00:00:53.580 It's very easy to look like you know what you're doing when both moderators are entirely on your side.
00:01:02.960 Trump did the best he could under the circumstances, but it really was like three fighters in the ring pummeling one opponent.

00:06:11.540 And you just, you knew where the night was going when we got the first fact check when Trump
00:06:14.880 was talking about abortion and was talking about, he misspoke in this instance.
00:06:18.200 He got it right later when he said the West Virginia governor, the former, he meant the
00:06:22.160 former Virginia governor had talked about abortions after birth, right?
00:06:26.620 And he didn't say in any state has abortions after birth.
00:06:30.680 He just said the governor had said this, which is a correct statement.
00:06:33.420 And then he's fact-checked by saying, well, Mr. Trump, there's no state in America that
00:06:37.480 has abortion after nine months.
00:06:39.240 Actually, there are a few instances in Minnesota.
00:06:40.840 He was correct about that as well.
00:06:42.040 But this is the point, the fact-check was incorrect, right?
00:06:45.280 And this is why debate moderators shouldn't fact-check.
00:06:48.600 You know, the CNN moderators did not fact-check because what you think the fact is in that
00:06:53.580 moment may be subjective, you may be wrong, and you're tilting the playing field.
00:06:57.600 And certainly to fact-check one candidate and never fact-check the other, she did the Charlottesville
00:07:03.380 lie, that both sides are fine.
00:07:05.660 People lie, no fact-check.
00:07:07.280 She did the bloodbath lie.
00:07:09.160 He clearly didn't mean that, you know, that the country is going to be, there are going
00:07:12.780 to be riots in the street if he's not elected.

00:07:17.160 So the moderators were a disgrace.
00:07:19.040 It's one of the reasons Trump seemed on defensive a lot of the night.
00:07:23.240 One was he took a lot of bait from Kamala Harris, so he didn't need to.

00:07:41.720 But I do want to just spend a minute on this fact-check you just mentioned.

00:07:45.760 Here's the moment we're referring to where Lindsey Davis, helpfully fact-checked Trump on
00:07:50.960 this abortion claim.
00:07:52.560 They have abortion in the ninth month.
00:07:55.760 They even have, and you can look at the governor of West Virginia, the previous governor of West
00:08:00.120 Virginia, not the current governor, is doing an excellent job, but the governor before,
00:08:04.920 he said, the baby will be born and we will decide what to do with the baby.
00:08:09.060 In other words, we'll execute the baby.
00:08:10.680 There is no state in this country where it is legal to kill a baby after it's born.
00:08:15.420 Okay.
00:08:16.560 That's not true.
00:08:18.300 Maybe she can use the word kill.
00:08:20.780 It's not like somebody's sticking a knife in the dead baby, in the alive baby as it's dying,
00:08:26.500 Emily, but you and I both know that in places like Minnesota and elsewhere, if you are trying
00:08:33.020 to abort a baby in the ninth month or otherwise, and it's born instead of dying in the mother's
00:08:39.620 womb, they will let that baby sit on the table and die.
00:08:45.240 And Trump's claim, though Rich is right, he said at first West Virginia, later he corrected
00:08:49.100 himself to Virginia.
00:08:49.860 Their former governor, Ralph Northam, said this on camera, admitted to this.
00:08:56.280 Here is the soundbite.
00:08:57.940 Boy, if a mother is in labor, I can tell you exactly what would happen.
00:09:02.480 The infant would be delivered.
00:09:04.620 The infant would be kept comfortable.
00:09:07.300 The infant would be resuscitated if that's what the mother and the family desired.
00:09:12.340 And then a discussion would ensue between the physicians and the mother.
00:09:16.200 So I'll give you one other Roger Severino.
00:09:19.100 He's with the Heritage Foundation tweeting out the following Harris.
00:09:23.060 And as it turns out, Lindsay Davis is dead wrong.
00:09:27.760 Some babies do survive abortions and can be saved, but are denied lifesaving treatment,
00:09:31.820 including under Tim Walz's watch.
00:09:34.360 Harris even voted against the Born Alive Abortion Survivors Protection Act to defend that would have
00:09:42.200 defended the lives of these babies, their right to live once born, unconscionable.
00:09:50.000 Trump didn't say any of that, okay?
00:09:51.980 He tried.
00:09:52.880 But the nerve of this moderator to inject herself into it without any of this.
00:10:00.240 That's for you, Emily.
00:10:00.980 Here's what I find especially infuriating about that.
00:10:05.360 She chose, she editorialized with all of the sanctimony in the world to say that word,
00:10:13.620 to focus in on that word, quote, execute.
00:10:15.920 I don't know if she knows any of the context that you just provided, which is all completely
00:10:20.960 accurate and known to people who follow the news closely, unless you're in a total bubble
00:10:26.560 and aren't doing your job, which is obviously the case here.
00:10:29.260 But she chose to editorialize and say, it's not true.
00:10:32.240 You can't execute, you can't kill babies.
00:10:35.400 I mean, actually, it depends on whether or not you consider having a baby who could be
00:10:39.980 cared for, born alive, and then left without care.
00:10:43.640 If you don't consider that an execution, okay.
00:10:46.720 But she is injecting here to quibble, editorially.
00:10:51.200 And she doesn't have a leg to stand on, on this particular issue.
00:10:55.720 There are obvious moments where Kamala Harris could have been fact-checked,
00:10:59.480 just as any candidate could.
00:11:01.300 I don't object to them fact-checking Donald Trump.

