00:04:58.000notice tonight. We had a lot of excitement happen at the commission today, didn't we?
00:05:03.740Yeah, sure was. Quite a bit of things going on. So happy to help explain what was going on and
00:05:10.380you know what was going on kind of in the background and on the ground. Okay. So Marco
00:05:15.200Mendocino, the Minister of Public... I always laugh every time I say this. He's the Minister
00:05:21.100of Public Safety in Canada, was on the stand today. And apparently there was some problem
00:05:27.940with the documents the government, the federal government had dropped at the last second on all
00:05:35.640of the other lawyers in the room. Can you explain exactly what's been going on with that, first of
00:05:40.540for sure and so it wasn't just this last day uh right before mendicino it was actually it's been
00:05:46.620going on for the last week i'd say um all parties were given a deadline of when all the documents
00:05:53.080were due and we're talking about months ago not just days before because how can you have a you
00:05:58.360know a uh a process where people are dumping documents while you're in the process of course
00:06:04.300all those documents should have been disclosed and uploaded and available to all parties before
00:06:09.380we even got to ottawa because there were those kind of deadlines and you'll get it when there's
00:06:14.420a document or two that comes later in the day it all it'll happen to anybody but we're talking
00:06:21.200about hundreds of documents and when i'm saying documents i don't mean a one pager there was one
00:06:27.800document the government dumped on us last week that was a thousand pages so like it's just going
00:06:36.840to the procedural fairness and integrity of this process that nobody else like we made an issue of
00:06:44.500it because we've we've raised this but commission isn't making an issue of it and it's getting a
00:06:50.900little bit frustrating let me ask you how many lawyers does the government team have as compared
00:06:56.320to everybody else in the room well on the ground in the hearing room sometimes we see six lawyers
00:07:03.280and that means that there's likely at least double working behind the scenes or more we know that's
00:07:10.740how it is that's always how it is including paralegals and things like that so we don't know
00:07:14.860how many people are actually helping with the government and that's a very good point too um
00:07:20.120i was working on another case with the federal government where they were using an excuse of
00:07:24.940time and resources and the judge actually chastised them a bit saying you are the largest
00:07:30.940law firm in the country let's not talk about resources when everyone else is
00:07:36.720pittance next to you yeah no kidding and so if those guys have let's just say they've got 15
00:07:43.240people paralegals lawyers in the room whatever uh compared to you guys how many do you have
00:07:48.220working uh on on your team well we have four really that's that's it and yeah four
00:07:55.200because i was commenting yesterday uh brendan was uh standing there trying to bring something up and
00:08:01.780he was arguing with well i wouldn't say arguing with the commissioner but i think one of the
00:08:05.620government lawyers objected to what he wanted to use in evidence and because there was certain
00:08:10.740notations on the documents that he wanted to use and this caused a great big problem my comment
00:08:16.640was simply don't you have a personal assistant or somebody who can do that for you well yeah and
00:08:23.280I'll just, in normal cases, yeah, like he's got us, but everything is moving so fast. This is
00:08:30.880not normal, the speed of what's going on and the amount of documents being dumped on us on a daily
00:08:37.080basis. Like this has been happening for a long time. You can even see that like the names of
00:08:42.280the documents are called bp.ca.ssm.40s or more one two ten nine dot like nothing it's good it's
00:08:56.120you know if it's meant to get the information out they're certainly making it difficult and
00:09:01.960what brendan was doing yesterday with the document is he compiled a whole bunch of them
00:09:07.280into one document to make it easy for him to use while you're on have you have 10-15 minutes max
00:09:15.380so it doesn't even matter if somebody's helping you out when he compiled it nicely on one document
00:09:21.620so that nobody had to worry about what all these numbers are and all these documents are
00:09:26.820everyone had access to it but that was a problem with the government of canada
00:09:31.720that just dumping of the documents especially the redacted ones i mean if you guys have to go
00:09:37.500through let's just say a thousand documents nightly or every second day how do you know
00:09:42.180what's been redacted legally and what hasn't been like how do you even find that yeah well we don't
00:09:48.900know at all so how it normally would work is you would you would have an opportunity to challenge
00:09:54.900it and that's what we did so that was i guess the kerfuffle today is it was last week or maybe
00:10:02.540two weeks ago i don't know like time doesn't seem to make sense here when we're pulling these days
00:10:08.240but we filed a motion that's challenged some of the redactions saying these don't seem proper
00:10:15.120there's a bunch of redactions and you've seen them on the screen before chunks of documents and it
00:10:20.960just says irrelevant parliamentary privilege um section 39 so we challenged a few key documents
00:10:28.660that we we wanted to see more of the information on and that motion hadn't been decided for a week
00:10:38.220and that's a little bit where the frustration was and then all of a sudden poof today we got
00:10:44.660the decision after there was a bit of you know after the problem i mean where brendan had to say
00:10:51.900look we need the decision because i wouldn't have to make this request of you commissioner if if we
00:10:57.320had your decision and and so then he got tossed out of the room and yeah how is he doing by the
