00:02:35.340 Federal Reserve Board of Governors member Lisa Cook on Thursday officially suing the Trump administration over her firing,
00:02:43.400 hiring attorney Abby Lowell, known for his representation of, among others, Hunter Biden, to represent her.
00:02:50.400 Cook is battling to retain her 14-year appointment at the Federal Reserve, set to expire in 2038.
00:02:56.600 The president on Monday moving to fire Cook over a criminal referral made earlier this month
00:03:02.220 by the nation's top housing finance regulator, Bill Pulte, alleging she committed mortgage fraud,
00:03:08.880 claiming she listed two separate homes as her primary residence, fraudulently securing more favorable loan rates.
00:03:17.080 Cook firing back with a lawsuit against the administration,
00:03:19.740 calling her ouster, quote,
00:03:21.520 unprecedented and illegal,
00:03:23.840 arguing, quote,
00:03:24.520 an unsubstantiated allegation about private mortgage applications submitted by Governor Cook
00:03:29.920 prior to her Senate confirmation does not constitute cause for termination.
00:03:35.240 Notably, she uses that term unsubstantiated,
00:03:38.420 but she does not, in her lawsuit,
00:03:40.500 nor anywhere publicly since the allegation broke,
00:03:43.640 actually deny it.
00:03:45.060 Her lawyer is now asking for a D.C. federal judge to declare her firing was unlawful
00:03:50.840 and that she can remain an active member of the Board of Governors.
00:03:55.160 The first hearing set for 10 a.m. today before a Biden-appointed judge.
00:04:00.020 We spoke with Julie Kelly, reporter for Declassified on Substack, about this case.
00:04:04.840 She says it is the latest example of D.C. courts bending over backwards
00:04:08.900 to rush anti-Trump lawsuits to the front of the line.
00:04:12.220 It's pretty amazing to watch how quickly these judges,
00:04:16.540 especially in Washington, D.C., are taking up these lawsuits
00:04:20.400 and in many cases immediately entering temporary restraining orders
00:04:25.240 on behalf of whoever the plaintiff is seeking to be reinstated
00:04:29.840 or not fired or not dismissed.
00:04:31.960 I mean, they are moving with great speed,
00:04:35.800 in fact, so much so that an appellate court judge
00:04:38.580 mocked even the Supreme Court and his other colleagues
00:04:42.660 as this sort of Denny's restaurant atmosphere,
00:04:45.760 that whatever these plaintiffs are looking for,
00:04:49.380 immediately seeking relief from whatever the president
00:04:53.360 and his administration are trying to do,
00:04:56.380 immediately setting these hearings.
00:04:59.400 Like, this is some sort of national emergency.
00:05:01.760 You've set aside real legitimate cases, including criminal cases,
00:05:05.780 so you could take up the latest lawsuit against the president.
00:05:09.740 It's pretty remarkable to see.
00:05:12.160 Cook's lawyers now claim the allegations against her
00:05:14.860 were simply a clerical error,
00:05:17.300 that she accidentally mislabeled one of her homes
00:05:21.060 as a primary residence on an application four years ago.
00:05:25.200 Keep in mind, both applications were made within weeks of one another.
00:05:28.880 They argue the real reason for her removal is a policy dispute
00:05:32.900 over the Fed's decision to keep interest rates steady
00:05:35.420 in defiance of President Trump's many public pleas to lower them.
00:05:39.540 As a semi-independent body under the executive branch,
00:05:42.920 the president is not technically allowed to fire employees
00:05:45.960 solely over policy disagreements.
00:05:48.840 A White House spokesperson responding in a statement to the New York Post,
00:05:52.020 quote,
00:05:52.600 the president determined there was cause to remove a governor
00:05:55.220 who was credibly accused of lying in financial documents
00:05:58.360 from a highly sensitive position overseeing financial institutions.
00:06:02.780 The removal of a governor for cause
00:06:04.380 improves the Federal Reserve Board's accountability
00:06:06.840 and credibility for both the markets and American people.
00:06:11.280 Julie Kelly questioning the very logic

00:06:15.880 This is the whole, really, point.
00:06:18.080 What is an independent agency?
00:06:20.640 There shouldn't be any.
00:06:22.160 There has to be accountability.
