The ATF has a deadline of May 31st to register a weak gun with stabilizing brace on it, or face up to 10 years in prison and thousands of dollars in fines. Gun owners who have weak guns to register with the ATF have a chance to get out of the ban without paying the $200 per weapon fee. Will they comply? Or will they continue to fine people who don't register? In this episode, we talk to a gun expert, an ATF pistol brace expert, a suppressor maker, and someone who lives in the business to give you all the info you need to know about the ATF Pistol Braced Rule and the insanity that's going on in the gun industry. We also talk about the pros and cons of compliance with the law, and which side of the fence you should go on, and why you should comply or not. If you're on the fence about whether or not to comply, this episode is a must listen! Thanks for listening and share this episode with your fellow gun enthusiast friends and family! Don't forget to subscribe and share it on your social media so you don't miss the next episode! . . . . I'm not advocating for going along with this, but I understand that I also understand that some purists don't like the idea of this. I don't get a pass on these things, and I know there's a lot of reasons why they shouldn't be doing things the way we do these things. Remember, we should be doing these things the right way, and that we should do them the way. We're all in this way more than we do them. - Hunter Biden - and we should all be doing them the best we can do it the way they can do them right, not the best way possible, right here in this episode - not the way that we can. Thank you for listening to the best of our ability to do the best, right? . Thank you all for listening, and supporting us, and we appreciate the support we can get the most out of this episode. Peace out! - Timestamps xoxo, John Rocha - John Rotherday - P.S. - The Gun Control Guy - - Jason Vincent - Timestamp: 0:00:00 - 5:00- 6:00 - Andrew Clyde: 6:30- 8:30 - George Armstrong: 7:30 8:15- 9:15 - 9:00 | 11:40 - 12:40 13:15 14:30 | 15:15 | 16:40 | 17:20 | 14:00 & 15:00 // 16:00 +16:30 // 17:00 / 16:30 +17:00 ? 18:00 @ 17 :00
00:00:33.000you Thanks for tuning in. Tonight, we're going to do something a little bit different.
00:00:39.000Tonight, we're going to have a tutorial.
00:00:41.000Everything you need to know about the ATF pistol brace ban, some of the insanity that's going on around that, whether you choose to comply with the laws or not, and the pros and cons of that.
00:00:53.000We're going to be talking with Congressman Andrew Clyde of Georgia, a gun expert, a Class 3 owner himself, someone in the business.
00:01:01.000We're going to talk to my buddy George Armstrong, an ATF pistol brace band expert, someone who does this, another manufacturer of Class 3 weapons, full auto stuff, suppressors, someone who lives this world, has to comply, has to understand.
00:01:17.000We're literally going to go through the Form 1 that you got a weak gun to fill out before you can literally be in violation of federal law.
00:01:25.000Now, again, I'm not advocating for going along with this.
00:01:31.000I also understand that I am not Hunter Biden, okay?
00:01:35.000I will not get a pass on these things.
00:01:38.000So we'll also have my friend from Field Ethos, the outdoor publication that I publish and help create because I thought they were going too woke in even the hunting and outdoor space.
00:01:50.000Jason Vincent, former law enforcement, my partner in that deal, he'll probably take on the more cynical side of the issue, but the idea is to learn.
00:02:34.000I also understand that I've been on social media about a billion times shooting these things.
00:02:38.000They know I have it, and I would think...
00:02:41.000Given everything else we've seen, given every witch hunt, given all the nonsense they've thrown at me and my family, I have a feeling on June 1 they'd be knocking on my door.
00:02:49.000So for me, that's the choice I'll probably make.
00:02:53.000And I also have plenty of other stuff that they don't know about yet.
00:02:55.000And whatever list I'd be on because of this, I promise you, I've been on that list.
00:03:04.000So make sure you like, subscribe, and share this episode.
00:03:08.000Because I think you're going to learn a lot.
00:03:09.000For your friends who are on the fence, maybe they can figure out which way they want to go on this one.
00:03:15.000If they're not sure how they're filling it out.
00:03:17.000You know, this is your chance, as much as I don't like the idea of it, your chance to get in with the SBR stuff without having to pay the $200 per weapon fee.
00:03:27.000So we're going to take you all of this.
00:03:30.000Now, to me, this unconstitutional rule will turn millions of law-abiding gun owners into felons for merely possessing guns with stabilizing braces, okay?
00:03:43.000If you don't comply with the ATF. Now, bear in mind, the ATF made the rules.
00:03:49.000For these weapons. They designed them and now they're changing the rules that they made, putting millions of people into jeopardy.
00:03:58.000Gun owners who have stabilizing brace attachments on their firearms must register the device by May 31st.
00:04:05.000Or... Face up to 10 years in prison and thousands of dollars in fines, okay?
00:04:11.000Now, I get it. Many of you can go under the radar.
00:04:15.000Many of you aren't out there, you know, vocally 2A. Many of you aren't on hundreds of very public pages shooting these weapons like I am.
00:04:23.000So I get why you may not want to do it.
00:04:28.000I would have to serve out every last second of that ten years and every last dollar of the tens of thousands of dollars in fines on moment number one.
00:04:38.000If you've been watching for the last six years, you understand that.
00:04:43.000Don't hate on me for it, and I know I'll get plenty because there's the purists who I actually agree with who say we shouldn't be doing these things, we shouldn't do it, but I understand also why certain people would want to comply with the law, where the downside is not worth that risk, where people already know that you're shooting, where the reasons go on and on.
00:05:06.000Remember, folks, if you will, Hunter Biden broke gun laws, and nothing happened to him.
00:05:13.000Hopefully, Congress will do something about that.
00:05:15.000Again, that's why we're going to talk to Rep.
00:05:17.000Andrew Clyde about exactly what they're doing.
00:05:19.000But Hunter lied on a gun background check by claiming he isn't a drug addict.
00:05:24.000That carries a punishment of up to 10 years in prison as well.
00:05:27.000But nothing will happen to him because he is above the law.
00:05:31.000He doesn't own a stabilizing brace, and if he did, that would probably be fine.
00:05:36.000But I think any conservative, any vocal Second Amendment supporter, anyone out there...
00:05:42.000Who's, let's call it, on the conservative side of things, may not get the same treatment because there isn't equal justice under our laws.
00:05:51.000What will this rule accomplish other than punish Americans that don't like the Biden administration?
00:05:56.000Not much. Democrats aren't concerned about crime.
00:06:00.000They're concerned about finding ways to gut the Second Amendment.
00:06:06.000They want you to not be able to defend yourself.
00:06:08.000Just look at what they're trying to do around the country.
00:06:12.000Okay? Whether it's Daniel Perry and the prosecution of a good Samaritan, because they want to make sure that no one else jumps in when you, a loved one, is perhaps a victim.
00:06:36.000It's a shock to everyone, obviously, that the places with the strictest gun control laws also have the most amount of shootings, whether it's Philadelphia, whether it's Chicago, whether it's L.A., or all these other examples.
