00:03:48.780 There is a pending motion to dismiss the case on the grounds that the prosecution did not make its case.

00:04:48.600 And he didn't really seem to care that Michael Cohen was as lacking in credibility as any witness I've ever seen appear for a prosecution case.

00:05:27.380 Odd for a lawyer to be taping his client.

00:05:30.500 And in that, Donald Trump seems to be completely unaware of what Michael Cohen's talking about related to the hush money payment.

00:05:40.420 And you can hear Michael Cohen on the tape saying, I've got this, I'm doing it, which is exactly what the Trump defense is, which is Michael Cohen did this on his own.
00:05:50.180 And Trump was really not aware of it.
00:05:52.940 The tape kind of leaned in that direction for the jury.
00:05:55.820 That's going to be one of those O.J. Simpson glove moments.
00:05:59.380 And then I think there are other instances in the trial where prosecution witnesses undercut the entire theory of the case.
00:06:07.320 The theory of the case is Donald Trump was trying to violate an election law by lying to the American people and hiding the allegations of an affair.
00:06:16.100 And one of the key prosecution witnesses is Hopix.
00:06:20.340 And she comes in and said, no, no, no, that's not what Donald Trump was worried about.
00:06:23.340 He was worried about embarrassing his wife, Melania, had nothing to do with the campaign.
00:06:27.800 That's a prosecution witness undercutting the prosecution's clearly stated theory at the beginning of the case.
00:06:34.500 I just don't know how the jury processes all of this and comes up with a verdict of guilty.
00:06:40.560 I think it's highly likely that he can either be acquitted or a hung jury.

00:06:46.920 I mean, history will soon tell us whether Bragg's political show gets a conviction or whether it ends up in some other form.

00:07:32.620 And Colangelo, by the way, looks like he should have been number 30 or 40 in the Justice Department, not number three.

00:16:15.920 And just a few weeks ago, it was finally confirmed that they double scanned some ballots during their audit

00:16:29.460 So we've known Fulton County has a basic competence issue.
00:16:33.200 It starts with its election, but it now has gone over into the law enforcement committee.
00:16:38.140 Fulton County Jail has one of the most unsafe conditions in the world right now.

00:16:44.080 And now you've got a prosecutor who openly had an affair with a special prosecutor she brought in.

00:17:35.420 Now, that said, she'll probably win the primary tonight and be on course to be the prosecutor, chief prosecutor.

00:17:42.880 It means that a large number of the voters in Fulton County in the Atlanta area don't seem to care about these issues that maybe create integrity in the prosecution system.
00:17:52.940 But the road ahead for Fannie Willis is extraordinarily uncomfortable.
00:17:57.800 There's an appeals court investigation that could reverse or kick her off the case.
00:18:02.800 There is a Georgia legislature investigation that's beginning to dig up important information and evidence.
00:18:09.060 And then you've got Jim Jordan, perhaps one of the best investigators that Congress has right now at the Judiciary Committee demanding documents.
00:18:18.040 And I think when people get those documents, and I'm sure we'll get them at some point, you're going to see that the Biden White House was in contact with the prosecution team.

00:18:31.260 We've gotten those documents a year ago, and we've got new documents recently.
00:18:35.200 But I think Atlanta, New York, and maybe the January 6th investigation, you're going to see continued contacts of the Biden White House there.

00:20:30.980 It started with at least two prosecutors openly campaigning, saying, if you elect me, I will go and prosecute the opposition party leader, Donald Trump.

00:20:52.180 And now it's happening on our shores, in front of our eyes, in some of America's most famous and big cities.
00:20:59.720 And I think that's why so many people, when you look at the polling data, say they believe that Joe Biden was simply trying to get Donald Trump put in prison before the election.

00:21:12.440 The core beliefs that are showing up in all these different polls, many polls that are showing it, are rooted in we've actually seen prosecutors who literally said, elect me so that I can go after your favorite political enemy.

00:21:28.840 Elect me and I'll have contacts with the White House, even though they should be out of this.
00:21:32.480 Those are really remarkable thresholds that in past history, America hasn't crossed before.

00:21:42.300 There's one institution that stands above them all that has the power, the authority, indeed the responsibility to clean up these corrupt courts, these corrupt prosecutors.
00:21:54.780 And that is the chief justice of the Supreme Court.

00:21:59.140 They're testing whether or not immunity is a word that should apply to the president.
00:22:04.100 Only, I believe, a blind fool would think.
00:22:08.500 And as a witness to all that is happening and all the jurisdictions you enumerated, the corrupt prosecutions, persecutions, how could the chief justice not intercede and demand immunity for the president of the United States?
00:22:26.620 Well, listen, I think when you listen to the arguments that played out a few weeks ago, I think there was a majority of the justices that believe the president does a president, no matter who he is, Joe Biden or Donald Trump or anyone past and present or future.
00:22:40.560 They do enjoy immunity for their official actions.
00:22:43.800 And I think what's going to happen in that case and what they signaled will happen in that case is they're going to send it back and say, all right, prosecutors, official things that happen as that are official actions taken by president, they are covered by immunity.
00:22:56.740 You have to go back now and try to convince us which acts that Donald Trump took are not official acts.
00:23:03.080 And then we're going to look at that very suspiciously because we have a broad interpretation of what constitutes an official act.
00:23:09.620 What does that mean?
00:23:10.300 It means it's going to delay the trial so well after the election, so well after we know who the next president is.
00:23:15.860 But more importantly, it's going to force prosecutors who sort of had a run of the place, right?
00:23:23.100 No one's really challenged them to go back and say, all right, when Donald Trump gave a speech as the president of the United States driving in the presidential limel out of there,
00:23:31.400 he wasn't acting as the president when he gave that speech.
00:23:34.020 Well, how do you make that argument?
00:23:35.660 When the president put documents in a box while he was still commander in chief, while he was getting his daily classified briefings,
00:23:43.960 he put them in a box that went in the closet and then some guy in a taxpayer funded staffer took that box and happened to ship it to Mar-a-Lago, that that wasn't an official act.
00:23:55.420 But I think when prosecutors have to go and try to make the argument at the threshold that the Supreme Court is probably going to set,
00:24:02.580 some of their arguments are going to look pretty silly and some of the judges downstream from the Supreme Court is going to say,
00:24:08.600 well, if he took a presidential limo, he gave a speech, how is that not an official act?
00:24:15.140 And I think that's where the prosecutors are going to find their first great moment of PEPCIT when the Supreme Court kicks his back and tells him,

00:24:25.980 It's going to be pretty tough for them to make that case.
00:24:28.080 The president of the United States, John, in my opinion, and I've sought this as an undergraduate in school, very simple.

00:27:21.920 warrant for Benjamin Netanyahu for presiding over a war against a terrorist organization.

00:27:28.120 And if you take what he's accused of and you think of, well, how many times in history have