00:11:07.680 You know, we didn't, after that CNN debate about Biden, talk about the moderators for
00:11:11.260 a lot of reasons, namely because of Biden.
00:11:13.160 But we also really saw them sink into the background of that debate.
00:11:17.200 It was the opposite in this case.
00:11:18.680 They were constantly injecting themselves, constant fact-checks.
00:11:21.180 Didn't get a fact-check on IVF, Project 2025, as Abigail Schreier pointed out.
00:11:26.040 Nothing on Charlottesville, even when Snopes had fact-checked what Joe Biden was saying
00:11:31.120 about Charlottesville that Kamala Harris repeated.
00:11:33.520 Nothing on abortion.
00:11:34.680 Nothing on that bloodbath comment.
00:11:35.940 They just let it all go and just went straight for Trump.
00:11:38.560 It was all him.

00:11:41.380 Not one fact-check on Kamala Harris.
00:11:43.960 But Emily, what you point out gets to the insanity of it.
00:11:46.100 If she was going to be strictly accurate in her fact-check, she would have said, well,
00:11:49.400 it's not technically an execution because you're not affirmatively killing the child.
00:11:53.620 Instead, after the child's born, you're just giving the child comfort care and not the
00:11:57.880 medical care that might be necessary to save him or her.
00:12:00.380 That's an opinion, right?

00:12:03.460 And so, but instead they do it under the guise of a fact-check, which gives it this authority
00:12:08.720 it doesn't deserve that they're using by the grace of them sitting there as moderators.

00:12:18.760 And the same thing on Trump's attempt to claim that when he said on a podcast that he lost
00:12:26.240 the 2020 election by a whisker, he, I said this on my show today, you guys, I said, if
00:12:32.620 I were asking the questions tonight, I would ask him about that and about the fact that
00:12:38.060 he sat on a podcast last week, he lost by a whisk by a whisker and you should bring that
00:12:42.880 up.
00:12:43.020 And that's fine to bring that up, which they did.
00:12:45.180 And I was actually surprised by Trump's answer.
00:12:47.420 I was being sarcastic and I'm going to be honest.
00:12:50.080 I don't know that he was being sarcastic in that answer either.
00:12:52.920 I didn't detect the sarcasm myself.
00:12:54.480 That's not appropriate as a fact-check.
00:12:57.840 David Muir, here's the moment.
00:13:00.360 Mr. President, for three and a half years after you lost the 2020 election, you repeatedly
00:13:04.800 falsely claimed that you won, many times saying you won in a landslide.
00:13:09.120 In the past couple of weeks leading up to this debate, you have said, quote, you lost by a
00:13:13.700 whisker, that you, quote, didn't quite make it, that you came up a little bit short.

00:13:18.660 Are you now acknowledging that you lost in 2020?
00:13:21.160 No, I don't acknowledge that at all.
00:13:22.400 But you did say that.
00:13:23.140 I said that sarcastically.
00:13:23.700 You know that.
00:13:24.620 And we said, oh, we lost by a whisker.
00:13:26.340 That was said sarcastically.
00:13:28.220 Look, there's so much proof.