00:11:03.180way i mean did he expect that he would have the hopes of millions and millions of people on his
00:11:09.380shoulders at this point in the game i can't imagine he would have uh you know i don't i don't know if
00:11:15.500i want to frame it that way i certainly think that like our some of our clients have been here you
00:11:20.780know the whole time and they've gotten the brunt of these false accusations too and that's what
00:11:27.560we're getting at too you know they've been labeled as terrorists and nazis and extremists and that
00:11:37.120needs to be addressed at some point and that's what he's trying to do here like how did that
00:11:41.880narrative even come to play well before anybody came to Ottawa and that at least has been
00:11:48.580established we were able to put that into evidence and that's not controverted at this time
00:11:53.880that there was already a narrative January 27th by some of the staffers to say that there's a
00:12:00.840violent and extremist rhetoric will not be tolerated and then you see the PM using that
00:12:06.540in a speech a few days later. So this is the first case I've been with Brendan. What I know
00:12:16.220about him is he's a fighter. Obviously, as we can say, he's incredibly smart. I don't know if he
00:12:21.940came in here expecting that he'd have so many people that were relying on him, but certainly
00:12:28.140he loves what he's doing. And I think he's always been up for the government challenge. So I think
00:12:33.440he's the right man for the job for sure. So this week is obviously different. You've got
00:12:38.380federal government cabinet ministers that you're dealing with. Is the vibe any different in the
00:12:44.140room this week at all? You know, to be honest, no. The commissioner made a bit of a like speech
00:12:50.180before it started, but it's been basically the same. And, you know, one thing I could say about
00:12:55.460the room too is when it was government officials, very lowly attended, not many people coming
00:13:03.360to the room and this is you know maybe speaks to how much confidence people have in government
00:13:10.080officials right now and maybe a bit of the apathy as well uh to what's going on in canada but when
00:13:17.040it was the protesters that were um giving evidence the room was packed there was so much support for
00:13:24.080the protesters and you know what they were doing including ottawa residents that were right here
00:13:29.660just saying thank you for what you've been doing yeah but let me ask you this i noticed today as i
00:13:35.660was live streaming uh the testimony that a lot of the lawyers seem to have some kind of a familiarity
00:13:41.980with uh marco mendocino there was a lot of smiles and side glances exchanged and that didn't sit
00:13:48.440well with me and many of the viewers either they thought that there was some kind of a
00:13:52.060backdoor connection between mendocino and and some of the lawyers not all of them but some of them
00:13:58.500And people were wondering if this was rehearsed, if the witnesses have any extra time to go over certain things they're going to be asked specifically from certain lawyers.
00:14:09.520Is any of this a reality or is it just that they know each other from years ago?
00:14:17.720Okay. You know, I came to law school here and I, after being here for three or six weeks now, when I came to law school, there was right away kind of a criticism of me coming from the West that I'm from the Wild West.
00:14:33.680And what I saw then, and I was super apolitical at the time, is this was an Ottawa bubble. And I think that you see it a bit more now on a national scale, which is probably, again, a good way to see what's really going on here and who are the people running the show apart from the people we see on the news once in a while.
00:14:55.520but I don't I think it's I think it's you know they get put on a pedestal a little bit and I
00:15:02.960think that's what we were seeing I don't know whether or not they know people know these people
00:15:07.240really some may I'm certain some of the people know but I I also think that there's a little
00:15:13.340bit of that celebrity status um that goes on here interesting you say that because I mean this is
00:15:20.380only marco mendicino today and uh we've got christia freeland coming on uh and and trudeau
00:15:26.580is going to be on later on this week i wonder what the starstruckness level is going to be like
00:15:31.140on that day yeah yeah i don't know i don't know i i know i haven't been feeling the starstruckness
00:15:40.540at all it's actually been making me concerned about you know it wasn't it hasn't been impressive
00:15:49.960so far like i you know you want to think that there's really good smart competent people
00:15:56.500running the country and this last week and into this week certainly hasn't proved it for me at all
00:16:02.600at all what about today do you think we got anything worthwhile out of mendocino today i
00:16:10.180mean he was going on and on and on about many things there was a couple of small things we
00:16:14.140might have got him on but you know your legal uh observance of what happened today was there
00:16:18.900anything noteworthy yeah well you know there was a lot of on and on i'm with you on that i think
00:16:24.840no noteworthy nor noteworthy um is when brendan actually had a chance to cross-examine
00:16:31.880and we know the story that they've been painting since february these are nazis these are racist
00:16:39.420these are extremists and there was discussion in the house of parliament about the flags being
00:16:45.320waved in the crowd and then when he's being asked about it there's he actually said I don't know
00:16:53.400what flag you're talking about I don't know what you're talking about it didn't to me these people
00:17:01.320just look very not not credible at all and I've said this before is I don't know how they're
00:17:08.660getting prepared for cross-examination because you know that's what lawyers do before witnesses
00:17:13.660is cross-examine. But when it's evidence that's this central to the issue and your role is this
