00:02:58.120 a stunning upset in the Democrat primary for governor, narrowly defeating Democratic Socialist

00:03:08.360 39.4 percent, Hong going into Election Day as the clear favorite despite facing growing

00:03:14.000 scrutiny over her far-left record and resurfaced comments, including past support for abolishing

00:05:34.300 The real opponent has always been Tom Tiffany.

00:05:40.040 We spoke with RealClearPolitics co-founder and president Tom Bevin,

00:05:43.620 who tells us the result was a genuine polling miss,

00:05:46.440 although not necessarily because pollsters overestimated Hong.

00:05:50.060 It's a pretty big upset, and the polls were, you know, did not see this one coming.

00:05:55.840 You know, what's interesting about this is if you look at our RealClearPolitics average,

00:05:59.100 I think she finished, Hong finished around 39.4%,

00:06:04.200 and that's pretty much where she ended up on election day.

00:06:09.320 So the polls actually got her support right, but what they got wrong was Crowley's support

00:06:14.680 and it undecided seemed to break overwhelmingly in his favor.

00:06:19.040 And I think a lot of that movement might have come in the last week.

00:06:22.420 Despite Hong's loss, Bevin pushing back on the idea that the result represents a major defeat for the Democratic Socialist movement.

00:06:29.260 I do think, you know, there has been story after story written that this is the, you know,

00:06:34.300 the the socialists hit a wall and this is the end of their march and the momentum has stopped

00:06:39.580 i really don't think that's the lesson here i mean francesca hong was a political novice

00:06:45.800 she had a bunch of positions that were well outside the mainstream in addition to that

00:06:52.400 she had these other comments like she you know about wanting to do away with thanksgiving and

00:06:57.540 white proximity to her half-white son and all these things and yet despite all of that she

00:07:03.900 only lost by 3,800 votes. I mean, she was a whisker away, half a percent away from becoming

00:07:11.740 a Democratic nominee. So I still think that the lesson is that the DSA still, they still have

00:07:19.020 energy, they still have, you know, activism on their side, and they've proven that they can win

00:07:24.740 not just in deep blue urban districts, but in statewide races in Michigan, and now almost in

00:07:32.080 a place like Wisconsin. As for November, we asked Bevan how Crowley stacks up against Republican

00:07:37.800 Congressman Tom Tiffany. Crowley certainly is, I think, now the favorite, just because if you

00:07:43.800 look at, if you, Wisconsin is very much a swing state. It's one that Trump has won twice, albeit

00:07:49.200 very, very, very narrowly. But in this year, with Democrats running about seven points ahead of,

00:07:57.760 Democrats running seven points ahead of Republicans in the generic congressional ballot,

00:08:01.360 But it's definitely shaping up to be a good Democratic year.

00:08:05.080 The early polls show Crowley ahead by a couple of points.

00:08:09.140 And he's certainly ahead in sort of the betting markets, if you look at those.

00:08:13.100 So he heads into this race as the favorite.

00:08:16.260 And we'll see, though, whether he's able to stand up to the scrutiny of a statewide campaign

00:08:22.560 because he's not tested at that level.

00:08:24.840 Meanwhile, in Minnesota, former NFL sideline reporter Michelle Tafoya

00:08:28.800 easily winning the Republican nomination for the state's open U.S. Senate seat.

00:08:33.320 She will face Democrat Lieutenant Governor Peggy Flanagan,

00:08:36.260 a progressive who easily defeated the more moderate Congresswoman Angie Craig

00:08:39.940 in her own primary, 59% to 39.4%.

00:08:43.980 An Emerson College poll from February showing Flanagan leading Tafoya by 6 points,

00:08:48.980 47% to 41%.

00:08:50.820 We asked Bevin what Tafoya's decisive primary win tells us about her appeal

00:08:55.240 and whether the message that worked with Republican voters can translate to a broader Minnesota electorate.

00:09:01.740 Michelle Tafoya is, I mean, she's running as the super normie, if you will, right?

00:09:08.180 She's not a particularly partisan person.

00:09:11.020 She's certainly not a standard issue politician.

00:09:14.720 And her, even though she's running on the Republican ticket,

00:09:17.900 I mean, her entire appeal was to restore common sense that the world had sort of spun off its axis.

00:09:25.240 And that message obviously resonated with Republican voters.

00:09:30.260 But the question is whether it resonates with independents and even some Democrats in a state like Minnesota, you know, given the current political environment.

00:09:38.820 I mean, the good news for her is that, you know, Peggy Flanagan, who won on the on the Democratic side, she's very far to the left.

00:09:48.120 ABC News reporting prosecutors and defense attorneys in Luigi Mangione's federal case

00:09:54.720 are expected to discuss a possible plea deal during a court conference scheduled for tomorrow.

00:10:00.800 The two sides jointly requesting the hearing in Manhattan federal court,

00:10:04.580 reviving the possibility of a deal after earlier plea negotiations ahead of a June hearing

00:10:09.460 failed to produce an agreement. Mangione currently facing two federal counts of stalking,

00:10:14.880 resulting in death over the December 2024 killing of UnitedHealthcare CEO Brian Thompson,

00:10:20.660 who prosecutors allege Mangione shot and killed outside a Manhattan hotel.

