00:08:27.100 movement's favor and then today you got kind of a punch in the gut well you know
00:08:32.040 you'll you always want to be upbeat you're like you don't want to even though there's
00:08:37.400 some skepticism and some optimism even with the the conversations that myself and others have
00:08:42.520 had with you know you know the lawyers that we have working this case with us um and you know
00:08:47.580 and we understand the kind of different sort of hardships and um uh and you know uh awkward
00:08:55.280 situations that could come flying our way you don't want to go jump on camera and go ahead and

00:10:22.220 in time um yeah the the jccf and the seven churches um from may of last year had put forth
00:10:29.920 their constitutional challenge about kind of you know sort of what i consider to be sort of the
00:10:36.060 most um easily explained uh version of that was sort of like you know you know walmart was open
00:10:41.820 but we couldn't be right and we're you know we're giving religious services we're doing something
00:10:46.080 very different than you know the average big box store or whatever so what's the reason behind all
00:10:51.900 of that. That was the major impetus from still what I believe from that original constitutional
00:10:57.480 challenge, for the most part. It did unravel a few other different perspectives into it,
00:11:03.440 but still its major goal was to question that in a constitutional value. And we figured, well,
00:11:11.060 us five that got arrested, again, I'll just repeat it one more time, and I'm sure many people already
00:11:16.280 you know this already, myself, Patrick Allard, Dr. Jerry Bohemia, Sharon Vickner, and Minister
00:11:22.100 Tobias Tisson. And we knew very, very well that what we got arrested for was holding outdoor
00:11:31.760 events. We also knew very, very well that the- Was it holding outdoor events, Todd, or was it
00:11:38.080 just attending, speaking at? You could consider both, kind of wrapped up in the same thing. You
00:11:43.520 could kind of argue both of course but we were arrested for the hosting value right and they
00:11:49.080 even considered and we had to talk about this after a court was done today a very key point
00:11:54.600 or something just kind of very interesting that was only said to one person one time that being
00:11:59.440 Patrick Allard when he was arrested on his breach for mentioning on social media that it would only
00:12:05.760 take a certain amount of people to go block a Winnipeg Blue Bombers game which I still I can't
00:12:12.180 help but mention that and laugh but he didn't incite anybody he just happened no but he still
00:12:16.180 got he still got taken away from his home and arrested and put in solitary confinement for
00:12:19.900 over 24 hours so they took that as a threat obviously but they said to him and this is
00:12:24.280 this is something that i even when he first said it to me i thought well that's interesting and he
00:12:29.860 knew that as well too uh which is they said yeah but you're a social media influencer
00:12:34.500 so we're acting on you and didn't we see a big thing that went viral just this week

00:13:02.840 people are idiots and they're going to do what what we say of course of course personally thinking
00:13:07.560 about it themselves right i mean like that's the thing that they forget is that people can do what
00:13:12.580 they're going to do because they want to do it right and so one thing that's very hard for us
00:13:17.880 to kind of grapple on and try to fight you know as far as like you know very direct goes with the
00:13:23.040 law would be this understanding of well you targeted us for those reasons we have kind of
00:13:29.460 a language we know what we can under we can see what sort of the impetus was it's fairly obvious
00:13:36.080 and lots of reasons but here's the weird thing about the law and you know what i didn't even
00:13:41.020 know this too much until today and it's really interesting because you know i'm i'm going on
00:13:48.640 like two different sides here sort of like you know a civilian activist and journalist at the
00:13:53.340 same time not knowing which way to go with you know kind of what i'm gathering here and i i'd
00:13:58.700 much rather learn something even if it's going to be a bit of a uh not a fail but even it's going to
00:14:04.580 be a lot harder than once perceived i'd rather really pick up some just solid information learn
00:14:09.220 something to you know to to put forth to the rest of the world so that people can hear this
00:14:13.560 um and it's still been a very tough process even in that so what was said today was that
00:14:20.680 that understanding of a constitutional challenge did not fit the criteria off of something that
00:14:30.760 is written very strongly in law and i believe it i guess only to be mostly i guess western law most
00:14:36.680 i couldn't say how many other countries this is very inherent to uh it has a latin name that the
00:14:42.800 the judge used a few times i kind of wish i could recite it to you right now but i'm forgetting it
00:14:46.880 but it basically has to do with when the higher court mentions or when the higher court rules
00:14:53.100 something the lower courts have to follow and yes yes um and because the jccf and the seven churches
00:15:04.320 was actually done at a higher court than what ours was being done at which is also interesting
00:15:09.900 as well too i i might add um it was then ruled that we did not have enough difference in criteria
00:15:20.500 to meet the necessary requirements to have it be differentiated from the fact that a higher court
00:15:31.720 ruled this but down here at this court we should still hear you out in this value um it was deemed
00:15:39.600 that that was not not relevant um and that outdoor gatherings were not really heavily mentioned it
00:15:48.360 was even said in the court the judge mentioned it not heavily mentioned but that there was certain
00:15:52.780 portions where talking about let's say that uh at a certain point in time tobias had to go mention
00:15:59.620 that they were receiving tickets and hardship from say um vehicle gatherings in their parking
00:16:05.780 lot and so the judge said well that was mentioned in that case so so that matches that matches up
00:16:13.780 close enough to you and and moved in that direction very rapidly so what was the judge's
00:16:19.980 attitude today well you know at first i i would have liked to have walked away just kind of going
00:16:27.680 like well i you know it was it was very very understandable what she was doing was taking
00:16:33.160 the easy way out and that wouldn't be something that would be um the number one thing that i would
00:16:39.720 want to go choose to sort of uh want to you know condemn or ridicule necessarily well then again i
00:16:45.880 mean it should be ridiculed i mean it is it is she's coming back from her vacation to make this
00:16:50.540 yeah it's yeah it's and she gave us a bunch it's you know a lot of it seemed like lip service you
00:16:55.960 know a big long explanation about why the the the you know the the duty of the what she has to do
00:17:01.540 the the what's the word the dutiful dutifulness the dude the duty of the law that you need to
00:17:07.140 follow goes in this path goes in this way so therefore it's hard for her to veer away and
00:17:12.800 blah blah blah and then at the end she gives us this whole sort of um you know pretends to kind
00:17:18.260 of look at us and pretends to actually you know one final point in time treat us like human beings
00:17:23.900 and do this whole sort of really pathetic i don't want to call it an apology but the sort of like
00:17:32.400 sense of reasoning, you know, of, well, I know you're going to be very disappointed in this.