00:06:49.000Look at this headline, For Reason Magazine, quoting...
00:06:56.000Philadelphia's district attorney sees little value and much injustice in possession arrests.
00:07:03.000Really? Seems they'd be all about that if it was on the other side of the political spectrum.
00:07:11.000Democrats would rather politicize the issue and coddle criminals continually, again and again and again, than take the actual steps to make our city safer and give people the ability to defend themselves.
00:07:26.000The point of this pistol-stabilizing brace ban is to punish the people with them.
00:07:31.000They are largely America-loving patriots, not criminals.
00:07:36.000Unfortunately for them, though, crime is the priority under Joe Biden.
00:07:42.000Just not the crime that we'd normally care about.
00:07:44.000If you were breaking the law, that's the crime they care about.
00:07:47.000Even if you're a law-abiding citizen, even if you go about it right, even if you're just looking to defend yourselves and your freedom and your family...
00:08:11.000They want to do anything and everything they can to try and undermine the important Second Amendment rights we all love.
00:08:21.000And we're here to do a deep dive into everything you need to know.
00:08:24.000It's just one of the many reasons why dismantling the federal bureaucracy is so important.
00:08:30.000So much of the destructive Democrat agenda takes place inside the federal bureaucracy.
00:08:37.000And it's why 2024 is so important because the only real way to get meaningful change is to gut the federal bureaucracy and get rid of all of these left-wing bureaucrats.
00:08:48.000And we have Congressman Andrew Clyde from Georgia here in just moments to lay out how he's working to stop it.
00:08:55.000But first, I want to take a second and thank our great sponsors like Gold Co.
00:09:14.000And gold and silver can protect your retirement savings from inflation, dollar devaluation, and owning tangible, physical inflation-hedging gold and silver can help diversify your portfolio.
00:09:25.000So from precious metals to direct purchases of tangible gold and silver, gold codes help thousands of Americans.
00:09:31.000So support companies who support you instead of the woke companies that hate your guts.
00:09:57.000I want to make sure you know about them and where you can stock up on everything that you may need

00:10:45.000Spell out the junior, J-U-N-I-O-R.com to learn more and check it out.
00:10:50.000But just, hey guys, it's an insurance policy.
00:10:52.000Better to be prepared, but if you've been watching, you understand just how important that insurance policy is.
00:10:59.000And with that, guys, we're going to go to my friend, Congressman Andrew Clyde out of Georgia to talk a little bit about what's going on right here.
00:11:06.000Congressman, thank you so much for joining us.
00:11:09.000Well, Don, thank you so very much for inviting me on.
00:11:13.000And I love the name of your program, Triggered, because that's exactly what we're doing with the Democrats with my little pin here that I wear in my tie all the time, the little AR-15.
00:11:45.000So, you know, talk about this, because so many Republicans and Second Amendment advocates and believers You know, what can we do about this?
00:12:12.000I'll get into the details of that with my next guest, my buddy George from Battle Tested Equipment.
00:12:18.000Talk a little bit about what's going on, because I feel like so often the Republicans say, well, we have a couple guys fighting, but no one's really taking it seriously.
00:12:26.000They're going to walk all over and trample our rights.
00:12:28.000What's going on, and how do we push back on this?
00:12:32.000Well, thank you. Well, I'll tell you, it's a very, very serious thing.
00:12:36.000You've got the Second Amendment of the Constitution has a supremacy clause, shall not be infringed.
00:12:41.000And so we in Congress are responsible, our government is responsible for upholding the individual rights in the Bill of Rights in our Constitution for everyday citizens.
00:12:52.000And the Second Amendment just happens to be one of my favorite ones.
00:12:57.000Actually, after the First Amendment, it is the most important amendment, because the Second Amendment is the teeth behind the first.
00:13:04.000If we didn't have the second, we wouldn't have the first for very long.
00:13:07.000So I think it's so very important that we protect and defend the Second Amendment.
00:13:12.000And that was one of the things I promised my district when I came to Congress, that that would be a priority for me.
00:13:18.000So we're doing a number of things, three things actually that I can talk to you about.
00:13:23.000First, we can do it through legislation.
00:13:26.000The SHORT Act has been introduced already, and that means the SHORT stands for Stop Harassing Owners of Rifles Today.
00:13:35.000And what that piece of legislation would do Is it would eliminate short-billed rifles, short-billed shotguns, and AOWs from the National Firearms Act in 1934, because those are the more restricted weapons under the NFA. And if we can eliminate those three categories of weapons and we can make this This issue of pistol braces being reclassified, redefined as a short barrel rifle, we can make it completely go away.
00:14:03.000And we've got sponsors, many sponsors here in the House.
00:14:06.000We've got sponsors in the Senate for that bill as well.
00:14:09.000It has not moved yet, though, unlike the next piece of legislation I want to talk about, and that is a Congressional Review Act.
00:14:19.000You know, when the ATF wrote their pistol brace rule, they overreached Their authority in the government.
00:14:30.000I mean, you've got the three branches of government and ATF clearly did not stay within their branch, the executive branch.
00:14:38.000They wanted to become, I guess, legislators.
00:14:40.000They want to be members of Congress or something and write laws themselves.
00:14:45.000That is a clear violation of the separation of powers in the Constitution.
00:14:50.000And so, HJ Res 44 is the piece of legislation that can strike down this ATF rule and prevent the ATF from ever drafting another rule or a similar rule like it in the future.
00:15:15.000I've spoken with leadership already this week about bringing it to the floor before the 31st or by the 31st of May so we can send a strong signal, Don, to To the ATF and to the judicial system that Congress does not approve of this rule.
00:15:32.000And you got to remember, this is a rule that ATF has created.
00:15:41.000I mean, this is literally not not only is it a rule that ATF created, but it's something that they designed.
00:15:47.000And so they came up with something, and like all things, like the people who put together the New York Safe Act, all of a sudden the next day, police officers were literally felons for committing the crime of going to work with their duty pistol because the people writing the laws didn't even understand them themselves.
00:16:06.000They didn't know the difference between a trigger and a muzzle on a firearm, and yet they want to be the first to act, so we're going to check this box.
00:16:15.000But, you know, I think people do want to see some action.
00:16:19.000So, you know, if you have, you know, you don't have 218, so that means there's at least, you know, I guess you said, what, 198?
00:16:25.000So there's 20 Republicans that have not yet signed on to that legislation.
00:16:30.000Are there any Democrats that have signed on?
00:16:32.000Are there any Democrats that, you know, would possibly sign on to this to actually do this?
00:16:36.000Or is this just totally, you know, partisan at this point?
00:16:40.000I think that's something that people do need to understand, which is that You know, the reality is that while we have the House, we barely have the House.
00:16:49.000While we have the House, there's plenty of weak Republicans there.
00:16:53.000And so, you know, I don't know that we can actually pass actual legislation.
00:16:57.000How do we have some teeth behind this so that people see that something's actually getting done?
00:17:21.000And this was designed for disabled veterans.
