00:02:33.260 The FBI filing a seven-page affidavit in federal court, outlining a meticulous, exhaustive
00:02:42.280 investigation sifting through millions of data points, leading investigators to arrest
00:02:47.340 30-year-old Brian Cole Jr. in Woodbridge, Virginia, yesterday morning in connection with
00:02:53.500 the D.C. pipe bombs discovered on January 6th, 2021.
00:02:58.240 Cole is charged with one count of interstate transportation of an explosive with intent
00:03:03.160 to kill, injure, or damage a building, in addition to maliciously attempting to damage
00:03:07.980 or destroy by explosion.
00:03:10.300 One pipe bomb found lying near the DNC, another near the RNC headquarters in Washington, D.C.
00:03:17.120 Neither went off, but investigators did determine viability.
00:03:20.960 Upon taking office, FBI Director Cash Patel and Deputy Director Dan Bongino renewing the Fed's
00:03:26.560 drive to find the suspect, seen on video wearing a hood and face mask, planting the devices.
00:03:33.160 Attorney General Pam Bondi, U.S. Attorney for D.C.
00:03:36.360 Janine Pirro, along with Patel and Bongino at a presser yesterday afternoon.
00:03:41.300 The FBI, along with U.S. Attorney Pirro and all of our prosecutors, have worked tirelessly
00:03:48.340 for months sifting through evidence that had been sitting at the FBI with the Biden administration
00:03:56.900 for four long years.
00:04:00.100 Re-examined every piece of evidence, sifted through all the data, something that the prior
00:04:05.680 administration refused and failed to do.
00:04:08.040 We were going to track this person to the end of the earth.
00:04:11.000 There was no way he was getting away.
00:04:12.600 This case involved millions of pieces of data, and it is a huge win because it was like finding
00:04:21.060 a needle in a haystack.
00:04:23.420 The affidavit laying out the forensic trail that led the feds to coal.
00:04:27.620 According to investigators, both devices were built from similar component parts, including
00:04:32.460 a 1-inch by 8-inch pipe with end caps, 14-gauge electrical wire in red and black, alligator
00:04:39.300 clips connecting the wires, a 9-volt battery and connector, a white kitchen timer, steel wool,
00:04:46.440 paper clips, and homemade black powder.
00:04:49.860 FBI officials obtaining credit and banking records belonging to coal, showing purchases corresponding
00:04:55.920 to the items used in the devices from October 2019 through December 2020, coal purchasing galvanized
00:05:03.420 pipes the same size as the ones planted in D.C. in June and November of 2020, end caps matching
00:05:10.540 the ones on the device purchased from Home Depot on multiple occasions, coal buying five
00:05:15.860 9-volt battery connectors near the end of 2019 and two white kitchen timers in June 2020.
00:05:22.620 The affidavit also detailing cell phone tower records, placing coal's phone in the areas
00:05:28.580 around the RNC and DNC the night the bombs were placed, his phone pinging cell towers in
00:05:34.540 the area approximately seven times during the period the devices were planted.
00:05:39.540 Coal's height is listed as 5'6", video analysis of the suspect in security video, estimating
00:05:45.620 earlier a height of 5'7", plus or minus an inch.
00:05:49.240 Officials executing search warrants on Cole's home in Virginia, where he lives with his mother
00:05:54.680 and other family members.
00:05:56.460 Janine Pirro yesterday on Fox, describing what agents found.
00:06:00.120 When the FBI went in this morning, they found a lot of other products and pieces for pipe
00:06:07.440 bombs.
00:06:07.900 Like what?
00:06:08.960 Other pipes, other wires, other, you know, timers.
00:06:12.820 He was into this, very much into this.
00:06:15.520 The family home, a five-bedroom, three-bathroom house valued at $611,000, Cole graduated from
00:06:23.320 high school in 2013 and did not attend college.
00:06:27.040 His mother's social media calling him, quote, the other part of my heart.
00:06:32.180 A neighbor describing Cole to the New York Post as, quote, very antisocial, very, he keeps
00:06:37.500 to himself.
00:06:38.720 Another saying, quote, he seemed very quiet, he would never make eye contact, almost like
00:06:43.200 he just didn't see you.
