00:00:56.580 Richard Nixon tried that in Watergate when it was learned that he had taped his conversations in the White House.
00:01:03.420 He released a full transcript, but the media, the courts, the Congress insisted that they have the actual audio tapes.
00:01:15.300 The courts ultimately ruled that Nixon must release them.

00:01:20.580 And it cost him his presidency.
00:01:23.020 Unfortunately, the media, the Democrats, the Congress didn't demand that Joe Biden release the actual audio tapes of his interview.

00:06:38.720 I was pardoned by President Donald Trump because I was subjected to a Soviet style witch hunt in which the judge withheld exculpatory evidence from my defense attorneys.

00:07:15.040 But had those on a private setting so they could not be seen during the time that each prospective juror was was determined in terms of their fitness to serve.

00:07:33.840 The pardons Joe Biden signed for his cronies, for example, Adam Schiff, Nancy Pelosi, Liz Cheney and others, not to mention Dr. Fauci, those are likely signed by auto pen.

00:20:10.220 So, Sam, tell us about this pattern of fraud that you have detected.

00:20:17.100 What happens is she was buying a property in Norfolk, West Virginia, with her niece.
00:20:25.600 And the property was purchased as joint tenancy with rights of survivorship.
00:20:31.220 When she originally was purchasing the property, she claims, well, she shows an email whereby she did not want the property to be her primary residence.
00:20:45.500 That was on August 2nd or 3rd, 2023.
00:20:51.040 But 14 days later, she signs a power of attorney saying that she intends to occupy the premises with her niece as their primary residence.
00:21:05.080 And that document was witnessed by two key people in her office.
00:21:10.780 One who happens to be the deputy attorney general of New York.
00:21:15.220 The mortgage eventually closes based upon the power of attorney that she's going to occupy the property, but she never occupies the property.
00:21:25.560 The other item is, is that this was done a few weeks before the Trump trial, where she's basically, where she's suing Donald Trump for mortgage fraud.
00:21:35.460 So, when she signs that power of attorney, she claims it was a mistake.
00:21:40.420 So, she never intended to occupy Virginia.
00:21:42.800 She claims, okay, if that's the case then, okay, why wasn't the loan corrected?
00:21:49.260 Why wasn't the rate reset higher?
00:21:52.140 Why wasn't anything fixed?
00:21:54.920 Because she had the benefits of a loan that was underwritten based upon the fact that she was going to occupy the property with her niece.

00:22:08.380 So, she's not a mistake.
00:22:10.340 So, just to clarify this, by claiming that the property would be owner-occupied by she and her niece, not both, not either, but both, she got a lower mortgage rate.

00:22:23.440 Also, probably lower insurance.
00:22:25.980 But that's another thing.
00:22:27.580 So, she's saying it's a mistake.
00:22:29.480 If it's a mistake, then, why wasn't it corrected?
00:22:33.120 Why was the mortgage underwritten based upon her sworn statement, which was a sworn power of attorney, where she said that she was going to occupy the property?

00:22:45.780 That is her main problem.
00:22:48.040 Well, as you have pointed out, if she made the Virginia property her principal residence, which she signed under oath of power of attorney saying she would do, she would be legally ineligible to be the attorney general of New York.
00:23:05.360 And I checked the law immediately upon her declaring residency in another state, the seat would be vacated.
00:23:13.000 And then, of course, if she signed a document saying she would move and she didn't, well, then she is guilty of mortgage fraud.

00:23:22.540 Now, her lawyer, after the Justice Department referral, in other words, the FHSA, the Federal Housing Finance Administration, referred this case to the Justice Department.
00:23:36.300 Her lawyer wrote a letter of response saying that there was another document that was filed after the power of attorney that was on August 17th.
00:23:48.700 So you have an email that says that she's not going to occupy it.
00:23:52.480 I'm sorry.
00:23:53.020 She has an email saying she's not going to occupy it on August 2nd, August 3rd.
00:23:57.600 She has, on August 17th, the power of attorney that contradicts the email.
00:24:01.980 And then he has this third document that he refers to that also says that she's not going to occupy the property after she said she was going to occupy the property.
00:24:11.760 However, when he did the letter to the DOJ, that third document, which was subsequent to the power of attorney, he points to the email that was dated before the power of attorney.
00:24:26.600 In other words, the claim that there was another subsequent document, that document never existed.
00:24:33.760 In fact, she doesn't even refer to it when she did that hour breakfast yesterday in her speech.
00:24:39.420 In other words, that excuse now disappears.
00:24:42.180 So Lowell's timeline is completely garbage.
00:24:46.680 It is completely discredited, so to speak.
00:24:51.040 But in any case, even if she signed the third document subsequent to the power of attorney that contradicts the power of attorney,
00:24:57.500 it wouldn't matter because the mortgage is underwritten based on the power of attorney.
00:25:02.480 It is interesting to me that she claimed to have this document, which no one has ever seen.
00:25:08.740 And the New York Times just wrote it as a fact, even though I doubt they've ever seen it because, well, it doesn't exist.
00:25:14.960 Now, there's another issue, although I should point out the FBI Director Cash Patel has now confirmed his agents are actively investigating this mortgage fraud case
00:25:23.940 and reporting directly to him and to Deputy Director Dan Bongino.
00:25:27.700 There's also a credible report that a federal grand jury has been convened in Virginia to examine Letitia James' actions in this particular matter.
00:25:39.980 Now, there's a different issue.
00:25:42.260 That is her qualification earlier for a so-called HAMP loan, which is a loan of which you get a mortgage for an investment property.
00:25:51.800 But as I understand it, it's an investment property that has to be four units and under rental properties, which she claimed.
00:26:01.060 But didn't you and documentary filmmaker, investigative reporter Joel Gilbert visit that property so you could examine with your own eyes whether it was four units or five?
00:26:13.540 We visited the property, Joel, first of all, let me just say this.
00:26:19.080 Joel was the one that uncovered the HAMP fraud.
00:26:22.340 We visited the property.
00:26:25.440 And we saw that there was five doorbells, one for each apartment.
00:26:30.120 Also, when I got the Con Ed records, there was one electric meter for each of the five apartments plus a common area.
00:26:39.780 And, of course, the certificate of occupancy, which is the ruling document, says it's five units.
00:26:45.720 Now, right after that, right after that, somebody has filed a complaint with the Department of Building saying that the building is not in conformance with the certificate of occupancy.
00:26:59.420 In other words, there's four units that she claims instead of five units that the certificate of occupancy says.
00:27:05.820 Well, the building's department went there and inspected it and said there's five units.
00:27:10.280 Everything is fine.
00:27:11.520 In other words, they don't know that she's misrepresenting it as four units.
00:27:15.480 So she's fried on that one, Tom.
00:27:17.500 Once again, she's able to qualify for this mortgage rate based on a false statement.

