00:02:43.520 So let me just hit you up on the ones that are in the news first, and then we'll get to the book.

00:02:47.640 What do you think is going to happen now with this would-be Trump assassin?

00:02:51.720 Because there's a bit of a turf war starting to unfold between Florida and the feds, where Ron DeSantis says he's going to get to the bottom of how the security lapse occurred.

00:03:02.660 And yet the feds say it's our investigation and the FBI will run point on it.

00:03:06.300 We had Eric Prince suggesting DeSantis should not turn over this shooter to the feds.

00:03:12.380 He should keep him in Florida to make sure he doesn't suddenly have an Epstein-like ending.

00:03:16.900 So how do you see that playing out?

00:03:19.780 Well, I've actually been in one of these before, one of these turf battles, and it's interesting.

00:03:24.380 I think that the way this will shake out is that this is known as dual jurisdiction.

00:03:29.500 So both the state has jurisdiction over this and the feds have jurisdiction over this.

00:03:34.500 So it's like the old expression, what is it, possession is nine-tenths of the law.

00:03:38.980 Florida, I think, has the body right now.

00:03:41.000 They've got the would-be shooter.

00:03:43.240 So it's going to be really interesting.

00:03:45.840 One of the things that I think they're going to hesitate about is that right now the feds have only essentially brought up gun charges.

00:03:53.940 The obliterated serial number and a felon in possession of a firearm, that doesn't – there are a lot of confidence in where this case is probably merited to go, and that is attempted murder.

00:04:07.140 Now, attempted murder is a very interesting concept in a case like this because it requires a direct but ineffectual step towards the completion of the act, so the intended act beyond mere preparation.

00:04:20.460 So it's actually – this is almost a law school hypo.

00:04:23.400 When you've got somebody who intends to kill somebody, you know, forget presidential candidates, just any other human being, who takes – who prepares for it and then takes direct but ineffectual steps beyond mere preparation, is that satisfied here?

00:04:37.740 I think a lot of people would say it is.

00:04:40.840 But then at the same time, you know, attempted murders are also historically difficult to prove.

00:04:46.640 So this is going to be really interesting to see the way this shakes out.

00:04:50.140 Worst case scenario, I think.

00:04:50.800 It's going to be a defense of, like, I was just sitting on the golf course.

00:04:53.340 What do you mean?

00:04:53.660 I was going to shoot birds.

00:04:56.700 I mean, we've seen so many crazy things in court, so who knows what they're going to come up with.

00:05:01.620 But, yeah, something like that.

00:05:02.780 What I think is really interesting about this, and just in the – as everybody has been sort of looking at this case, the first thing every prosecutor is going to look at is, is this a John Hinckley type situation?

00:05:15.620 You're going to look at the mental health or the mental stability of the would-be shooter.

00:05:20.060 That's the first thing that, whether you're a federal prosecutor or a state prosecutor, is there going to be some sort of insanity defense.

00:05:27.140 And based on everything I've read so far, that's a nonstarter.

00:05:30.240 This guy's functional.

00:05:31.600 He might be wacky, but there's a huge difference between being, you know, a loon and being legally crazy under what is known as the McNaughton rule, which means you do not recognize the nature and quality of your acts.

00:05:44.140 So this guy, an insanity defense, isn't going to play.

00:05:47.760 The next thing, and I guarantee they are furiously doing this behind the scenes, both the state guys and the federal guys, everybody is looking for – essentially there's two types of assistants in cases like this.

00:05:59.000 There's assistants before, which makes somebody a principal to the crime or a co-conspirator.

00:06:04.160 And they're – I guarantee they are looking at every machine he's got, every phone, every computer, trying to track down if there's any accomplices in a conspiracy type context.

00:06:15.340 And then there's help after the crime or accessory after the fact.

00:06:19.000 That's anybody who attempts to destroy evidence or hide things.

00:06:22.500 And, I mean, the weight of the world is going to come down on this investigation, be it state or federal.

00:06:29.360 And anybody involved is going to be in a whole lot of trouble.

00:06:33.880 But this also could be a guy who acted alone.

00:06:35.680 Another thing is that just drives me crazy, as long as anybody else has been in law enforcement or the military, is this gun keeps being described, the rifle he had, is an AK-47 style rifle, and it's not.

00:06:47.580 This is an SKS.

