01:28:56.460 a single hair, about nine inches long, light to medium brown, untreated, with a dark ring

01:29:04.060 just above the root. That band of color comes from a phenomenon known as post-mortem root

01:29:11.140 banding. Stephen Shaw, the FBI examiner behind the root banding validation study, is anything

01:29:17.840 but defensive when the defense gets its turn with him on the stand. Baez asks him about

01:29:23.580 this area of forensic science while casting doubt on its accuracy.

01:29:28.340 You don't know if post-mortem root banning is exclusively from people who are deceased, correct?

01:29:36.800 Okay. And you can never testify in a court of law to such a fact?

01:29:42.620 This is still a very ongoing area of forensic science, is it not?

01:29:49.500 there's still research being done. I mean, I'm conducting research myself. It's pretty well

01:29:59.880 established discipline, but it's mostly, for the most part, based on the experience,

01:30:08.400 experience of hair examiners and observing hairs known to be from deceased individuals,

01:30:14.260 hairs known to be from living individuals, and noticing these differences.

01:30:19.500 The defense gets Shaw to admit that he submitted his root banding validation study for approval only after he'd already been deposed in this case and after he'd already given his opinion on the hair evidence.

01:30:32.400 They elicit an admission that Shaw then asked to have the study expedited so it would be finished before trial.

01:30:40.540 He looks agenda driven, perhaps even self-aggrandizing.

01:30:44.380 Then prosecutor Jeff Ashton gets up to rehabilitate Shaw.

01:31:25.680 the only environmental condition that has consistently been found to lead to post-mortem

01:31:35.220 banding is the attachment of the hair to a decomposing body. At this point, that's where

01:31:41.000 the science is, correct? That's correct. No further questions. The hair also goes to an FBI examiner

01:31:49.280 named Karen Korsberg Lowe, who puts it under a microscope. The hair from the trunk is untreated.

01:31:56.460 It has never been bleached or dyed and is microscopically dissimilar to the sample from

01:32:02.580 Casey. Lowe excludes Casey Anthony as the source of the hair from the trunk. The known sample she

01:32:09.420 has for Kaylee is a hairbrush with a single hair in it. She tells the jury the two hairs have

01:32:14.980 consistent characteristics. However, she cannot confirm an exact match. Lowe sends out a piece

01:32:22.300 of the hair for mitochondrial DNA testing. Mitochondrial DNA is passed down from mother to

01:32:28.680 child, generation to generation. It is identical, so cannot point to any one person within that line.

01:32:36.800 Katherine Tyson, also of the FBI, handles the actual DNA analysis. She compares a cheek swab

01:32:43.500 from Casey Anthony, the hair from the trunk, and a hair from the mass of hair that was found

01:32:49.340 with the skull in the swamp. All three share the same mitochondrial DNA. The hair in the trunk

01:32:57.120 belonged to someone in Kaylee Anthony's maternal line.

01:33:01.240 Kaylee, Casey, Cindy, anyone else on that side of the family.

01:33:06.580 Tyson explains how rare this finding is on the stand.

01:33:10.240 Further, I would not expect to see that mitochondrial DNA type

01:33:13.940 in more than 0.26 of the African-American population,

01:33:18.020 nor in more than 1.85% of the Caucasian population,

01:36:14.320 Burdick takes Bradley through the report page by page. Then just before she sits down, Linda asks

01:38:23.400 then ran the data again through a newer program called Cash Back, which he believed would give

01:38:29.440 him a more reliable result. This time, Baez puts the earlier Net Analysis report in front of Stinger

01:38:36.600 and takes him through it slowly, line by line, until they reach the Chloroform website,

01:38:42.120 an entry from the afternoon of March 21st at 2.16 p.m.

01:38:48.080 And how many times does it show that that website was visited?

01:38:51.300 One, sir.

01:38:52.700 Then Baez puts the cash back report, the one the state had introduced,

01:38:56.820 in front of Sergeant Stinger and takes him to the very same entry.

01:40:55.420 The medical examiner sends samples to Bruce Goldberger, a nationally recognized forensic toxicologist at the University of Florida, for testing.

