00:00:30.000 Good morning, everyone. I'm Megan Kelly.
00:00:35.000 It's Tuesday, October 28th, 2025, and this is your AM Update.
00:00:40.080 A Minnesota resident arrested after allegedly offering a $45,000 bounty on social media,
00:00:46.800 calling for the death of Attorney General Pam Bondi.
00:00:49.920 The defendant's request to appear in civilian clothing for all pretrial proceedings is granted.
00:00:54.720 The judge overseeing the accused Charlie Kirkassass and Tyler Robinson's case
00:00:59.760 rules on motions related to the defendant's court appearance, as well as some rules for media coverage.
00:01:06.560 Hurricane Melissa officially swelling to the most powerful storm of 2025, just prior to slamming Jamaica.
00:01:13.640 One theory on how you might try to serve a third term is that you could run as the vice president.
00:01:19.220 And President Trump triggering the media yet again in response to his plans for 2028.
00:01:25.720 All that and more coming up in just a moment on your AM Update.
00:01:28.820 As President Trump is settling into his new administration, one of the top Democrats in Congress aiming to undermine the Trump agenda
00:01:38.760 is Democrat Senator Dick Durbin of Illinois.
00:01:41.860 And according to our sponsor, the Electronic Payments Coalition, Senator Durbin has a new plan,
00:01:47.540 a government takeover of your credit card.
00:01:50.440 Today, Americans have thousands of choices in credit cards, but they say Senator Durbin's plan
00:01:55.300 will result in less competition and less security, which means more risk for your credit and your identity.
00:02:01.800 You can learn more for yourself at guardyourcard.com.
00:02:05.520 And you could consider telling your senators to stop
00:02:08.400 Dick Durbin's government takeover of your credit card before it's too late.
00:02:12.680 A Minnesota resident arrested earlier this month for allegedly posting a $45,000 bounty on TikTok
00:02:22.440 calling for the death of Attorney General Pam Bondi, according to an FBI affidavit.
00:02:28.200 Authorities taking Tyler Maxon Avalos into custody on October 16th
00:02:33.520 after a post from an account he allegedly controls was reported to the FBI.
00:02:37.780 The post features a picture of A.G. Bondi with a sniper scope red dot laid over her forehead
00:02:44.400 and a caption reading, quote,
00:02:46.700 Wanted.
00:02:47.540 Pam Bondi.
00:02:48.560 Reward.
00:02:49.460 45,000.
00:02:50.880 Dead or alive.
00:02:52.380 Preferably dead.
00:02:54.140 The profile bio containing they, them, theirs pronouns and reading, quote,
00:02:58.920 Make John Brown proud.
00:03:01.220 Brown was a pre-Civil War abolitionist who believed slavery in the U.S. could only be ended through
00:03:06.560 violent uprising.
00:03:08.580 Avalos's profile also containing multiple symbols of the letter A with a circle around
00:03:13.500 it, commonly associated with anarchy, the page also linking to an anarchist FAQ book.
00:03:20.220 More from the affidavit, quote,
00:03:22.060 Avalos has a multi-state conviction history, including a July 2022 felony stalking conviction
00:03:28.300 from Dakota County, an August 2016 felony third-degree domestic battery from Polk County, Florida,
00:03:36.020 and an April 2016 misdemeanor domestic assault from Dakota County, which appears to have been
00:03:41.680 reduced from a felony domestic assault by strangulation charge.
00:03:45.680 Last Wednesday, Avalos, who is believed to be 29 or 30 years old, released from custody on
00:03:51.900 personal recognizance, meaning no bond, but he must follow a certain set of restrictions,
00:03:57.060 including staying within Minnesota, continuing mental health treatment, no alcohol or drug use,
00:04:02.940 and subject to random drug testing, no computer or internet access without approval, and GPS
00:04:09.660 monitoring. Avalos has not been formally indicted. He was arrested on a charge of interstate
00:04:15.660 transmission of a threat to injure another person. His attorney, Daniel Gertz, tells AM Update,
00:04:21.760 quote, no date is set for the next court hearing because he has not yet been indicted. He was
00:04:26.180 arrested on the basis of a criminal complaint. In federal court, the Fifth Amendment requires an
00:04:31.000 indictment to go forward. He is not guilty of any crime, however, so we will wait and see.
