00:12:59.600 night and the early hours of this morning to both the judge and the crown the judge does not like

00:13:12.980 reference letter from someone named danny blake in support of anthony olenek prefers to help

00:13:17.720 cleaning up after a fire that happened last year. Olenek was in jail last year. We don't know what

00:13:22.160 that means. Another reference letter in support of Olenek states support of the actions at the

00:13:27.720 Coutts blockade earlier this year. The blockade was in 2022. Crown says this is bizarre. Carbert

00:13:33.340 filed no reference letters in support. Judge says that he has been a witness to the defendants now

00:13:39.520 convicted of having people who love them throughout this trial. He says he sees no obvious warts in

00:13:45.280 the past of Olenek or Carbert. They were hardworking, productive people before their

00:14:22.420 Maythorpe. Dennis Cheeseman and Sean Hennessey each pleaded guilty to manslaughter in the 2005

00:14:28.520 deaths of the officers on a rural property near Maythorpe. James Roscoe killed himself after

00:14:35.760 gunning down the officers, but court heard that Cheeseman and Hennessey gave him a rifle and a

00:14:41.020 ride to his farm before the ambush. I'm not sure exactly what the relevance of that is.

00:14:47.200 Let's continue on. Sheila says for what it's worth, so that's noted. Crown starts by saying

00:14:53.560 this case is not about protest and that disagreements with the government are not

00:14:57.480 illegal. Justice LeBrens corrects the Crown and says the disagreements with the government are

00:15:02.600 essential in a democracy. Crown is asking for nine years in prison for Olenek and Carbert,

00:15:11.020 forfeiture and destruction orders on everything seized and DNA submission. He also asks for a

00:15:17.220 10-year firearms ban for Olenek and a lifetime ban for Carbert. Co-accused, who took guilty

00:15:23.040 pleas, got time served. What's the extra part of this tweet? The duo have been in jail now for

00:15:32.300 2.5 years, she goes on to say there. Next up, Crown Prosecutor, by the way, is Stephen Johnson.

00:16:32.280 ago, mentioned that. Judge just said Carbert didn't want to shoot anybody. Crown says, yes,

00:16:45.760 that opening fire on the ERT team would mean suicide by cop. Good save, Sheila says. Carver

00:16:52.760 claimed he had a cache of weapons to undercover officers, but no cache was found. He did have an

00:16:58.020 illegal assault-style weapon, some overcapacity magazines, and some other varmint plinkers. He

00:17:03.200 had thousands of rounds of ammunition, but who doesn't love to stock up, Sheila says, when there's

00:17:07.920 a good ammo sale going on. Crown says the men were prepared to die, and it sounds like they're

00:17:14.120 retrying the case this week after all of the time these guys have spent in court and in lockup and

00:18:26.960 up, Marilyn Burns, defense lawyer for Tony Olenek, makes her sentencing arguments and says her client

00:18:32.520 was very concerned about conflicts with U.N. troops, the World Economic Forum, CCP, that's

00:18:38.260 China, Antifa, and the safety of children. The judge stops her and reads from transcripts, noting

00:18:43.480 Olenek was far more candid when speaking with UC's undercover cops than he was once in custody,

00:18:53.240 tells Burns Olenek was ready to engage in conflict with police. Now,

00:18:56.460 they were found not guilty of conspiracy to commit murder so i don't see how that comes

00:19:32.140 seat of their cars. The judge says you might be overstating things. And then Sheila goes on to

00:19:36.600 say I'm as rural as it gets and we don't bring guns to the grocery store. Burns is now reading

00:19:41.060 from supportive reference letters for Olenek. One was from a businessman who offered employment and

00:19:45.620 a place to live. Another letter from an Anglican deacon talks about Olenek's tolerance for his

00:19:50.380 beliefs before jail and Olenek's embrace of Christianity. Tony does not and will not represent

00:20:03.320 Byrne says the potential for a DNA collection order is inappropriate and intrusive and quickly

00:20:08.180 moves on. The judge stops her and asks if there is more to her argument or if she would like to

00:20:13.300 cite case law to make her point. She does not and then moves on. Byrne says Olenek should get extra

00:20:18.680 credit for triple bunking, gang-affiliated roommates, and other terrible conditions

00:20:22.580 experienced during the 13 days he spent in remand in Calgary. The judge wants evidence

00:20:45.420 defense lawyer wanted adjourned for an hour. Carbert's lawyer, Catherine Bayak, is up after

00:20:49.520 the break. So now we move on to Catherine Bayak making her request. Catherine Bayak for Chris

00:20:56.520 Carbert is now up arguing against his continued incarceration. She notes his broad community

00:21:00.900 support, strong family bonds, and says his business assets have largely been liquidated

00:21:05.600 during his 900 plus days in jail. Chris Carbert had previously sole custody of his son since he

00:21:14.440 was nine months old and was unable to see his son during much of his incarceration. Bayak says the

00:21:20.180 damage done to his relationship with his child is a motivating factor for Carver to stay out of

00:21:24.540 trouble. Bayak is arguing the social isolation and emotional and psychological impacts of responding

00:21:30.400 to the mandates helped get Carver where he is today. He was dissatisfied with the government

00:21:35.260 response, and he joined in the convoy. Bayak says there's nothing in evidence to support the

00:21:40.680 Crown's assertion that he would have engaged in violence to defend their protest. Bayek is arguing

00:21:45.780 the significant differences between Carbert and Olenek. Drawing the judge's attention to their

00:24:05.480 sentenced to 7.5 years. Sean Hennessey was sentenced to 10. The Crown wants nine years

00:24:12.940 for these guys, nine years. And then finally, sentencing will be issued on the 9th of September.

00:24:19.600 It was supposed to be tomorrow, but I guess the judge has much more to think about now,

00:24:24.620 even with the verdicts that came in a few weeks ago from a jury.