00:06:48.920 It's a totally different kind of gun.

00:06:50.180 They fired the same ammunition.

00:06:51.780 But it's a cheap, readily available rifle that also everybody should be aware of.

00:06:57.820 He was not entitled to have.

00:06:59.600 He was a convicted felon, so nobody can legally sell him that firearm.

00:07:03.460 So this is going to be interesting to see where it goes.

00:07:06.280 Oh, so those people could potentially be in trouble, whoever sold it to him.

00:07:10.400 Could he argue, Matt, I wasn't going to kill anybody?

00:07:14.160 This isn't like Butler, where the shooter fired shots and took a man's life and hit Trump.

00:07:21.020 Could he argue, I wanted him to listen to me about Ukraine?

00:07:25.860 My plan was to get him to a point where he was scared and just to hear me out.

00:07:32.060 Now, I realize he had a GoPro and he had, they said, they call it ceramics in his backpack, which my understanding is, as I just learned yesterday, is some sort of defense mechanism.

00:07:42.540 It's like to help him be bulletproof if he took fire.

00:07:45.360 But that shows only that he was worried about somebody shooting him, not that he was necessarily going to shoot someone.

00:07:51.780 So couldn't a clever defense attorney potentially get him off on an argument like that since he didn't actually pull a trigger?

00:07:58.960 I think you hit the nail on the head.

00:08:02.460 I think that we're going to see something almost exactly like that.

00:08:06.000 And also, that's another thing that drives everybody crazy that's mirroring it.

00:08:09.540 They keep calling it ceramic tiles.

00:08:11.680 Ceramic tiles are what you have in your house or in your kitchen.

00:08:14.320 These are called ceramic plates, and that defeats high-caliber ammunition.

00:08:21.480 So our soldiers in the military wear ceramic plates, and certain law enforcement wear ceramic plates as well.

00:08:27.440 So it's not tiles.

00:08:28.900 It's ceramic plates, everybody.

00:08:31.000 So that also shows preparation.

00:08:34.260 And you're right.

00:08:34.760 That shows that he's preparing to engage in a gun battle where you can wear soft armor is what it's called that will defeat handguns.

00:08:42.320 But plates are for rifles like those carried by the Secret Service.

00:08:47.280 So this was, at least initially here, and this is all based on what's just come public, but this appears to be a very planned out scheme.

00:08:57.900 And you're right.

00:08:59.400 At some point, we're going to hear some defense lawyer, whether it's in state court or whether it's in federal court, coming out and saying he just wanted his attention or he didn't really want to do it, blah, blah, blah.

00:09:10.020 But I think, based on the evidence we have so far, this was a 7.62 magazine with live ammunition in it.

00:09:19.020 So good luck with that one, especially with a Florida jury.

00:09:23.620 I don't see that.

00:09:24.580 And they're probably finding his writings, emails, diaries, and so on showing intent.

00:09:29.380 We've seen intent, even in his own self-published book, that he wanted Trump to be assassinated.

00:09:34.480 But so we'll see.

00:09:36.240 Okay, let's shift gears.

00:09:37.240 Again, the name of Matt's book is The Book of Murder.

00:09:40.580 It's not about these cases, but the reason Matt can speak so intelligently about these cases is he's a lifelong prosecutor in Orange County.

00:09:47.380 He did dozens of felony criminal prosecutions in one year, never mind all the lifetime that he's devoted to it.

00:09:53.860 Some of the worst serial killers on earth put behind bars, thanks to Matt, and he talks about it in The Book of Murder.

00:10:00.140 Let's get to P. Diddy, because this news hit, and this is big.

00:10:04.460 So he finally did get arrested.

00:10:06.000 He's in federal custody, charged with racketeering conspiracy, multiple acts of kidnapping, arson, bribery, tampering, forced labor, prostitution, transportation,

00:10:16.680 and inducement of travel for purposes of prostitution and other illegal sexual activities, multiple offenses, including possession with intent to distribute,

00:10:24.980 distribution of narcotics, controlled substances, including cocaine, oxycodone, and others,

00:10:30.180 sex trafficking by force, this is the second count, and transportation to engage in prostitution.

00:10:35.080 The allegations are deeply disturbing.