00:17:25.000That was the whole point of this thing.
00:17:27.000So H.J. Res 44 is truly, it's a government overreach piece of legislation, and it's a piece of legislation that protects and cares for our disabled veterans.
00:17:40.000You know, we have a duty in the government to To take care of those who have sacrificed for our nation, especially those that have gotten the Purple Heart, that have lost a limb or something like that.
00:17:55.000I mean, it's egregious that we don't put those people at the very top of our priorities.
00:18:02.000And the ATF is definitely not doing that.
00:18:05.000And so this particular bill is much more a veterans, a disabled veterans bill and a government overreach bill than it is a gun bill.
00:18:12.000So I think we have a great opportunity and a great Potential to pass this bill either late this week or early next week before the 31st, before the ATF rule actually goes into effect.
00:18:27.000Right now, it still has to pass the Senate, and we have great co-sponsors over there, Senator Marshall and Senator Kennedy, and they have a significant amount of support.
00:18:36.000Don't know exactly where it would go in the Senate, and I really don't know that President Biden would actually sign it.
00:18:42.000So it's a potential to do, but there's really a third area that Congress can work on.
00:18:52.000And this is, I think, the most powerful and the most important.
00:18:55.000And that's through the appropriations process.
00:18:58.000And I'm very thankful that I am on the appropriations subcommittee that actually deals and has a vote on the budget of the Bureau of Alcohol, Tobacco, and Firearms.
00:19:08.000Imagine that. Imagine a federal firearms licensee who has a say in what the DOJ and the FBI and the ATF's budget actually will be for 2024.
00:19:19.000And so we are going to do what is called, and I've already submitted it to our subcommittee, a limitation amendment which will basically say that no money may be spent on either On implementing or enforcing this ATF rule.
00:19:37.000Now, it won't go into effect until FY24 begins, which would be October 1st, all right?
00:19:44.000So any prosecution of people, I think we can eliminate after October the 1st.
00:19:51.000But we will send a strong message to the court system, and there's a number of court cases out there already, that Congress does not approve of this ATF rule.
00:20:00.000Yeah, I mean, I think, you know, that's the problem.
00:20:02.000You know, again, not controlling the Senate, not having, you know, enough of a majority to overrule a veto by Joe Biden.
00:20:10.000Like, that's the reality, unfortunately.
00:20:14.000You know, are you aware of any of the gun groups out there doing anything to, you know, challenge this legally or, you know, take it to the Supreme Court?
00:20:22.000You sort of, you know, you hear a lot of noise, but who are the people actually doing anything from that perspective outside of Congress?
00:20:30.000Oh, there are a number of them out there that are doing that.
00:20:32.000I know gun owners of America are doing it.
00:20:34.000I know that you've got National Association of Gun Rights is in that space as well.
00:20:43.000I think there's also a few state organizations that are in that space.
00:20:47.000I believe, from what I remember, there's about eight lawsuits right now that are Are moving forward on it.
00:20:57.000So this thing I don't think will stand.
00:21:04.000Although, like you said earlier, this rule is still treated as if it was a law.
00:21:11.000And so people do have to take it very, very seriously.
00:21:14.000And I'm really glad that what you're going to be doing in the next part of the program Is going through the actual Form 1 paperwork that's going to be required for folks if they want to register their pistol-braced firearm as a short-barreled rifle.
00:21:32.000Yeah, I mean, I think, you know, again, for me, I know that there's gonna be people giving me all sorts of hell for even, you know, talking about the possibility of doing it.
00:21:40.000I also know, based on, I don't know, seven years of experience and millions and millions and millions of dollars in legal fees, that again, I won't be treated like Hunter Biden.
00:22:13.000Weak people in courts are going to allow something to happen.
00:22:16.000The injunction efforts hopefully prevail, because I want to make clear, I'm not a fan
00:22:20.000of any of these things, but I also understand the consequences to people on our side.
00:22:25.000I understand that we don't have equal justice under the law.
00:22:28.000Talk about just how severe these consequences are to everyday gun owners.
00:22:33.000I know from your perspective as a Class 3 owner, as a dealer yourself, you know that if you get one of these things wrong, You know, these are not minor consequences.
00:22:45.000We're not getting the Hunter Biden treatment where he can fill out, you know, lying on a form and then throw a handgun in a garbage can outside of a high school.
00:23:14.000So people do have to take this rule very seriously.
00:23:19.000Whether you want to have a short-barreled rifle or not, whether you want to remove the pistol brace, In fact, when Director Dettelbach was in front of the Judiciary Committee here in Congress and Congressman Massey was questioning him about, you know, what were the consequences and what could people do?
00:23:38.000You know, Dettelbach said that, well, you just take the brace.
00:23:42.000If you don't want to register, you don't want to register.
00:23:43.000You don't want to destroy it. You don't want to turn it in.
00:23:45.000You know, just take the brace off of it.
00:23:47.000And then Congressman Massey asked, well, what about, you know, constructive prosecution?
00:23:51.000If you have the brace and you have the pistol and the two of them not together, but, you know, in the same household, can you be prosecuted for that?
00:24:00.000And Dettelbach said, no, but yeah, I think ATF came out just a day or two ago and said, hey, you actually have to Destroy the brace, all right, for it not to be, you know, a constructive prosecution.
00:24:14.000And, of course, there would be those that ATF would completely overlook because there is a two-tiered system of justice.
00:24:25.000Yeah, and for those of you guys watching, for those watching, I'm going to go through right after the congressman has to go to some votes in a few minutes.
00:24:33.000We're going to go through literally every machination of this, how to do it, how to turn it back into a pistol if you want it to be that, how to go full SPR if that's the way you want to do it.
00:24:43.000You have this window, you can do it for free, but it's got to be done by May 31st.
00:24:47.000If you don't do that, it's over as far as they're concerned.
00:24:51.000That doesn't mean it doesn't get hopefully overturned later on.
00:24:56.000But we don't know and we understand that we're not dealing with a legal system that's actually in our favor or, you know, even has an understanding of what the word shall not be infringed actually means.
00:25:07.000So, you know, Congressman, before you have to go to your votes, what else can you tell us about Joe Biden's ATF? How big a threat are they to our gun rights?
00:25:18.000Well, I can tell you that their budget, they want to increase their budget by literally $200 million from $1.5 billion to $1.7 and a half.
00:25:43.000The way we stop it is we take away their money.
00:25:46.000Money in Washington, D.C. is power, and the way we reduce their power is we reduce their budget.
00:25:52.000And as you have seen with the FBI here lately that has simply overreached their authority, whether it's the Durham report that exonerated your dad, Or whether it was, you know, the overreach in the prosecutions of Mark Houck, etc. You know, it's on the Justice Department, the ATF, the FBI are simply on steroids here, creating this two-step.
00:26:35.000And the way we do it is we cut their funding.
00:26:37.000The only thing they understand is money.
00:26:39.000Okay, so, you know, you're on appropriations.
