00:14:21.160 because the conspiracy to commit murder charges they were found not guilty of,

00:14:26.620 but we thought they were going to get time served.

00:14:58.480 David Labrens, who is the judge in this, basically relitigated the case today during sentencing,

00:15:07.500 but we'll get to that.

00:15:08.860 So here is the story.

00:15:11.320 Alberta Justice David Labrens today sentenced Chris Carbert to six and a half years in prison

00:15:15.960 for possession of a restricted firearm.

00:15:18.400 And Tony Olenek to six years for the same charges.

00:15:21.160 Now, even though Tony had an extra charge he was found guilty of, he got less time for some reason.

00:15:25.960 I'm still trying to sort that.

00:15:27.920 Plus additional six months possession of an explosive weapon.

00:15:31.460 So six and a half each.

00:15:33.160 Each defendant was sentenced to six months for mischief.

00:15:36.220 Mischief.

00:15:38.760 They got six months for mischief to be served concurrently with time served for other offenses.

00:15:45.320 all in its possession of an explosive charge is to be served consecutively, meaning tacked

00:15:50.140 onto the other sentence rather than served simultaneously. This is a deterrent sentence,

00:15:54.560 the judge said. In other words, we don't want any of you people who believe in defending your rights

00:16:00.940 under the Charter of Rights and Freedoms to ever do anything like this again.

00:16:07.860 Granted, they should never have had these weapons with them. That's one thing about this entire

00:16:14.420 case that I have never agreed with. You just don't bring the guns. You just don't do it. Or

00:16:21.140 the explosives. You don't. You don't. You don't. But you should be able to go out and protest.

00:16:31.000 But this is a deterrent sentence, as the justice said. To signal not just to the defendants,

00:16:36.840 but to everyone else, putting police officers and the public in jeopardy would not be tolerated.

00:16:42.220 He mentioned several times the RCMP members of the public and even some children could have been harmed if firearms were taken up.

00:16:48.860 They knew what they were doing was illegal, but they didn't care because they believed they had a worthy cause, said the judge.

00:16:55.320 The pair got credit for 1,409 days in pretrial custody, a reduction of nearly four years, meaning they will have to serve the two remaining years.

00:17:03.500 but you're probably eligible for parole one-third into that sentence so it could be 10 months in

00:17:10.680 jail uh prison sorry before they're allowed the possibility of parole the two men known as the

00:17:19.900 coots two originally part of the coots four charged in february of 2022 in relation to their

00:17:24.080 participation in the border blockade carbert and olenek have been held in remand for 935 days they

00:17:30.280 They were charged with conspiring to kill an RCMP officer.

00:17:32.940 Those charges were dropped.

00:17:34.300 August 2nd, crowd prosecutors, however, are pursuing an appeal on that, believe it or not.

00:17:39.460 So let's go to Sheila Gunn-Reed's tweets today.

00:17:41.560 She was, as I mentioned earlier, tweeting live from the courtroom as this was going on today.

00:17:46.500 Now, I was following this.

00:17:48.440 Couldn't believe how long it was taking this judge to pass down the sentence.

00:17:54.000 I believe it was upwards of two hours from the time he started speaking until the time the sentences came out.

00:17:58.860 Can you imagine being a family member, close friend of one of these two men?

00:18:02.680 You'd be sitting there going, come on, man.

00:18:04.380 Now, I understand you've been waiting for two and a half years, and maybe you can wait a little bit longer.

00:18:08.560 But this is like sitting in a doctor's office for an 11 o'clock appointment.

00:18:12.380 The doctor comes in and says, okay, you may or may not have cancer, and here are the reasons why.

00:18:21.800 And then he goes on for two hours explaining before he finally says, oh, and by the way, you do have it.

00:18:27.100 anyway let's start with uh when the judge is just about to start wrapping up his incredibly long

00:18:36.900 spiel in the courtroom today sheila says judge says he does not differentiate between carbert

00:18:43.580 and olenek in relation to moral blameworthiness moral blameworthiness has nothing to do with this

00:18:49.880 whatsoever so that's one thing that the judge could have kept to himself the judge notes the

00:18:56.660 inherent danger of the weapons at a large-scale blockade protest. LeBrens, the judge, said both

00:19:03.260 men possessed firearms at Coutts for the expressed purpose of using them against police at a time and

00:19:08.020 place of their choosing. Well, again, they were found not guilty of conspiracy to commit murder

00:19:14.880 against a police officer, so I don't see how that's relevant. And the jury found that. So is

00:19:20.880 the judge relitigating and superseding the decision of the jury. Is it possible that the

00:19:26.520 two lawyers involved here defending Carbert and Olenek could appeal this sentence? Probably.

