00:04:02.000 Since our pal Arthur over here is going back to court for Harvey Weinstein,
00:04:09.800 who thanks to Arthur, we talked about this, you know, when he did it,
00:04:13.440 has a new trial in New York on these criminal allegations against him
00:04:17.480 that he's a sexual pervert.
00:04:19.480 And Arthur represented him in the trial, but he got convicted.
00:04:22.860 But then Arthur got the conviction thrown out
00:04:25.300 because they let everybody and her mother take the stand,
00:04:28.580 even people who weren't plaintiffs or victims alleged in the case.
00:04:33.780 And the Court of Appeals of New York State said,
00:04:35.760 you can't do that.
00:04:36.800 That wasn't fair to Mr. Weinstein.
00:04:38.280 So now he's back in court and the jury selection begins on Tuesday?
00:04:43.060 Yeah, jury selection begins on Tuesday.
00:04:45.100 And Megan, that's honestly, that's the biggest hurdle here.
00:04:47.580 It's, you know, 90% of the cases,
00:04:50.260 99% of the cases Mark and I are involved with,
00:04:53.080 you know, you walk into a courtroom and jurors don't know who the defendant is.
00:04:56.200 They don't know what the charges are.
00:04:57.640 You know, you have a clean slate.
00:04:59.520 So at least you have a shot at the jury reaching a verdict
00:05:03.500 based on the evidence they hear in court.
00:05:05.520 Here, the huge hurdle we have is, God forbid,
00:05:08.560 they base the evidence on what they see on TMZ or People Magazine
00:05:12.660 or something along those lines.
00:05:14.320 So the jury selection part is going to be tedious
00:05:17.460 because we're going to ask, okay, can we have a raise of hands?
00:05:21.220 Who knows who this is?
00:05:22.920 Okay, fine.
00:05:24.120 And then when you say, raise your hands if you know about this case,
00:05:27.920 you then need to call them in the back individually
00:05:30.140 because you don't want them to blurt out,
00:05:32.180 oh yeah, I know Harvey's a rapist and he's a bad guy
00:05:34.560 and he killed his this and killed his cat.
00:05:36.640 And so one at a time, you have to ask them what they know
00:05:39.620 and whether they can get over their own personal knowledge,
00:05:42.780 which is in the hard drive of their brain,
00:05:44.740 to then just base their verdict on the facts
00:05:47.840 that they're going to hear in this trial.
00:05:49.440 Not a trial in California,
00:05:51.060 not a trial in New York five years ago,
00:05:53.060 not some documentary on Netflix.
00:05:56.460 So jury selection here,
00:05:57.740 probably more than any case I've ever been involved with,
00:06:00.140 is probably the most important part of the whole case.
00:06:04.280 And Megan, let me tell you something about Arthur
00:06:06.380 and this case.
00:06:08.320 He won't tell you this,
00:06:09.320 but it is so much more challenging the second time around
00:06:12.860 because now you've got the trial transcripts,
00:06:15.800 thousands and thousands of extra pages
00:06:18.540 that you didn't have in the first trial.
00:06:21.100 And you must go through every word line by line
00:06:25.240 to use for your advantage.
00:06:27.660 So Arthur is being very generous with this time right now
00:06:30.760 because if it was me, I'd be knee deep in preparation.
00:06:33.580 I know, I'm kind of amazed he's here.
00:06:36.740 Yeah, and Megan, talking to you as a friend,
00:06:38.940 the hardest part right now, honestly, is my kids.
00:06:41.980 Like I have a three-year-old and an eight-year-old
00:06:44.500 and I barely, I barely seen them.
00:06:47.280 And like, it's my,
00:06:48.160 Arthur's like opening day of baseball on Saturday.
00:06:50.760 So I'll be there for two hours
00:06:52.140 and then I come back to the office
00:06:53.340 and his face just drops.
00:06:55.180 He's like, daddy, you got to go to work again.
00:06:57.360 But you have someone's life in their hands.
00:06:59.120 And if Harvey gets convicted,

00:07:03.560 And that's an enormous amount of pressure.
00:07:05.220 It's going to be a five, six week thing.

00:07:08.560 I'll give you guys a little preview.
00:07:09.640 I am seriously, this isn't Huffery,
00:07:12.080 seriously contemplating putting him on the stand
00:07:14.800 because it's basically, it's a he said, she said.
00:07:17.060 There is no other evidence.
00:07:18.520 There's no medical evidence.
00:07:20.460 There's no video.
00:07:21.680 There's, it's just their word.
00:07:23.740 And I think in today's day and age,
00:07:25.320 I think a jury wants to say,
00:07:27.460 look, if he, if you didn't do it, guy,
00:07:29.980 you come up here and tell us you didn't do it.
00:07:31.780 So, and Mark will tell you,
00:07:33.140 it's the most excruciating decision
00:07:35.040 the vet has to make.
00:07:36.960 But if they're probably going to Rikers Island
00:07:41.500 this weekend to start prepping him
00:07:43.120 just so that, no, we're ready to go
00:07:44.980 if he needs to take the stand.

00:13:57.860 with this case down in Texas.
00:13:59.520 It's so disturbing.

00:14:04.340 like this didn't need to happen.
00:14:07.080 The 17-year-old assailant,
00:14:09.600 Carmelo Anthony,
00:14:10.500 is arrested and charged
00:14:11.660 with murder
00:14:12.320 over the stabbing death
00:14:13.340 of 17-year-old Austin Metcalfe.
00:14:15.620 It happened on April 2nd.
00:14:17.640 Austin and his twin brother
00:14:19.500 and this Carmelo Anthony,
00:14:21.520 who belonged to a different school,
00:14:23.380 were all at a track meet
00:14:25.060 as spectators.
00:14:26.440 And I don't totally understand
00:14:28.860 because I've heard
00:14:29.320 different versions of this,
00:14:30.400 but it appears that
00:14:31.180 at the track meets,
00:14:32.400 they would set up these tarps
00:14:33.700 and then various kids
00:14:35.660 would hang out under the tarps.
00:14:38.000 And Austin and his twin brother
00:14:40.400 and a group from their school
00:14:41.480 were under one tarp.
00:14:42.840 There were many tarps.
00:14:44.160 And Carmelo Anthony,
00:14:45.520 who was from a different school
00:14:47.020 and definitely not part
00:14:48.400 of their posse,
00:14:49.980 came under the tarp
00:14:51.280 and appears to have sat
00:14:53.000 in Austin's seat.

00:15:13.220 that Austin went over
00:15:15.740 and Austin told Anthony
00:15:18.600 that he needed to move out
00:15:20.260 from under their team's tent.
00:15:22.280 And Anthony grabbed his bag,
00:15:25.640 again, quoting here,
00:15:26.320 this is a full description,
00:15:27.380 Officer Taylor Wetzel wrote this
00:15:29.740 based on what a witness told him.
00:15:32.400 Then Carmelo Anthony grabbed his bag
00:15:34.220 after being told he had to move
00:15:35.500 and reached inside of it
00:15:37.160 and proceeded to tell Austin,
00:15:38.960 touch me and see what happens.
00:15:40.880 No one really thought Anthony
00:15:42.260 really had a weapon in his bag
00:15:43.740 and Austin proceeded to touch Anthony.
00:15:46.700 And then Anthony told Austin
00:15:48.460 to punch him and see what happens.

00:15:53.060 Austin grabbed Anthony
