00:12:59.940day of a preliminary hearing, expected to last all week. The proceedings mark the most significant
00:13:05.820presentation of evidence in the case to date, with prosecutors tasked with persuading Judge
00:13:10.620Tony Graff that they do have enough evidence to take Robinson to trial. Robinson faces seven
00:13:16.740charges, including aggravated murder, with prosecutors seeking the death penalty if he

00:13:36.520through the evidence. After the break, defense attorney Catherine Nestor resuming her cross
00:13:40.940examination of former Utah Valley University police officer Chris Bagley, who was on campus
00:13:46.820the day of the shooting. Nestor first pressing Bagley on his body camera, Bagley testifying the
00:13:52.920battery had died and that he did not replace or recharge it because of the chaos unfolding that
00:13:58.880day. Nestor then turning to the surveillance video Bagley later reviewed at the police
00:14:03.760department, suggesting neither her client nor the alleged murder weapon were identifiable in that
00:14:09.760tape. When you looked at that video, were you able to identify the individual's face? I know.

00:14:58.680anything about a hat or what was on their head? At the moment, no, I couldn't. Okay.
00:15:05.320And did you see a gun in the video? I saw a long black object in the left hand as he was running
00:15:13.680across the roof. Prosecutors then calling David Hull, a former Utah State Bureau of Investigation
00:15:19.980agent who now works for the Utah Department of Public Safety. Hull testifying he spent years
00:15:25.260investigating major crimes, including dozens of murder cases, before being sent to Utah Valley
00:15:30.320University after Charlie was shot. Hull describing phone tips pouring in from members of the public,
00:15:37.260along with cell phone videos taken by people who were at the event. That quickly set off one of
00:15:42.680the central fights of the afternoon. Prosecutors want several of those videos and accompanying
00:15:47.900statements admitted into evidence. Defense attorney Nestor objecting, arguing the people
00:15:53.220who recorded or verified the videos were not in court to testify, thus the tapes could not be
00:15:58.680authenticated. In some cases, the judge allowing these videos to be shown in court and on the
00:16:04.280public livestream. For example, Judge Graff allowing one video from a woman who submitted
00:16:09.480a written statement confirming she recorded it. In other cases, Judge Graff allowing the videos
00:16:16.060but blocking them from being shown on courtroom screens or broadcast to the public, including
00:16:21.960video of the moment Charlie was killed. Judge Graff watching that video on a monitor atop his
00:16:28.900bench. The judge clearly wincing as the sound of the fatal shot rings out, appearing to hold back
00:16:35.280emotion as the gruesome scene unfolds. Later, a dispute over identifying Tyler Robinson in court.

00:17:12.700but I believe there's a long line of case law that says,
00:17:16.040and you ask someone to identify the defendant when they're the only person, you know,
00:17:21.920sitting at the table with defense counsel, that that's unduly suggestive
00:17:25.880and taints any future or past, well, definitely future, identification.
00:17:34.220So we object to that happening in this fashion at this time.
00:17:38.200I've simply asked him if that person that he has seen,
00:17:42.380both in driver's license photos and the surveillance video,
00:17:46.960if that person is here in the courtroom today.
00:17:49.880And I don't know that that's unduly prejudicial or suggestive.