00:17:44.280 behalf. I mean, she still has to admit at the end of her little sort of closing speech that we still
00:17:50.880 have a five-day trial booked, and that her calling down of the constitutional challenge does not
00:17:55.820 cancel out the five-day trial. So now, basically, what she's told us is, you know, your five-day
00:18:01.060 trial now has little to no legs left to stand on so have fun with that knowing that it's going to
00:18:05.860 cause us a lot of hardship to come back and go face that well you see now that's the thing but
00:18:09.920 then she says that then she says that to us was this kind of condescending you still get to come
00:18:15.080 back here and i'm still your judge let's go see what's next kind of thing and you know look it was
00:18:24.400 it was spoken in a very yeah like looking yeah it was condescending look okay so if she was
00:18:31.200 condescending that's that's fine you you still have this five days right yes yeah so what about
00:18:38.220 the canadian bill of rights because the canadian the canadian bill of rights does not have the
00:18:45.880 section one clause in it that allows the government to wriggle off the hook every single time this is
00:18:52.180 still part of law in canada and a lot of people are completely and totally forgetting about it
00:18:58.100 because of the charter but there's two things the charter has that this doesn't have that
00:19:02.520 section one and it has the notwithstanding clause right so the government can say well you know what
00:19:08.440 i know this is against the charter of rights and freedoms but because uh we strongly believe in
00:19:12.840 what we're doing we're going to enact the notwithstanding clause and you're screwed anyway
00:19:16.600 this does not have that this is the bill of rights the preamble from 1960 written by
00:19:22.860 john dieffenbaker and some of his cabinet the parliament of canada affirming that the canadian
00:19:28.920 nation is founded upon principles that acknowledge the supremacy of god blah blah blah blah all right
00:19:34.120 there have been fights winning uh they've been winning with the bill of rights all across
00:19:45.160 the atlantic provinces the bill of rights says it is hereby recognized and declared that in canada
00:19:51.140 there have existed and shall continue to exist without discrimination by reason of race national
00:19:56.060 origin color region or sex the following human rights and fundamental freedoms namely the right
00:20:01.840 to the individual life liberty security of the person enjoyment of property and the right not
00:20:07.240 to be deprived thereof except by due process now what you're talking about here would be
00:20:11.160 probably freedom of speech and freedom of assembly and association no no no we're challenging
00:20:17.900 hold on i'm getting a little bit of echo is it starting to echo you guys tell me yeah i'm getting
00:20:25.580 i've been having a problem with this it goes off and on okay okay um so i'll just continue to mention
00:20:36.880 the the parts of at least the constitution and the charter that we are talking about