00:26:42.000I know you're 100% on board with that.
00:26:44.000Are there Republicans on there that are gonna go weak because they get a little pressure from the Democrats to allow this to go through?
00:26:51.000Are there Democrats that we can actually win over because they're in, perhaps, a red state or a state that actually believes in the Second Amendment, generally speaking, you know, or across the board?
00:27:01.000You know, how do we make sure we apply as much pressure as we possibly can To make sure that people understand what we're fighting for here.
00:27:13.000It won't be more than that. But I'm pretty confident that we'll get the vast majority of the Republicans, that we will get enough Republicans, especially on this one.
00:27:21.000You know, with what we've seen from the FBI and the Department of Justice and ATF as part of the Department of Justice, from what we have seen, their tremendous overreach is so egregious.
00:27:31.000That the only solution is going to be cutting their budget, and that has to happen.
00:27:36.000I've spoken to many, many folks on the Appropes Committee, and they're of the same mindset that I am.
00:27:41.000They might not be quite as passionate about it as I am, but I think they're going to be in the boat with me, and we're going to get this done.
00:27:49.000We're going to get this done for the American people.
00:27:52.000And just let us know, or let me know, who isn't playing along with some of this stuff, because I want to make sure that everyone is aware of that when they're out there and they're fundraising, because this is a huge one.
00:28:07.000And again, because The law was designed by the same people who are now trying to make you a felon for following the rules that they created.
00:28:15.000And if we don't see the hypocrisy in that, if we don't see the danger in that, if, honestly, if people are still dumb enough to believe that agencies like the ATF or the FBI, after everything we've literally found out, even in the last week, if you're still dumb enough to believe that they are going to do things, you know, in a nice partisan fashion, like, you haven't been watching You probably deserve to lose your rights because you're an idiot.
00:28:42.000And, you know, that's a scary, scary thing.
00:28:45.000So I understand that you have some votes.
00:29:46.000This is the form you need to fill in from the ATF. We actually went through this, and honestly, the precipice for this show and why we're doing them, and this is a little different than what I'm normally doing, and it's almost, at this point, this one's going to be part of a tutorial.
00:30:01.000For those of us, Jason Vincent, my partner in Field Ethos, if those of you who follow me on social will probably see me posting about it.
00:30:07.000It's my sort of outdoor magazine, and he's former law enforcement in a talk about the pros and cons.
00:30:13.000And again, we totally understand why people wouldn't do it.
00:30:15.000Save your hate. For me even talking about it, the reality is I know I'd be going to jail for 10 years, and it's a little different.
00:30:23.000So you can choose for yourself, but for me, I mean, I filled out the form for literally,
00:30:31.000I can only probably hundreds of times.
00:30:34.000The Form 1, which is what this would be, allows you to, you know, I guess...
00:30:39.000What a Form 1 is basically, 5320.1 is a technical term.
00:30:42.000It's called a Form 1. That's the application to manufacture a firearm.
00:30:47.000What manufacture means is you buy it as a pistol, which in this case, as a manufacturer, we were allowed to build guns with barrels shorter than 16 inches and attach these arm braces to them.
00:30:59.000That essentially kept this thing as a pistol.
00:31:02.000Now, the Form 1 allows you to take that pistol and register it as a short barrel rifle.
00:31:08.000We're going to use the term SBR, which is short barrel rifle.
00:31:10.000And it allows you to do that, and that's basically when we talk about being in compliance, that's what you're going to do with a Form 1.
00:31:17.000And we'll walk you through those steps today and kind of show you, you know, if you want to keep it as a pistol, what you have to do to remain compliant.
00:31:23.000If you want to go the SBR route, We'll show you the benefits of that, what you have to do to that.
00:31:29.000We can show you how to fill out the Form 1.
00:31:32.000With guys like you and I, I mean, as much as we'd love to take the stand and say, you know what, this is where we're going to draw the line in the sand, I'm in the business, machine gun collector, manufacturer, you're a high profile guy, big, you know, big gun guy, hunter, shooter.
00:31:43.000We obviously have to err on the side of caution and follow the law.
00:31:47.000Yeah, I mean, I'm on an SOT. I have suppressors.
00:31:53.000Plus, I'm probably on thousands of social media posts shooting stuff like this.
00:31:58.000So, yeah, it's not a stretch to say, if they're using the FBI's HRT, the hostage rescue team, to do a search warrant on Mar-a-Lago, I'm probably getting a visit.
00:32:08.000And so, for me, that's a personal choice.
00:32:16.000It just means, you know, hey, I'm not going to jail for this knowing that I'm the first person that they'd love to make an example of if they can.
00:32:23.000You know, you've had conversations with people at the ATF. Absolutely.
00:32:27.000Hate me for even talking about these things, for even shooting with you and taking my kids out, shooting full auto with you out in Arizona.
00:33:00.000It's a little bit different than the standard.223, you know,.556, depending on which way you want to look at it.
00:33:05.000But this is, you know, a go-to for me.
00:33:08.000This is sort of my under-the-bed, and this is my truck gun, because it's even a little bit smaller and can fit in a backpack.
00:33:12.000Absolutely, same as me. So talk about the differences in even then because, again, as many times as I filled out the Form 4, going through the Form 1, I'm like, oh, that's weird.
00:33:20.000There's so many little things I could have made a mistake.
00:33:23.000There's so many things that aren't quite that clear.
00:33:26.000If you read the Form 1 cover to cover, it's 13 pages, and it might as well be written in Greek because I literally remember the first one I ever filled out.
00:33:34.000We're talking 20-something years ago, and they've changed since then.
00:33:37.000As a manufacturer we have to remain fluid even since the introduction of the pistol brace ruling.
00:33:44.000We've had to remain fluid because in the beginning they told us we had X amount of days to liquidate all of our inventory that had pistol braces on it.
00:33:50.000The very next day we got an email that says you can no longer sell that configuration so we were literally stuck with all these Inventory that we had to get compliant.
00:33:56.000We couldn't move it. So we had to remain fluid.
00:33:59.000But when you read these forms, like I said, they might as well be written in Greek.
00:34:02.000So what we want to do today is walk you through and kind of show you, interpret some of that stuff.
00:34:21.000In order to measure the barrel length, we have to actually Essentially put the gun into battery, which we never do because we're safe gun people.
00:34:27.000And by the way, just, hey guys, all of these have been opened, cleaned.
00:34:30.000This one, because it's a folder, you actually can't open the chamber, you know, when it's in the folded position, so it's been cleared and all that stuff, because I know there's going to be someone in there, oh my god, muzzled is a triple!
00:35:01.000Yeah, this is for under 16 inches, pistol braced.
00:35:05.000The law states that it's measured from the breech face, which is the bolt face, to the end of the muzzle threads, if this can be removed.
00:35:11.000So if we spun this off, there would be threads that would stop right here.
00:35:14.000Yeah. So what I do is I take a wooden dowel, Drop it in there, and then I take my pen, and I'll actually mark it where it ends, which is going to be right here, and then I will pull that out and measure from this point to this point, and that is literally the value that's going to go in on the barrel length section of the Form 1.
