00:00:38.520 George Floyd. Good luck. Good luck. Neely was reportedly living on the streets of New York City

00:00:44.880 and had been for many years, and on Monday went on a subway car, the downtown L train, and began yelling

00:00:51.720 and threatening passengers. He was restrained in a chokehold. No, today was the, or this time was

00:00:57.840 the F train. He'd caused trouble before on the L train. He's been on all of them. He was restrained

00:01:02.660 in a chokehold by a Marine veteran and fell unconscious. EMS workers at the station were

00:01:08.320 unable to revive him, and he has died. Now the left, including AOC, is calling this a murder,

00:01:16.560 a lynching, and demanding for the Marine to be charged accordingly. As of now, Manhattan prosecutors

00:01:22.940 are continuing to conduct an investigation into the death, which has been ruled a homicide,

00:01:28.600 but that doesn't attribute any intention to it. It's a death that's been caused by another,

00:01:35.360 and there's a big push by those who have a bloodthirst for anyone who intervenes to stop this

00:01:43.200 kind of behavior from happening, to see this Marine charged with a crime that would put him in jail for

00:01:48.820 the rest of his life. Joining me today, very happy to see Mark Stein is here, host of The Mark Stein Show

00:02:05.060 Likewise. So let's start with this case, because the left really is trying to make this guy

00:02:09.260 into the next George Floyd. He's black, the man who died, the homeless man, the Marine veteran is white,

00:02:16.780 and that was all they needed to pounce. AOC, she calls this a public execution. She calls this

00:02:25.140 a murder. I'll just read you in part what she says. Jordan Neely, that's the name of the decedent,

00:02:31.460 was murdered. But because Jordan was houseless and crying for food in a time when the city is raising

00:02:38.320 rents and stripping services to militarize itself, while many in power demonize the poor,

00:02:42.580 the murderer gets protected with passive headlines and no charges. It's disgusting. It's disgusting.

00:02:49.640 She goes on from there. It wasn't a murder. A murder is an intentional killing of another.

00:02:56.160 There's clearly no intent by this Marine to kill this man. But the thing about it, Mark, is she and

00:03:01.840 others intentionally ignore the fact that for the umpteenth time, this guy Neely was on board a subway

00:03:08.420 train actively threatening, not just yelling, threatening the passengers, and he had hurt

00:03:15.480 others on the subway before in the not-too-distant past. He had just gotten out of prison

00:03:21.280 recently for assaulting a 67-year-old woman, fracturing her orbital bone, breaking her nose,

00:03:29.260 causing head injuries, and so on. He had just been arrested again this past February.

00:03:33.080 He'd hurt a lot of people, but we're supposed to pretend he's still the Michael Jackson imitator

00:03:38.400 that used to perform on the subway tracks 10 years ago.

00:03:42.100 No. And you say all that, and that would apply, Megan, if we were in a rational system of justice,

00:03:52.480 which Democrat cities aren't anymore. They all operate far more on the basic Leninist principle

00:03:59.460 of who whom. This is a black homeless man, and so that, by definition, puts him in the victim

00:04:06.680 category. And if I were the guy who'd put him in the chokehold, if I were advising that guy,

00:04:16.540 it's a bit late for that now, but I would have told him to hop in the back of the pickup truck,

00:04:21.200 and I'd drive him across the border into Canada, because it's doubtful if they do decide

00:04:26.160 to go ahead and prosecute him whether he can actually get a fair trial. It's not a George

00:04:34.220 Floyd case, but it's part of the consequences of George Floyd, which is that Democrat cities

00:04:40.220 across the United States have become increasingly lawless. And basically, when you're on the subway,

00:04:45.380 you're on your own down there. We've heard all the stories about people getting thrown in front

00:04:51.260 of the tracks and all the rest of it. And there's no law down in the New York subway at the moment.

00:04:57.980 And actually, I would say there's no law even in Midtown Manhattan. Back when I used to guest host

00:05:06.760 for Tucker Carlson from New York, I used to stroll the two or three blocks from my hotel to Midtown

00:05:16.000 Manhattan. Never bothered with the car service. I'd just walk up 6th Avenue, and then when the show

00:05:21.740 was over, I'd walk back at night and be quite happy to pose for selfies and things with people.