00:13:43.960 You and your allies, 60 cases in front of many judges.

00:14:06.140 And that's why these moderators getting into the business of live fact-checking debates is a farce.
00:14:12.020 And in this case, it was so obviously a farce because not once, not once did they attempt to do the same thing to Kamala Harris.
00:14:19.840 And it was interesting because in the first half of the debate, Kamala Harris came out.
00:14:24.020 She seemed maybe a little nervous.
00:14:25.940 Donald Trump seemed like he thought that she would be easier to debate than she actually was.
00:14:31.020 And, you know, he took the bait a couple of times from her.
00:14:34.280 She baited him into talking about his rallies, when he probably shouldn't have been litigating the size of his rallies.
00:14:39.120 But then as the media fact-check started piling up, and as it became clearer and clearer that the editorial line from ABC News, from the leadership that is very close to Kamala Harris, as you pointed out, Megan,
00:14:51.100 they said that there was an editorial firewall in this case, which was obviously not true.
00:14:55.240 So that bled all the way down into this debate.
00:14:58.380 And that became increasingly obvious.
00:15:00.220 And that's where Donald Trump picked up steam.
00:15:02.480 He was, you know, he, I thought, came across as a little overly defensive and angry in the first half of the debate.
00:15:07.600 But as the media performance started to get more and more egregious, he actually really, really did start picking up steam.
00:15:13.580 So even by their own objectives, they're too dumb.
00:15:17.300 They're too dumb to actually fulfill their own state of their own objectives, which we all know is that they want to destroy Donald Trump,
00:15:25.620 because this ends up helping him when it may not have been a good debate for him, period.
00:15:29.840 Now the big conversation coming out of the Trump camp is going to be an entirely reasonable one about what a joke the media was.
00:15:37.260 So the big loser here, and I mean bigger than Donald Trump in this case, is ABC News.
00:15:41.740 Because now I think all of the networks, to your point, Megan, might be losing access to debates from Republicans going forward.

00:15:50.580 And I just want to find a point on the fact-check, the so-called fact-check by this Lindsay Davis.
00:15:53.900 Because it's even more egregious and annoying when she's like, okay, there's no state in this union that allows my baby to be killed after being born.
00:16:05.000 Like, if you do it, you know, with the right body language, like, it's very hard to deal with this lying liar who lies all the time, but I will handle it because I work for ABC News.

00:16:20.120 You can't, if Trump agrees to another debate on ABC, NBC, CBS, CNN, maybe not CNN, because he did okay on the last one.

00:16:46.300 And she's got an emotional support team out there now in the form of Muir and Davis, and she would have the same thing of this were an NBC or a CBS debate as well.

00:17:26.540 But she got her points across, and I think they're probably delighted with her performance tonight.
00:17:31.020 As we said, a lot of help from the moderators, but I wouldn't be surprised if the Insta polls say that she won.
00:17:37.960 I doubt it's decisive in the race, but they probably feel pretty good about what she did.
00:17:43.360 I have to tell you, I watched this seeing, yes, she scored some points.
00:17:47.680 It was like watching a boxing match where you'd have to give her some technical points for landing points, articulating them.

00:17:55.700 I actually don't think so, because I think your average viewer at home understands it was three against one and would have a national sympathy for Donald Trump.

00:18:03.240 They don't like an unfair contest.
00:18:04.780 And I also thought her ridiculous preening and facial expressions and tsk-tisking and her rumphing over on screen right were a massive turnoff.
00:18:14.900 And that all happened, especially in the first 20 minutes of the debate, when people are watching more than they are as the debate goes on.

00:18:56.140 She's the one who should be happy that they wound up mutating it because she was the interrupting cow, not Trump.

00:19:03.160 So the Democrats have had some trouble with their on-camera not speaking moments.
00:19:08.020 With Biden, it was the mouth just hanging agape, which wasn't a good look.

00:19:13.380 She got it under control a little later, but it was just awful at the beginning.
00:19:17.680 And she repeatedly tried to interrupt, even though her mic wasn't on.
00:19:21.140 And that led to a good Trump moment where he did the, I'm speaking, please.