00:06:44.400 Cole worked for a bail bonds company run by his father.
00:06:48.320 The company, according to the Daily Wire, worked to free illegal immigrants from ICE
00:06:53.060 facilities.
00:06:54.280 The company reportedly suing the first Trump administration's Department of Homeland Security
00:06:58.620 over its immigration policies, complaining that illegals for whom they posted bond, who
00:07:05.020 then jumped bail out of fear they would be deported by Trump, were costing the company money.
00:07:10.000 The U.S. Court of Appeals tossing the case just weeks before Cole allegedly planted the
00:07:15.340 bombs in D.C.
00:07:16.940 The Wire, also reporting Cole's father in another case, hired the same attorney that represented
00:07:22.400 Trayvon Martin's family, Benjamin Crump, in an effort to go after a Tennessee prosecutor
00:07:28.100 who had concerns about the bail company's ethics after it had been suspended from operating in
00:07:33.780 a nearby district.
00:07:35.380 Cole accusing the Rutherford County Assistant D.A. of racial persecution.
00:07:40.580 Here he is, again, this is Cole Sr. at a presser with Crump in November 2021.
00:07:45.920 We hope that the Department of Justice can come in and do a brief investigation because what
00:07:52.700 we see and what we've seen is a lot of questionable acts that Mr. Zimmerman has demonstrated towards
00:08:02.780 minority-owned companies.
00:08:04.180 In April 2024, a state appeals court rejecting Cole's allegations, finding repeated misconduct
00:08:11.040 by Cole's company, warranted those sanctions.
00:08:13.720 The Wire reporting Cole Sr. initially ran the company out of Fairfax County, Virginia,
00:08:19.460 then moved it to Knoxville, Tennessee around 2017.
00:08:23.700 Brian Cole Jr. set to make his first court appearance later today.
00:08:27.940 FBI Director Cash Patel set to appear on the MK Show today as well, where we will ask him about
00:08:33.340 the case and much more.
00:08:36.580 New details on the exhaustive criminal history of James Rizzo, the New York man arrested on
00:08:42.380 Tuesday for allegedly assaulting 20-year-old NYU student Amelia Lewis.
00:08:47.940 Lewis walking to class Monday morning when, as security footage shows, Rizzo stalked her
00:08:53.120 down the sidewalk without her knowledge, slapping her hard on the backside before pulling her to
00:08:58.900 the ground by her hair, then running away.
00:09:01.780 Cops arresting Rizzo on Tuesday in NYU off-campus housing, where prosecutors say the suspect was
00:09:08.000 found surrounded by multiple stolen items totaling thousands of dollars.
00:09:13.000 It was a story you saw exclusively on the Megan Kelly show.
00:09:16.520 Lewis, a friend of a close family friend of ours.
00:09:20.220 Rizzo, age 45, appearing in a Manhattan courtroom late Wednesday night, where he was charged with
00:09:24.740 not just the assault on Lewis, but on another woman as well.
00:09:28.400 Officials also accusing Rizzo of elbowing a 68-year-old woman on Thanksgiving, slamming her
00:09:34.140 into glass, causing an injury requiring six stitches.
00:09:38.140 Rizzo now charged with assault, persistent sexual abuse, forcible touching, and four counts
00:09:43.300 of burglary, topping a lengthy rap sheet, including 16 prior run-ins with law enforcement.
00:09:49.300 ABC reports that it was just this past September that Rizzo was released from prison after serving
00:09:54.540 two years on a conviction for persistent sexual abuse.
00:09:58.640 Police saying in December 2023, he groped a 33-year-old woman asking,
00:10:03.080 quote, oh, you want more?
00:10:05.020 That conviction resulted in Rizzo registering as a level 2 sex offender, which the New York
00:10:10.100 State Division of Criminal Justice Services classifies as someone at a, quote, moderate
00:10:14.380 risk of re-offending.
00:10:16.500 Rizzo also reportedly charged with attempted murder in 1997 for beating and stabbing a man.
00:10:23.120 The outcome of that case is unclear.
00:10:25.540 On Wednesday, Rizzo's attorney attempting to persuade the judge to release his client, citing
00:10:30.160 his history of mental illness and housing instability.