00:04:38.560 The judge overseeing defendant Tyler Robinson's case ruling yesterday on whether the 22-year-old
00:04:43.940 accused of assassinating Charlie Kirk will be allowed to appear unrestrained and in civilian
00:04:49.780 attire in future court appearances. Judge Tony Graff holding the hearing virtually, Robinson speaking
00:04:56.300 only once off camera, confirming he was able to hear the proceedings. Robinson originally set to
00:05:02.940 appear in court for the first time this Thursday. That hearing postponed, allowing more time to complete
00:05:08.520 discovery and file additional motions relating to whether certain hearings should be conducted
00:05:13.200 virtually and issues relating to restrictions on media coverage. Judge Graff issuing a decision on
00:05:19.360 a motion filed earlier this month by the defendant's legal team regarding his court apparel.
00:05:25.200 Mr. Robinson sits before this court presumed innocent, and that presumption remains unless and until
00:05:31.600 each element of every offense charged against him is proved beyond a reasonable doubt. To date,
00:05:38.280 this has not occurred and the presumption of innocence remains. Balancing these factors,
00:05:44.440 the court finds that Mr. Robinson's right to the presumption of innocence outweighs the minimal
00:05:50.860 inconvenience of permitting civilian attire, and Mr. Robinson shall be dressed as one who is presumed
00:05:57.980 innocent. Accordingly, the defendant's request to appear in civilian clothing for all pretrial
00:06:02.680 proceedings is granted. The defendant's counsel ordered to provide civilian apparel 72 hours before any
00:06:10.340 upcoming hearings. Judge Graff denying the defense's request for the defendant to appear without physical
00:06:16.540 restrictions. To the second request, request to appear without physical restraints. Mr. Robinson also
00:06:22.880 requests to appear unrestrained during pretrial proceedings. He argues that visible restraints would
00:06:28.600 prejudice potential jurors, undermine his dignity, and interfere with his ability to communicate with
00:06:35.300 counsel. The court recognizes that Mr. Robinson has no criminal history and no record of misconduct
00:06:42.380 while in custody. However, the charges he faces are extraordinarily serious, carrying potential penalties
00:06:50.260 of life imprisonment or death. The safety of Mr. Robinson, the attorneys, court staff, and the public
00:06:57.460 must remain the court's highest priority. The emotional nature of these proceedings also raise the risk of
00:07:04.360 disruption. Judge Graff directing the Sheriff's Department to, quote, use the least restrictive
00:07:09.640 restraints necessary to maintain safety. Media will be prohibited from capturing images of the defendant
00:07:15.720 entering, exiting, or standing in court when his shackles will be visible. Judge Graff directing both sides to
00:07:22.500 file a joint motion in the event they wish to restrict electronic media coverage any further.
00:07:26.800 The defendant is charged with one count of aggravated murder, felony discharge of a firearm, obstruction
00:07:33.500 of justice, two counts of witness tampering, and commission of a violent offense in front of a child.
00:07:39.720 Prosecutors will seek the death penalty. The next two pretrial hearings, set for January 16th and 30th
00:07:46.220 at 1 p.m., the defendant is set to appear in person.
00:07:49.640 Coming up, Jamaica battening down the hatches as the immensely powerful Hurricane Melissa
00:07:56.640 makes landfall. And President Trump weighs in once again on one of the media's favorite questions,
00:08:03.000 will you run for a third term?
00:08:05.200 Every October, we honor the strength and resilience of women and families affected by breast cancer.
00:08:16.000 But cancer touches all of us in some way, and more people today are seeking options beyond the standard approach.
00:08:22.000 That's why I want to tell you about what All Family Pharmacy is doing this month.
00:08:25.840 They are helping patients gain access to trusted, affordable medicines like ivermectin and mabendazole.
00:08:33.600 These treatments that are sometimes used off-label are currently being researched in Florida for their potential
00:08:38.980 to support cancer treatment and prevention.
00:08:41.800 For those looking for an alternative or addition to their current care,
00:08:45.820 it's always important to consult with a doctor, and All Family Pharmacy makes that simple.
