00:00:43.040 Mark Fishman, a Bronx father of four, has been sentenced to 45 days in jail following a ruling in Westchester County, New York Supreme Court.
00:00:53.000 And after a contentious trial hearing.
00:00:56.620 Now, Mark Fishman is a gentleman who lives with traumatic brain injury, tinnitus-related hearing impairment, cognitive occipital neuralgia, and post-concussion memory loss from multiple car accidents.
00:01:11.080 Mark Fishman says that the Westchester County courts, the Westchester County, New York District Attorney, and New York State Attorney General Letitia James are treating him unfairly.
00:01:23.960 His sentencing comes nearly a decade after an incident in which police arrested Mr. Fishman during a court-ordered, bi-monthly supervised visitation with his children on December 15, 2018.
00:01:37.220 A visit fully prepaid and supported by a 22-page visitation order granting him access to his autistic son from 10 a.m. to 5 p.m.
00:01:49.840 A court-approved supervisor and disability aide were both present, and the supervisor had confirmed the visitation in writing earlier that very day.
00:01:59.700 Now, in withheld police video and audio, which was only obtained by Mr. Fishman through his federal lawsuit against those who are oppressing him, the now terminated arresting officer in this case, one Lane Schlesinger, is heard telling Mr. Fishman's disability aide that Mr. Fishman had no intent to commit any crime.
00:02:23.320 Nonetheless, Mark Fishman was arrested at 11.35 a.m. during his prepaid Super 5 visit with his son on allegations tied to an unserved order of protection.
00:02:36.820 Neither the jury nor his defense team was ever shown the exculpatory evidence.
00:02:42.100 Then, on July 16, 2020, after years of legal battles, a federal appeals court ordered the transcription as an ADA accommodation in his case, yet Judge David Zuckerman has refused to grant a retrial despite knowing that Mr. Fishman could not fully participate in his own defense.

00:03:14.060 I'm glad that you could join us to tell this horrific story to our audience here in the Stone Zone.

00:03:22.780 Thank you for having me, and thank you for giving the time to talk about a subject which is taboo, disability discrimination.
00:03:30.700 I'm not accommodating, you know, those who have disabilities, especially invisible disabilities, you know, like hearing impairment from tinnitus or brain injury from a traumatic car accident, you know, or PTSD or other mental impairments.
00:03:48.100 You know, society marginalizes us, labels us, belittles us.
00:03:51.580 And, unfortunately, many judges have no empathy, no patience, don't accommodate us.
00:03:57.460 And, you know, we're forced to go to federal court and spend years on litigation just to try to get the American with Disabilities Act and Rehabilitation Act enforced to protect many of us.
00:04:07.380 I saw you on the Sal Greco show on Rumble.
00:04:14.300 You were terrific, and it really moved me to talk about your case here on the show and also to post information on my various social media platforms.
00:04:23.940 I really feel for you as a father.
00:04:27.740 This is a horrific tale.
00:04:29.480 But why has your alleged misdemeanor over a child custody visitation turned into a seven-plus-year legal battle, which has to have cost you a fortune?
00:04:41.460 Well, Roger, you know, when David faces Goliath, you know, Goliath, which is the New York court system, and the Westchester judges have enormous resources.
00:04:51.020 To answer your question and try to be as brief as possible, you know, after I was convicted in a trial of attempting to violate an order of protection I never received,
00:05:01.700 and actually violating an order of protection I never received for not going on a property,
00:05:06.280 I went to return to court for the DA to argue that my kids should have a lifetime order of protection.
00:05:12.340 I wasn't charged or prosecuted with violating any of my kids, my four kids, Joanna, Jonah, and this guy.
00:05:22.740 Yet the DA, you know, tried, not once, not twice, but over nine appearances, Roger, the next year and a half, to just say,
00:05:31.780 okay, we've got to get orders of protection.
00:05:33.980 A judge saying, I have no authority.
00:05:35.260 You didn't prosecute me and charge him for that.
00:05:36.760 And the DA then saying, you have to, and making me out to be someone I'm not, you know, and then constantly, you know,
00:05:46.000 wailing on false allegations, unfounded charges, you know, things like, oh, you committed child abuse.
00:05:52.260 You know, that's the irony here.
00:05:54.180 I was accused of committing child abuse in 2014 after I had my injury, after I had surgery.
00:06:02.960 And it was so absurd, Roger, that someone like my ex-wife would go to a member of the government and say,
00:06:10.280 oh, my ex-husband attempted to strangle the kids when he picked them up in the gym.
00:06:15.680 Roger, any medical doctor can tell you that, you know, I have cubital tunnel syndrome.
00:06:20.760 I had just had ulnar release.
00:06:22.240 That's nerve release in your arm.
00:06:24.380 You can't squeeze your fingers.
00:06:25.580 You can't hold a key.
00:06:26.540 How do you strangle anybody?
00:06:27.960 Obviously, the video evidence cleared me.
00:06:29.760 Picked up my kids at the gym.
00:06:30.860 They were roughhousing, they're two twins, they're four years old.