00:05:27.800 You never know now, in these Democrat-run cities, the point at which it's all going to go south for

00:05:35.180 you. So it's all very well to say, oh, well, he was just goofy, and he was shouting, and he was

00:05:41.040 excited. He was just a poor homeless man. There's no need to go and kill him. Unfortunately, the reality

00:05:48.340 of American cities, and it should embarrass the Democrat Party, I don't even know why they're

00:05:55.200 actually talking about this, is they've rendered them lawless. They've turned them over, and you're

00:06:00.240 supposed, and then if you have to make a calculation, you've got a split second to make a calculation

00:06:05.720 about whether this guy is just a harmless nutter, or he means you ill. And then somebody like AOC from

00:06:12.940 behind her entourage gets to second-guess you. It's disgusting, man.

00:06:18.280 Absolutely right. So well said. The guy who took some of the video that we've seen,

00:06:25.020 he filmed part of the encounter. His name is Juan Alberto Vasquez. He's a freelance journalist.

00:06:30.100 He told the New York Post and WNBC that this homeless guy, Neely, came on, started making a

00:06:35.960 speech, started screaming in an aggressive manner. This is a third-party witness. He doesn't have a

00:06:39.940 dog in this haunted. Said he had no food. I have nothing to drink. I'm tired, and I don't care if

00:06:45.720 I go to jail. Then Vasquez told WNBC that he, Vasquez, was scared, and that others on board the

00:06:51.820 subway were scared, too. They could tell that he was behaving in a threatening manner, and that had been

00:06:57.440 a long thing for him. He has a long history of doing that, at least 42 arrests for this guy over

00:07:03.760 the last 10 years. Just to get the chronology right, the New York Times says, last arrested November 2021

00:07:09.760 for hitting that 67-year-old woman in the face. Before that, June of 2019, arrested for punching a

00:07:15.840 64-year-old man in the face during a fight in a subway station in Greenwich Village. In August 2015,

00:07:22.360 arrested for attempted kidnapping after he was seen dragging a 7-year-old girl down a street. He

00:07:29.480 pleaded guilty to endangering the welfare of a child there. This was not a well person. This was

00:07:35.900 not sweet Michael Jackson imitator. His own grandparents, with whom he spent most of his

00:07:41.720 time, you know, when he did try to find housing, would not let him inside the house at night. So

00:07:47.520 dangerous was he? He threatened to kill his own grandfather repeatedly. He'd been sent to Bellevue

00:07:53.160 for psychiatric services time after time, said he was schizophrenic, said he was hearing voices. The

00:07:57.580 city ultimately failed him, I mean, in every single way. Just now in New York, Mark, we have a mayor and

00:08:03.540 sort of the governor saying, maybe we should be more open-minded to involuntary commitment for people

00:08:09.640 like this. And all the local officials beneath the mayor are saying, absolutely not. The left is saying,

00:08:14.500 absolutely not. You can't affect their civil liberties. But now that he's dead, they want to

00:08:19.560 protect him. Well, what I find interesting about what you just said is that if you were to, if you're

00:08:27.600 just haphazardly following this story in the media, the Michael Jackson impersonation stuff is the only

00:08:37.040 bit you'll take away. I don't know whether, I don't know, have no interest in the guy's Michael Jackson

00:08:43.200 impersonation. I don't know whether he's doing the bad stuff. I don't know whether he's doing the early

00:08:49.800 Jackson 5 stuff. Oh, look there, he's doing the, I was completely wrong on both counts. He's doing the

00:08:56.240 mid-period thriller moonwalk stuff. Who the hell thinks that this is actually the salient point of this

00:09:05.060 story? Now, that 67-year-old, if you're hit at the age of 67 by a big, powerful guy like this,

00:09:13.800 you're not kind of quite 100% for the rest of your life. That actually is something you live with,

00:09:20.880 even if you survive it, even if your injuries are superficial, there are consequences to that

00:09:26.920 that will stay with you forever. Yet the fact that he's still, oh, you know, it's a thriller,

00:09:49.160 So the Marine who tackled him means that this guy is in the designated victim class. And as I said,

00:09:59.820 the point is, you have a split second to decide, is this guy just, is this that charming, delightful

00:10:26.460 that situation. Because unfortunately, in this country, we're bifurcating into a Latin American

00:10:34.540 style society where there's the ruling class behind their entourages with their private security teams,

00:10:44.180 and then there's the great big mass of the rest of us who have to take our chances where we can.