00:21:36.120 the constitution let's go ahead and see if we still have that ridiculous echo here with todd
00:21:40.240 uh so do we do we still have it nope we're good okay good all right so you were saying
00:21:47.020 yeah um the constitutional challenge that we put forth were very much on something that we
00:21:53.820 figured was still you know not figured but we knew is still evolving um is you know the science

00:22:06.860 put those right to the court also with the um information that we had uh witness experts or
00:22:15.520 expert witnesses sorry i should say that were already scheduled to come in for our five-day
00:22:19.860 trial as well too, like Dr. Joel Kettner and others as well. So we were doing, I think,
00:22:28.400 everything we could to try to make a very, very, very strong mention of the fact that the JCCF and
00:22:35.180 the seven churches from a year ago was almost like a premature sort of constitutional challenge
00:22:41.540 and that we had done a lot i think to to build up all kinds of good proper evidence and proper
00:22:49.940 argument that this one that also included arrests which we also thought would like how can you not
00:22:56.940 look at this differently are you arguing charter breaches is that what ultimately this is or is it
00:23:04.860 about science both well you see that's the problem i mean like a judge is not a scientist so a judge
00:23:12.520 is not going to be able like and that's what the judge said in the previous case but yeah well but
00:23:17.520 sometimes they'll call on you to go use some of the science to go talk about when you know what
00:23:21.840 you're talking about for the charter breach right but it's all based upon what they were preventing
00:23:27.380 us from doing which the charter doesn't cover right the bill of rights does cover well see now
00:23:34.700 i would be very surprised that nobody in this conversation for the last long while didn't
00:23:38.220 understand that i mean uh we've gone through the ringer talking to you know everybody throughout
00:23:44.580 the jccf and multiple lawyers all over the place about the best way to attack this and uh you know
00:23:51.160 what we've been left with is is this fight against the province that's been basically saying well
00:23:56.000 you know we've gone this road once we're not doing it a second time i had this group on from i think
00:24:02.580 they were from ontario a couple of months ago they've been using the bill of rights to win cases
00:24:06.720 all across ontario i forget what they're called now i want to have them back on but i mean they've
00:24:11.820 been using the bill because there is no uh escape hatch for the government to get out of they then
00:24:18.260 once there's no escape hatch they then have to prove their case and if they can't prove it using
00:24:24.320 science like you say then they lose period right it might be something to bring up with your lawyer
00:24:32.560 man well absolutely i mean and um i'd be very shocked to know that uh anybody involved in all
00:24:39.600 the conversations we've been having over the last several months doesn't know of any any group like

00:24:53.920 success there and for some reason that's been void to our perspective hang on let me check some of
00:25:00.640 these comments here our lawyer says we cannot use the bill of rights apparently the charter
00:25:04.720 supersedes the bill it wouldn't no it doesn't that's awesome yeah and again i always keep
00:25:10.440 hearing conflicting arguments about that as well too right like it keeps going back and forth back
00:25:14.200 and forth back and forth i mean we don't know and sometimes sometimes though and we get told this
00:25:18.760 and i have you know what i think we have touched on this with our lawyers it can you know it's it's
00:25:23.820 one of these awkward things right that it's it's a roll of the dice it can be it can just depend
00:25:28.260 on the judge sometimes look at what this says here in section two of the bill of rights every
00:25:33.140 law of canada shall unless it is expressly declared by an active parliament of canada
00:25:38.780 shall operate notwithstanding the bill of rights so unless unless the mandates that came down
00:25:46.120 provincially supersede or supersede and they're not even acts of parliament the provincial acts
00:25:52.900 were not acts of parliament they were orders in council which are not acts of parliament
00:25:57.680 right an act of parliament would supersede an order in council and i've got that right here
00:26:03.980 as a matter of fact right here it can be but see no we're all we're already stuck under this thing
00:26:11.680 where the province of manitoba figures what what joyelle already said uh about the original case
00:26:19.200 is now this precedent setting situation and we're just kind of stuck underneath it