00:10:34.380 Hello?
00:10:35.020 How was that an argument for his release?
00:10:37.380 The judge ordering Rizzo to be taken into custody, where he would receive medical attention
00:10:41.940 and also, said the judge, undergo a psychiatric evaluation.
00:10:46.660 Rizzo is due back in court in Manhattan on Monday.
00:10:49.320 He's now also facing parole violation matters, which remain ongoing.
00:10:53.380 Just to be clear, he was a repeat sex offender, on the sex offender registry, newly out of
00:10:59.700 jail, on parole but already delinquent with his parole officer, squatting in an NYU housing
00:11:05.440 facility, and no one did anything to track him down or turn him in, leaving him free to
00:11:11.620 commit any other crimes he wanted.
00:11:14.300 Great job, New York City.
00:11:16.140 Great job.
00:11:16.680 Coming up, U.S. investigators clashing with Indian officials on the cause of the Air India
00:11:23.180 crash this summer that killed more than 250 people, and a doomsday climate report that
00:11:29.180 caused all sorts of commotion last year now retracted.
00:11:37.280 I've been talking a lot about Riverbend Ranch because I love their steaks.

00:11:51.760 Their prime rib roast and holiday bundles are only available while supplies last, and they're
00:11:56.420 going fast.

00:12:38.420 U.S. officials now say Air India Flight 171's pilot, Captain Sumit Subberwal, deliberately
00:12:48.080 caused the plane crash in June, killing 241 people on board and 19 more on the ground, according
00:12:55.360 to the Wall Street Journal.
00:12:56.920 Only one passenger survived.
00:12:58.580 News that the crash may have been deliberate broke over the summer, but the Journal now
00:13:03.780 reporting on significant tensions between Indian officials investigating the flight and
00:13:08.540 American officials assisting.
00:13:10.560 The National Transportation Safety Board, along with reps from the FAA, Boeing, and GE Aerospace,
00:13:16.300 are working with India on the crash inquiry because the plane was manufactured in the U.S.
00:13:21.760 and it was safety-certified by American regulators.
00:13:25.700 According to the Journal, tensions beginning almost immediately.
00:13:29.240 American investigators first arriving in India shortly after the crash.
00:13:33.240 The chief of India's Aircraft Accident Investigation Bureau reportedly telling them,
00:13:37.880 quote, we're not a third-world country.
00:13:39.720 We can do anything you all can do.
00:13:41.680 We have the same capabilities.
00:13:43.780 Indian authorities initially refusing to allow U.S. officials to take their own photos of the
00:13:48.120 wreckage and moving some pieces before they could be examined.
00:13:51.760 U.S. investigators also struggling to get Indian investigators to download and analyze crucial
00:13:56.920 information from the black box, which contains flight data and a voice recording from the
00:14:01.720 cockpit in the moments leading up to the crash, but ultimately Indian officials complying with
00:14:07.020 U.S. requests.
00:14:08.420 From the Journal, quote, the data showed someone in the cockpit moved the switches that cut off
00:14:13.540 the engine's fuel supply.
00:14:15.580 The data also showed that Subberwal, the captain, did not pull back on the yoke in the final moments
00:14:20.560 of the accident.
00:14:21.760 In other words, as the plane was descending, he did not try to make it ascend.
00:14:27.000 The report released by the Indians providing a vague summary of the moments, failing to identify
00:14:31.740 the pilots by name, just that, quote, one pilot asked the other why he moved the engine
00:14:36.760 cutoff switches while the other pilot denied doing so.
00:14:39.840 The engine switches moved back to run about 10 seconds later, according to the report.
00:14:45.080 U.S. officials believe it was the captain who cut the engines, as the data shows the first officer
00:14:50.180 did pull up before the plane crashed.
00:14:53.180 The Journal reports its sources are worried the Indian government will not accept pilot suicide
00:14:58.180 and homicide as the conclusion, and instead will point to non-existent problems with the plane
00:15:04.020 or engines.
00:15:05.360 We spoke with former Navy pilot Wiz Buckley, who is not surprised to hear U.S. officials suspect
00:15:10.460 this crash was deliberately caused by the pilot.
