After retiring from the department, he continued to serve through honest work as a private investigator in New Jersey. He was subsequently charged with a crime. 00:00:38.980 Michael McMahon is a distinguished and decorated New York City police sergeant,
00:00:44.320 now retired, who served New Yorkers with honor during some of the most dangerous years of crime
00:00:49.280 in America's largest city.
00:00:52.000 After retiring from the department, he continued to serve through honest work
00:00:56.200 as a private investigator in New Jersey.
00:00:58.320 He was subsequently charged with a crime.
00:01:01.740 His alleged crime was nothing more than accepting an assignment that involved surveillance for clients
00:01:06.940 he had no reason to believe were connected to a sinister operation by the Chinese Communist Party
00:01:13.160 known as Operation Fox Hunt.
00:01:15.240 So what did Michael McMahon do?
00:01:17.340 He took photographs.
00:01:18.320 He observed movements.
00:01:19.320 He performed perfectly lawful investigative work that private investigators across America perform every single day.
00:01:27.200 Yet the U.S. Department of Justice under Joe Biden twisted these routine tasks into a theatrical display of espionage and conspiracy.
00:01:35.200 They smeared him as if he was the one who was an enemy of the state,
00:01:37.880 and they railroaded him into a false conviction.
00:01:40.520 They sent Michael McMahon, a good and decent man, to prison while the true traitors of our republic walked free.
00:01:47.880 Now at the center of this fight for an innocent man's rights stands his wife, actress and author Martha Byrne.
00:01:54.660 She has shown courage that can only be described as incandescent.
00:01:58.980 She has written, spoken, and now documented this horrific story in her book, An Interest of Justice,
00:02:05.680 which exposes the corruption and cruelty of the system.
00:02:09.320 And Martha Byrne joins us now in the Stone Zone.
00:02:11.620 Martha, welcome.
00:02:13.180 Thank you, Roger, for that introduction.
00:02:15.200 I greatly appreciate you having me on.
00:02:16.880 It's an honor to talk to you, sir.
00:02:18.440 It truly is.
00:02:19.440 Now, if you saw Martha Byrne, you would definitely recognize her.
00:02:23.960 She is an actress, well-known for her role in the soap opera As the World Turns, where she played the role of Lily,
00:02:31.860 then twin sister Rose, for which she won the lead actress Emmy.
00:02:35.660 After leaving As the World Turns, Martha starred on General Hospital, Crisis, wrote for the soap opera Bold and Beautiful,
00:02:42.680 and she executive produced several award-winning and Emmy-nominated digital productions.
00:02:48.240 But she joins us today not as an actress or a professional, but she joins us as a wife and a mother.
00:02:55.660 She is married for over 30 years, 42 years, I believe, to retired New York Police Department Sergeant Michael McMahon.
00:03:04.440 They have three children, Michael, Max, and Anne-Marie.
00:03:07.840 And Michael, Max, and Anne-Marie need their father home with them.
00:03:11.540 So, Martha, tell us this story.
00:03:14.980 That's such a beautiful setup.
00:03:16.120 Thank you.
00:03:16.540 I'm honored to talk to you.
00:03:18.040 I met Mike when we were kids, and I was on As the World Turns, and he was this hero cop.
00:03:25.000 He was an NYPD detective during the 90s, you know, with the street crime unit.
00:03:30.840 He was one of the elite chosen.
00:03:32.200 Remember when Rudy Giuliani cleaned up New York City?
00:03:34.440 Well, guess what?
00:03:35.120 My husband was right there at the front lines doing it, plainclothes, and earned 78 medals while he was on the NYPD.
00:03:43.980 He became a school safety sergeant.
00:03:45.980 He was incredible, had an incredible career.
00:03:48.980 And then he actually got the combat cross, which is for a gang-related shooting in the Bronx from Rudy Giuliani.
00:03:55.220 He actually put it on his neck at one police plaza and had an incredible career.
00:04:00.200 And had a severe car accident during a police chase in the Bronx and hit a telephone pole at 50 miles an hour, which ended his career.
00:04:09.540 And he was devastated.
00:04:11.200 I mean, he loved the job.
00:04:13.100 He really did.
00:04:14.180 He was a cop's cop.