00:35:34.000Now, if the muzzle brake for some of those who live maybe in the People's Republic of New York where you can't, I guess prior to the SAFE Bullshit Act, If the muzzle brake is pinned, that's different, because that then adds that extra length to the barrel.
00:35:50.000Because I had a couple of guns like that where, I know you make a tanker, and I know I have one.
00:35:54.000I was like, hey George, it's less than 16 to the brake, but if you include the brake, it's probably 17, 17 and a half inches.
00:36:01.000But because it's pinned, it's actually okay, and it doesn't apply to this.
00:36:20.000It's welded. I leave my welds obvious.
00:36:21.000You'll notice it on the bottom of the tanker so they know that it's pinned and welded.
00:36:23.000Once you do that, that becomes part of the overall length of the barrel.
00:36:26.000So we would be measuring from the breech face to that point.
00:36:29.000Now on a gun that has a 14.5 inch barrel, you can pin and weld a flash hider on it, have it professionally done, and then you don't have to file a Form 1.
00:36:37.000And by the way, for those of you who don't want to fill in anything, if you have something like that that's pushing those boundaries, you can do that, and then all of a sudden you're in compliance.
00:36:45.000Now, theoretically, you're breaking the law from May 31st to when you actually get that done.
00:36:50.000I imagine no one's coming to look for you, so it's a way to get legal, even if you're perhaps...
00:36:55.000Semi-legal or illegal for, you know, the amount of time that it takes you to do that.
00:37:00.000But it saves you having to even think about this if that's something you're willing to do.
00:37:05.000Any competent gunsmith can do it in about, you know, five minutes.
00:37:09.000Absolutely. And another option as well, say you have an 8-inch barrel 9mm and you have an extra 9mm silencer laying around, you pin and weld that to the barrel, that becomes part of the barrel.
00:37:18.000You obviously already have your tack stamp on the suppressor and then you don't have to worry about SBR and it becomes a one-stamp gun.
00:37:23.000So you don't have to fill out the form on it.
00:37:25.000So that's something to think about as well.
00:37:27.000Now I'm going to put this gun, I'm going to lock the bolt back because what I want to go over next is I want to actually go over the overall length.
00:37:32.000And that's going to be another question. That's the next question on the form is the overall length of the weapon.
00:37:36.000And that, there's so many different, if you go down the Google rabbit hole, there are so many different answers you can get for this.
00:37:43.000But the proper way as defined by the National Firearms Act of 1934 is you remove the buttstock, And you'll literally measure from the end of the barrel, which we now know is the muzzle and the threads, to the end of the buffer tube.
00:38:00.000The exception to that is if you have a folder, like your Mark V folder over there, you'll actually measure that overall length.
00:38:06.000So that's a little different. You'll measure that from in the folded position, from the rear of the receiver to the threads on that guy.
00:38:14.000So that's the difference between the two, and that's why we have these two different specimens out here, so we can show you how to properly measure either way.
00:38:21.000It's one of those things where I don't know if the ATF would even know that that gun's a folder.
00:38:25.000I don't know if they would know that you got it wrong, but it's one of those things when they come knocking or they see you at the range or they see this, you want to have all of this perfect because it's one of those things that you don't want to be caught with your pants down.
00:38:35.000Okay, so the way to do nothing about this.
00:38:37.000If I wanted to do nothing about it and just be compliant as an AR pistol, what is it that I need to do?
00:39:01.000Simply by doing that, this gun is now a pistol.
00:39:04.000However, as a pistol, you have to refrain from doing certain things.
00:39:09.000One of the things you cannot do as a pistol is use a vertical grip.
00:39:12.000You cannot put a vertical grip on it as to where if you did a Form 1 and SBR'd it, you can do a vertical grip.
00:39:16.000So if you Form 1 it, you can put the vertical grip on it.
00:39:19.000You're basically Theoretically, as much as we don't like it, but this is sort of a one-time, and again, before May 31st, it's free.
00:39:27.000You can waive the tax stamp, the $200 thing.
00:39:31.000So if you go the SBR route, you can have that vertical pistol grip.
00:39:35.000You basically can do anything. No, just to make sure everybody's...
00:39:37.000Once you receive the approved form back, you can go that route.
00:39:41.000And you can also put a buttstock on it.
00:39:42.000So you can go buttstock, vertical grip.
00:39:44.000You essentially lift the restrictions or limitations on that weapon as far as barrel length are concerned.
00:39:48.000Of modification. The irony of the whole thing is, now if we look back at the NFA Act of 1934, that was drawn up for pistols, to ban pistols, okay?
00:39:58.000The SBRs and SPSs, SPS is a term for short barrel shotgun, the SBR, short barrel rifle, those were added to that for the sole purpose of preventing the circumvention of the pistol part of that ban.
00:40:09.000Now here's the irony. The pistol was removed from that ban before it was actually published.
00:40:14.000So the pistols weren't regulated under that act.
00:40:16.000They actually slipped the SBR and the SBS on it, so you couldn't circumvent the pistol act of it, and then they removed the pistol from the actual law.
00:40:23.000So if you read up on the 1934 NFA Act, it's going to blow your mind.
00:40:28.000Interesting. So let's go through the form for those of us, because again, this is something that was sort of interesting.
00:40:34.000You can go through the form, but there's a couple things you need.
00:40:36.000What I noticed, because you're not just sending And it's two copies of this to the ATF, okay?
00:40:43.000So whatever package you're putting, and we'll talk about how to even mail that so you can get it in, but you're gonna fill out two forms of this.
00:40:49.000So you need two passport photos with that, but then you also need a third copy, okay, that you're gonna send to your local sheriff's office.
00:40:55.000Yep, your Clio. Cleo, so look up who your sheriff is, you put it, and you're not asking for permission in that process.
00:41:02.000That was the interesting thing that you said.
00:41:22.000There's actually fingerprint outlets all over.
00:41:24.000There's literally Google fingerprints.
00:41:28.000It's the same form you use for a federal background track, your CCW permit.
00:41:33.000So tell them it's just for NFA purposes.
00:41:36.000But again, you need two of those sheets.
00:41:37.000You can do it. I did it in about half an hour.
00:41:39.000If you're one of those gun nuts that has, you know, say like 15 or 20 SBRs you have to register, you only need the pair of fingerprint cards if you send it in the same packet, but each form still has to have the 2x2 photo.
00:41:50.000Correct, yeah, like I got, let's call it, you know, dozen plus in my package, but yes, it was only two fingerprint ID cards, and those don't need to go to your local law enforcement.
00:41:58.000No, they do not. Those actually go right to the ATF, yeah.
00:42:01.000Make a fourth copy for yourselves, guys.
00:42:02.000You don't need the extra, obviously, passport photos, but make an extra copy because while it's in process of the form itself, both sides, print it on both sides because if you have that form and that copy, that's basically your license that you're in process because I imagine the ATF's going to be flooded with this.
