01:01:32.220The interesting piece of this is that it all hinges really on the 22nd Amendment, which is the term limit portion of this, of the Constitution.
01:01:43.140When you look at this, it essentially says that you can only be elected to two terms in the wording, but that means only elected to two terms.
01:01:55.460See, if Obama were to become part of the Biden ticket, he would be elected as vice president.
01:02:01.420And there's nothing that I see, at least is what I've looked at, that indicates that that wouldn't be possible or legal.
01:02:30.380We'll get into all of the conversation about that, whether this is even legal or not, or it's just some pipe dream coming up in just moments.

01:05:43.360There's some sort of plan out there to remove, I guess, Kamala Harris from the ticket in the Biden campaign as a vice presidential candidate in this election and insert former President Barack Obama.

01:06:06.400I'm not sure that that could cause a little pain for a lot of folks.
01:06:10.740But anyway, this then, they say, would allow them to run and then give Democrats the confidence.
01:06:17.840In fact, they might even come out right out and say it that, hey, we're just going to get across the line.
01:06:21.860And once we do, we're going to restore everything that needs to be restored here.
01:06:26.500And, of course, Biden will step down and then Obama will step up and serve.
01:06:33.540And I was looking at this 22nd Amendment, and the language I read is that the president can only be elected twice.
01:06:41.420And so the question is, if he's elected twice, but then he's elected as a vice president, could he still serve a third term?
01:06:47.820And what's the restrictions around serving in the Constitutional?
01:06:51.000Since you are the constitutional coach here, Rick Green, I thought we'd ask you, is this just a pipe dream or is this some reality to this fantasy?

01:07:03.780And, yes, Independence Day last night, wonderful to celebrate the 248th birthday, 48th birthday of the nation.
01:07:09.620And we've got two years left, man, before we hit the 250th, which is when most countries crumble.
01:07:14.440And this is what makes them crumble, exactly this kind of thing.
01:07:17.720These are the same people that don't know what the meaning of the word is, is, right?
01:07:22.240So remember the nuance that they tried to get around for Bill Clinton, all of the ways that they have twisted the statutes, created, literally took a statute designed to keep you from shredding documents while you're under investigation to bully these J6 defendants and put them in jail.
01:07:39.060I've watched a lot of the hours from J6.
01:07:41.640I don't remember anybody with a shredder outside the Capitol on their way in shredding documents.
01:07:46.640That's the types of things that they have done.
01:07:48.880They've twisted the statutes to convict Donald Trump.
01:07:51.600They've twisted the statutes to do all of these things.
01:07:54.700And now here they are doing the same thing with the Constitution.
01:07:57.440And, of course, this is how we've ended up with a federal government doing 17 million things instead of 17 things like the Constitution allows them to.
01:08:05.140This is how we've ended up with a completely post-constitutional America where the federal government dominates everything in our lives when, in fact, the Founding Fathers intended for it to do so little.
01:08:15.560And so here they're trying to do it again.
01:08:16.900They're basically trying to reverse the idea where, OK, you have somebody that's vice president.
01:08:22.040They ascend to the presidency because of the 25th Amendment, and it's in the second half of the term, so they haven't filled out more than half of the term.
01:08:30.040So they could get elected two more times and serve 10 possible years.
01:08:43.520They're actually talking about putting somebody on the ballot just because of the technical language in the 22nd Amendment about can't be elected to the presidency and completely ignoring the language in the 12th Amendment that says you cannot run for vice president and be elected vice president if you're ineligible to be president.
01:08:59.380Well, he's ineligible to be president.
01:09:01.780And so this is this is now I'm not saying they couldn't do it, Justin.
01:09:05.000These people do not care about the law.
01:09:07.400The rule of law means nothing to them.
01:09:09.200They don't listen to America, the beautiful in the song where it says by liberty in law.
01:09:14.280And that's why they'll probably find any way they can to replace Joe Biden on the ballot in Wisconsin and these other states that where they have statutory issues.
01:09:22.360They'll change their their their convention rules.
01:09:43.720And for all of those Republicans and conservatives out there that are thinking this is impossible and they would never do it.
01:09:50.060Don't forget what what Glenn and Mark Levin and all these other people told us back in the summer of 2020 when they saw the secretary of states starting to change election law.
01:10:00.680Now, unconstitutionally, only the legislature is supposed to change election law.
01:10:04.560And we warned and we warned and we warned and people didn't pay attention.
01:10:56.760I mean, that's how they've been able to do all of these things they've done.
01:11:01.200I mean, brother, we don't we don't even have we don't even have but 25 percent of the country that know there are, you know, three branches of the federal government.
01:11:08.940We got we got about a third of the country that can name even one freedom out of the First Amendment.
01:11:14.360And so when they go monkeying around with it like this and changing the system and and and, you know, moving the shifting the power from the states to the feds and from us as individuals to the government and all that, we stand by.