00:04:15.860 And when he left and he retired from the NYPD, I was working full-time, and he was with the children, but I could see that he really missed the job.
00:04:24.780 And he started working part-time as a private investigator, and he really enjoyed it.
00:04:29.600 And his business took off, and he was doing some great jobs.
00:04:35.440 And then in 2016, he got a routine phone call from a New York-based company in the fall of 16.
00:04:43.140 The client wanted to find someone who had apparently stolen money, millions of dollars, from a family construction business.
00:04:50.840 The construction business was in China, but the man had fled to the United States, apparently, and stolen all this money.
00:04:56.180 And the client wanted to, you know, where's the money?
00:04:59.760 And so my husband hired two NYPD retired detectives to work with him on this case and did basic work.
00:05:07.220 You know, public records, found out the man had millions of dollars in real estate, LLCs, cars.
00:05:14.600 There was the money, right?
00:05:16.580 And he did some surveillance, notified the local police every single day of surveillance with the other two NYPD officers, retired.
00:05:25.680 Documented everything.
00:05:26.680 He made a few thousand dollars on the case and then moved on with his life.
00:05:31.240 All he knew about the subject that he was following was that the man was alleged to have stolen some money in China.
00:05:36.920 But it was a financial thing.
00:05:38.620 No big deal.
00:05:40.280 And he moved on with his life.
00:05:42.360 And then on October 28th, 2020, you know this, Roger, the pre-dawn pounding at the door.
00:05:51.120 And my children were younger.
00:05:53.040 Obviously, this has been five years now.
00:05:55.960 And, you know, the first thing you think when you hear that knock is someone, your children, like, is everybody alive?
00:06:03.360 It's the mother's worst nightmare to go to the door and hear Michael McMahon because it's my son's name, too.
00:06:09.540 And for that minute, you think, this is it.
00:06:12.120 Prepare yourself.
00:06:13.100 Something's happened.
00:06:14.500 No, they were there to see my husband.
00:06:15.960 And they just walked in, Roger.
00:06:18.020 It was so casual.
00:06:20.100 They were talking to my husband in the hallway.
00:06:22.300 And my husband said, are you here about some other case he had worked on?
00:06:25.120 They said, no, no, we know you from that case, which was weird.
00:06:28.300 They let him walk to his bedroom, get dressed.
00:06:31.400 They were petting my dog.
00:06:33.200 They didn't go to his office.
00:06:34.420 They didn't take his guns.
00:06:35.440 They didn't take his computers.
00:06:36.620 He didn't.
00:06:37.020 He wasn't handcuffed.
00:06:37.880 The whole thing was strange.
00:06:38.940 And then he gets to get taken away.
00:06:44.520 And I'm panicking.
00:06:45.480 I'm what the hell just happens, you know, and I'm in this daze and I don't hear from him for hours and hours.
00:06:51.100 And apparently when he went to be interrogated, he spoke freely.
00:06:55.780 He didn't know why he was there.
00:06:57.100 They never told him why he was there.
00:06:59.020 But he's a cop.
00:07:00.180 You know, he thinks like a cop.
00:07:01.320 If something was wrong or something was, he wanted to be a part of the discussion.
00:07:05.260 Like, what happened?
00:07:07.120 And as they're speaking to him, they're asking him strange questions.
00:07:10.740 And he remembers a lot of the case.
00:07:13.660 And very forthcoming, happy to talk and help.
00:07:16.120 And then turns out he's being arrested for the Foreign Agents Registration Act, FARA, which was bizarre.
00:07:26.620 He only worked for a New York company.
00:07:28.220 He had no evidence that he found that he had in his possession that had anything.
00:07:33.680 There was nothing.
00:07:35.040 And interstate stalking, Roger, interstate stalking.
00:07:39.480 He's a private investigator.
00:07:41.780 He was parked on a public street.
00:07:43.340 He, the subjects never saw him.
00:07:46.700 So we're thinking, how could, this must be a mistake.
00:07:49.100 Must be a mistake.
00:07:50.840 So he comes home.
00:07:51.880 The press are outside our house.
00:07:54.060 There's a big article in the New York Post that he's China's muscle.
00:07:56.780 And he's intimidating people and harassing people.
00:07:59.120 They're like, what is going on?
00:08:01.440 So immediately, Roger, we went to his office and we started looking at all his emails.
