history?
00:22:28.000 Walk us through that.
00:22:29.000 Only in America could someone like AOC go from cocktail waitress to fake constitutional scholar in less than a decade.
00:22:36.000 There is zero basis for any of these arguments for Justice Clarence Thomas' impeachment, for Justice Kavanaugh's impeachment, Justice Gorsuch's impeachment.
00:22:49.000 This is a radical assault on judicial independence.
00:22:52.000 It goes back to the fact that FDR nearly 90 years ago in the switch in time that changed nine, he cowed the Supreme Court, got them to change their jurisprudence and gave the federal government unlimited powers, essentially.
00:23:07.000 And so 90 years later, nearly 90 years later, President Trump transformed the Supreme Court.
00:23:14.000 The left loved the Supreme Court and the federal judiciary when they controlled it.
00:23:19.000 They've lost control now, and so they want to destroy it.
00:23:22.000 Cut 42.
00:23:23.000 This is Joy Behar screaming, we are in a theocracy right now.
00:23:27.000 Let's play Cut 42.
00:23:29.000 Don't we have separation of churches?
00:23:31.000 Yes, we don't anymore.
00:23:32.000 I think we don't have Thomas and have Thomas Jefferson there and Alexander Hamilton.
00:23:38.000 Hello?
00:23:39.000 Do we still have a separation of church and state here as in the Constitution?
00:23:43.000 Yeah, it's a First Amendment guarantee.
00:23:46.000 We don't seem to have that information.
00:23:48.000 We're in a theocracy right now.
00:23:50.000 Wrong, wrong, wrong.
00:23:52.000 Actually, nowhere in the Constitution does it say separation of church and state for the low IQ view.
00:23:59.000 It has an establishment clause and a free expression clause, which is a fundamentally different thing than separation of church and state.
00:24:05.000 That is pulled from a singular letter that Thomas Jefferson wrote to the Danbury Baptist Convention.
00:24:10.000 It was resurrected by either the Warren Court or the Burger Court to justify the elimination of prayer in schools.
00:24:16.000 But that's not really what we're even talking about.
00:24:18.000 We're talking about a 10th Amendment issue.
00:24:20.000 Nowhere in the decisions or the opinions of Gorsuch Kavanaugh, Amy Coney Barrett or Thomas or Alito, God bless Alito, who's just, I think, one of the most underappreciated members of the court, were they talking about religious views.
00:24:31.000 Expand on that, Mike.
00:24:33.000 Well, number one, if I were Joe Biden, I'd be very upset that Joy Behar stole his sunglasses and he should demand them back.
00:24:40.000 But number two, these leftists have a very fundamental misunderstanding of our U.S. Constitution.
00:24:48.000 Our U.S. Constitution is a loan agreement between we, the people, and our government.
00:24:55.000 And we loan our government specific, limited, separated, enumerated rights in exchange for the federal government securing, not giving us rights, securing our rights, right?
00:25:08.000 So we get our rights from God.
00:25:09.000 We're different from England, where we from where from which we declared independence.
00:25:13.000 And England's, the sovereign is the king.
00:25:16.000 The king gets, or the queen, the sovereign gets the power from God and loans power to its subjects through documents like the Magna Carta.
00:25:25.000 The United States is the opposite of that.
00:25:27.000 We are the sovereign.
00:25:28.000 We, the people, are the sovereign.
00:25:30.000 We get our power.
00:25:31.000 We get our rights from God.
00:25:32.000 And we loan power to government through the U.S. Constitution.
00:25:36.000 90 years ago, that got flipped on its head.
00:25:39.000 That's starting to change back.
00:25:41.000 This is nonsense, what the left is arguing about a theocracy.
00:25:46.000 Just because you're a high school football coach does not mean you lose your free speech rights under the First Amendment.
00:25:52.000 That doesn't mean you lose your free exercise rights under the First Amendment.
00:25:56.000 The Democrats, the left, the Marxist left have used the establishment clause for decades where it says that government can't establish a religion.
00:26:04.000 The Marxist left has used the establishment clause to chase Christians out of the public square because they hate religion.
00:26:13.000 They hate Christians.
00:26:14.000 It's their anti-Christian bigotry on full display here.
00:26:17.000 Not to mention, though, that they have their own religion of secular humanism.
00:26:22.000 They have the religion of secular humanism that they've imposed on the rest of us.
00:26:26.000 I want to play this piece of tape here, which is going to be a line that we're going to have to properly respond to, which is there's an accusation that is kind of being floated that these justices lied under oath, that they said one thing and they went to the other.
00:26:41.000 I had it right in front of me here.
00:26:42.000 Let me try to get it here, which is basically when they were going through the process that the justices were misleading to senators and other people.
00:26:53.000 I'll find the clip, but first, what's your response to that, Mike?