00:10:25.100 A federal judge previously dismissing two other charges against Mangione,

00:10:29.320 including the murder through use of a firearm count that had made him eligible for the death penalty.

00:10:34.640 Mangione pleading not guilty in both the federal case and a separate New York state prosecution for Thompson's murder.

00:10:41.360 A possible federal plea now raising major questions about what would happen to that state case.

00:10:47.480 Manhattan prosecutors already signaling they are prepared to push back against any federal resolution they believe could interfere with their prosecution.

00:10:55.580 The district attorney's office writing to the state judge last month that New York retains what it calls primary jurisdiction because Mangione was first taken into custody on the authority of the state prosecution,

00:11:07.620 adding that if a federal plea would undermine a, quote,

00:11:10.180 just outcome in the state case,

00:11:12.580 prosecutors could raise those concerns with the federal judge deciding whether to accept it.

00:11:18.100 Absent a deal, Mangione's state trial remains scheduled to begin with jury selection September 8th.

00:11:23.740 His federal trial is scheduled to follow next year,

00:11:25.920 with jury selection beginning January 5th and opening statements set for January 25th.

00:11:31.300 We spoke with the MK True Crime Show co-host Phil Holloway,

00:11:34.200 who tells us renewed plea negotiations this close to Mangione's state trial are not especially

00:11:39.960 surprising. I'm not surprised that we are hearing some reporting about maybe the contours of a plea

00:11:46.260 deal in regards to the Luigi Mangione federal case. He attempted this apparently previously

00:11:53.160 in the summer back in June, but I guess the parties were too far apart. Now that you get

00:11:59.240 sort of to the foot of the cross, so to speak, with the state trial looming large. It's not

00:12:04.720 uncommon for these kinds of negotiations to rekindle and sometimes with more earnest. And so

00:12:11.560 this doesn't really surprise me at all. Holloway weighing in on what a federal plea could mean for

00:12:16.740 Mangione's separate prosecution in New York. It's important to remember that there is a double

00:12:22.740 jeopardy issue that is conceivably in play here. If Mangione were to plead guilty in federal court

00:12:30.280 before the state case goes to trial, then he will argue that the state New York case is barred by

00:12:39.000 double jeopardy under New York law. New York has a different double jeopardy rule than would apply

00:12:46.160 under the federal constitution, and so if he has already been prosecuted and convicted by the

00:12:52.040 federal system, New York law might very well bar a state prosecution. So he has a lot of interest

00:12:59.600 to try to get the federal case completed. He would have a very interesting and perhaps winning legal

00:13:06.440 argument that his state prosecution would be halted due to state double jeopardy in the event

00:13:14.100 he enters a plea and completes his federal case before the New York case goes to trial.

00:13:20.280 We asked Holloway about the Manhattan District Attorney's reported pushback against any federal agreement that could interfere with the state case.

00:13:27.880 We're seeing some pushback in the public reporting that the New York prosecutors are weighing in.

00:13:36.100 They don't want the federal judge to approve of any plea deal that would impact their case in a negative way.

00:13:43.060 They may very well be aware of this potential double jeopardy issue, and so if that's the case, and this all stands to reason, it makes sense that they would weigh in and want to remind the judge that if there is something that happens in federal court, it could negatively impact the outcome of the state's case.

00:14:03.980 And by outcome, that could very well mean a dismissal on double jeopardy grounds.

00:14:07.920 We asked Holloway what Mangione could still gain by agreeing to plead guilty, given that the death penalty is already off the table.

00:14:14.940 A lot of people are asking, you know, what would bring the defense to even entertain a plea deal at this point since the death penalty is already off the table?

00:14:25.400 And my answer to that question would be that finality and certainty and knowing what your fate is, is a big motivator for lots of criminal defendants.

00:14:37.180 It takes the guesswork out of it. It takes the not knowing out of it. He knows that he's going

00:14:41.740 to be in prison for a very long time regardless, but having some specific end in sight, whether it

00:14:48.960 be 25 years, 35 years, or whatever, that is oftentimes a large motivator and can be very

00:14:56.000 attractive for people even when they are facing lengthy prison sentences. And Holloway says if

00:15:01.020 the two sides really are closing in on an agreement, he suspects it would ultimately

00:15:04.740 resolve both prosecutions. I think if there's going to be some kind of a plea deal, it would

00:15:11.020 probably be a global resolution. I suspect it might resolve both the state and the federal case. But if

00:15:17.200 the negotiations fall apart, then everything stays on course for a trial. The trial is the default

00:15:23.880 setting. If a case is not resolved by some type of mutual agreement, it will go to trial. That's

00:15:30.160 just the way the system works. But it's important to remember that judges are the final say.

00:15:35.580 So if the parties are meeting by joint request, they want to meet with the federal judge,

00:15:41.620 it stands to reason that the parties already have an agreement in mind. They might just be

00:15:46.900 needing the judge to give his blessing. Holloway will be breaking down this case