00:08:07.020 He had saved everything, every invoice, every text message.
00:08:12.000 He had everything.
00:08:14.040 And we're trying to look and go, there's nothing here.
00:08:16.180 It's a few days of work, a few hours of work from 2016 and 17.
00:08:20.740 What are they talking about?
00:08:22.820 This is bizarre, right?
00:08:25.580 So, of course, we're going to fight this.
00:08:28.400 Of course.
00:08:29.860 And, Roger, as you know, as soon as you take that position, you're done.
00:08:35.240 I think it is abundantly clear in the case of retired New York police detective Michael McMahon,
00:08:41.220 this is an upside-down crafted narrative that was developed where Michael McMahon became the villain
00:08:46.940 while the U.S. government protected a rogue Chinese government official and his wife
00:08:51.280 who lied to obtain residency in the U.S. while laundering tens of millions of dollars of embezzled dollars.
00:08:57.540 Let me say two things abundantly clear.
00:09:00.580 There is no evidence whatsoever that Michael McMahon was ever paid by any foreign entity.
00:09:05.700 And he's a fully licensed, fully licensed private investigator.
00:09:09.700 So, the media here has glossed over the failure to provide due process
00:09:15.440 and a willful January 6th-style behavior by the U.S. government
00:09:19.820 to deny key exculpatory information to defense counsel for Michael McMahon
00:09:25.380 and to possible manipulation of the U.S. government by the victims
00:09:29.440 who happened to be connected to the Chinese Communist Party
00:09:33.840 who made false statements to enter the country.
00:09:37.120 This is an upside-down world.
00:09:38.680 If I hadn't experienced this myself in the District of Columbia,
00:09:42.300 I would find it hard to believe.
00:09:45.220 I know.
00:09:46.160 And, you know, I think, you know, there's some things about this case which are truly shocking.
00:09:51.040 So, if, back in 2017, the FBI knew Mike was, they had enough evidence that Mike was innocent.
00:09:56.920 And yet they were, they obtained illegal search warrants for years
00:10:00.300 and lied in the search warrants.
00:10:02.100 And we've heard this before, haven't we?
00:10:03.380 Doesn't this sound familiar?
00:10:04.640 It does.
00:10:05.140 Now, the four years that this investigation went on between the FBI and New Jersey,
00:10:10.760 the New Jersey FBI Red Bank office, and the EDNY,
00:10:15.260 the FBI, the FBI never spoke to the three NYPD detectives,
00:10:20.880 my husband or the two other NYPD detectives retired who were intelligence officers.
00:10:27.300 They never called them.
00:10:29.680 They never.
00:10:30.680 But yet, the FBI was speaking to the Chinese agents all the time, interviewing them,
00:10:39.480 allowing them to flee to China and return.
00:10:41.960 They were protecting the alleged victim.
00:10:44.420 There's communications between Robert Riley, who was an FBI agent retired in New Jersey,
00:10:48.740 and the alleged victim regarding their immigration, a civil lawsuit against them.
00:10:53.460 There was so much collusion going on between the actual criminals in this case,
00:11:00.920 while my family was left vulnerable.
00:11:04.160 Roger, if these people were as dangerous as they're claiming they were,
00:11:07.800 my family was left vulnerable.
00:11:09.820 We were sitting ducks, and they left.
00:11:11.480 They did not protect us.
00:11:13.120 And they had an obligation.
00:11:14.200 There's a law called the duty to warn.
00:11:17.800 When you have been targeted by any foreign entity,
00:11:20.400 you must alert the person that they have been targeted.
00:11:25.160 And instead, they protected the enemy in this case.
00:11:29.440 So here we go.
00:11:30.920 We're like, we're going to go to trial.
00:11:32.380 Here we are going to trial.
00:11:33.780 And of course, exculpatory evidence is buried.
00:11:36.060 We can't put in evidence.
00:11:37.800 We're not allowed to talk about Mike's career on the NYPD.
00:11:40.400 Can you imagine, Roger?
00:11:41.140 We cannot tell the jury why this man would never, ever hurt anybody.
00:11:46.620 He's the opposite of that.
00:11:47.940 No good deeds.
00:11:48.860 You know that.
00:11:49.400 They do that in trial.
