00:02:28.260 During the final weeks of the Biden administration, the White House granting commutations and pardons
00:02:33.260 to thousands of individuals.
00:02:35.480 These acts of clemency all signed with the auto pen, a mechanical device used to replicate
00:02:40.520 the president's signature.
00:02:42.380 The lone exception was the unprecedented Hunter Biden blanket pardon, which the president personally
00:02:47.820 signed.
00:02:48.800 At present, there are multiple investigations into the extensive use of the auto pen within
00:02:53.880 the Biden White House, critics pointing to clear signs of Mr. Biden's cognitive decline
00:02:58.720 and raising questions about who was making key decisions in his administration.
00:03:03.800 Former President Biden, in an apparent attempt to defend himself from these accusations,
00:03:08.320 raising even more questions with the Times.

00:03:12.360 Mr. Biden said that he had orally granted all the pardons and commutations issued at the
00:03:18.180 end of his term, calling President Trump and other Republicans liars for claiming his aides
00:03:23.440 had used an auto pen to do so without his authorization.
00:03:27.140 The Biden White House targeting thousands for commutations, including reducing the prison
00:03:31.580 time of about 2,500 so-called nonviolent drug offenders and turning 37 death sentences to
00:03:39.000 life without parole.
00:03:40.140 And of course, a set of preemptive pardons for the members of the staff of the January
00:03:44.760 6th House Select Committee, Dr. Fauci, General Mark Milley, and certain members of the Biden
00:03:50.380 family.
00:03:51.660 The Times finding the auto pen was managed by White House Staff Secretary Stephanie Feldman
00:03:56.660 after assistance to key Biden aides, including Chief of Staff Jeff Zients and White House
00:04:01.860 Counsel Ed Siskel would draft, quote,
00:04:04.160 blurbs describing President Biden's instructions.
00:04:07.140 The Times noting, quote, the assistants who drafted the blurbs were not themselves in the
00:04:12.480 room with Mr. Biden.
00:04:13.700 According to the lists of meeting participants, the emails from the Biden White House imply that
00:04:18.760 Mr. Siskel and Mr. Zients relayed what Mr. Biden had said to the assistants who then
00:04:24.820 documented it.
00:04:26.040 In other words, for pardons like that of Dr. Fauci and the January 6th Committee, there is no direct
00:04:31.580 written proof that former President Biden approved and directed them.
00:04:36.540 Meanwhile, the Times reporting one former aide saying the list of inmates provided by the Bureau
00:04:41.200 of Prisons kept changing and, quote, rather than ask Mr. Biden to keep signing revised versions,
00:04:47.960 his staff waited and then ran the final version through the auto pen, which they saw as routine
00:04:53.440 procedure.
00:04:54.720 President Trump, who previously ordered an investigation into the Biden White House's use of
00:04:58.920 the auto pen on Monday from the Oval Office reacting to the latest reporting.
00:05:03.000 The auto pen, I think, is maybe one of the biggest scandals that we've had in 50 to 100 years.

00:05:17.580 We spoke to Mike Howell, president of nonprofit governmental watchdog The Oversight Project,
00:05:22.760 the group responsible for discovering the widespread use of the auto pen, about these latest revelations.
00:05:28.920 Howell says nothing about the Biden White House's auto pen process was routine.
00:05:33.740 There's nothing routine about the frequency of auto pen usage in the Biden administration,
00:05:38.380 and there's nothing routine about the level of incapacitation we saw out of President Biden,
00:05:43.360 which the whole country witnessed when he malfunctioned on stage at the debate when they
00:05:47.240 finally let him out unsupervised for a couple hours.
00:05:49.640 And there's also nothing routine about President Biden being in the White House and signing some
00:05:54.400 things and not signing others.
00:05:55.800 There's nothing routine about Neera Tanden's testimony where she said as staff secretary,
00:06:00.620 she would rarely even see the president when she was the one in charge of moving the paper
00:06:04.860 and limiting legal liability and things like this massive scandal of the century.
00:06:08.920 There's nothing routine about setting up, quote unquote, decision memos to the president
00:06:12.700 and then getting an initial back without seeing the president actually approve it and then spitting
00:06:16.460 out an executive order, which for all I know may not have even matched what was in the decision
00:06:20.920 memo.
00:06:21.620 You know, President Trump has said maybe Biden didn't even know he opened the border.
00:06:25.140 And I think, you know, when you have this kind of process, that really buttresses the argument
00:06:29.220 that maybe he didn't actually know what was spitting out of these executive orders.
00:06:33.160 The New York Times separately releasing a write-up containing excerpts of its 10-minute
00:06:37.220 phone call with President Biden, the short blurbs containing many verbal stumbles and
00:06:41.920 fragmented thoughts.

00:06:49.120 I wonder why the New York Times didn't publish the audio of it.

00:07:14.980 person to believe he probably didn't sound too sharp in that.

00:07:44.240 I don't understand that as a matter of journalism, and I guarantee you if it were Republican,

00:07:49.460 They'd have some hysterical law professor saying this is an impeachable offense, and
00:07:53.300 they'd have a Republican saying this needs to be investigated.

00:07:58.580 Mike Howell also says the New York Times reporting vindicates the Oversight Project's investigation,
00:08:04.280 which the Times has criticized in the past.
00:08:07.240 In March, the New York Times published a piece calling us, or our investigation, a conspiracy
00:08:12.760 theory, and so last night, I guess they did a full 180, admitted we were right and they
00:08:18.320 were wrong.
00:08:19.200 I mean, it's clear their intent in that piece was trying to control the damage to the Biden
00:08:23.720 legacy, but I don't think it was effective in that.
00:08:26.760 I think this is absolute validation.
00:08:29.940 You know, you can't get better validation than when the opposition says you were right.
