00:01:54.380 Specifically, why are so many judges who were appointed by Ronald Reagan,

00:01:59.260 at least four of them by my count,

00:02:01.480 publicly attacking the president and his administration?

00:02:05.360 Now, to give just one example of this,

00:02:09.280 Massachusetts District Judge Mark Wolf,

00:02:11.240 who was appointed by Reagan 40 years ago and retired in November,

00:02:15.360 stated this week that, quote,

00:02:16.500 Other Reagan appointees have lashed out at Trump's efforts

00:02:24.700 to end birthright citizenship,

00:02:26.680 as well as his pardons of January 6th defendants.

00:02:30.360 It's the usual hysterics and talking points that we're all familiar with,

00:02:33.700 but it's coming from judges who are supposed to be neutral.

00:02:36.240 So, where is this insurgency from the conservative judiciary coming from, exactly?

00:02:42.160 Well, if you ask Democrats, the reason for this phenomenon, of course,

00:02:45.280 is that Donald Trump is orange Hitler,

00:02:47.640 and even his party can't stand him anymore.

00:02:49.940 He's so evil that even judges can't be expected to, you know, act like adults anymore.

00:02:55.920 If you ask Republicans, especially Trump supporters,

00:02:59.500 many of them will point out correctly that Ronald Reagan wasn't as conservative

00:03:03.140 as we often give him credit for.

00:03:04.700 He did, after all, grant amnesty to millions of illegal aliens,

00:03:07.880 a move that permanently destroyed the state of California and many others,

00:03:12.180 and the country.

00:03:13.820 So, maybe Reagan appointed leftist judges because, at some level,

00:03:18.540 he harbored sympathies for their ideology.

00:03:21.960 But the actual reason for this revolt by the allegedly conservative judges

00:03:25.520 is none of the above, really.

00:03:28.860 Although, outside of a small number of people,

00:03:30.640 including the law professor Margot Cleveland,

00:03:33.420 nobody really has pointed this out.

00:03:34.680 And the truth is that, indeed, many of these conservative judges

00:03:38.440 are not actually conservative at all.

00:03:41.000 That's true.

00:03:41.560 But at the same time, in many cases, Reagan's hands were tied.

00:03:46.520 In many cases, the judges were selected

00:03:48.660 because of something called the blue slip process,

00:03:52.000 which removes a huge amount of authority

00:03:53.840 from the democratically elected president.

00:03:57.360 Now, this is a process that's worth talking about in some detail,

00:04:00.660 and most Americans have no idea what it is.

00:04:05.460 They have no idea what a blue slip is or why it's relevant.

00:04:09.260 So, just from a historical perspective, it's interesting enough,

00:04:12.280 but it's also extremely important to learn about it

00:04:15.360 for practical reasons as well.

00:04:17.540 The blue slip process doesn't simply explain

00:04:21.060 why so many Reagan judges are attacking Trump.

00:04:23.420 The continued existence of this ridiculous process

00:04:26.780 also helps to explain why Republicans are completely failing

00:04:30.020 to accomplish anything in Congress at the moment.

00:04:33.180 If you want to understand why the GOP has a majority

00:04:45.160 Now, for his part, the president clearly understands the implications.

00:04:48.040 On Monday, Trump, once again, weighed in on blue slips,

00:05:56.480 Okay, so here's how the blue slip process works

00:05:59.480 and why Trump is furious with congressional Republicans

00:06:02.300 over it, and rightly so.

00:06:04.840 Starting around the 1900s,

00:06:07.040 if the White House wanted to nominate a federal judge

00:06:10.040 or a U.S. attorney,

00:06:11.260 the Senate Judiciary Committee would send a blue slip

00:06:13.640 to the two senators from that nominee's home state

00:06:17.020 for approval.

00:06:18.000 And yes, it's literally a blue slip.

00:06:20.960 It looks something like this,

00:06:22.320 hence the name blue slip.

00:06:24.160 And if either of the senators disapproved,

00:06:26.160 which they indicated by not returning the blue slip

00:06:28.980 or by writing nasty words on it,

00:06:31.480 then the nominee was in a lot of trouble.

00:06:33.260 Then he'd probably never become a judge

00:06:35.520 or a U.S. attorney.

00:06:37.080 The Senate committee would generally recommend

00:06:39.700 that the full Senate vote against the nomination.

00:06:42.960 So this was a very powerful tool

00:06:44.620 because it meant that in the end,

00:06:46.160 just one or two senators out of 100

00:06:48.120 could tank a candidate's nomination to be a judge

00:06:50.980 if those senators were from the nominee's home state.

00:06:54.560 Now, back in the early 20th century,

00:06:56.640 the process made some degree of sense

00:06:59.460 because the home state senator

00:07:00.740 might have some useful and unique knowledge

00:07:04.520 about the nominee that nobody else knew.

00:07:06.840 And this was, after all, an era before the internet.

00:07:10.040 Information about individual nominees

00:07:11.680 was often hard to come by,

00:07:13.760 especially if you didn't live in the area

00:07:15.740 where this nominee was.

00:07:18.000 By the 1960s or so,

00:07:19.440 the blue slip began serving a very different purpose, though.

00:07:22.900 It was primarily a way for segregationist senators

00:07:25.420 in the South to tank the nominations

00:07:27.000 of federal judges who might enforce civil rights laws

00:07:29.360 and integration.

00:07:30.880 A single negative run return blue slip

00:07:32.940 would completely sink a nomination

00:07:34.480 and prevent any further action in the Senate.

00:07:36.400 So in this time period,

00:07:38.640 basically gave individual senators

00:07:40.900 a veto power over any nomination.

00:07:44.640 And then, from the 1970s to today,

00:07:48.400 the blue slip process underwent more changes,

00:07:51.340 depending on which party controlled the Senate.

00:07:53.260 And in general, the blue slip

00:07:55.140 has remained extremely important

00:07:56.820 in the confirmation process.

00:07:58.500 If your home senators don't like you,

00:08:00.760 then you're in a lot of trouble.

00:08:03.500 So this is how we ended up

00:08:05.800 with Reagan-appointed judges

00:08:07.480 like Mark Wolf in Massachusetts.

00:08:11.200 It's not that Reagan liked Mark Wolf.

00:08:14.260 The blue slip process dictated

00:08:16.240 that if Reagan wanted to appoint

00:08:18.000 a federal judge in Massachusetts,

00:08:19.600 then he had to get the approval

00:08:21.920 of John Kerry and Ted Kennedy.

00:08:24.360 So he had to appoint a liberal, basically,

00:08:26.800 because those two guys

00:08:28.220 had unofficial veto power.

00:08:31.260 And Reagan's hand was forced

00:08:32.760 by a very old, very dumb Senate tradition.

00:08:36.960 And it's important to keep in mind

00:08:39.680 because you might be wondering this,

00:08:41.800 there's no law,

00:08:43.840 there's no article in the Constitution

00:08:45.440 about the blue slip process.

00:08:47.740 It's totally arbitrary.

00:08:50.560 It doesn't have any basis in anything,

00:08:54.640 ancient legal traditions

00:08:59.480 And it's long outlived any usefulness

00:09:03.900 at one point a hundred years ago.

00:09:16.520 was appointed to the Ninth Circuit

00:09:20.200 of either of his home state senators

00:09:24.440 even though the Democrat senators

00:09:26.300 failed to return their blue slips.

00:09:29.460 And that should have been the moment