00:42:20.000I imagine we're not going to be seeing anything in return anytime soon.
00:43:04.000A couple of the things I want to go through on the form itself.
00:43:05.000Yeah, talk about the form a little bit.
00:43:07.000I know you have this up on your website as well, right?
00:43:09.000Yeah, so what I did is I actually put on the BTEUSA Instagram, so it's at BTEUSA, in the bio, there's a link right to the ATF website to the exact form you have to fill out.
00:43:20.000It's a 5320.1 or Form 1, and you can fill it out.
00:43:23.000What I do is I download it to my computer as a PDF, and I'll go through and fill out all the information, then I'll go through and change the make model serial number and then print it, you know, my forecast.
00:43:31.000Especially if you're doing a bunch of these like George and I were, by doing that, saving the PDF, you can leave all of your information basically the same and change, you know, I have a bunch of George's guns, so I literally had to change serial number and...
00:43:47.000Serial number, because it was basically a lot of duplicative guns, etc.
00:43:53.000But by saving it there, you don't have to fill out your information each and every time.
00:43:57.000You sort of fill it out once, save it, and then you can go through and just change the things.
00:44:02.000You also have to sort of delete out in the PDF. They literally put a cross through your signature area on there.
00:44:07.000Both front and back. You're going to sign this thing actually in two places.
00:44:10.000You're going to sign as the applicant, and then name and title of authorized official is going to be you because you're the applicant.
00:44:15.000You're going to date it for the day you submit it.
00:44:17.000And on the back, signature of maker, because you're making this from a pistol into an SBR, you sign it there as well.
00:44:23.000Yeah, so signature maker, I mean, yeah, you've got to remember, you're actually the maker of this now when you're going through this process.
00:44:29.000And if you don't do that, that's going to be a reason they kick you back.
00:44:32.000They will definitely kick you back. Who knows if they'll let you in.
00:44:33.000So when you have one week, again, there's some nuance.
00:45:58.000Let's go through from the very beginning.
00:46:01.000The very first thing at the top, it says, gives you an address, PO Box 53015 Portland, Oregon.
00:46:07.000That's where you're going to mail your packet to the ATF. And how do you want to mail it?
00:46:10.000You said, send it priority so that you have something, but don't send it with a signature because they won't sign it and you'll get kicked back to it.
00:46:41.000No, and that's another thing here I want to go over.
00:46:44.000Starting on the forum, and I don't know if you're going to even see that, but if you guys pull them up on the site, it's going to ask you, question number two, it's going to ask you what type of entity is actually asking for permission to do this.
00:46:54.000And you're going to check, unless you have a corporation or a trust, you're going to check individual, because you are an individual.
00:46:59.000And you're going to go through literally to the next question, trade name.
00:47:02.000You're not going to have that as an individual.
00:47:32.000Because when I send these in, and I mean, if I were a gun nut, I would probably have hundreds of tax stamps.
00:47:37.000And I would send in a $200 check with them.
00:47:39.000And you would check the tax paid portion and send the check.
00:47:42.000Now, when you do this on the e-file, they automatically divert until the 31st to the tax exempt option.
00:47:48.000So you will check the tax exempt option.
00:47:50.000So that's box C. That's box C. And you will not send in...
00:47:54.000A check. Now, here's where it gets interesting.
00:47:56.000We've had some come back recently where they, normally when you pay the money and you get this back, they literally, they put a lick and stick tax stamp on here with the serial number on it.
00:48:03.000So you actually feel like you're getting something for your money.
00:48:06.000I'm getting represented by this tax stamp.
00:48:07.000We've had some come back where they didn't give us a stamp, but they approved them.
00:48:11.000And they said, well, you didn't pay the $200, but we approved them.
00:48:13.000So you got your approved form. Basically, what more do you need?
00:48:15.000And it's like, hey, if that's what I need to be compliant, listen, I got bigger fish to fry, right?
00:48:19.000So that's the box you check to be taxed.
00:48:21.000So see, for the guys going through this process, if it's, you know, Yes.
00:48:25.000In by the 31st, turning a pistol-braced firearm into an SBR, you can do that.
00:48:41.000But there's places that you wouldn't be able to do that because they've already banned them regardless of what the federal law is, the state law.
00:48:48.000I'm going to say it again just for redundancy here.
00:48:50.000You will not put a buttstock or vertical grip on this until you've received your approved format.
00:48:57.000Correct. Because at that point you'd be in violation.
00:48:59.000So if we're going down the list here, name and address of original manufacturer.
00:49:03.000That's easy for us. It's going to be battle-tested equipment.
00:49:06.000So what you do here, you don't have to put the full address.
00:49:08.000You actually put BTE USA Manufacturing, Phoenix, Arizona.
00:49:52.000It's going to ask you the model. This one's going to be the Sub-9 because it takes the Glock magazines.
00:49:56.000Barrel length, we showed you how to measure that, and you're going to be very accurate with that because you're going to go to Walmart or Hobby Bench or wherever and buy your wooden dowels and you're going to be spot on.
00:50:04.000Your overall length, we showed you how to measure that on both a folder and non-folder model.
00:50:08.000Now this also works on like an AK-47 with a pistol brace.
00:50:12.000It's going to be, if it's a folder, it's in the folder configuration.
00:50:16.000Yeah, my buddy Jason Vincent is actually going to talk about some of that because the irony of some of this is there are configurations of just full rifles that actually end up still being shorter than some of these.
00:50:26.000The folders, you know, some of the bullpup stuff, so I'll talk about that guys in a little bit so you can see the nuance and the differences.
00:50:32.000Then of course you jump right to serial number, that's easy.
00:50:35.000Just write out the full serial number as it appears on the gun.
00:50:38.000When you go to this next box, this is one that was really never messed with before and they're starting to crack down on it.
00:50:44.000You're going to go to, it says additional description.
00:50:46.000Now what this box is for and What you'll do is you'll actually take your name, and they say name and address, so you'll take your name and the city, state, and zip that you live, and you'll write that in there.
00:51:13.000Name your full name as it appears up here, and your address.
00:51:16.000I mean, city, state, zip right there, and then get your gun engraved with that.
00:51:20.000That information on the gun and you're in full compliance.
00:51:22.000When it comes to the engraving, I know theoretically it's there, but you don't know anyone that's ever done this and no one's ever checked.
00:51:31.000I would hate to be the guy when they kicked in the door if that's what they're taking you to prison for.
00:52:25.000That's not the one you want to be a smartass on.
00:52:26.000This next box here, Jay, a lot of people miss this because it says type of destructive device.
00:52:32.000We're not dealing with a destructive device.
00:52:34.000That is irrelevant to what we're talking about, so you will literally skip over question J. It's neither a firearm, because a destructive device, I guess, in that case would be a short barrel shotgun.
00:52:51.000So, but yeah, so J, you can just ignore for the purposes of this.
00:52:55.000Now K, this is going to ask you, is this firearm being reactivated?