01:41:06.220 A piece of bone marrow scraped from inside the thigh bone and a hair taken from the mat around the remains.

01:41:14.460 Goldberger tests those samples for a long list of substances.

01:41:18.100 Chloroform is one of them.

01:41:20.200 He finds none.

01:41:21.780 But in his report, he adds an important caution.

01:41:24.720 A negative test does not prove that Kaylee was never exposed to chloroform before she died.

01:41:30.780 In her opening statement, prosecutor Linda Drain Burdick told the jury the duct tape would explain how Kaylee died.

01:41:37.920 Now the state turns to the duct tape itself.

01:41:41.440 Several overlapping pieces of tape were found across the front of the lower skull, over the lower jaw, and part of the upper jaw as well as still caught in Kaylee's hair.

01:41:52.020 In the written autopsy report, the medical examiner is unequivocal about when it was put there.

01:41:57.580 Quote, this duct tape was clearly placed prior to decomposition, keeping the mandible in place.

01:42:04.560 In other words, the report says the tape was already on Kaylee before her face decomposed.

01:42:13.160 Three of them examine the same remains, and they do not all agree on whether that tape was holding Kaylee's jaw in place.

01:42:24.980 He tells the jury that once a body reaches this stage of decomposition,

01:42:29.740 the lower jaw usually separates from the skull completely.

01:42:33.680 But Cayley's had not.

01:42:35.660 So the prosecutor asks him what was holding it there.

01:42:39.360 Utz does not say duct tape.

01:42:41.700 He points instead to the mat of hair around the skull with plant roots grown through it,

01:42:47.180 binding the bones together.

01:42:49.320 Then the state calls its second doctor, forensic anthropologist, Dr. John Schultz,

01:42:57.320 He is asked essentially the same question.

01:43:07.160 Then comes the third doctor, forensic anthropologist Michael Warren.

01:43:11.740 He looks at the same remains and reaches a different conclusion.

01:43:15.600 To Warren, the fact that Kaylee's jaw is still lined up with the skull means something had to be holding it there.

01:43:22.580 And when Prosecutor Jeff Ashton asks what that something was, Warren has one answer.

01:54:13.440 his anxiety. And sometime after he gets into that room, he starts taking pills. By his own account,

01:54:20.860 about 70 of them. Not one prescription. Whatever he has with him. He starts drinking beer, too,

01:54:27.580 as much as he can. At some point, he sits down and begins writing a letter. Later that night,

01:54:35.040 George starts sending goodbye messages. He texts friends, family, even lead defense attorney

01:54:42.380 Jose Baez. He leaves Baez a voicemail asking him to tell Casey he is sorry and that he loves her.

01:54:50.060 George tells people he wants to be left alone. He says he wants to make sure Kaylee is in God's arms.

02:02:02.740 talk about it when the time is right. Well, the time is now. The time is now to try and save his

02:02:11.500 sister's life. It's true about the FBI. They asked Lee to take a paternity test, allegedly to help

02:02:18.480 clear up an Internet rumor. He does, and it is negative. Baez tells the jury these allegations

02:02:25.200 explain Casey Anthony, the lies, the imaginary nanny, the fake job, the life she appeared to

02:02:32.080 be living while Kaylee was missing. Jose Baez describes Casey as a sex abuse survivor who had

02:02:39.780 learned to retreat into a world of her own making. In Baez's words, quote, that's what Casey had to

02:02:46.300 do to live. She forced herself to live in a world that she wanted to, not the one she was thrust

02:02:52.380 into. No witness will ever come into that courtroom and support either allegation against

02:02:58.560 George or Lee Anthony, which both men flatly deny. George is the first to deny the allegation.

02:03:10.960 questions about something else. Have you ever sexually molested your daughter, Casey Anthony?

02:03:36.600 The defense story is that on June 16th, 2008, while Casey and George are both at home, George finds Kaylee dead in the pool.