00:10:50.580 Exactly right. The New York Post, Nicole Galinas has an article dated yesterday saying,

00:10:57.640 Neely's life mattered, and so did the lives of the 27 other people violently killed on the subway

00:11:03.680 since March of 2020. 27 other people. She points out that this city councilwoman, Tiffany Caban,

00:11:12.700 is out there alleging that this is racist, that this is wrong, that this is murder. And this is

00:11:19.420 the same person who, even as four people were killed within a month last fall on the subway,

00:11:25.800 including this union steam fitter who had two kids, he was on his way home from work,

00:11:29.400 a city field worker, similarly, on his way home from work late night, dismissed concerns about subway

00:11:34.820 violence back then, calling these one in a million events. This is a one in a million.

00:11:38.240 Yeah. Okay. How about this? This is not one of them. You don't care about the 27 others.

00:11:42.740 This guy, why? It's solely because of the racial element.

00:11:46.060 Yeah. And it's absolutely, I mean, basically, the Democrat-run cities, New York and elsewhere,

00:12:46.100 like small Asian ladies tossed onto the tracks, in that situation, you need to hope that there's some

00:12:56.920 guy around who's willing to get into the guy's face. And this is all there. And actually, it's not

00:13:03.940 even, I mean, they have this sort of thing going on in relatively small cities these days. It's

00:13:10.160 actually trickle down lawlessness starts in the big coastal metropolis and then trickles down to all

00:13:19.300 kinds of smaller cities. But you know what's going on. Big chain stores are suddenly deciding,

00:13:25.380 eh, we don't actually think we can operate in this place anymore because there's too many

00:13:30.260 homeless people coming in and shooting up in the bathrooms. So we're going to close down our

00:13:35.300 Starbucks and just the cost of operating in these towns. So they're going to get worse and worse and

00:13:44.100 more and more lawless. It's the realization of the broken windows theory. That was Bill Brattens who

00:13:50.500 cleaned up the city under Mayor Giuliani. You don't let the broken windows stay broken. You don't let

00:13:54.840 the graffiti go unprosecuted. You don't let the subway jumpers jump this turnstile because as soon as you

00:14:00.280 allow people to start doing that stuff, they start doing worse things because there's an element of

00:14:34.200 and he was angry as F cursing and bad mouthing community commuters screaming. What the F are you

00:14:39.380 looking at? Don't effing. Look at me. Totally did not expect him to act this way ever since that day.

00:14:44.580 He's just been a scary dude to me. He doesn't dress up anymore. No more dancing. Just ask for money.

00:15:28.420 back they have to go. Once they've decided that someone is the victim in a story, then you'll see

00:15:36.240 really weird things. It'll be like some 27 year old guy. But the only picture they'll ever use

00:15:42.020 is his high school yearbook photo. And they'll be doing all this, oh, the gentle giant and all that

00:15:49.180 kind of thing. And it's almost as if they all get the facts at 5.45 a.m. the first morning and they

00:15:58.400 never deviate from that. So this guy is going to be memorialized as a Michael Jackson impersonator

00:16:05.240 now and forever, even though, as you say, almost a decade ago, people were warning that the Michael

00:16:12.280 Jackson guy was, in fact, a man of violence. And here's what people are looking at, Mark,

00:16:32.000 subway. This accurately captures the nature of riding the New York City subway. It's not the

00:16:37.320 guy, Neely, who was just killed. It is another guy. But this is what life is like on the subway.

00:21:56.580 people were utterly failed by a city that wouldn't protect them thank god there was a marine there who

00:22:10.020 subway car with a guy like that marine than without him but nobody should get to decide whether unless
