00:13:39.400 Students should be punished if they are violating neutral rules of conduct,
00:13:45.040 if they're protesting, agitating against neutral rules of time, place, and manner.
00:13:52.100 But they should not be punished for any speech.
00:13:55.860 Because, Megan, if we, the conservatives, the traditionalists who have been arguing
00:14:01.620 that the left should not be penalizing people who argue that there are two biological sexes,
00:14:08.200 that you cannot change the chromosomes in your body by cutting off your sex organs,
00:14:13.440 you do not thereby make yourself a member of the opposite sex.
00:14:16.760 People who say that schools are not racist, the reason we don't have proportional representation
00:14:22.440 on faculty and student body is not racism.

00:14:33.020 If the right now turns around and says they want to punish these anti-Israel statements,

00:14:54.040 of speech code, by any capitulation to the idea that hate speech somehow falls outside of protections

00:15:09.600 intifada revolution, celebrating our martyrs, we have to know this is going on.

00:15:40.840 Because you and I would probably be kicked off campus for just saying the things about
00:15:44.780 gender that you just said, and you've gotten harassed off campus for saying even less controversial

00:15:50.160 But we wouldn't be allowed, even at a Ron DeSantis school in Florida, a state university
00:15:57.540 in Florida, to go onto a campus and find a group of trans kids meeting together for support
00:16:06.000 to surround them and chant death to the tranny bastards, death, death, death.
00:16:13.820 That would be targeted harassment, right?
00:16:16.040 So like there is an amount of free speech or I agree hate speech is protected by the
00:16:20.740 Constitution, but you can get to the level of targeted harassment where you lose your
00:16:25.380 right to say the thing and you get kicked off.

00:16:33.780 don't think that's going to do it.

00:17:31.280 that sentiment prevents us from knowing what these students have been taught.
00:17:40.600 And again, this is this, we're not saying this is happening, that the right is saying
00:17:46.120 this, what this is overwhelmingly coming from the left.

00:17:54.420 So you're saying even if the university could censor it under its free speech policies that
00:18:00.660 prevent targeted discrimination or bullying, why would they?

00:18:12.840 And I think that apart from very, very specific targeted threats, it's also a mistake.
00:18:23.100 And I'm sympathetic to Jewish students on campus, but they are starting to use the same rhetoric

00:18:59.560 wing or conservative, truthful speech that is silenced all the time, we've got to allow

00:19:14.060 of Pennsylvania, Harvard, if you guys are claiming we can't silence this because we are so committed

00:19:26.380 at, at, at Harvard, who voluntarily resigned because she was so harassed by saying that sex
00:19:31.480 is biological, you can't have it both ways left.
00:19:34.880 You cannot censor, uh, the right, and at the same time claim that free speech demands that

00:50:42.840 He didn't say that, but that's a political reality, a legal reality for him.
00:50:45.660 But he resurrected that claim by saying, I can still bring this dead claim if it was done,
00:50:53.320 this falsification, to cover up another crime.
00:50:56.240 And then everybody looked at the indictment breathlessly and said,
00:50:58.700 what's the other crime?
00:50:59.460 What's the other crime?
00:51:00.300 And he actually looked in the caverns and said, I don't have to tell you.
00:51:04.600 So for a year, we've been speculating, what was it?
00:51:09.120 What is the other crime that he falsified the business records for?
00:51:12.020 And our best speculation has been that Bragg would argue Trump's situation with David Pecker
00:51:19.800 at the National Enquirer to bury bad stories about him and promote bad stories about his
00:51:26.440 adversaries and to buy the silence of certain women threatening to come forward with affair
00:51:32.340 allegations, that that somehow amounted to a campaign finance violation.

00:51:37.900 When he actually did the opening argument, not Bragg, but his deputy, this guy Colangelo,
00:51:42.000 it didn't sound anything like that.
00:51:44.780 It sounded all about this, quote, scheme where David Pecker of the National Enquirer and Trump
00:51:50.080 and Trump's lawyer, Michael Cohen, got together and decided to get the women to sign NDAs in
00:51:55.020 exchange for money because it would be bad for Trump's election if they didn't.

00:53:28.960 For me, there is something wonderfully poetic about the fact that despite the fact that
00:53:35.640 even if convicted, he's not going to go to prison, the first person to actually criminally
00:53:41.400 prosecute Donald Trump is a black Harvard grad, the very kind of person that his former
00:53:48.100 staff, the people who worked for him, Stephen Miller, et cetera, want to never be at Harvard
00:53:54.400 law school.
00:53:55.780 But he was.
00:53:57.160 And a black woman is doing that same exact thing in Georgia.
00:54:00.660 And a black woman forced you to pay one hundred and seventy five million dollar fine.

00:56:26.400 we're thinking about nominating to the federal courts.