02:05:25.800 Years later, I asked veteran criminal defense attorney Jay Cheney Mason about the allegation

02:05:31.880 that George had sexually abused Casey. Mason served as co-counsel on Casey Anthony's defense

02:05:37.980 team sitting beside Baez throughout the trial. When I spoke with him in 2021, I asked what he

02:05:44.980 made of that accusation. I told George in my office with the permission of his lawyer what

02:05:53.780 was going to happen, that George is going to be accused of sexually molesting his daughter. I

02:06:01.900 wanted to see his reaction. All George did was just look and sigh, put his hands on his laps

02:06:08.840 and no other on his legs and no other response. I thought there was a peculiar response for a

02:06:15.100 father having been accused in some situation like this by a lawyer of, you know, kind of officially,

02:06:22.180 you know, this is what's going to happen. You make that kind of accusation, you got to prove

02:06:27.100 it somewhere. It's a really bad situation for a defense lawyer or either side to make promises

02:06:33.840 to a jury that they cannot deliver on. Jurors remember it. Later in the defense case, Mason

02:06:41.220 calls Dr. Werner Spitz to the stand. Spitz has been doing this work for more than half a century.

02:06:48.020 Over 56 years in forensic pathology, he has conducted or supervised more than 60,000 autopsies.

02:06:55.340 He also literally wrote one of the standard textbooks in his field.

02:07:00.180 Spitz testifies that he believes the duct tape was placed on Kaylee's face after she had died.

02:07:06.640 He also has a problem with the autopsy in this case.

02:09:52.920 that prompted me to look up chloroform. Right now I don't understand how you can get those two mixed

02:10:00.500 up. Not getting them mixed up if you look into chlorophyll there's some bacteria associated with

02:10:07.900 chlorophyll production. And looking up that, it comes from different species of plants that have

02:10:18.100 red and brown coloring. And that prompted me to look up chlorophyll because some species of algae

02:10:26.980 and seaweeds and stuff produce naturally chloroform. The problem for Cindy is her work 1.00

02:10:34.840 records. They put her at the office on the afternoons when those chloroform searches were 0.99

02:10:39.800 made. Cindy says that does not necessarily mean she was at the office. She also tells the jury

02:10:45.940 she had been searching other household chemicals that March after a warning about hand sanitizer

02:10:52.200 and small children, things like alcohol, acetone, and hydrogen peroxide. Kaylee was just the age to

02:10:59.700 get into something like that, Cindy says. So she went home and started looking up what was in it.

02:11:58.940 plea deal. Baez, on the other hand, writes that Burdick approached him about a plea deal. According

02:12:05.340 to Prosecutor Ashton, at this point, the state is willing to discuss second-degree murder for 30

02:23:40.740 prosecutors call rebuttal witnesses. They start with Cindy Anthony's employer, Gentiva Health

02:23:47.320 Services. Cindy had told the jury that the records showing her at work did not necessarily mean

02:23:53.540 she was at work at the time. Now, John Camperlingo, general counsel from Gentiva,

02:27:06.480 And it is during the state's rebuttal case that George Anthony's letter from the Hawaii Motel in Daytona Beach two years earlier finally goes into evidence.

02:27:25.340 of George as the reason the letter is now admissible. So the jury gets to read the eight

02:27:31.680 pages George wrote alone in that motel room, agonizing over not knowing what happened to

02:27:38.300 Kaylee. On the morning of July 3rd, 2011, before either side gives its closing argument, Judge

02:27:45.360 Perry rules on what the lawyers can and cannot say to the jury. He starts with the unsupported

02:27:51.360 allegations thrown out by Baez in his opening statement that George Anthony and Lee Anthony

02:27:56.660 sexually abused Casey. Judge Perry says there is absolutely no evidence to support either in the

02:28:05.120 record. Lee was not asked a single question about it and rules that Baez cannot mention either

02:28:11.040 allegation in closing. The judge turns his focus to the drowning theory. No witness has testified

02:28:17.980 that Kaylee drowned. No one has told this jury they saw it happened and nothing in the evidence

02:28:22.920 establishes when a drowning would have occurred. But the defense does have pictures of the pool

02:28:28.360 behind the Anthony house, the pool ladder, and Kaylee, not yet two years old, opening the sliding

02:28:34.520 glass door by herself. That is enough for Judge Perry. There is evidence that the defense can make

02:28:40.920 the reasonable inference of an accidental drowning by the use of the pictures, as Mr. Mason argued.