00:52:58.000Now we're going to check no on that because what that means is a gun that was once full auto or registered and we're re-registering or reactivating.
00:53:05.000You will never run into that unless you're a manufacturer.
00:53:07.000So J and K, you can skip. Well, you actually have to check no.
00:53:17.000Unless you have one, but yeah, you know. You wouldn't put it in there even if you did, because this is going in your personal.
00:53:21.000If you put it in your business, then you would do that.
00:53:23.000But at that point, why would you do it?
00:53:24.000Because you have a business. We're putting your SOT. So you're going to jump to signature of applicant.
00:53:28.000You're going to print your name here on 8.
00:53:30.000You're going to sign here. You're going to put today's date.
00:53:32.000And in the PDF, by the way, when you pull it up, it actually has it crossed out, so you can't do it.
00:53:36.000So you've got to just select it and undo it in the PDF form.
00:53:39.000But to make it pretty easy, again, it's on the BTE USA. Go to their Instagram, check it out.
00:53:44.000You can literally pull up the form, you'll see it.
00:53:46.000But you can see why so much of this is repetitive, basically other than, you know, make, manufacture, serial number, barrel length, and overall length.
00:53:55.000The rest of it's basically the same for you.
00:53:56.000So if you're doing a dozen of these, like someone I may know intimately, allegedly or more, you know, it's actually, you're literally changing this area here.
00:54:08.000So save the original form on your desktop, use that, and print your copies from there.
00:54:13.000So you'll skip. Once you sign and date the front page, you're done.
00:54:16.000This is actually for the ATF. You'll flip it over to the next page.
00:54:19.000Now this is where it gets kind of tricky.
00:54:21.000So you're actually going to have to look up.
00:54:22.000This... Question 10 is your acknowledgement that you're going to notify your CLIO, your local sheriff, your chief law enforcement officer of your county.
00:54:48.000Two With two pictures, you know, is going to the ATF. If you put them all in one package together, it's just the two sets of fingerprint cards.
00:54:57.000If you're doing individual packets, then you're going to have to get a lot more fingerprint cards.
00:55:00.000So just do it all at once. Do it all at once.
00:55:02.000And then you're sending one copy of this to your local sheriff's department just with the photo.
00:55:08.000And the fourth copy is literally for your own records.
00:55:11.000That's your receipt. So you'll put the agency or name, so in your case it'll be, let's just say you lived in Palm Beach County, let's just say PBSO, Palm Beach County Sheriff's Office, and then the actual name of your sheriff and then their address.
00:55:25.000That's all you do there. And then you're going to jump in.
00:55:27.000This is going to simulate a.4473 like you're buying a gun.
00:55:29.000It's going to ask you questions like, are you a felon?
00:55:33.000Are you illegal in this country? Have you renounced your citizenship?
00:55:35.000Do you kick your dog? You know, all these things.
00:55:37.000This is stuff you want to read and answer honestly.
00:55:40.000You're going to go through this little box here is where you actually attach your photo.
00:55:43.000Now, what you do with the photo, you write your full name and the last four of your social security number on it, and then you stick it with a piece of tape.
00:55:50.000Literally, just put a little tape, overloop it, you know what I mean, and stick it there.
00:55:53.000Again, times two to the 80th, times one Absolutely.
00:56:11.000Put it this way, the guy at CVS, when I was like, I need 60 passport photos, he's like, really?
00:56:17.000He had not seen anything quite like that.
00:56:19.000That was interesting. You'll go through, and it's going to ask you, it gets kind of, the only really tricky question here, if you're a U.S. citizen, there's a lot of stuff that's going to be not applicable to you.
00:56:30.000You'll just check NA. If it asks you, have you been issued, like this one asks you if you've been issued a UPIN, obviously if you don't know what that is, you're going to check no because you haven't been issued that.
00:56:40.000Ethnicity, you have to, this is split into two questions.
00:56:42.000They want to know if you're Hispanic or not, and then they want to know your race.
00:56:45.000So basically, are you Hispanic or not?
00:56:47.000And then pick a color is what they want you to do.
00:56:49.000They literally break it down like that.
00:56:51.000Below that, your country of citizenship.
00:56:53.000If you are a citizen of another country, you still can register.
00:57:10.000The signature. Even the date, you can do, again, on the PDF. But the signature on both front and back, again, you've got to sign as maker and you've got to sign as applicant on the front.
00:57:21.000So print them out, and then that's on each one of them, you've got to go through and sign each one.
00:57:26.000Two copies, again, to the ATF, one copy to your local sheriff's department, one for your files.
00:57:31.000I guess you don't need to save those, but it's probably nice to sign the receipt.
00:57:34.000It's good. That's good to have. And probably do it anyway.
00:57:36.000So you're going to do that times four just to be safe.
00:57:38.000Now, if you do this after May 31st, and you check the tax paid option, you're going to have to print the third page, and you only need two copies of this.
00:57:47.000What you'll do is, on this one, it asks you right down here.
00:57:53.000If you're doing a trust, which nobody does because it basically...
00:57:57.000That used to be a thing and now it doesn't really make much sense.
00:57:59.000Now it adds a year to your processing time.
00:58:00.000It's just not worth doing it. This is what you'd use for trust, but you actually check if you're going to pay the tax after May 31st, you would check how you're going to pay it.
00:58:07.000So mail in a check, which I always recommend because that's your receipt.
00:58:20.000You literally do the two copies, the two fingerprint cards, you do the passport photos on the back, you mail it, put your return address on it, send it, and like I said, just send it first class mail, put some tracking on it, and then...
00:58:32.000Page one's the only one that actually anything changes on.
00:58:35.000Again, so why it's so important to do that PDF method, save it, and then you're literally just going back and changing and reprinting.
00:58:40.000Change and reprint, because again, make, model, serial number, overall length, and barrel length are the only thing that's changing.
00:58:47.000So it's literally... If you're doing ten of these, just this little column changes.
00:58:51.000Everything else, you know, unless you've got stuff all over the place, is, you know, fixed.
00:58:57.000So it's actually pretty simple, but there's so many little things that you can do.
00:59:01.000The next thing, again, the two fingerprint cards going to the ATF at the address at the top of the form there in Oregon.
00:59:10.000But again, make sure, you know, if you put tracking on it, priority, but not tracking.
00:59:15.000Signature required, otherwise they're going to kick that back to you.
00:59:18.000Absolutely, they definitely will. So that's pretty much it for the Form 1.
00:59:22.000If you have any questions, like I said, you go back over the podcast.
00:59:24.000We've pretty much covered everything on there.
00:59:26.000As far as if you're going to go the non-registration pistol route, one thing I want to touch base on.
00:59:36.000And I'm going to grab this guy here, which is what's called an angled foregrip, because if you remain a pistol, the first thing you would do is obviously we're going to go through Show the world that we've cleared the weapon for the 150th time.
00:59:48.000We're going to pull the buttstock off, the arm brace off, and then what we have to do is we actually have to remove the buffer tube and replace it with a smooth tube.