00:10:37.280 Talking about how he used to have something called, well, not used to, but he has been hosting something called Freak Offs,

00:10:44.300 where they said he used his business, his enterprise, to intimidate, threaten, and lure female victims into his orbit

00:10:51.760 under the pretense of a romantic relationship, oftentimes.

00:10:56.500 He then used force, threats of force, and coercion to cause victims to engage in extended sex acts

00:11:01.400 with male commercial sex workers referred to as Freak Offs.

00:11:05.360 These were elaborate and produced sex performances that Combs arranged, directed, masturbated during, and often electronically recorded.

00:11:13.920 He kept the videos he filmed of the victims engaging in these sex acts,

00:11:19.160 and he says law enforcement, this says law enforcement seized various freak-off supplies, including narcotics,

00:11:25.940 1,000 bottles of baby oil and lubricant,

00:11:29.220 and that among other things he hit, kicked, threw objects at, dragged victims at times by their hair,

00:11:34.320 and threatened them to ensure continued obedience and silence.

00:11:40.440 Among other things, he engaged in abuse of people who crossed him or said they would speak out,

00:11:46.060 including kidnapping and arson.

00:11:49.620 I mean, that's one humdinger of an indictment, Matt.

00:11:53.280 It reads like a novel by itself.

00:11:58.240 This is going to be a fascinating case to watch for a variety of reasons,

00:12:02.620 but we're talking about federal sentencing guidelines.

00:12:05.560 So what that means is even kind of the throwaway counts,

00:12:08.680 where you're talking about the narcotics with firearms,

00:12:12.680 that alone, if nothing else, winds up a conviction,

00:12:18.680 that alone carries such incredible potential federal sentences.

00:12:25.580 You know, just being possession of Schedule 1 narcotics with the intent to distribute,

00:12:30.520 along with firearms by itself, you know, he could spend decades in prison for that alone.

00:12:35.720 I think that what's different on this case, also, Megan, is that we've read about these civil cases,

00:12:42.260 and of course he was charged with a shooting back in the day.

00:12:46.180 This is, he's been charged under what's called the Mann Act,

00:12:49.300 or that's essentially sex trafficking,

00:12:52.160 but also there appear to be RICO allegations in here, which is a criminal enterprise.

00:12:57.820 And when you're talking about criminal enterprises,

00:13:00.020 what the feds love to do, 0.70

00:13:01.600 and what every prosecutor loves to do, really,

00:13:03.960 is you look for people who have criminal jeopardy in the complaint.

00:13:09.060 In other words, they're part of the enterprise,

00:13:11.160 transporting these women or distributing narcotics, whatever it may be,

00:13:15.040 and they are now in legal jeopardy.

00:13:17.100 And you go to their lawyer and say,

00:13:19.520 hey, do they want to be a witness,

00:13:20.880 or do they want to be a defendant in this thing?

00:13:22.780 So I think that what we can expect is we're going to see confidants

00:13:26.200 and people that are a part of this enterprise

00:13:28.300 turning evidence against ditty.

00:13:30.640 I think that's what we can see.

00:13:33.120 And I mean, I shouldn't call him ditty, Mr. Combs.

00:13:36.340 But he is, he's in a lot of trouble here.

00:13:39.280 And I'll tell you another thing,

00:13:40.640 the feds don't like to, they don't like to take a lot of risk.

00:13:44.940 And when you're talking about that word video,

00:13:48.280 you know, that's one of the things about sex offenders 0.98

00:13:50.680 that it's always mind boggling,

00:13:54.240 but they love to record it.

00:13:55.880 And it is, you know, when they did the,

00:13:58.740 when they served the search warrant on his home in Los Angeles,

00:14:01.700 And the Bearcat trucks went in and they were seen,

00:14:05.160 they were seen leaving with computers.

00:14:06.500 And everybody in law enforcement at that point saw those videos

00:14:09.440 and said they're going to do a complete forensic workup.

00:14:12.520 And the FBI is actually the best in the world

00:14:15.100 at getting into electronic devices

00:14:17.820 and figuring out how to get past,

00:14:19.460 you know, passwords and all that sort of thing.

00:14:21.780 And the timing of this is interesting.

00:14:25.880 it appears to be a very methodical, careful investigation.

00:14:32.780 One quick question about the number of celebrities in his orbit,

00:14:38.200 is known for these massive parties, like days long.

00:14:43.580 This video when he first got his house searched,

00:14:46.280 recirculated as if he were threatening the celebrities.