00:19:35.680 The judge went on to say both men armed themselves for political reasons. Both men saw engagement

00:19:40.080 with police as a war. There is nothing before me to suggest the actions of either man was spontaneous,

00:19:45.160 indicating awareness and calculation.

00:19:47.580 In other words, the judge is suggesting

00:19:49.800 that he knows the reason these men

00:19:51.840 had these guns and explosives with them.

00:20:18.540 democratic processes however section 718 of the code states the fundamental purpose of

00:20:24.480 sentencing is to protect society and to contribute to respect to let's make this bigger so we can all

00:20:29.840 see contribute to safe society allowing the citizens to break the laws they see fit in order

00:20:36.360 to achieve their objectives is an animatha an anathema sorry got it wrong the first time to

00:20:42.920 the maintenance of a just peaceful and safe society so let's go back to the other tweets

00:20:48.780 because this one might make you angry judge is quoting from a case he was actually part of

00:20:55.880 as a prosecutor it's the myerthorpe alberta killing of four maudis by james roscoe

00:21:03.080 One of the men considered an accomplice, Sean Hennessey, was sentenced to 10 years with an aggravating factor that police were the targets.

00:22:06.240 That's obviously going to be appealed as well. The crowd is gasping, Sheila says. Olenek's mother

00:22:12.720 stares at the floor, no reaction from Carbert. And Olenek, concurrent sentence for both men,

00:22:23.140 for family Olenek and Carbert. Olenek is getting an extra six months consecutive for the pipe bombs

00:22:29.300 found at his house. Puts the total to 6.5 years for both. And that's it. So that's what happened

00:22:38.280 today at the trial, the final part of the trial of Tony Olenek and Chris Carbert. So again,

00:22:46.460 four years time served, maybe three and a half, they should be eligible for parole sometime in

00:22:53.800 the next year. And at least in prison, there will be some kind of visiting privileges and they will

00:23:02.860 be treated more like human beings, believe it or not, in prison than they were in lockup for these

00:23:07.580 past two and a half years. Peter Nygaard was sentenced today. He got 11 years. He's 83 years

00:23:14.280 old, 11 years for four counts of sexual assault. And this man should have been in jail 20 years

00:23:21.260 ago. And it should have been, I don't know, 800 year sentence. What this guy did. We're going to

00:23:29.140 play video for you in just a second. There he is looking like a ghoul, the backseat of a limousine.

00:23:34.580 That's from a few months ago. So Peter Nygaard, who was found guilty last November, four counts

00:23:40.140 of sexual assault after being accused of attacking five women in his downtown Toronto office has been

00:23:45.940 sentenced to 11 years. Credit for time served, Nygaard 83 will serve just under seven years in

00:23:52.160 prison. In his sentencing, Toronto Superior Court Justice Robert Goldstein described Nygaard as a

00:23:57.020 sexual predator. Well, at least the legal system got this one right. And a Canadian story got very

00:24:02.760 wrong who used his wealth and power to commit four sexual assaults. Way more than that, man.

00:24:08.760 way more than that, allegedly. Nygaard sat in the courtroom wearing a black Canada Goose parka with

00:24:16.460 a hood over his head, his bearded face largely obscured by paper shields that court heard he

00:24:21.520 wears around his glasses because of an eye condition that makes him sensitive to light.

00:24:25.540 Before his sentencing, Goldstein asked Nygaard if he had anything to say. No, sir, he said quietly.

00:24:31.300 Crown attorneys who prosecuted Nygaard had been seeking a 15-year sentence in federal prison.

00:24:35.680 nygaard's lawyer winnipeg-based jerry weeb said after the sentencing that her client would be

00:24:41.340 appealing the conviction and the sentence good luck with that however they they are saying that

00:24:46.400 because of hardship he may be released into a different facility he won't be serving it at a

00:24:51.540 federal facility rather a provincial facility either way he's gone he will die in jail this

00:24:57.240 is good because you guys know about peter nygaard and it wouldn't surprise me by the way