00:26:56.000 It's nonsense.
00:26:57.000 I ran Justice Gorsuch's confirmation as his former law clerk from the outside.
00:27:04.000 I was the Senate staff leader for Justice Kavanaugh's confirmation.
00:27:08.000 I worked on the Chief Justice and Justice Alito's confirmation from the Bush 43 White House.
00:27:14.000 I had a supporting role for Justice Barrett's confirmation from the Article III projects.
00:27:20.000 These Supreme Court nominees, they're federal judges.
00:27:23.000 They're bound by the judicial canons, and they all answer this the same way, whether they're Democrat-appointed or Republican-appointed, which is they will follow precedent.
00:27:32.000 And that includes following the law of precedent.
00:27:35.000 And the law of precedent includes factors that the judges have to look at, including whether the precedent is still good law and the consequences of overturning that precedent.
00:27:46.000 If Justice Gorsuch and Justice Kavanaugh somehow lied by doing that, then that means that Justice Kagan and Justice Sodomayor lied when they said that they would uphold precedent on Heller and the Second Amendment.
00:28:00.000 It's just political noise and political nonsense from liberals, whether it's Chuck Schumer or Senator Susan Collins, the Republican liberal from Maine who is losing her mind.
00:28:12.000 That's well said.
00:28:13.000 Any closing thoughts on this as we have about a minute remaining?
00:28:16.000 The court has received their vast amount of attention, and it's important that we recognize and realize we don't allow them to pack the courts.
00:28:25.000 Do you think that's in the cards if they actually get unified political power?
00:28:29.000 They will try to do it if they have the power.
00:28:30.000 And that's why it's so important for conservatives to show up at this next election and put a critical check on this.
00:28:36.000 We cannot, we've had nine justices since 1869, nearly 150 years.
00:28:42.000 We cannot allow this to happen.
00:28:43.000 If they pack the Supreme Court, we're going to lose everything.
00:28:45.000 We will lose our First Amendment rights to speech, to worship, Second Amendment rights to keep and bear arms.
00:28:51.000 The left talks about precedent now.
00:28:53.000 They will get rid of all of these precedents in a second if they pack the court and take power because all they care about is power.
00:29:00.000 Well said.
00:29:01.000 Mike Davis, thank you so much for joining us.
00:29:02.000 The wonderful Article 3 project.
00:29:03.000 Deeply appreciate it.
00:29:04.000 Thank you, Charlie.
00:29:05.000 Thank you.
00:29:08.000 Many of you ask us, Charlie, is Joe Biden going to run in 2024?
00:29:14.000 We've made the position publicly.
00:29:16.000 No, he is not.
00:29:17.000 In fact, we give it a 5% to 10% chance.
00:29:20.000 So why is all this stuff coming out against Joe Biden right now?
00:29:24.000 Well, it's probably being leaked by the Gavin Newsom for president campaign.
00:29:28.000 I don't say that jokingly.
00:29:29.000 I believe that there is a consolidation of interests, Nancy Pelosi, Eric Swalwell, Adam Schiff, and many others that are consolidating support of someone that could take over the White House that won't be deeply unpopular because of charisma.
00:29:44.000 Don't get me wrong, Gavin Newsom's the worst governor in America, only to be outrun.
00:29:47.000 Well, that's not true that he can't really run by J.B. Pritzker.
00:29:51.000 So that's a separate issue.
00:29:53.000 But Kathy Hochl and many others, J.B. Pritzker can more waddle, not to be outwaddled by J.B. Pritzker.
00:30:01.000 And so the California cartel would love nothing more than to have somebody in the White House.
00:30:07.000 And that is Pelosi, the Silicon Valley tech giants, the Napa Valley wine crew.
00:30:12.000 And that person they really are focusing on is Gavin Newsom, in my opinion.
00:30:16.000 But they got to get Joe Biden out of the way.
00:30:18.000 And one of the ways they're going to get Joe Biden out of the way is Hunter and Joe Biden's involvement with Hunter Biden.
00:30:24.000 Now, this is bubbling up to be a massive political liability for Democrats.
00:30:28.000 Democrats are worried kind of going into November, this is going to hurt them down ballot.
00:30:33.000 But some of the Democrats, this is their calculation.
00:30:35.000 They know gas prices are high.
00:30:37.000 They know the economy is terrible.
00:30:38.000 They know inflation is high.
00:30:40.000 They want to blame this all on Biden.
00:30:42.000 They actually, in some way, shape, or form are going to spin a midterm catastrophe.
00:30:48.000 The Democrats are going to spin a midterm catastrophe as a reason to get rid of Biden.
00:30:53.000 See, we were blown out.
00:30:54.000 It's an indictment on you, Joe.