00:08:50.060 They work with like-minded physicians across the country who review every order and provide prescriptions when appropriate.
00:08:57.260 In honor of Breast Cancer Awareness Month, they are offering 40% off mabendazole when you order this month with the code PINK40.
00:09:06.340 Visit allfamilypharmacy.com, allfamilypharmacy.com slash Megan to learn more.
00:09:11.520 And remember to use code PINK40 by October 31st to save on mabendazole.
00:09:20.060 Hurricane Melissa officially reaching Category 5 strength on Sunday night by Monday afternoon,
00:09:26.720 rising to the strongest storm of 2025, the worst Jamaica has ever seen,
00:09:32.480 with sustained winds of 175 miles per hour and even stronger gusts.
00:09:38.540 Only nine Atlantic hurricanes on record have been stronger than Melissa, according to CNN.
00:09:43.400 As of Monday afternoon, Melissa pivoting north toward Jamaica, already responsible for six deaths across the Caribbean. 0.53
00:09:51.480 Three in Haiti, one in the Dominican Republic, and two in Jamaica.
00:09:55.840 The Jamaicans killed while cutting trees in preparation for the hurricane. 1.00
00:10:00.300 A National Oceanic and Atmospheric Administration, or NOAA, aircraft forced to abandon its mission,
00:10:07.180 which included flying into the storm to collect data on Monday morning due to extreme turbulence.
00:10:13.380 The colossal storm making landfall in Jamaica late last night.
00:10:17.620 Analysts anticipating it could be the strongest direct landfall since the beginning of record-keeping.
00:10:24.460 In advance, authorities ordering mass evacuations, opening more than 800 shelters, closing both international airports.
00:10:31.880 The AP reporting some residents insisting upon staying in their homes.
00:10:37.180 Bruce Dawkins holding a beer and wearing a raincoat, saying, quote,
00:10:40.840 I'm not going anywhere, telling the reporter he intends to ride out the storm with a friend.
00:10:46.260 The National Hurricane Center warning Monday, quote,
00:10:48.800 Do not venture out of your safe shelter.
00:10:51.600 Catastrophic and life-threatening flash flooding and numerous landslides are likely today through Tuesday.
00:10:57.480 The slow-moving storm, crawling at roughly three miles per hour,
00:11:00.600 expected to drop 30 to 40 inches of rain, unleash destructive winds,
00:11:06.100 and push a storm surge of up to 15 feet along Jamaica's southern coast, according to AccuWeather.
00:11:13.120 Officials predicting catastrophic flooding, landslides, and power outages.
00:11:17.980 Here, Jamaican Prime Minister Andrew Holness.
00:11:21.220 No one can say that the government was not forward-leaning
00:11:26.000 in giving the information to persons who are in areas of risk.
00:11:31.500 You have been warned.
00:11:32.780 So it's now up to you to use that information to make the right decisions.
00:11:38.240 This is an unusual system.
00:11:40.200 Normally, a hurricane, you focus on two things, wind and rain,
00:11:43.720 because it happens very quickly.
00:11:45.440 Now we have to focus on three things.
00:11:46.900 It's wind, rain, and the length of time it will probably linger over the country.
00:11:51.180 While we understand wind and rain and what it can do,
00:11:56.060 but if it stays for a very long time,
00:11:58.560 you're not just dealing with saturation.
00:12:01.120 You're dealing with a higher level of destruction,
00:12:04.100 a higher probability of landslides,
00:12:06.220 a higher probability of flooding,
00:12:07.780 even in areas where flooding would not have taken place.
00:12:11.340 So we have to bear that in mind and be prepared.
00:12:15.280 The U.S. State Department pre-positioning supplies in six warehouses
00:12:19.760 to deliver emergency relief to those impacted.
00:12:22.860 AccuWeather Chief Meteorologist Jonathan Porter telling the AP,
00:12:27.220 this can become a true humanitarian crisis very quickly,
00:12:30.840 and there is likely going to be the need for a lot of international support.
00:12:35.700 Melissa is expected to move into Cuba by tomorrow morning,
00:12:38.960 hitting portions of the Bahamas as well.