00:57:27.400 If Joy Reid is making this about race, okay, let's talk about race.
00:57:30.820 When you look at the actual skills of black law students, they are at the bottom of the barrel.
00:57:38.600 About two-thirds of black students are in the bottom half of their class.
00:57:44.540 50% are in the bottom tenth of their class.
00:57:47.860 You cannot have diversity and meritocracy on the bench at the same time.
00:57:52.980 To the extent that you have opted for diversity on the bench, you are, by definition, going
00:57:59.480 to be lowering the standards of our jurisprudence, the standards of our lawyers, the standards
00:58:05.360 of our judges.
00:58:06.900 This matters.
00:58:07.900 And you are seeing it, as you said with Megan, in the quality of the lawyering that we're
00:58:14.300 getting.
00:58:14.600 And this is not just some abstract problem.
00:58:18.500 The rule of law depends on clearly articulated standards so that private parties can plan
00:58:25.700 commercial transactions.
00:58:28.000 And it matters.
00:58:29.140 Our constitutional jurisprudence matters for maintaining the fundamental principles of our
00:58:36.240 republic.
00:58:36.700 And if we're putting people into law school, onto law faculties, based not on their capacities
00:58:43.720 to do the law and to think about very, very complicated matters.
00:58:48.060 But based on their race, we are watering down our capacity to go forward.

00:58:56.000 And again, this is a subject that nice, well-meaning Americans do not want to talk about.
00:59:03.480 Far from being white supremacists, they are turning their eyes away from inner-city black pathologies.
00:59:10.260 But the reality is this, Megan, the skills gap between blacks on the one hand and whites
00:59:16.660 and Asians on the other is so high that you cannot have diversity and meritocracy at the

00:59:25.040 Any institution like a university, a federal bar, a law firm that tells you they're opting
00:59:32.960 for diversity is telling you they have discarded meritocratic standards when it comes to hiring
00:59:38.520 and promoting and admitting blacks.
00:59:41.500 I see your point entirely because a meritocracy will allow talented black people, brown people,
00:59:49.820 Asians, whites, whatever, to rise to the top if they deserve it, if they have the education
00:59:54.520 and the skills and the hard work ethic and so on.
00:59:57.380 But a system based purely on diversity will not allow those who are most meritorious to rise
01:00:03.940 to the top.
01:00:04.380 If it's purely on diversity, you're going to be judged by your body parts and your skin
01:00:08.660 color and so on.
01:00:09.800 It would in the absence of a skills gap.
01:00:12.100 Here's the reality.
01:00:13.180 Three percent of black seniors are ready for a career in STEM.

01:00:19.540 Three percent are ready for college.
01:00:22.700 And yet we have many more being pushed into these fields.
01:00:26.740 Sixty six percent of all black 12th graders do not possess even partial mastery of the most basic
01:00:32.520 12th grade math skills, such as being able to do arithmetic or reading a graph.
01:00:38.800 Sixty six percent of black 12th graders cannot do that even partially.
01:00:44.660 And yet you have our standard now of saying if we don't have 13 percent oncologists in the most
01:00:51.180 advanced cancer research labs, it's because of discrimination against qualified black cancer researchers.
01:00:58.000 No, it's because they are not in the pipeline.
01:01:02.160 The skills gap, 50 percent of black 12th graders do not possess even partial mastery of 12th grade
01:01:09.840 reading.
01:01:11.240 Again, if you are expecting 13 percent black representation in meritocratic, demanding cognitive
01:01:19.600 skills, demanding occupations, you are not going to get that without lowering standards.
01:01:26.560 The problem is the skills gap.

01:01:35.160 And and so, again, if we're going to go around saying that any racial disparity is the product of racism,

01:01:44.600 I just read today that a Pennsylvania convenience store chain is being sued for racial discrimination
01:01:52.860 because it uses background checks to screen for employees.
01:01:57.060 And guess what?
01:01:58.760 Blacks commit crime at so much higher rates that they get knocked out by criminal background checks.
01:02:04.880 That's not because the checks are racist.
01:02:07.200 Here's the reality, Megan.
01:02:09.920 In the post-George Floyd crime wave that we're still living through, black juveniles are shot at 100 times the rate of white juveniles.

01:02:21.720 They're not being shot by police officers.
01:02:26.180 They're not being shot by whites.
01:02:28.760 They're being shot by other blacks at 100 times the rate of white juvenile shootings.
01:02:35.480 That's the reality we're living with.

01:03:04.180 He wrote a December 2023 article on it for his newsletter talking about this 50-year decline in the crime rate.
01:03:12.900 And we heard a bunch of folks over on MSNBC touting this.
01:03:17.780 I'll give you just an example to set it up for the audience.

01:03:22.460 Violent crime at nearly a 50-year low.
01:03:25.140 The facts are the facts.

01:03:30.120 Crime in America is near a 50-year low.
01:03:32.780 Last year, the murder rates are the soppish decrease in history.
01:03:37.060 Violent crime fell to one of its lowest levels in more than 50 years.
01:03:40.960 On Earth 1, the FBI reports that violent crime in America is at a 50-year low.