01:11:32.600Tough times make tough men, tough men, good times, good times, make soft men, soft men lead to tough times.

01:11:42.280We've had it so good, so easy that we've gotten lazy and we've forgotten to do the hard work that it takes to keep freedom alive.

01:12:35.380I saw, this is Prager, you, I think, did one of these man-on-the-street things, and they went out and asked these kids and different people on beaches, hey, what's the significance of 1776?
01:12:48.260And a lot of the kids didn't even know what Independence Day was all about, and no wonder.
01:12:53.920I mean, all they've heard about the last two years has been Pride Month and Juneteenth and all these other summer holidays that really kind of cloud the water about how important Independence Day was and why it matters.
01:13:06.860And that's how you lose it, right? Ronald Reagan said if we forget what we did, we won't know who we are.
01:13:12.480And so the petri dish where bad government grows, and man, it's spreading like a virus, but the petri dish where it grows is civic and biblical ignorance.
01:13:20.180If we don't know truth, we don't know what our nation was founded upon, we don't know, you know, what the principles are, the good stuff that produces good stuff.
01:13:27.580In other words, if you put garbage in, personally, you're going to get garbage out. It's the same with a nation.
01:13:32.100If you put garbage in, you get garbage out. You put good stuff in, you get good stuff out.
01:13:35.860And in our nation, we've been pouring the cultural Marxism into our children for three generations.
01:13:41.120And the reason that we have so many people now come into these Constitution classes is because they went through those schools where that cultural Marxism was seeping in.
01:13:49.860And now they're going, wow, I was lied to. That's not the truth about America and who we are.
01:13:54.720And so now that they're learning it, that's why I think we're up to, we're a little over 28,000 Constitution coaches around the country.