00:15:13.460 I'm not surprised at all.
00:15:16.240 We knew this early on.
00:15:18.540 Modern day jets are cattle tales.
00:15:21.700 They're all electronic.
00:15:23.320 They will let us know if something is wrong with a system.
00:15:27.840 And if something, something would have had to have failed majorly for both engines to completely
00:15:33.980 flame out right after takeoff.
00:15:36.500 And we would have been able to discover that almost immediately.
00:15:39.520 I mean, and we're talking hours, you know, days after this mishap.
00:15:43.580 The fact that it's taken so long and it's still taken a long time tells us they're trying
00:15:49.380 to, you know, rule out every possible mechanical weather act of God.
00:15:55.900 It seems like they're finally begrudgingly getting dragged to the most reasonable conclusion
00:16:01.820 is that it was the pilot.
00:16:04.600 We asked Wiz whether it's possible the fuel supply could have been cut by accident.
00:16:09.020 Absolutely not.
00:16:10.080 These fuel switches are impossible to move by accident.
00:16:14.460 They actually are a guarded switch, meaning you have to lift them up to move them.
00:16:19.260 So it takes a conscious effort.
00:16:21.920 You can't bump them with your elbow.
00:16:23.300 You can't hit them with an iPad, anything like that.
00:16:26.220 These fuel switches have to be lifted up and moved for this very reason.
00:16:31.760 In 1999, Egypt Air Flight 990, en route from JFK in New York to Cairo, Egypt, crashing into
00:16:38.140 the Atlantic Ocean, killing everyone on board.
00:16:41.480 Wiz says investigators from both countries disagreed on the cause of that crash, too.
00:16:45.860 Yeah.
00:16:46.200 So this has happened before.
00:16:47.480 Egypt Air, when the captain went out to use the restroom, the first officer put the plane
00:16:53.060 into a nosedive to crash it into the Atlantic Ocean.
00:16:56.580 And the captain came in and said, whoa, what are you doing?
00:16:59.100 And the captain was actually fighting with this guy.
00:17:03.120 That's what Boeing said.
00:17:04.460 That's what the FAA said.
00:17:06.220 But the Egypt investigator said, no way, you know, that there's no way a Muslim would kill
00:17:12.700 himself or want to murder other people.
00:17:14.700 So I think even to this day, the Egypt Air people and the government of Egypt says, no,
00:17:20.860 it was a mechanical issue with the airplane.
00:17:23.080 He would never do that.
00:17:24.460 Wiz believes India's reluctance to conclude this captain acted intentionally is not based
00:17:29.440 on facts.
00:17:30.620 All interest is self-interest.
00:17:31.980 So Boeing clearly doesn't want this to be a mechanical issue.
00:17:34.860 But obviously, Air India doesn't want it to be a crazy pilot issue because that makes
00:17:39.940 them look bad.
00:17:41.100 So if you take out all the politics of it and just look at the facts, it's clear based
00:17:46.060 on the evidence that the pilot did it.
00:17:48.840 So they're probably going to end up disagreeing.
00:17:51.800 India just doesn't want to lose face.
00:17:54.000 Air India doesn't want to lose customers.
00:17:55.900 And whereas the United States government has an interest in Boeing aircraft being safe and
00:18:01.040 Boeing obviously has an interest in their people thinking that their airplanes are safe.
00:18:05.980 So, you know, if those are the two sides, what do we do?
00:18:09.780 You look at the facts and the facts right now say the guy killed all of them.
00:18:14.560 For those who hear a story like this and feel that they never want to fly again, Wiz describes
00:18:19.400 safety measures on U.S. planes to mitigate something like this happening.
00:18:23.880 We can have ongoing screening.
00:18:25.720 But here in the States, we started doing a two-person cockpit.
00:18:28.520 Like if the captain, you know, gets up to go use the restroom, the flight attendant goes
00:18:33.360 in there.
00:18:33.680 So at least there's another body in the cockpit.
00:18:35.800 So if the guy or the gal does try and do something, you know, at least maybe they can
00:18:40.060 try and wrestle them out of there.