01:03:48.460 And migrant crime is not a thing.

01:03:52.860 Because I know it's one of those things to me where it's like, don't believe your lion eyes with all the crime in front of you and in your local paper and happening to your neighbor.

01:04:14.180 Even Asher admitted in the study that they're all quoting that crime is still way up over 2019.
01:04:21.320 The post-George Floyd crime epidemic, the anarchy that has broken out ever since we celebrated rioters, ever since we celebrated looting, ever since we celebrated shooting at police officers, destroying police precincts, courthouses.

01:04:41.680 And Asher admitted that.
01:04:43.540 He's looking at third quarter rates of 2023.
01:04:48.800 We don't have the full 2023 data.
01:04:51.260 But here's the reality, Megan.
01:04:53.460 Carjackings in 2023 are still up 93% compared to post-pre-George Floyd race riots of 2019.
01:05:04.960 Car thefts are up 105% compared to 2019.
01:05:11.580 Homicides are up 18%.
01:05:13.440 And if you go back further to when the real glorification of, frankly, black crime began in 2014 with the whole Michael Brown hands up, don't shoot narrative that was completely false,
01:05:30.160 but that was amplified by the mainstream media and CNN and MSNBC, homicides are up 40% in 2022 compared to 2014.
01:05:40.480 The reality today remains anarchy unlike we've ever seen the types of lootings, the shameless strolls through supermarkets and convenience stores and jewelry stores with people without any fear of punishment, just dumping goods into their, into their knapsacks.
01:06:02.580 We've never had to lock up toothpaste before.
01:06:05.560 This is not a mark of a civilization.
01:06:07.860 The basic obligation of government is to protect property.

01:07:49.080 They can't be trusted to go through the self-checkout, and as you know, everything, everything is under lock and key now.

01:08:18.160 So it happened, sorry, Monday morning, 5 a.m., but the videotape has just made the news.
01:08:25.000 67-year-old woman fatally stabbed Myrna Souza Arauz, stabbed in the throat.
01:08:31.360 It was unprovoked.
01:08:33.000 She was stabbed as she was exiting the train onto the platform area.
01:08:38.400 The police reported out a description of the male.
01:08:42.640 He's since been arrested, and this is how they reported it.
01:08:46.240 Take a listen to the KTLA report.
01:08:48.160 The victim stabbed in the throat.
01:08:51.460 The ambulance was called, and the woman was treated by paramedics, but no word on the extent of her injuries or her condition right now.
01:08:58.000 As for the suspect, police say it was a man carrying two bags.
01:09:01.340 We don't have any other description at this point.
01:09:03.400 So this woman did later die, and it later came out.
01:09:08.520 They found the assailant, and it was a black man.

01:09:14.600 They strongly believe that he may have victimized other people, and they urged anyone who believed they were targeted by him to come forward.
01:09:20.820 Police now say he has a troubling, violent criminal history, including previous assaults.
01:09:24.940 He did four years in prison on an assault with a deadly weapon and an enhancement for inflicting great bodily injury.
01:09:31.180 He served about half the sentence before he was released in 2022.
01:09:33.540 So they won't say, in trying to track down the man while he was still at large, the color of his skin.
01:09:41.680 And of course, they would never have withheld that if it had been a white man.

01:09:48.620 I mean, we have just decided we're going to cancel ourselves.
01:09:51.920 You cannot go around coddling criminals on some phony theory of racial justice.

01:10:03.940 If you don't put away black criminals, it's going to be primarily disproportionately blacks who are victimized,

01:10:54.800 But the National Crime Victimization Survey shows us that blacks commit about 87 percent of all interracial violence
01:11:03.980 between blacks and whites and whites and blacks, a black person is 33 times more likely to commit a stabbing,
01:11:12.200 a drive-by shooting, a rape, a robbery against a white than vice versa.
01:11:17.380 The narrative is the exact opposite, and it's true for cops as well, Megan.
01:11:22.220 We're all supposed to believe that blacks are at huge risk from police officers.

01:11:30.740 In 2021, a police officer was 400 times more likely to be killed by a black person than an unarmed black
01:11:39.660 was likely to be fatally shot by a police officer.
01:11:44.300 So if the libertarians among us, if the cop haters among us like Radley Balco go around saying how safe it is
01:11:51.180 to be a police officer, notwithstanding the spate of fatal shootings of police officers during car stops,
01:11:57.460 not just in New York, but last week in Memphis, Tennessee, that it's so great to be a police officer,
01:12:03.980 well, it's 400 times safer to be a black person vis-a-vis the cops as it is to be a cop vis-a-vis a black person.
01:12:13.600 So everything the public thinks it knows about race, crime, and policing from the mainstream media is wrong,
01:12:20.800 reverse it, and you have the truth.