00:14:50.660 Like, I'm going to spill the tea on all of you.

00:14:54.220 It turned out to be the invite list,

00:14:56.880 I think for his 50th birthday party,

00:14:58.620 but we recued it up just to give you a feel

00:15:01.000 for this guy's friend group.

00:15:47.620 His penchant for drugging women,

00:15:50.380 for hurting women, abusing them, and so on.

00:15:55.480 And how does that dynamic of these very powerful,

00:15:58.740 well-known celebrities with lots of money,

00:16:01.480 which frankly is probably how Diddy state

00:16:03.540 out of law enforcement's crosshairs for this long.

00:16:06.360 How does that play into how you view this case?

00:16:09.060 Well, this is going to be obviously a hugely sensational trial.

00:16:15.120 With these charges, this is not the type of thing

00:16:17.740 that is going to plead either.

00:16:19.280 This is going to trial.

00:16:20.400 I can virtually guarantee it.

00:16:22.540 And then you start thinking about the witness list.

00:16:24.620 Now, from their perspective,

00:16:26.440 we kind of saw a little bit of this with the Jeffrey Epstein case, right?

00:16:29.480 There was, he got convicted in Florida,

00:16:31.400 and he had all kinds of people in his orbit for a while,

00:16:34.580 and he was taking the jet, putting people on his plane and all that stuff.

00:16:38.500 Almost all of them stopped contact with him

00:16:40.400 after he was convicted in Florida.

00:16:42.680 But then he got a whole new group of people,

00:16:44.640 including a lot of socialites here in New York City,

00:16:46.780 that didn't seem to mind this sex conviction.

00:16:51.260 So we're going to see something similar here

00:16:53.360 where I think we're going to see a lot of people

00:16:54.900 trying to distance themselves from him.

00:16:57.300 Now, what is fascinating here is somebody leaked

00:17:00.020 that hotel video from 2016 with his girlfriend, Cassie.

00:17:03.060 And we've all seen that by now.

00:17:04.780 And I think that we all kind of, you know,

00:17:07.520 you talk about a fall from grace, you know.

00:17:10.400 But we've seen this before,

00:17:12.100 when famous people get in trouble like Bill Cosby or O.J. Simpson.

00:17:15.500 And you just, we have this public persona,

00:17:17.880 this public image that we have a hard time wrapping our head around.

00:17:21.100 Then we saw that video.

00:17:23.240 Just telling the audience,

00:17:24.100 this is him abusing his now ex-girlfriend.

00:17:27.300 It's disturbing to watch.

00:17:29.560 She is 100% expected to be a witness against him.

00:17:51.040 Now, a thing that is disturbing me as an LA resident

00:17:55.280 is a lot of this stuff happened in the city of Los Angeles.

00:17:57.940 And we have a very progressive DA named George Gascon

00:18:02.020 who seems to be only interested in prosecuting police officers.

00:18:05.860 There's a permissive atmosphere regarding violent crime

00:18:09.720 in the city of Los Angeles right now.

00:18:11.620 And a lot of this went down in LA.

00:18:13.280 Where was the LA DA in this?

00:18:15.000 You know, again, we have the feds coming in to do this.

00:18:17.480 And there are certain crimes in this indictment

00:18:19.280 that can only be federal crimes.

00:18:20.740 But one of them is an arson that took place

00:18:22.840 in Los Angeles County.

00:18:23.840 And this is kind of what happens

00:18:26.220 when you have lax law enforcement

00:18:27.920 like we have under DA George Gascon in Los Angeles.

00:18:31.660 He's up for election coming up.

00:18:33.260 And any of your listeners who live in Los Angeles County,

00:26:58.380 they all want to represent themselves.

00:28:21.380 even when you're dealing with a monster.

00:28:23.260 But the second part of that is we had to move the trial along

00:28:26.100 and they can gum up the gears so much.

00:28:28.660 So when you went pro-per, Gina, you know, was like,

00:29:46.740 And I didn't know how it worked in California,

00:29:50.540 at San Quentin.

00:29:52.160 And they don't give us any training on that.

00:29:54.200 You know, strangely, we get training in everything,

00:29:56.020 but we don't get training

00:29:57.360 on how San Quentin actually operates.

00:29:59.000 And they have different yards.