00:06:34.800 You know, and unfounded, like four and a half, five weeks later, you had a family court judge,
00:06:39.260 Michelle Schauer, says, oh, I believe that you committed the abuse.
00:06:42.760 Oh, can we bring in, you know, Child Protective Services or ACS test fight?
00:06:46.320 No, I think you did it.
00:06:47.560 I don't care.
00:06:48.360 It doesn't matter.
00:06:49.840 You know, evidence doesn't matter in my courtroom.

00:06:52.840 Why am I guilty?
00:06:53.500 Because I sued you in federal court.
00:06:54.680 She denied me accommodations.
00:06:56.460 Yeah, that's what this is all about, Roger.
00:06:58.520 You know, and you asked.
00:07:01.020 So it's very simplistic.
00:07:03.200 Attorney General James, Attorney General Tisha James, defended Judge Schauer and her court
00:07:08.700 attorney, Brent D'Ambrosio, as well as Judge Oliver Gordon, as well as judges Horowitz and
00:07:16.940 others, who all denied real-time transcription, denied my note taker, denied aid to help me take
00:07:21.720 notes.
00:07:22.120 I can't take my own notes.
00:07:23.000 I have cubicle tele-syndrome.
00:07:23.820 I can't hold a pen.
00:07:25.160 Okay?
00:07:25.840 Denied in the courtroom.
00:07:26.380 They said, you didn't prove you were disabled.
00:07:28.520 No, my doctors did.
00:07:29.860 And the specialists, they did.
00:07:31.520 So how can Letitia James investigate the cop, Lane Slashier, who's charged in misconduct,
00:07:37.720 while she is representing the judges in my federal lawsuit, where the judges were ordered
00:07:41.540 to give the accommodation?
00:07:42.460 They refused.
00:07:43.440 You can't be impartial.
00:07:45.200 You know, you're not going to state the full investigation.
00:07:46.900 So it's no surprise, Roger, that in the law enforcement misconduct report on Lane Slashier,
00:07:51.520 the only cop in Westchester to be labeled pattern misconduct, that my case is intentionally
00:07:56.300 omitted.
00:07:57.200 Because then Letitia James would lose monetary damages, and worse, in my federal case against
00:08:02.080 the judges and the court staff that denied accommodations.
00:08:05.140 There's no fairness.
00:08:06.000 There's just cover-up and civil rights violations and no rights for those with disabilities.
00:08:10.120 Yeah, they're all in it together.
00:08:12.780 That is the problem in the nutshell.
00:08:14.840 They're all part of the same corrupted one-party system, and they're all covering each other's
00:08:20.960 misdeeds.
00:08:22.060 I want to focus for a minute on the arresting officer in your case, because this seems like
00:08:27.320 a real piece of work.
00:08:29.760 You're talking about an individual who had over 40 verified civilian complaints against
00:08:35.800 them.
00:08:36.400 This is Lane Slashier, I believe.
00:08:39.120 Why is this person still serving the public?
00:08:42.860 Why are they still in any position?
00:08:44.940 This is someone who should have been suspended long before they ended up railroading you.
00:08:53.380 Well, they didn't suspend to terminate them until Letitia James report came out, because
00:08:58.740 they wanted to try and win their federal lawsuit.
00:09:00.660 They didn't want to supply this in court order of discovery.
00:09:03.580 The cops were shocked that someone who was convicted for not committing a crime, for an
00:09:08.240 order of protection, where I wasn't given the third page, neither was the jury, which
00:09:11.360 says party not served.
00:09:12.620 The jury's just given order of protection saying, oh, I never got a copy of this.
00:09:16.320 So to answer your question, the New Rochelle mayor, okay, Noam Branson, purposely withheld
00:09:23.680 this along with their attorneys, Lee Lumba, okay, and several of the other cohorts in New Rochelle
00:09:29.140 to deceive and mislead a judge during discovery that their police were like Cinderella and the
00:09:37.980 prince in some fairy tale when they pattern disability discriminating cops.
00:09:43.220 He was terminated in 2014.
00:09:47.960 About August 2014 was his last paycheck.
00:09:51.040 About three, four months, Roger, after the law enforcement report was given to him, not
00:09:54.680 given to the public until later on that year in December 14th.
00:09:58.600 So December 24th, December 2024, pardon me, December 2024, terminated in August 2024.
00:10:04.920 I myself have been the target of a weaponized judiciary.
00:10:10.840 I know that your legal expenses in a seven-year legal battle, these things are usually resolved

00:11:15.240 that they have to accept the Attorney General for it.