02:28:50.820 So whether or not one chooses to believe or disbelieve, there is some inference that can be drawn.

02:29:01.500 Years later, I asked Jose Baez where the story of the drowning came from,

02:29:06.020 as well as the sexual abuse allegations he made in his opening statement.

02:29:30.540 That she immediately grabbed Kaylee and began to cry? This is very specific.

02:30:09.260 They're free to believe a witness or not believe a witness based on those questions.

02:30:13.540 And I can tell you this, a lot of the feedback that we got from the jury is they believe certain parts of the evidence.

02:30:21.320 There were statements made at numerous points throughout the trial that raised serious concern about the drowning in the pool.

02:30:31.720 And when I say concern, I mean raise the issue that that was certainly a potential aspect.

02:30:38.640 And it's the prosecutor's job to exclude that reasonable hypothesis of innocence.

02:30:44.700 So, you know, they knew about the drowning theory since day one.

02:30:50.540 On July 3rd, 2011, Prosecutor Jeff Ashton begins the state's closing argument.

02:32:23.600 And that, ladies and gentlemen, is proof beyond a reasonable doubt of how Kayleigh died.

02:34:06.520 it. They're hoping they throw enough against the wall and see what sticks. That's what they're

02:34:12.520 doing here. Let's throw it all against the wall and see what sticks. Right down to their cause 0.91

02:34:17.220 of death. One week it was chloroform. Today it's duct tape. Let's make up our minds and say we

02:34:27.120 proved to you that this case was proven beyond and to the exclusion of every reasonable doubt.

02:34:33.520 How can you say that? How? It makes no sense. Late in the argument, he talks about the Anthony's

02:34:42.280 pool. Cindy and Kaylee swimming on the evening of June 15, 2008. Cindy testified she took the

02:34:49.260 ladder down afterward, and Baez reminds the jury that the prosecution has attacked Cindy Anthony's

02:34:55.280 credibility as a witness. Then the photographs. Kaylee, not yet two, climbing that ladder. Kaylee

02:35:03.500 opening the sliding glass door of a house with no child safety locks on it. That, he tells them,

02:35:08.640 is as close to proof as anyone is going to get short of a video.

02:35:13.280 And the child was found with no socks and no shoes.

02:35:17.320 Law enforcement didn't want to keep their eyes open,

02:35:19.940 didn't want to look at every possible alternative.

02:35:23.580 There's nothing sexy about a drowning.

02:35:27.240 There's nothing interesting about a drowning.

02:35:32.160 And they didn't care.

02:35:33.680 The state gives its rebuttal on the 4th of July.

02:35:37.780 Prosecutor Ashton goes first, and he starts by telling the jury how to think about competing

02:35:42.940 experts. Look first at what the scientists agree on, he says, and then at what they don't.

02:35:49.400 He tells the jury the state believes the evidence fits a scenario in which Casey Anthony used

02:35:53.880 chloroform so that Kaylee would not suffer, and then placed duct tape over her nose and mouth.

02:36:00.900 He also tells them they do not have to accept that exact sequence, that they can decide for

02:36:06.820 themselves what scenario the evidence supports. Near the end of his argument, Ashton comes back

02:36:13.220 to George Anthony and the motel room in Daytona Beach. The defense has spent the entire trial

02:36:18.960 suggesting George knew more than he admitted. Ashton uses George's suicide attempt and the

02:36:24.720 letter he wrote that night to argue the opposite, that George was a grieving grandfather who was

02:36:30.580 shattered by Cayley's death and you cannot read this letter and not see that

02:36:38.620 this man was in pain you can even see the effects of the drugs and alcohol as

02:36:49.060 his handwriting deteriorates through this letter this is not some self-serving

02:36:58.300 deliberately created a manifesto of innocence. This is the cry of a man who just doesn't

02:37:07.580 understand the world anymore. He doesn't understand what happened to his granddaughter.

