00:03:45.680 Last Wednesday, Avalos, who is believed to be 29 or 30 years old, released from custody on
00:03:51.900 personal recognizance, meaning no bond, but he must follow a certain set of restrictions,
00:03:57.060 including staying within Minnesota, continuing mental health treatment, no alcohol or drug use,
00:04:02.940 and subject to random drug testing, no computer or internet access without approval, and GPS
00:04:09.660 monitoring. Avalos has not been formally indicted. He was arrested on a charge of interstate
00:04:15.660 transmission of a threat to injure another person. His attorney, Daniel Gertz, tells AM Update,
00:04:21.760 quote, no date is set for the next court hearing because he has not yet been indicted. He was
00:04:26.180 arrested on the basis of a criminal complaint. In federal court, the Fifth Amendment requires an
00:04:31.000 indictment to go forward. He is not guilty of any crime, however, so we will wait and see.
00:04:38.560 The judge overseeing defendant Tyler Robinson's case ruling yesterday on whether the 22-year-old
00:04:43.940 accused of assassinating Charlie Kirk will be allowed to appear unrestrained and in civilian
00:04:49.780 attire in future court appearances. Judge Tony Graff holding the hearing virtually, Robinson speaking
00:04:56.300 only once off camera, confirming he was able to hear the proceedings. Robinson originally set to
00:05:02.940 appear in court for the first time this Thursday. That hearing postponed, allowing more time to complete
00:05:08.520 discovery and file additional motions relating to whether certain hearings should be conducted
00:05:13.200 virtually and issues relating to restrictions on media coverage. Judge Graff issuing a decision on
00:05:19.360 a motion filed earlier this month by the defendant's legal team regarding his court apparel.
00:05:25.200 Mr. Robinson sits before this court presumed innocent, and that presumption remains unless and until
00:05:31.600 each element of every offense charged against him is proved beyond a reasonable doubt. To date,
00:05:38.280 this has not occurred and the presumption of innocence remains. Balancing these factors,
00:05:44.440 the court finds that Mr. Robinson's right to the presumption of innocence outweighs the minimal
00:05:50.860 inconvenience of permitting civilian attire, and Mr. Robinson shall be dressed as one who is presumed
00:05:57.980 innocent. Accordingly, the defendant's request to appear in civilian clothing for all pretrial
00:06:02.680 proceedings is granted. The defendant's counsel ordered to provide civilian apparel 72 hours before any
00:06:10.340 upcoming hearings. Judge Graff denying the defense's request for the defendant to appear without physical
00:06:16.540 restrictions. To the second request, request to appear without physical restraints. Mr. Robinson also
00:06:22.880 requests to appear unrestrained during pretrial proceedings. He argues that visible restraints would
00:06:28.600 prejudice potential jurors, undermine his dignity, and interfere with his ability to communicate with
00:06:35.300 counsel. The court recognizes that Mr. Robinson has no criminal history and no record of misconduct
00:06:42.380 while in custody. However, the charges he faces are extraordinarily serious, carrying potential penalties
00:06:50.260 of life imprisonment or death. The safety of Mr. Robinson, the attorneys, court staff, and the public
00:06:57.460 must remain the court's highest priority. The emotional nature of these proceedings also raise the risk of
00:07:04.360 disruption. Judge Graff directing the Sheriff's Department to, quote, use the least restrictive
00:07:09.640 restraints necessary to maintain safety. Media will be prohibited from capturing images of the defendant
00:07:15.720 entering, exiting, or standing in court when his shackles will be visible. Judge Graff directing both sides to
00:07:22.500 file a joint motion in the event they wish to restrict electronic media coverage any further.
00:07:26.800 The defendant is charged with one count of aggravated murder, felony discharge of a firearm, obstruction
00:07:33.500 of justice, two counts of witness tampering, and commission of a violent offense in front of a child.
00:07:39.720 Prosecutors will seek the death penalty. The next two pretrial hearings, set for January 16th and 30th
00:07:46.220 at 1 p.m., the defendant is set to appear in person.