01:25:10.280I always enjoy reading because you are bringing us a lot of times, I find, the story behind the story.
01:25:18.520In other words, you can read, you know, some of the blogs or mainstream media sources and a lot of times you're going to get a lot of stuff that's left out.
01:25:26.280You're bringing documents in actual conversations about what's happening in the courtroom.
01:25:31.560You've been in the courtroom, as I mentioned, a lot of the times for these things.
01:25:36.160So, there's just a unique perspective on this.
01:25:38.340I want to start maybe with the Supreme Court cases.
01:25:43.300Out of everything that we got, and there was a lot, but out of everything that we got, not only was there a good number of rulings that we got this last term, but, you know, there were, I think, several with major, major impact and implication on what we're seeing happening.
01:26:04.060Well, I mean, I think you could argue cases like the Chevron overturning the Chevron doctrine, which gives deference to federal agencies and the vagueness.
01:26:13.720And this is, this was an issue in another one, the Fisher ruling vagueness of the laws that Congress passes and really sets up these interpretations that maybe they didn't intend, maybe they did.
01:26:27.580So, Chevron will be a big one in terms of how these rogue federal agencies can just make up their own regulations and impose them on the American people, businesses, et cetera.
01:26:39.840Of course, the two that I was watching the most closely is the Fisher versus United States.
01:26:46.340This was the case that originated out of the J-6 prosecution and this 1512c2 obstruction of an official proceeding statute.
01:26:56.220Again, an example of how the DOJ can weaponize very vague language, misinterpret it, abuse it before the courts.
01:27:06.000The courts allow it, of course, and in this case, in a very destructive way.
01:27:10.820So, this was a post-Enron document evidence impairment statute, as you recall, Arthur Anderson shredding documents related to the Enron scandal in 2002.
01:27:25.500They claimed that protesters who went into the building, some who didn't even go into the building, obstructed an official proceeding, meaning interrupted the counting of the electoral certificates that day,
01:27:36.500and therefore were guilty of this felony punishable by 20 years in prison.
01:27:41.580Justin, they have brought this felony count against more than 350 J-6ers.
01:27:47.060It also represents two of the four counts in Jack Smith's criminal indictment against Donald Trump for January 6th in the 2020 election.
01:27:55.100What the court did on Friday, and I have to say this was so gratifying to me on behalf of the January 6th defendants and their families,
01:28:04.280my first article about 1512 C-2 is March of 2021, is they started indicting protesters on this count.
01:28:12.820So, the court basically came back and said, no, no, no, interrupting a government function that is not what this law is intended to do.
01:28:20.500You have to prove that there was evidence impairment, document record tampering, or impairment or destruction,
01:28:28.520not just interrupting a function of Congress.
01:28:31.800So, they have now kicked that back to the lower courts and basically said to the panel, the appellate court,
01:28:39.960who upheld this, and said, you have to demonstrate now, the government and the judges have to demonstrate
01:28:46.280in the burden of proof that that particular defendant impaired evidence or a record.
01:28:50.920So, we're going to see what happens there, Justin, but you won't be shocked to hear that the DOJ, Joe Biden,
01:28:57.480Merrick Garland, Matthew Graves, the D.C. U.S. attorney who's overseeing this criminal prosecution,
01:29:01.820they're trying to figure out a way that they can connect the electoral certificates that day.
01:29:07.140That's the nexus to holding up this count.
01:29:09.840They are absolutely unrepentant, and this demonstrates the corruption, the dirtiness, and the lawlessness of our own Department of Justice,
01:29:20.020who can't just say, okay, he tried, gave up.
01:29:24.620Of course, these people weren't impairing certificates.
01:30:47.120It seems like they may have gotten some relief from the Supreme Court.
01:30:50.200But as I've been paying attention more and more to these things and talking about these cases and what we see happening here,
01:30:58.220I realize the Supreme Court can come out and they can weigh in as they ought to.
01:31:05.000But at the end of the day, who holds these other folks accountable in the Justice Department and the Biden administration?
01:31:13.940How do we actually get relief for these folks who've gone through it all?
01:31:19.340Well, there has to be a full-blown investigation into the Department of Justice for how they abused and wrongfully prosecuted an entire group of individuals.
01:31:30.180And to your point, resulting in suicide, at least five January 6th defendants have committed suicide.
01:31:37.080One we know directly, Matthew Perna, as a result of the 1512 C2 charge, where they warned his attorney that they were going to ask for years in prison after he pleaded guilty to that count and a few misdemeanors.
01:31:52.380You have over 110, 120 defendants who already served their jail time or are in jail right now because of being wrongfully prosecuted and convicted, either by a D.C. jury or pleading guilty, which technically is still a conviction.
01:32:32.540Because never before has a group of political protesters, demonstrators, been cast as domestic terrorists, hearing this from Joe Biden and Merrick Garland and Christopher Wray, being hounded by the national media and their local media.
01:32:50.740I mean, I have so many horror stories.
01:32:57.820But, Justin, the one thing that's a little bit helpful is as these protesters, these Jay Sixers, are getting out of jail, they are telling their stories about what happened and their personal stories.