00:12:40.780 Forecasters predicting the storm will indirectly impact the United States as well.
00:12:46.120 According to the Washington Post,
00:12:47.800 its moisture is expected to fuel another storm
00:12:50.360 that could douse the East Coast from the Mid-Atlantic up to New England.
00:12:56.880 President Trump weighing in again on the possibility of running for a third term in office
00:13:01.800 as he swings through a diplomatic tour of Asia.
00:13:05.280 The latest round of speculation prompted by recent comments made by Trump advisor,
00:13:09.500 Steve Bannon, to The Economist.
00:13:12.560 Well, he's going to get a third term.
00:13:14.040 So Trump 28.
00:13:15.000 Trump is going to be president in 28.
00:13:16.840 And people just ought to get accommodated with that.
00:13:19.240 So what about the 22nd Amendment?
00:13:21.220 There's many different alternatives.
00:13:22.880 At the appropriate time, we'll lay out what the plan is.
00:13:25.140 But there's a plan, and President Trump will be the president in 28.
00:13:28.520 We need him for at least one more term, right?
00:13:32.200 And he'll get that in 28.
00:13:33.720 Mr. Trump, in recent months, trolling the media and Democrats, passing out Trump 2028 hats.
00:13:40.780 The 22nd Amendment provides that, quote,
00:13:43.240 no person shall be elected to the office of the president more than twice, end quote.
00:13:49.360 One commonly floated theory suggests Mr. Trump could run as a vice presidential candidate.
00:13:54.560 Then the president would step aside, allowing him to ascend to the top job.
00:13:59.500 That scenario would also likely run into legal roadblocks, as the Constitution specifically
00:14:05.140 states, quote, no person constitutionally ineligible to the office of president shall
00:14:11.240 be eligible to that of vice president.
00:14:13.980 Regardless, the president on Monday firmly ruling out that option.
00:14:17.840 One theory on how you might try to serve a third term is that you could run as the vice
00:14:22.860 president.
00:14:23.480 Yeah, I'd be allowed to do that.
00:14:24.600 Is it the White House or the White House counsels or your legal position, I guess?
00:14:29.500 You'd be allowed to do that, but I wouldn't.
00:14:31.040 I wouldn't do that.
00:14:31.980 I think it's too cute.
00:14:33.860 Yeah, I wouldn't rule that out because it's too cute.
00:14:36.020 I think the people wouldn't like that.
00:14:37.620 It's too cute.
00:14:39.000 It's not.
00:14:39.680 It wouldn't be right.
00:14:41.060 Asked whether he would be willing to go to court to challenge the two-term limitation,
00:14:45.360 Mr. Trump replying that he hasn't really thought about it, then touting the political
00:14:49.840 strength of his possible successors in his administration.
00:14:53.500 We have some very good people, as you know.
00:14:55.840 We're the very good people.
00:14:56.960 You said that for 2028, there are very good people that you have in mind.
00:15:01.720 Well, we have great people.
00:15:02.860 I don't have to get into that, but we have one of them standing right here.
00:15:06.820 We have JD, obviously.
00:15:08.880 The vice president is great.
00:15:11.000 I think Marco is great.
00:15:12.080 I think I'm not sure if anybody would run against us.
00:15:15.020 I think if they ever formed a group, it would be unstoppable.
00:15:19.780 I really do.
00:15:20.300 I believe that.
00:15:21.380 I would love to do it.
00:15:24.000 I have my best numbers ever.
00:15:25.580 It's very terrible.
00:15:26.400 I have my best numbers.
00:15:28.020 So you're not ruling out under a term?
00:15:30.440 Am I not ruling it out?
00:15:31.960 You'll have to tell me.
00:15:32.920 All I can tell you is that we have a great group of people, which they don't.
00:15:38.080 Out of that full comment, some outlets cherry-picking that one line, quote, I would love to.
00:15:44.100 MSNBC, quote, Trump renews talk about seeking a third term, colon, I would love to do it.
00:15:50.940 Axios, quote, Trump again declines to rule out unconstitutional third term.
00:15:56.580 Establishment media marching to the beat of Donald Trump's drum once again.
00:16:00.680 And that'll do it for your AM update.