00:26:34.600 have a big meeting coming up we're all going to get together and talk about a lot of you know
00:26:38.040 what's what's going on here um so i i don't want to get into too many more details about like what
00:26:44.380 i think the future holds for this process but of course number one thing to say would be obviously
00:26:49.580 The process is not done. The judge even already made note of that in the end for a kind of like
00:26:57.280 conclusionary speech today saying that, you know, hey, you know, this is very disappointing for you
00:27:02.240 guys, but you can still do this. You can still do this. You still have a trial set. You can still
00:27:06.260 come for that trial and you can start it off in whatever way you want. Does appealing it sound
00:27:13.080 reasonable to us in some ways yes do we know 100 for sure that it's the best way to go
00:27:19.860 not yet so i'm not going to say anything more than that um i know i know appeal courts
00:27:28.220 and but basically what our judge even said today and she will be the same judge that goes and
00:27:34.360 oversees she will be the same judge for the full trial depending on how we take that a five-day
00:27:40.300 trial now seems like a waste of time at this point in time because we don't have the constitutional
00:27:44.180 challenge to stand behind and i want to make a mention of this as well too just so people
00:27:48.420 understand what the constitutional challenge for us in this case was specifically going to mean
00:27:52.760 in a very big way um it was going to be to and i don't know if this is okay to say i believe it
00:27:59.940 must be at this point in time i'm going to say it anyways um it was to be able to get some of the
00:28:06.040 ticketing officers on the stand to cross examine and say how did how is it that in your job in
00:28:13.560 your time working that job in whatever period of time you could ticket these individuals and not
00:28:19.420 those individuals equal application of the law right yes yes and i was and here's something
00:28:25.180 interesting and i guess this is a really good key point to mention and probably one of the biggest
00:28:30.140 key points of why it's been you know worthwhile to have me on other than just mentioning you know
00:28:34.880 hey here's what happened in court today this would be kind of one of the like i mentioned earlier you
00:28:39.380 know hey even as a journalist i'm trying to learn something here and it's tough but this would be
00:28:44.300 the one thing that i could mention and it shocked me and it's still kind of i'm still trying to kind
00:28:50.340 of figure it out because it still doesn't make good sense to me so it's a good thing to mention
00:28:54.620 on air to as many people as possible get people thinking about this um is apparently without a
00:29:01.520 constitutional challenge it's not really worthy enough to have the evidence proof and bring it
00:29:11.820 out through a court of law of ticketing officers law enforcement so on and so forth you know you
00:29:19.500 know what we dealt with in the last two years that being uh was it manitoba justice not real
00:29:25.260 law enforcement but some bastardized version of it um trumped up with a lot of extra capital um
00:29:33.920 i think they were working outside their parameters for the last time and it's what one of the things
00:29:39.320 we wanted to prove and see and that that works perfect as some commentary right there because
00:29:44.440 i thought we could still be able to try to prove that without a constitutional challenge i learned

00:43:01.420 among the most sustained stringent policies regarding restrictions on internal movement
00:43:06.560 unquote but recently released court documents which capture the decision making behind the
00:43:12.020 travel mandate indicate that far from following the science as trudeau says they do
00:43:20.400 the prime minister and his cabinet were focused on politics. Canadians are hardly alone. As
00:43:27.640 common sense recently reported, American public health agencies have also been politicized.
00:43:33.820 Two days after announcing the mandate, Trudeau called a snap election, presumably expecting
00:43:39.560 that his liberal party, which was in the minority in the House of Commons, would benefit from the
00:43:44.160 announcement and be catapulted into a majority. As it turned out, the liberals failed to win that
00:43:49.660 majority in september of 2021 in the meantime roughly 5 million unvaccinated canadians were
00:43:55.840 barred from visiting loved ones working or otherwise traveling trudeau for his part stayed
00:44:00.740 in power even though the conservatives have won the popular vote in the past two elections because
00:44:05.340 of canada's parliamentary system uh they have been denied the top job now guys remember this

00:44:15.340 perspective it's written from. The court documents are part of a lawsuit. I'm going to go long

00:44:31.100 against the government. Until last month, they were under seal. This came out today, by the way,
00:44:37.600 guys. Both plaintiffs are business owners. Both have family in Britain. Both have refused the
00:44:43.540 vaccine on the grounds of bodily autonomy. Both were reluctant to identify their businesses out
00:44:48.700 of fear of losing customers. One plaintiff, Carl Harrison, in his affidavit, Harrison 58 said that
00:44:54.620 he and his partner, Emma, had immigrated in 2009 from Britain to Canada. He became a Canadian
00:44:59.260 citizen in 2015. They have two children, a 24-year-old son, 14-year-old daughter. They live
00:45:05.860 in a tiny neighborhood in Vancouver. He'd always been an entrepreneur. I was involved in establishing,
00:45:11.580 owning and co-owning over 40 venues, blah, blah, blah, blah, blah. Since 2000, Harrison had been
00:45:16.580 involved in the travel industry. We have a company in the UK, Ireland, Spain. We're the largest
00:45:20.880 retailer of packages for Disneyland Paris, he said. He also has an 88-year-old mother in Britain.
00:45:26.740 He was furious that for months he could not visit her. When you've got oppressive government
00:45:31.100 behavior, you're only left with three choices. Accept it, fight it, or leave. I can't accept it.
00:45:37.520 I moved my family here, and I'd be letting them down if we moved, so I'm in fight mode.