00:06:23.540 If you can appoint members to boards like the Federal Reserve,
00:06:28.660 then logic follows that they are under the purview
00:06:32.300 and oversight of the president.
00:06:34.500 So the idea that you just appoint people
00:06:36.580 and then they go willy-nilly and work on their own
00:06:39.020 and do whatever they want,
00:06:40.600 and in many cases work to sabotage
00:06:43.560 and undermine the president and his administration's agenda,
00:06:47.820 that should be enough cause to justify their lawful removal.
00:06:53.240 Kelly noting recent cases over similar terminations
00:06:56.300 involving independent bodies
00:06:58.180 indicate likely success for the Trump administration.
00:07:01.580 We already have recent examples of the Supreme Court
00:07:04.720 even stepping in and saying
00:07:06.120 the president's dismissal of Hampton Dellinger,
00:07:09.160 who was the Biden-appointed Office of Special Counsel,
00:07:12.720 and he was removed.
00:07:13.780 He was fired by the president and personnel director
00:07:17.580 earlier this year,
00:07:18.580 and he fought that firing under the same basis
00:07:21.680 that he had to have cause,
00:07:23.920 that they had to have a reason why.
00:07:26.400 And basically the higher court,
00:07:27.860 Supreme Court, said,
00:07:28.940 no, no, you don't.
00:07:31.880 This is a position under the direct purview of the president,
00:07:36.700 and so the removal was justified,
00:07:40.380 was lawful,
00:07:40.780 and he finally had to leave that office.
00:07:44.600 So there is some recent case history
00:07:47.900 that will support the president.
00:07:50.320 The Supreme Court also found, however,
00:07:52.700 that the Fed is a uniquely structured quasi-private entity
00:07:56.940 with a distinct historical tradition,
00:07:59.820 which has some doubting that the high court
00:08:01.840 would do anything to undermine the Fed's independence.
00:08:05.100 If the Trump administration is successful in ousting Cook,
00:08:08.380 it could lead to a fundamental realignment
00:08:10.960 of how the executive branch works,
00:08:13.300 says Kelly.
00:08:14.260 And of course, this will apply to a Democratic president.
00:08:17.280 Once, you know, a Democrat is elected again,
00:08:21.060 these terms really should not last longer
00:08:24.660 than, say, two terms of a president.
00:08:27.500 So in this case,
00:08:29.280 a 14-year staggered term
00:08:31.400 for the members of the Federal Reserve Board.
00:08:34.280 There is no such thing as independent.
00:08:37.600 Is this the fourth branch of government then?
00:08:40.300 All of these independent offices and boards?
00:08:42.980 Then we need to address the entire Constitution
00:08:45.900 if that's the case.
00:08:47.080 There is no such thing as independent bodies of government
00:08:51.180 that have very powerful decision-making authority
00:08:55.320 outside of Congress,
00:08:57.000 outside of the president.
00:08:58.920 So, yes, this should be part of a complete overhaul
00:09:03.600 in rethinking the idea
00:09:05.620 that any of these powerful boards and offices,
00:09:09.200 commissions, et cetera,
00:09:10.420 should be independent
00:09:11.700 from presidential authority and oversight.
00:09:14.900 Late last night,
00:09:16.440 Bill Pulte sending a second criminal referral
00:09:19.080 to the DOJ regarding a third Lisa Cook property.
00:09:23.360 Pulte alleging Cook entered into a 15-year mortgage loan
00:09:27.120 on a condo in Cambridge, Massachusetts,
00:09:30.100 representing it as her second home.
00:09:33.020 On later government ethics forms,
00:09:34.980 Cook allegedly represented the property
00:09:36.540 as an investment property,
00:09:38.720 not a second home.
00:09:40.440 There's a difference.
00:09:41.820 Investment properties typically come
00:09:43.500 with higher interest rates than second homes do,
00:09:46.760 as investment homes are considered more risky by lenders.
00:09:51.140 Cook also allegedly represented an Atlanta property
00:09:54.140 as her residence.
00:09:55.420 Despite evidence, it was used as a rental.
00:09:59.100 A residence would typically result
00:10:00.720 in a lower mortgage rate than a rental property would
00:10:04.380 and could lead to a lower down payment requirement too.