00:28:34.080 little did they know that there would be subsequent sexual harassment and assault cases filed against Mayor Eric Adams, Governor Andrew Cuomo, and Senator Kevin Parker.
00:28:45.320 Parker now says the law, which he co-sponsored, the amendment, is unconstitutional.

00:28:52.640 Letitia James is trying to use this crucible to raise money.
00:28:59.580 She has a new fundraising appeal out.
00:29:02.760 She's going to need the money for her legal defense because it appears that New York State Republicans have blocked legislation in which Governor Kathy Hochul and the New York Democrats wanted the New York taxpayers to pay for Letitia James' legal defense,
00:29:19.320 even though these actions, as outlined by Sam Antar here today in the Stone Zone, have nothing to do with her official duties.
00:29:29.460 It has to do with her own personal conduct and a, I would say at this point, a 22-year span of 10 different mortgage applications,
00:29:45.280 every single one of which has some material problem.
00:29:50.160 And then, Sam, there's the question of her public filings.
00:29:54.380 As an elected official, she has required public filings about her own finances,
00:30:01.540 but sometimes she shows rent from these properties on her disclosures.
00:30:07.740 Other years, that disappears.

00:30:12.440 Her filings appear to me to be a mess, no?

00:30:16.940 Take, for instance, every year she has to file an ethics form with the New York State Board of Elections.

00:30:31.720 How many assets she has, how many liabilities she has, certain things she doesn't have to disclose,
00:30:36.500 but let's talk about what she has to disclose.

00:30:39.940 She has two properties in Virginia.
00:30:42.640 One is the one that she intended to make a primary residence that she didn't.
00:30:48.140 That's the subject of a major fraud investigation by the DOJ.
00:30:53.160 That property is nowhere to be found on our financial statements, and it's supposed to be there.
00:30:58.880 The mortgage is nowhere to be found on our financial statements, and it's supposed to be there, too.
00:31:03.540 There's another Virginia property where the property is listed on our financial statements,
00:31:09.740 but the mortgage that she took out when she bought the property is not listed on our financial statements,
00:31:16.260 but there are two mortgages that are not in the property records that are listed on our financial statements.
00:31:24.920 So, in that property, she lists two mortgages that don't appear in the property records,
00:31:30.320 and one mortgage that does appear in the property records is not on the financial disclosure.
00:31:36.540 And then you have the Brooklyn property also that she has,
00:31:40.080 where there's one property that she lists on our financial disclosures.
00:31:43.900 It's nowhere to be found on any property databases.
00:31:49.280 She, of course, claims that this is all about retaliation.

00:31:53.680 In all honesty, there's a great editorial in the New York Post as to what the delay is
00:31:59.300 in Trump's appeal of the unprecedented prosecution of Donald Trump by Letitia James.
00:32:08.660 Remember, she claimed that he inflated the value of his assets in order to get commercial real estate development loans,
00:32:18.980 all of which were paid back on time and in full.
00:32:22.360 In fact, those making the loans made $40 million in interest.
00:32:26.140 Every one of them said that they would be willing to do business with them again.
00:32:30.760 They, of course, were not permitted to testify at that rigged trial.
00:32:35.060 I don't know a single lawyer who doesn't believe that that, I think it is a $580 million, I think, judgment can be reversed.
00:32:46.880 So, yes, there is lawfare.
00:32:49.480 There is a politically motivated prosecution.
00:32:51.840 But it isn't by Donald Trump.

00:34:08.500 as well as the Biden Justice Department, looked the other way at a New York financial institution that was violating Iranian sanctions.

00:34:24.240 We're talking about tens of millions of dollars.
00:34:27.720 I expect that story to break any day now.
00:34:32.060 Once again, she's going to claim this is retaliation or this is revenge.
00:34:37.160 No, this is a rebalancing of the scales of justice so that we have one justice system, not two, and that all public officials are treated equally.

00:37:00.460 Now, what's going to happen is all these flights, they have to, the charter carrier has to keep records, and the feds are going to get it from the charter carrier when they continue their investigation.
