00:03:54.860 And they said, we're shutting down a Russian ring that was defrauding Medicare of $15 billion.

00:04:10.880 The second fraud investigation that I was stunned by and so happy to see was when Joseph Edlow, who is the Citizenship and Immigration Services Director, was in Minneapolis.

00:04:27.140 And he started talking about how immigration fraud, fake marriages and everything else, how it is rampant in the system.

00:04:35.740 And he started in Minneapolis, found all kinds of stuff, and said, we're going city after city after city on this.

00:04:50.440 So, but certainly not me, Joseph Edlow is with us now, who has been directing this on immigration fraud.

00:05:06.480 So, can you tell me what you found in Minneapolis?

00:05:09.840 And why did you start in Minneapolis?

00:05:11.900 Well, we started in Minneapolis for a lot of reasons, mainly because we were looking at various fraud patterns that we've seen.

00:05:19.340 We know that there is rampant fraud, as you said, within the system.

00:05:23.460 And looking at our data, one of the cities that had the largest examples of it was Minneapolis.

00:05:29.440 Plus, we have great cooperation there with our partners at FBI, with ICE, and with the U.S. Attorney's Office.

00:05:35.980 So, we want to make a big splash.

00:05:37.680 And we thought, what better place to make a big splash than a place where we can maybe prosecute some cases after we find the fraud.

00:05:43.320 So, that's why we started there.

00:05:44.540 What we found, I can't even begin to tell you how many examples of fraud in various areas of immigration we found.

00:05:54.980 I mean, I expected marriage fraud.

00:05:56.780 I expected some fraud in those trying to naturalize and become citizens.

00:06:00.460 I did not expect the amount of fraud we found within the optional practical training program,

00:06:05.400 where students who have graduated are able to stay in country for a couple more years to work.

00:06:11.420 We found fake businesses.

00:06:13.440 We found fraud within the H-1B program, where someone came in saying they were in some high-skilled career.

00:06:20.740 It turns out they're acting as a caregiver.

00:06:23.040 Not saying that's not important, but that's not the basis for an H-1B fraud.

00:06:27.620 We found marriage fraud, where someone was saying that their spouse was dead.

00:06:33.720 They apparently had paid money for a death certificate in Kenya.

00:06:37.100 The mother is actually alive, and as I said in the press conference, living in Minneapolis, has five children,

00:06:43.220 and the alien also has another wife in Sweden with another three children.

00:06:47.180 So, we're finding all sorts of things.

00:06:49.140 Bottom line is, this has to stop.

00:06:51.520 As I said in the conference, we are declaring an all-out war on marriage fraud, on immigration fraud,

00:06:59.720 How common is it in the Somali community to, quote, marry a relative?

00:07:10.280 You know, we've got examples of it in many different nationality groups of ethnic nationalities,

00:07:21.340 but, you know, we have seen in Minneapolis many examples of marriage fraud within that Somali community.

00:07:28.760 You know, there are a lot of active investigations pending on that matter.

00:07:33.620 I don't want to get into specifics on any one of them, but we are looking into it, and we're going to end it.

00:07:39.480 Is there anyone in a high-level congressional that is being looked into?

00:07:56.620 Nobody's off the table.

00:07:58.120 I can't say that there's any one person that we are specifically looking at,

00:08:03.060 but there are fraud investigations that will continue, and depending on what comes up,

00:08:09.900 those findings will become public as we develop what the next steps are going to be.

00:08:15.040 So, are you guys finding the same kind of pushback that ICE is at all?

00:08:21.180 Yeah, sure.

00:08:22.260 You know, we did a number of site visits.

00:08:24.820 The outward-facing part of this investigation, of this operation, was done with door knocks.

00:08:34.200 And we would go out.

00:08:35.720 Obviously, officer safety would be paramount, but we're not, at this point, USCIS does not have armed officers.

00:08:41.620 We're going out to ask questions.

00:08:43.920 People were not, many people were not willing to answer.

00:08:49.540 Many people thought that we were not legitimate law enforcement,

00:08:53.240 so they called the police on us.

00:08:55.540 Minneapolis police isn't exactly helpful, but they did come in these cases and confirm that we are who we said we were.

00:09:03.160 But certainly there's pushback, and I think if you saw any part of my press conference with the questions that I got from the media out there,

00:09:11.180 yeah, there was a lot of pushback as to why we're doing it.

00:09:13.740 And what I don't understand is why anyone looks at immigration fraud through any lens that it's less troubling than something like IRS fraud.

00:09:23.640 I said in the conference, if we were here announcing a major breakthrough in tax fraud,

00:09:32.060 we'd be applauded nationwide by everyone, saying that we were saving the taxpayers' money and that we were doing the right thing.

00:09:38.700 Why is this any different when we're trying to enforce another type of law like immigration law?

00:09:44.480 So who are the bad guys here?

00:09:47.080 The people applying?

00:09:49.220 The people who are advising those who are applying?

00:09:52.420 Or the people who are taking the applications in our own government?

00:09:56.460 Well, no, it's not the people taking the applications.

00:09:59.900 I mean, we have a very robust program to find those in the government or in my agency here who are not acting above board.

00:10:12.700 And we can suss that out very, very quickly.

00:10:16.160 The issue here, it's a combination of those that are preparing the applications, the lawyers that are advising,

00:10:23.680 and in some cases, in many cases, the aliens who are entering into these fraudulent marriages.

00:10:29.040 I mean, it really gets down to, are we talking on a case-by-case basis about a case where the attorney filed something

00:10:35.620 and the alien had no idea that it was filed, or are we talking about a case where the alien was 100% involved in the fraud?

00:10:44.400 We're finding both.

00:10:46.100 So what is the remedy for that?

00:10:49.240 It's different depending on the type of fraud that we're looking at.

00:10:52.520 In one case, it's going to be denial of the benefits and referral to the immigration courts for ultimate deportation

00:11:00.720 even if the alien has no other right to be here, which, let's be honest, if they commit marriage fraud 0.90

00:11:05.020 and any other types of fraud, they shouldn't have any other right to be here.

00:11:09.820 But in the cases where we are seeing large-scale fraud patterns,

00:11:14.380 I want to make sure that those attorneys are facing the consequences,

00:11:18.520 that those non-attorney preparers are facing the consequences,

00:11:21.620 and that requires coordination with the U.S. attorney's offices, with ICE, with FBI,

00:11:26.900 to see if there's larger investigations out there, and that's what we're going to keep doing.

00:11:31.920 Do you believe that there is any kind of large-scale coordination?

00:11:39.180 I don't think it's nationwide coordination.

00:11:41.620 I do think there are large-scale fraud patterns out there that we have not had as a government

00:11:48.840 either the interest or the resources to investigate.

00:11:53.140 So, to that end, I don't know if you saw, but USCIS now has the authority to hire investigators,

00:12:00.600 special agents, who are actually going to be going out there specifically to look at fraud of this magnitude.

00:12:07.120 Additionally, we're also starting now a massive hiring campaign

00:12:11.800 where we are looking to bring in new adjudicators, which we will train.

00:12:17.520 There's going to be signing bonuses and retention bonuses for certain openings,

00:12:22.320 and there's going to be some flexible duty locations for these openings.

00:12:30.000 and I will hire whatever and whoever I need to make sure that we have the resources

00:12:35.280 to investigate these fraud patterns and to take the appropriate action.
