00:02:40.920yesterday by the DOJ for a second time under the Trump administration, this time for an Instagram
00:02:46.260post made by Comey last May. The post featuring a picture of seashells arranged to resemble the
00:02:52.420numbers 86-47. In gang slang, 86 means to get rid of or possibly kill someone, while in restaurant
00:03:01.100slang it refers to canceling an order or being out of an item or to refuse someone's service or
00:03:06.320to kick them out. 47, of course, a reference to President Trump, the 47th president.
00:03:12.140Comey captioning the image, quote, cool shell formation on my beach walk. The post quickly
00:03:17.260drawing condemnation from many Trump supporters, Donald Trump Jr. posting at the time, quote,
00:03:22.640just James Comey casually calling for my dad to be murdered. This is who the Dem media worships,
00:03:28.260demented. Comey deleting the post several hours later, uploading a new statement, quote,
00:03:33.380I posted earlier a picture of some shells I saw on a beach walk, which I assumed were a political
00:03:39.820message. I didn't realize some folks associate those numbers with violence. It never occurred
00:03:45.140to me, but I oppose violence of any kind, so I took the post down. Comey making several media
00:03:51.180appearances in the following weeks, coinciding with a book tour, defending the post as a
00:03:56.160misunderstanding. Yesterday, Acting Attorney General Todd Blanche announcing the charges
00:04:01.040against Comey. A grand jury sitting in the Eastern District of North Carolina returned
00:04:05.920an indictment against James Comey on two counts. The first count is that on or about May 15th of
00:04:13.640last year, he knowingly and willfully making a threat to take the life of and to inflict
00:04:18.720bodily harm upon the president of the United States. Count two, same day, May 15th, 2025,
00:04:25.740that the defendant James Comey knowingly and willfully transmitting in interstate commerce
00:04:31.320a communication that contained a threat to kill the president of the United States. Both of these
00:04:37.080counts carry a maximum term of imprisonment of 10 years. So I think it's fair to say that
00:04:43.140threatening the life of anybody is dangerous and potentially a crime. Threatening the life of
00:04:51.480the president of the United States will never be tolerated by the Department of Justice.
00:04:56.960A DOJ press release clarifying that Comey faces 10 years total behind bars.
00:05:02.420A.G. Blanche pointing to a string of similar cases involving threats against public officials,
00:05:07.360stressing that while this indictment may draw attention because of the defendant's name,

00:05:16.640tolerated by the DOJ and will continue to be investigated and prosecuted aggressively.

00:06:45.020And I think if you look at this communication, these seashells, it's just way too ambiguous.
00:06:52.180Yes, there have been instances in pop culture and elsewhere where people have used 86 to
00:06:56.700mean kill, but there have been plenty of other instances, apparently far more instances where
00:07:01.440it simply means to remove or to cross off a list.
00:07:04.720And that ambiguity is going to be a major problem for prosecutors, because I will tell
00:07:09.180you, ambiguity is always the enemy of the prosecutors, because you have to prove your
00:07:14.360case, not just by 51% or 75%, you have to prove your case beyond a reasonable doubt. And I don't
00:07:20.900see any realistic way prosecutors are going to be able to do that here. Mike Davis, attorney and
00:07:26.620former law clerk to Justice Gorsuch, as well as the founder of the Article 3 project, sees it
00:07:32.140differently. James Comey is the former director of the FBI. He clearly knows that saying 8647,
00:07:40.260promoting that on Instagram is a clear threat. And this was after the second assassination
00:07:47.340attempt against President Trump. James Comey did this. I think it was long past time for
00:07:53.860the Justice Department to step in. In September, a grand jury in Virginia
00:07:58.200indicting the former FBI director, accusing him of lying to Congress and obstructing a 2020
00:08:03.860investigation tied to his testimony. That indictment dismissed in November after a judge
00:08:08.700ruled, Prosecutor Lindsay Halligan was improperly appointed. The DOJ is appealing that dismissal.