00:45:49.720 also in Britain, is suffering from late-stage Alzheimer's. Rickard is 55. He lives in the town
00:45:54.540 of Pickering, outside Toronto, and he owns a small exterior siding and eaves contracting business.

00:46:43.500 the lawsuit has cost the two plaintiffs about $186,000. See what I mean about bleeding us dry?
00:46:50.260 Will they go ahead and spend our tax dollars? Of which, Rickard has raised $121,000 on GoFundMe.
00:46:57.540 in February of this year, when the Canadian government invoked the Emergencies Act in
00:47:02.720 response to the truckers protesting a separate vaccine mandate in Ottawa. Well, that's not all
00:47:07.920 they were protesting, but anyway. GoFundMe forced Rickard, like those raising money for the truckers,
00:47:13.500 off the site. Rickard and Harrison's attorney, Sam Prevellos, said that all Canadian or
00:47:20.340 government decisions related to public health demanded transparency. Civil servants shouldn't
00:47:25.540 hide behind a shroud of secrecy, the lawyer said. The whole point of the case was to lift that
00:47:31.000 shroud and cast a spotlight on the unscientific basis of the mandate. Among other things,
00:47:37.800 the court documents indicate no one in the COVID recovery unit, including Jennifer Little,
00:47:42.440 who we referenced earlier, the Director General, had any formal education in epidemiology,
00:47:48.020 medicine, or public health. Little, who has an undergraduate degree in literature from the
00:47:54.060 University of Toronto, testified there were 20 people in the unit. When Prevolos, the lawyer,
00:48:00.760 asked her whether anyone in the unit had any professional experience in public health,
00:48:04.760 she said there was one person, Monique Saint Laurent. According to Saint Laurent's LinkedIn
00:48:09.680 profile, she appears to be a civil servant who briefly worked for the Public Health Agency of
00:48:14.280 Canada. Saint Laurent is not a doctor, Little said. Reached on the phone, Saint Laurent confirmed she
00:48:19.300 was a member of COVID recovery. She referred all other questions to a government spokesperson.
00:48:25.240 Little suggested that a senior official in the prime minister's cabinet or possibly the prime
00:48:29.900 minister himself had ordered COVID recovery to impose the travel mandate. During cross-examination
00:48:36.300 Little told Presvalos repeatedly that discussions about the mandate had taken place at senior and
00:48:42.560 very senior levels but she refused to say who had given her team the order to impose the travel
00:48:48.900 mandate i'm not at liberty to disclose anything that's subject to cabinet confidence which is
00:48:54.640 untrue she's not a member of cabinet the term cabinet confidence is noteworthy because it
00:49:01.040 refers to the prime minister's cabinet meaning that little could not talk about who had directed
00:49:05.880 the covid recovery unit to impose the travel mandate because someone at the very highest
00:49:11.020 level of government was apparently behind it so we know it was somebody in the in the cabinet

00:50:09.760 for the travel mandate. This was less than two weeks before the mandate was set to kick in.
00:50:15.980 To the extent that updated data exists or that there is clearer evidence of the safety benefit
00:50:20.840 of vaccination on the users or other stakeholders of the transportation system, it would be helpful

00:51:14.160 mandates. Two days later, the mandate took effect. Then, eight and a half months later, June 14th of
00:51:20.780 this year, government officials announced they would be suspending the mandate, although they
00:51:25.680 made it clear they could bring it back at any time, which they have. Within days, government
00:51:30.080 lawyers filed a motion seeking to shut down Harrison and Rickard's suit on the grounds it
00:51:34.780 was now moot. And Presvallos said to make sure the public never saw the court documents since
00:51:41.720 the case was still open and court documents are unavailable to the public while cases are open,
00:51:46.880 shutting it down would have sharply reduced the likelihood of anyone seeing government
00:51:51.100 officials' testimony. So on July 12th, Presvallos filed an additional damages motion, arguing that
00:51:58.400 his clients had suffered damages during the mandate. Neither Harrison nor Ricard said they
00:52:03.080 wanted money. The point was to make sure the suit didn't go away and the court documents were made
00:52:08.460 public. But even so, the inner workings of the COVID recovery unit and more generally the Trudeau
00:52:14.500 government's thinking around the travel mandate remain opaque. COVID recovery has no website and
00:52:21.780 its name appears almost nowhere in government records. There is a brief mention of the unit
00:52:26.200 in the guidance document announcing that effective June 20 if the travel mandate would be suspended.
00:52:32.340 The Trudeau government has claimed to follow the science on COVID, but that science is strangely different than it is everywhere else.