02:37:12.760 He doesn't understand why his daughter won't tell him. He just doesn't understand. And he's just

02:37:18.080 tired. When Ashton is finished, he does not ask the jury to convict. He simply thanks them and

02:37:26.300 sits down. Linda Drain-Burdick is the last lawyer to stand up. She is the final voice these 12 jurors 1.00

02:37:33.100 will hear before the case is theirs. Linda says she feels like the kicker being sent out for the

02:37:38.800 last second field goal after a teammate has carried the ball to the one-yard line, only to have to

02:37:43.820 wait through a timeout before she can take the kick. Her biggest fear, she tells them, is that

02:37:48.840 after weeks of testimony, arguments, experts, and accusations, that common sense gets buried

02:37:54.880 underneath all of it. So she goes back to the 31 days. The defense has called that evidence

02:38:00.860 a smear, an attempt to turn Casey Anthony's behavior into proof of murder. Linda tells

02:38:07.420 the jury why the state spent so much time on those 31 days, because Casey's lies, her

02:38:13.300 avoiding and her misleading, are evidence of guilt. She gives the jury a simpler way

02:48:44.040 As to the cause of death, Ford does not believe that Kaylee drowned in the family pool,

02:48:57.940 believe the defense on that? I'm not saying that. I'm saying it's a lot easier to get to that

02:49:01.280 conclusion. I can walk from here to there and make it happen. But the chloroform, I'm all over the

02:49:05.700 place. I have no idea. I'm in a maze. I don't know where I'm at. I can't get from beginning to end.

02:49:09.400 A to B to see what even happened. I can't make it work. Moran then asks Ford's opinion on George

02:49:15.020 Anthony, one of the state's most important witnesses and the first called to testify.

02:49:20.460 What did you make of George Anthony's testimony? He did not. He did not hold the state's case.

02:49:27.540 Why? Because he was clearly dishonest. He was dishonest? Yes. He was evasive, number one.

02:49:35.120 His story seemed to change depending on, like they said, initially he was on the defense's side.

02:49:40.440 So he would, you know, fight with Mr. Ashton, not give straight answers.

02:49:43.720 But then he switched to the prosecution side and then he now he won't give the defense straight answers.

02:49:54.680 Ford later tells CNN that during deliberations, the jury took a vote on the manslaughter charge and that she voted to convict.

02:55:32.660 People magazine about the moment they took their final vote, when the decision stopped being

02:55:38.620 something they were debating and became the verdict. He says, quote, and then we sat there

02:55:45.020 for a few minutes and were like, holy crap, we are letting her go free. Everyone was just stunned

02:55:52.320 at what we were about to do. One of the women jurors asked me, are you okay with this? And I

02:55:58.500 said, hell no. But what else can we do? We promised to follow the law. Ten years later, People

02:56:06.700 Magazine goes back to this juror and he is still wrestling with his decision. He says, quote, I think

02:56:13.980 of the case at least once every single day. Every time I see her face or hear her name, I get a pit

02:56:20.480 in my stomach. I think about those pictures of the baby's remains that they showed us in court.

02:56:25.860 I even remember the smell of the courtroom. My decision haunts me to this day. I think now if I

02:56:32.320 were to do it all over again, I'd push harder to convict her of one of the lesser charges like

02:56:37.800 aggravated manslaughter, at least that, or child abuse. I didn't know what the hell I was doing

02:56:44.320 and I didn't stand up for what I believed in at the time. He says the jurors stayed in touch for

02:56:51.160 a while. They had a group text. He says eventually even seeing one of their names light up on his

02:56:56.960 phone made him feel sick, so he muted it. Two days after the verdict is read, Casey Anthony is back

02:57:04.800 in Judge Perry's courtroom, this time getting sentenced for the four misdemeanor convictions.

02:57:11.020 Judge Perry gives her one year in jail and a $1,000 fine on each count with credit for the