00:11:50.140 They did it all the time.
00:11:51.200 Yeah, no, I'm very, very familiar with it.
00:11:53.660 In my case, I was specifically prohibited from the judge from arguing that I had either been
00:11:58.000 selectively prosecuted or that there were political motivations behind my prosecution.
00:12:03.120 I was also prohibited from saying that the prosecutors in my case offered me a deal
00:12:07.960 where they would have recommended no jail time if I had just agreed to testify falsely
00:12:13.720 against President Donald Trump, which, of course, I refused to do.
00:12:17.340 The essence of the U.S. government's case against Mike McMahon is that he didn't file
00:12:21.480 under the Foreign Agents Registration Act.
00:12:23.720 But to be guilty of failing to file under that law, one must factually know that their clients
00:12:29.060 are members of foreign government.
00:12:30.340 The FBI and the DOJ failed to demonstrate in this case, based on what I read in your book,
00:12:36.280 that Mike McMahon factually knew that his co-defendants were part of the Chinese Operation
00:12:41.760 Fox Hunt program.
00:12:43.440 There's no legal requirement in FAR for someone to obtain a signed deposition from a client
00:12:47.960 stating under penalty perjury that they're not an over or class nine member of the foreign
00:12:54.020 government.
00:12:54.540 Mike McMahon had no idea what was going on.
00:12:57.620 He was doing legal work, and the government never proved that he was acting on behalf of
00:13:02.300 a foreign government.
00:13:03.780 On the other hand, he was persecuted by a politicized Justice Department.
00:13:10.320 When we come back, I'm going to ask Martha Byrne about where Mike McMahon is now and what the
00:13:15.520 next step is in terms of getting true justice in his case.
00:13:19.820 You're listening to The Stone Zone here on the Red Apple Audio Networks, talking to mother
00:13:25.380 and wife of Martha Byrne, who is married to the former New York Police Department Sergeant
00:13:33.200 Michael McMahon.
00:13:34.940 They have three kids.
00:13:36.540 They've been married for 32 years.
00:13:38.160 This is a shocking story of injustice, folks.
00:13:41.020 When we come back, we're going to ask Martha Byrne where the case stands now and what you
00:13:44.680 can do to help Martha Byrne and her husband, Michael McMahon, and their children get justice
00:13:50.540 and move on with their lives.

00:14:15.440 The Stone Zone, entertaining and informative on the Red Apple Podcast Network.
00:14:24.320 Welcome back in to The Stone Zone.
00:14:27.960 We're joined today with Martha Byrne.
00:14:30.000 She's a three-time Emmy Award winning actress, writer, and producer with a career spanning over
00:14:35.160 30 years in the entertainment industry.
00:14:37.800 At the age of 10, Martha starred on Broadway in the hit show Annie, and she's had a successful
00:14:43.980 career, but she joins us today, not as an actress, not as a professional, but as a wife and mother
00:14:49.800 to tell the horrific story of persecution of her husband, former New York City police detective
00:14:56.940 Michael McMahon.
00:14:58.500 She has memorialized this incredible story in a book entitled In the Interest of Justice
00:15:03.880 by Martha Byrne.
00:15:05.380 You can find it online.
00:15:06.900 It has gotten rave reviews.
00:15:09.300 It is a book that every American should read because it is shocking.
00:15:14.420 It details the attacks on her family by the Obama-Biden Justice Department and the unrelenting
00:15:20.260 fight by Mytha Byrne to clear her husband's name.
00:15:24.300 Martha, we've got about five minutes.
00:15:26.640 First of all, how is your husband doing today?
00:15:29.520 Well, he was in a federal prison in Michigan, a low-security prison.
00:15:33.380 They sent him 600 miles away, even at the sentencing.
00:15:38.720 By the way, Roger, at the trial, nobody testified against my husband.
00:15:43.980 The case agent didn't testify.
00:15:45.780 The victims couldn't identify my husband in court, and the victims asked for no jail time
00:15:51.900 and no restitution.
00:15:54.360 And the judge gave him 18 months in federal prison because he had no remorse for the victims.
00:16:00.440 Roger, we've just explained who these victims are.
00:16:03.620 These people perjured themselves to put my husband in federal prison, and they sent him
00:16:08.140 600 miles away as a retired cop into general population.