01:33:38.320More importantly, Justin, this Congress, if we win again, needs to impeach, hold impeachment proceedings for, I mean, I have 15 judges in D.C.

01:33:52.480They need to regain their oversight, ability, control, authority of federal courts, especially in Washington, because you had 18 judges sign off and put their judicial imprimatur on the abuse of that statute.

01:34:17.340But you had 15 judges on the district court, including Trump-appointed judges, and then two on the appellate court, who also upheld this, or excuse me, three.

01:37:51.300He's got various, including the one that they've now moved the sentencing back from July 11th until September 18th.

01:38:01.280So, the immunity decision that came down Monday, this originated out of Special Counsel Jack Smith's indictment against Donald Trump in Washington.
01:38:11.080And unlike the other cases, well, except for Georgia, this case relates to specific conduct of the former president while he was in office versus the classified documents case I'm also covering in Florida, where the indictment starts after or the alleged crimes happened after he left.
01:38:29.700So, this has been moving, marching through the court system rather quickly, despite how the media has portrayed it.
01:38:36.360And to your point, Justin, this is an unprecedented question.
01:38:40.280Never before has a president been criminally charged in a federal indictment.
01:38:45.960Jack Smith now has two against Donald Trump.
01:38:48.360And the presumption that, of course, the president would not be criminally prosecuted for things he did in office because of the potential chilling impacts, et cetera, things that the court talked about in the opinion handed down Monday, authored by Chief Justice John Roberts.
01:39:05.500So, basically, what the court said, they kind of created three different buckets of immunity.
01:39:13.840So, number one, the court said very explicitly, a president has to be immune from criminal prosecution for official acts.
01:39:21.040So, these are authorities and powers that only a president has.
01:39:24.860You know, Justin, the idea that a president is just like the rest of us and should be held to the same standard of the rule of law.
01:39:31.480Well, the president is the only person in America who can send troops to war, who could authorize the murder, the killing of foreign leaders or terrorist leaders, et cetera.
01:39:43.200There's a whole host of powers outside of the law that a president possesses.
01:40:18.380You know, they have a collaborative, consultative relationship.
01:40:22.400So, in terms of the J6 indictment, was his communications with Mike Pence under his even outer perimeter authority as the president at the time?
01:40:34.660Or was it outside of that because, of course, he was trying to convince Mike Pence to go with the Eastern Plan and send these electoral certificates in contested states, either reject them or send them back to the states, right?
01:40:45.840So, the court said the lower courts have to figure out where that falls.
01:40:51.220And then the court said, quite reasonably, if it's clearly personal conduct and criminal conduct, it's not protected by immunity.
01:40:59.380So, of course, that would be related to, you know, a lot of different crimes.
01:41:03.820If the president went and knocked off the Saks Fifth Avenue, okay, well, he's not going to get immunity from criminal prosecution.
01:41:13.780What happens now, Justin, and I have a piece on my sub stack explaining this, the court sent it back to the lower courts because the lower courts really did not do their due diligence in figuring out in the elements in Jack Smith's indictment which one is an official act.
01:41:27.720And, of course, the president can't be charged criminally and which aren't.
01:41:32.020So, this will now go back to the lower courts.
01:41:34.740Judge Chetkin, who's presiding over this in Washington, will hold some sort of evidentiary hearing between both sides as they flesh out what should be covered based on the Supreme Court's ruling and what isn't.
01:41:46.120That will then make its way through the courts again and probably end up at the Supreme Court in the fall.
01:50:52.040There's plenty and there's enough out there to, to beat him up over.
01:50:57.300And that's, obviously, that's not, that's not the, that's not the goal anyway.
01:51:02.880But it is the goal to at least discuss, at least talk about what is really, really happening.
01:51:11.160And, of course, because, again, the, you know, the media has been absolutely silent on this for the last few years.