00:30:56.000 Not to mention your son literally might be indicted anytime soon, and you might be indicted anytime soon.
00:31:02.000 Get out of here, and then we can have Gavin Newsom.
00:31:05.000 Now, the obvious question is, well, why not Cammy Kamala Harris?
00:31:09.000 Number one, Kamala Harris doesn't get along very well with Pelosi and what I call the California cartel.
00:31:14.000 She kind of just slipped into there.
00:31:16.000 Number two, she's deeply unpopular.
00:31:18.000 As much as people hate Joe Biden, they hate Kamala Harris more.
00:31:21.000 Number three, she cackles all the time.
00:31:23.000 It's one of the laws of nature.
00:31:25.000 One of the laws, the laws of physics, for every action, there's equal and opposite reaction.
00:31:29.000 An object at rest will stay at rest.
00:31:31.000 Force equals mass times acceleration.
00:31:33.000 And the fourth law of nature is you cannot cackle your way to the presidency.
00:31:36.000 It's just one of the ways the universe is wired.
00:31:38.000 I didn't make the rules.
00:31:39.000 Take it up with the Almighty Creator.
00:31:41.000 You cannot cackle and win a presidential election.
00:31:43.000 Can't happen.
00:31:45.000 So, but now you have this new piece of tape coming out.
00:31:50.000 Cut 45 is the new voicemail from Joe Biden to Hunter Biden.
00:31:54.000 Play Cut 45.
00:31:57.000 Hey, pals, Dad.
00:31:58.000 It's 8.15.
00:32:01.000 On Wednesday nights, we get a chance to be a call.
00:32:04.000 It doesn't hurt you.
00:32:06.000 Just wanted to talk to you.
00:32:07.000 I thought the article released a thing on online.
00:32:10.000 It's going to be printed tomorrow.
00:32:11.000 The Times was good.
00:32:13.000 I need to clear.
00:32:14.000 And anyway, if you get a chance, give me a call.
00:32:19.000 I love you.
00:32:20.000 And then Cut 62 is Joe Biden on the campaign trail saying he never discussed Hunter Biden's business dealings with his son.
00:32:26.000 But what he was talking about in the voicemail was Hunter Biden's Chinese business dealings.
00:32:31.000 Remember when Joe Biden said this?
00:32:33.000 Play Cut 62.
00:32:34.000 I've never spoken to my son about his overseas business dealers.
00:32:37.000 I have never discussed with my son or my brother or anyone else anything having to do with their businesses, period.
00:32:45.000 Do you stand by your statement that you did not discuss any of your son's overseas business dealings?
00:32:50.000 I stand by that statement.
00:32:51.000 I thought the article released a thing on online.
00:32:54.000 It's going to be printed to one.
00:32:55.000 The Times was good.
00:32:57.000 I need to clear.
00:32:58.000 And anyway, if we get a chance, give me a call.
00:33:03.000 I love you.
00:33:05.000 We can't fall for the trap.
00:33:06.000 Democrats are not dumb.
00:33:08.000 I'm talking about the Obama Democrats.
00:33:10.000 I'm talking about Valerie Jarrett, David Axelod.
00:33:12.000 They see Biden as a ship that is going down that they will not be able to turn around.
00:33:18.000 So they're going to use Joe Biden's complete and total plummeting presidency to their advantage to get the pardons they need, to get the radical appointees they need.
00:33:26.000 That's fine.
00:33:27.000 But politically, as Joe Biden continues to descend into the abyss and the midterms look like it's not going to be very good for Democrats at all, as the disapprove-approve ratings are completely inverted, they're going to use that as a way to displace him.
00:33:43.000 They're using all this new footage, this new voicemails, the looming indictments, the money laundering.
00:33:48.000 Not to mention, I mean, there's evidence to show that Joe Biden gave Hunter Biden $100,000 and all of it was used on Russian hookers.
00:33:56.000 All of it.
00:33:58.000 And apparently, Hunter Biden was like floating a gun around and mistreating the hookers.
00:34:03.000 New video emerges.
00:34:04.000 Hunter Biden and his sex worker illegally obtained gun.
00:34:09.000 Okay.
00:34:10.000 Again, that's not in the New York Times, nor will it be anytime soon.
00:34:13.000 Look at the deeper level.
00:34:14.000 Let's not make this all about Biden.
00:34:15.000 It's about the Democrat Party.
00:34:17.000 They will remove Biden in an instant.
00:34:19.000 The same way they remove Cuomo, the same way they remove people they don't like, and they'll put Gavin Newsom or somebody else.
00:34:24.000 But let's see if Hillary runs.
00:34:25.000 That'll be interesting.
00:34:26.000 Don't fall for it.
00:34:28.000 Thank you so much for listening, everybody.
00:34:29.000 Email me your thoughts as always.