00:16:13.400 He was there for almost four months.
00:16:17.600 He is now in a halfway house in New Jersey.
00:16:21.080 He is a warrior, Roger.
00:16:24.300 He went to federal prison for the truth.
00:16:29.580 He refused.
00:16:32.200 He's done nothing wrong.
00:16:33.580 He committed no crime, Roger.
00:16:35.780 So we're desperately trying.
00:16:37.820 And I listen.
00:16:38.560 You know, Donald Trump, when he hears this story, he is going, first of all, talk about
00:16:45.000 back the blue.
00:16:46.480 NYPD persecuted.
00:16:49.480 Same tactics, making up a case.
00:16:51.820 This was legal PI work, Roger.
00:16:53.540 They took it, and they made it look nefarious for the jury, and they lied to the jury every
00:16:59.040 single day.
00:17:00.140 How would he be a hero?
00:17:01.440 I think it's abundantly clear his real crime here is that he stumbled much too close to
00:17:07.080 the nefarious illegal operations of the Chinese Communist Party right here inside the United
00:17:12.400 States, where they have set up their own police stations and where Chinese special operators
00:17:17.280 are monitoring their own citizens here in the U.S.
00:17:21.880 As a private investigator and a decorated police officer, Mike McMahon stumbled into that operation, and that had to be covered up because it made those in power look very, very bad.
00:17:33.020 This is a shocking story.
00:17:34.840 It should be shocking to every American.
00:17:37.460 I urge you to get to Martha Byrne's terrific book, In the Interest of Justice.
00:17:42.600 But beyond that, I urge everyone out there to pray for justice in this matter.
00:17:47.580 I learned in my own trial, in my own horrific fight for justice in which I was targeted at
00:17:58.500 the Justice Department, I could have walked away free, no problem at all.
00:18:01.640 All I had to do was agree to lie under oath and incriminate Donald Trump.
00:18:07.120 I would have had to make it up, by the way, because I'm not aware of anything the president
00:18:10.940 did wrong, and I did nothing wrong.
00:18:12.600 In fact, Robert Mueller's final report, which the judge refused to give my attorneys, my defense
00:18:20.860 attorneys at trial, on page 178, we later learned, becomes very clear that they found no evidence
00:18:28.340 of Russian collusion, WikiLeaks collaboration, or any other crime on my part.
00:18:34.340 Yet, a jury and a judge who essentially prohibited me from having any defense whatsoever, a judge
00:18:41.440 who withheld exculpatory evidence, very much like the judge in Mike McMahon's case, was
00:18:48.000 ready to send me to prison.
00:18:49.940 Prosecutors recommended seven to nine years.
00:18:53.660 So I have lived this, and this story should be shocking for every American.
00:19:00.840 Martha, other than buying and reading a great book, which I strongly recommend, what can
00:19:05.160 people do today to help you and your family?
00:19:08.240 Well, like you said, prayer, prayer, prayer.
00:19:10.420 I mean, I know you read the book.
00:19:12.120 I was visited by the Blessed Mother right before my husband was arrested, and she came into my
00:19:17.200 heart and strengthened me.
00:19:18.780 And the prayer has gotten us through this.
00:19:20.740 The Blessed Mother has gotten us through this of prayers.
00:19:22.920 I would also encourage everyone to, if you don't mind, I know Eddie Gallagher, the Navy
00:19:29.680 SEAL captain who was also falsely arrested for murder, who started the Pipe Hitter Foundation,
00:19:36.400 which is pipehitterfoundation.org.
00:19:40.140 They have been supporting us.
00:19:41.540 They support first responders who are falsely accused and arrested, and lives are destroyed.
00:19:48.460 They've been with us for years.
00:19:49.580 I'm so grateful to them.
00:19:52.860 They've been a supporter there.
00:19:54.380 So pipehitterfoundation.org, there's a page direct just for Mike, and we're so grateful.
00:19:59.540 We're so grateful, our entire family.
00:20:01.560 All right, we have to wrap it up there.
00:20:03.240 Please join us in praying for Michael McMahon, his wife of 32 years, Martha Byrne, and their
00:20:08.640 children, Michael, Max, and Anne-Marie.
00:20:11.280 God bless you, Martha.
00:20:12.540 Never give up the fight.