00:11:18.980 They've refused to comment in my case over years, since 2023, that even their videos
00:11:23.880 existed that they had to give on the Caliph's discovery law.
00:11:26.820 They don't want to because, again, you'd be taking down the Westchester DA.
00:11:30.340 Hey, we're talking about a 17-year cop and a supervisor.
00:11:34.660 Let's not forget about Officer Cocaine.
00:11:37.360 Officer Sean Cain caught on police's best video planting drugs on Ivan Harper.
00:11:43.400 Okay, in June 24, he's suspended.
00:11:47.420 He was a supervisor who signed my report.
00:11:49.580 He signed that the arrest was authenticated.
00:11:51.620 He signed that there were no police audio video.
00:11:53.780 He signed that it's unknown if a supervisor was present.
00:11:56.780 Yet on the police cameras, my supervisor, Ann Elliott, who's a Republican, the cop says
00:12:02.140 nine times, calls her supervisor in the police precinct.
00:12:04.240 But on his arrest report, he says unknown.
00:12:05.740 Well, he put down that the supervisor was present, Roger.
00:12:08.620 He couldn't do the arrest because the only person who can cause arrest to be made during
00:12:13.840 supervised visitation, which is probation in New York State, okay, probation for going
00:12:18.580 to see your own kid, right, is the supervisor.
00:12:21.320 So, of course, they said, oh, unknown, she's a supervisor.
00:12:23.840 And why'd you call a supervisor, you know, nine times in two and a half hours?
00:12:27.420 These are the corrupt things.
00:12:28.580 The cops don't give us the audio and video.
00:12:30.180 The cops don't give disabled people the discerning reports.
00:12:34.140 They just want convictions.
00:12:36.180 The DAs just want convictions.
00:12:37.880 And they elevate, you know, the ADAs like Joyce Miller here, who is smiling with a smirk

00:16:56.260 You know, she couldn't see her kid five years, couldn't deal with it.
00:16:59.780 Then we have Catherine Kasanoff, who went to Switzerland to commit suicide, assisted suicide,

00:18:15.840 But it was only part of the entire overall U.N. experience.
00:18:19.740 Let me read what the President said about it.

00:19:40.080 I was told the sound was completely off in the auditorium where the speech was made and that world leaders, unless they used their interpreter's earpieces,

00:19:52.260 The first person the President saw at the conclusion of the speech was the First Lady, who was sitting right next to him.
00:19:58.240 He asked her, how did I do?
00:20:00.040 And she said, I don't know.
00:20:01.660 I couldn't hear a word you said.
00:20:03.600 This was not a coincidence.
00:20:05.320 This was a triple sabotage at the United Nations.
00:20:08.880 They really should be ashamed of themselves.
00:20:10.900 But more importantly, I think those in charge of the security and safety of our President need to do a much, much better job.
00:20:18.700 I think this could have been a potential disaster with the President suspended there on the escalator ever since Butler, Pennsylvania, ever since West Palm Beach.
00:20:30.980 I have feared for the life of our President, particularly since he's making these enormous changes in American policy, bringing America back,
00:20:39.840 insisting on fairer trade deals with our trade partners, mounting the greatest deportation of dangerous illegal immigrants in U.S. history,
00:20:50.360 working day and night for a cut in the interest rates so more people can buy homes, buy cars, pay off their credit card debt, pay off their student loans.
00:21:00.100 This is a President who's standing up for the American people, but he's also on the cusp of justice against those in the deep state who tried to destroy his presidency, tried to send him to jail.

00:22:02.180 Look, I think it's a mistake to look at American politics today as being divided between Republicans and Democrats.

00:22:11.160 Tulsi Gabbard didn't leave the Democrat Party so much as the Democrat Party left her.

00:22:19.440 She was against the police state, the surveillance of Americans without warrants, in all honesty.

00:22:30.660 She woke up one day, and she realized that the Democrat Party, the old Democrat Party of John F. Kennedy and Harry Truman, no longer represented her viewpoint.

00:23:12.040 Let's remember that we only know definitively that the entire Russian collusion narrative that we now are certain of, we know this only because she had the courage to follow the president's direction,
00:23:27.900 to declassify all of the documents that prove that there was a criminal cabal, that this was born in a meeting in the Oval Office with Barack Obama presiding.

00:23:45.540 FBI Director James Comey, a man who we read in the news today may be facing prosecution for her lies about this very event.

00:24:02.980 Only because of the courage and the precision of Tulsi Gabbard do we now know that there was, in fact, a cabal and the Russian collusion narrative is a total hoax.