00:19:27.040 Kind of needling her with that line she used half a dozen times in the debate with Mike Pence.
00:19:31.600 But wait, I'm going to give you one more reason why I don't think she did well.
00:19:38.080 And it was the personal insults.
00:19:39.980 Because I don't think American women, who they're all trying to get at home, are going to respond favorably to the repeated, repeated personal insults she hurled at him in virtually every answer.
00:19:54.080 She was small and she was petty.
00:19:56.980 And he didn't respond.
00:19:59.480 On that, he didn't take much bait.
00:20:02.840 Maybe here or there he dropped a word.
00:20:04.760 But she was like a dog with a bone in her trying to attack him personally.

00:20:13.440 World leaders are laughing at Donald Trump.
00:20:16.340 I have talked with military leaders, some of whom worked with you.
00:20:20.340 And they say you're a disgrace.
00:20:22.320 It is very well known that Donald Trump is weak and wrong on national security and foreign policy.
00:20:29.120 It is well known that he admires dictators, wants to be a dictator on day one, according to himself.
00:20:35.980 It is well known he exchanged love letters with Kim Jong-un.
00:20:40.840 Why the European allies and our NATO allies are so thankful that you are no longer president.
00:20:47.680 And why don't you tell the 800,000 Polish Americans right here in Pennsylvania how quickly you would give up for the sake of favor and what you think is a friendship with what is known to be a dictator who would eat you for lunch.

00:21:05.380 We could have pulled more.
00:21:07.560 And I just I wonder I mean I again on points I don't know that Trump would win this debate but on style Emily I think she was a massive turnoff.
00:21:15.700 That's interesting because there were also a couple of moments where she you know the the race question in particular where they asked Donald Trump why he said that she used to be Indian and now she's black.
00:21:32.800 And then they turned the question to Kamala Harris and like we saw her do in the Dana Bash interview I thought she did a good job of not getting into the identity politics trap.
00:21:42.520 I thought there were a couple of moments where she like was clearly scripted in the right direction.

00:53:43.480 We need to turn the page from a decade of division and polarization on substance.
00:53:49.780 I think she, she pitched a shutout and I think she did on style as well.

00:53:57.260 I look, I think these Democrats are feeling good because they finally have a candidate who

00:54:55.980 was to their constituency, which was, well, you need to take on Donald Trump.
00:55:00.560 They're going to get kudos from their colleagues and from the legacy media tonight because
00:55:05.380 they felt as though they had to fulfill that role.
00:55:09.320 That's exactly right.

01:02:11.580 And you get mixed up in these debates and you just see who wins for the moment.

01:02:42.700 I totally get why the Democrats say she won and she did well for her, as I predicted.
01:02:47.980 I mean, I told the audience, I'd gone back and looked at that Kamala Harris versus Mike
01:02:51.640 Pence debate weeks ago, and I said, she did well.
01:02:54.400 You should know that she's going to do well.
01:02:56.600 She's obviously good at memorizing lines.
01:02:58.420 And it was very clear when she was just regurgitating her rehearsed bits.
01:03:01.620 But I can't shake the feeling that people know when they're looking at a phony, they know
01:03:06.320 that those bits were rehearsed.
01:03:08.180 The overly emotional facial expressions that she was doing for the first 35 to 40 minutes
01:03:14.060 made her look like off.
01:03:16.940 She looked off and she looked a little emotionally unstable to me.
01:03:21.720 She couldn't stop with the personal insults.
01:03:24.040 If Donald Trump had said half of the nasty things to her that she said to him on that
01:03:29.320 debate stage last night, we'd be hearing from all the CNN anchors about how alienating and
01:03:33.980 divisive he is and how these Republican women aren't going to like that.
01:03:38.180 And they're going to vote against him, but not a peep when she does it to him over and
01:03:42.440 over needling him personally.
01:03:44.060 And so while, yes, she spat out the her talking points and she did successfully bait him.
01:03:50.380 I just think because of all those things, I cannot say she won.
01:03:54.580 I'm not sure I can say Trump won either.
01:03:56.440 Maybe Spicer is the closest with it's a draw.
01:03:59.300 But in my it, my conclusion is this doesn't move the needle for her.