00:17:23.540central to the issue, if you have selective memory on something that important and you're that
00:17:31.080important in the process, not remembering or not knowing is not acceptable. But as a lawyer,
00:17:37.700you can't push it where fingers are crossed is that the decision maker is recognizing that
00:17:45.880and they're recognizing that the witness is incredible yeah the same thing i guess with
00:17:51.520bill blair yesterday saying i don't recall that sir i don't remember that sir i don't know who
00:17:55.680you're talking about sir uh so for the people who haven't been paying attention and we've got
00:18:00.140uh i think about 1100 live viewers right now probably going to have about 20 000 by this
00:18:05.420time tomorrow on this video. A lot of people are interested in this, Eva, but they haven't had the
00:18:09.980time to be watching the commission every single day. But they're expecting that something is
00:18:15.120going to happen, that Trudeau is going to be ousted from power should the commissioner find
00:18:19.320that he called the Emergencies Act illegally. What really could be the best outcome for the
00:18:25.840freedom people? Well, you know, honestly, until Sunday, I thought that we would have gotten a
00:18:34.400decision that showed that the Emergencies Act was not necessary because that's all we've heard
00:18:39.960for the last five weeks. Things seem to have changed a little bit here in the last few days
00:18:47.840with CSIS's evidence coming up all of a sudden different. So I'm not even sure
00:18:53.300if that's what the commission is going to roll at this point, which is incredibly frustrating for
00:18:59.460all of us. The thing that this commission will do, regardless of how it decides on that central
00:19:08.440issue, is there's one week of policy and recommendations after this. So we've heard a
00:19:13.400little bit about the legal definition of CSIS and whether or not that was the same definition
00:19:19.160as the Emergencies Act. I think one thing we're going to find out, I believe, is what is the
00:19:25.440proper definition to invoke an emergency act in Canada because there should not be any qualms
00:19:33.160about it. Same with the definition of national security threat. Does that need to be updated or
00:19:38.900not? So those are the kind of things that we could see coming out of it. A resignation from Trudeau
00:19:45.100I think will only come from pressure from the public and not from this commission, unfortunately.
00:19:51.400So David Vigneault, the head of CSIS, testified yesterday that he did in fact support the government. This is what you were just referring to, the government calling the Emergencies Act, when all we had heard, as you say, was no, there was no law enforcement agency in this country that recommended that whatsoever.
00:20:08.980And yet he did it apparently at a meeting in camera behind closed doors. So there's no evidence to say that he actually did that aside from maybe some notes from that meeting. Am I correct in saying that?
00:20:21.400Well, a little bit, yes and no. So he did confirm it on the stand yesterday. So what he said in his evidence yesterday, and it goes to that in-camera meeting, is he said that under CESIS Act, and this is also what we were hearing last week, is under that definition, which Jody Thomas was trying to paint as a narrow definition, and it was too narrow for this modern era, that that definition, it didn't qualify.
00:20:49.860but what he was saying in evidence yesterday and that's what came out in the in camera
00:20:55.100is that with the expanded emergencies act definition which lawyers suggested was different
00:21:02.720then it was worth it was available to be invoked that there was a national security threat but
00:21:10.000that's not the same as the um CSIS act definition so there's two different definitions well
00:21:17.220not if you that's not our interpretation at all but they're trying to say that that's
00:21:23.440the legal interpretation they got and i think it was um vigno he was taken i know it's
00:21:30.600it's mind you need to hit your head or like hold your head up sometimes when you're saying this
00:21:35.760because i think it was vigno or somebody else that was taken to the definition of national
00:21:41.540security threat in the Emergencies Act. And it says the words, CSIS Act definition. So there's
00:21:50.800only so much legal gymnastics you can do. But the thing that bothers me more, and I don't know if
00:21:56.140it's been picked up as much, is if it's a legal definition that we're quabbling about.
00:22:02.600That's not an intelligence issue that we're have an issue about. It's not a policing issue that
00:22:08.200we're quabbling about we're quabbling about the legal definition and that's certainly not
00:22:14.120something that we should be invoking in emergencies and having protesters you know having the riot
00:22:20.680police come out after protesters if it's what is the legal definition that's that's not the test
00:22:27.480ever yeah you know it's interesting i said the same thing last night i said if we're quibbling
00:22:31.840over the definition of what will invoke the emergencies act then it's not an emergency
00:22:36.540yeah or which act is it the definition here or the definition here like you know it's it just
00:22:43.320it's silly to even have this discussion i agree completely eva thank you for taking the time

00:26:59.780we have that many doctors in the entire province i might be wrong but if we do that's all of them

00:27:12.240every single doctor in the province but they say they do here in the winnipeg sun
00:27:16.060they have warned that hospitals are at risk of being overwhelmed in the new future remember i

00:33:11.220When the lawyers for Freedom Convoy, Inc. suggest new unredacted documents show that they knew that the Emergencies Act did not meet the criteria to be called.

00:34:04.980He is a lawyer, after all, and he knows what he's doing.

00:34:20.880Now, let's be honest, when you're a cabinet minister in the federal government, you have stepped on a lot of people and you've talked your way around many, many, many things.