00:59:56.000At that point, the only other device we can put on for a front grip is an angled foregrip and it cannot protrude below the magwell.
01:00:03.000So that's why you're limited to a handstop or an angled foregrip.
01:00:05.000If you put this vertical grip on here, even in the pistol configuration, You're in an NFA violation and it's 10 years and $10,000.
01:00:12.000Minor details. Which I'm sure they won't exercise that with discretion.
01:00:16.000If you can cook, you're popular in federal prison aid.
01:00:52.000No, but in all seriousness, George has been great.
01:00:54.000He gives to a lot of law enforcement and veterans, charities, as well as helping active duty guys.
01:01:00.000That's where Battle Tested actually came into effect.
01:01:03.000He always goes above and beyond with this stuff.
01:01:05.000And again, I don't know that neither of us are happy about what's going on with this, but we also understand he owns Full auto machine guns.
01:01:14.000He's class three. If he breaks one little, it's over.
01:01:18.000It's his entire business. Me, similar.
01:01:22.000I have these kinds of things. I'm on any list in the world.
01:01:27.000I just know that people are waiting for me to make an error.
01:01:31.000And as much as that sucks, it's the reality of the situation.
01:01:33.000That's not to say we're soft on this issue.
01:01:36.000I promise you, no one on this podcast, no one watching or that could be watching in the future has more vested, more guns than certainly you or I combined.
01:01:48.000But, you know, than us, but we're just trying to make sure that people understand how to stay within the law, even if we're not happy with that law, even if we think it's overreach, even if we think it's bullshit, which it is, you know, we also understand that we're the first people that are going to get a visit, and we're going to be made an example of it.
01:02:07.000There's nothing worth your freedom, you know what I'm saying?
01:02:09.000You fight, you know, your podcast, you fight the good fight every day, and I watch it, I'm a huge fan, I've told you that, I watch it every day.
01:02:14.000Yeah, George actually chimes in a lot to the Ask Me On Many things on Locals that I do afterwards.
01:02:20.000For those of you with questions, your subscribers there, he's going to stick around anyway.
01:02:26.000So if we have other questions about the details, I hope the rest of it's self-explanatory, showed you all the details how to do it, and we should be good to go.
01:03:06.000You know, on a subway trying to protect people.
01:03:08.000Everyone says he's a hero that was actually there, but he's gonna be charged with murder.
01:03:13.000You know, that's why he's, you know, they're trying to put us in a situation where people don't want to be good Samaritans, where they don't want to defend themselves.
01:03:22.000But guys, one day you, one of your loved ones, is going to be in a situation, and you're gonna hope...
01:03:28.000That someone has the balls to actually step up and be that good Samaritan.
01:03:33.000These leftist DAs, the Soros Fund, the Democrat, just policy in general, they want to eliminate that person.
01:03:40.000They want people just weak like sheep.
01:03:44.000And again, while we're talking about how to go about giving them this information, they probably have it already.
01:03:50.000And like I said, I'm on every list, which is why people have to make their own decisions with that.
01:03:54.000One of the things we have to keep in mind, too, this affects five to seven million Americans.
01:03:58.000That's five to seven million people we need to keep out of jail so they can vote for Donald Trump in 2024.
01:04:02.000That's the way I look at it. That's the way it has to go.
01:04:04.000Thank you very much, George. I appreciate it, buddy.
01:04:07.000Thank you. So, guys, now what we're going to do, we're going to bring in my buddy Jason Vincent.
01:04:13.000Former multiple agency law enforcement.
01:04:16.000He's a funny and witty guy who can discuss the amount of hate that I will get for even suggesting or talking about how to possibly stay within the laws.
01:04:28.000I can assure you Jason's seen at least a third of my gun collection and understands that I'm not a slouch on the Second Amendment.
01:04:39.000Yeah, I mean, honestly, I just started actually using Twitter for the first time in the last week.
01:04:45.000I had no idea how much bullshit you put up with every day on Twitter.
01:04:51.000If you think Twitter's bad, imagine what the ATF would do to me if I was in violation of some of these things.
01:04:58.000Again, I'm not saying it's for everyone, but I just want to make sure people have their options.
01:05:03.000Man, you're such a fun target for the ATF. But yeah, I mean, this whole thing, what it's about is turning guys like you and I into criminals.
01:05:39.000Really, the way that things are supposed to work and the way that things worked for Charlie and I, if there was a change that was going to come into play in how we did our job and how we enforced the law, It came through a legal update.
01:05:55.000And we got several legal updates a year.
01:05:57.000But legal updates were based off of court decisions that we then had to change how we operated.
01:06:04.000It was never an agency going, you know what, guys?
01:06:07.000We're just going to... Change how we do this, just for the hell of it.
01:06:11.000We're going to decide that we want to put these people in jail for no fucking reason.
01:06:15.000And so it has changed a lot for the guys that are working for the ATF. Yeah, listen, you heard me make that distinction.
01:06:23.000I mean, the distinction between sort of the bureaucrats at the top and the door kickers.
01:06:27.000I mean, I can't tell you the amount of FBI agents in the last few years that have come up to me.
01:06:31.000It's a disgrace what's going on, but they also, you know, they can't lose their job, their pension, their livelihood, their families, you know, because...
01:06:38.000They understand that they say something.
01:06:40.000They're gone. You saw the testimony last week.
01:06:42.000I mean, you know, well, you know, I said something and I was immediately blackballed and I was locked out of my files and sent to Guam to do it.
01:06:49.000I mean, they are going after the whistleblower.
01:06:52.000So, you know, we understand we're not blaming all of law enforcement.
01:06:56.000I do know from conversations with George in the past, I mean, you know, connections that...
01:07:01.000We've had... He has at ATF. Literally, people were using me as the example because months ago, I was out shooting with Spencer, with George, and we were shooting full autos in the desert, totally legal.
01:07:12.000He's got all the stuff. And I... The boss...
01:07:16.000Literally said, like, Donald Trump Jr.
01:07:20.000It's like, really? I'm the threat? Not like the, you know, people murdering people with illegal 400-year-old handguns in the streets of Chicago?
01:07:26.000No, no, I don't think I'm the actual threat.
01:07:28.000I don't know that any of my guns has ever just magically got up and shot someone.
01:07:33.000It just doesn't happen that way, but that doesn't matter because it's not about law.
01:07:37.000It's not about actually stopping the crime.
01:07:40.000It's about stopping people who have the ability to defend themselves from being able to do so.
01:07:49.000I mean, it has nothing to do with making the United States a safer place.
01:07:55.000Changing the restrictions on a pistol-braced firearm or an SBR, that does not make anything safer.
01:08:00.000As a matter of fact, I've got several examples of things that are legal and things that are going to be illegal if you don't update them by the end of the month.
01:08:08.000If you're cool with it, I'll go ahead and pull those things up and kind of show them off and explain the differences.
01:08:12.000That's it. So this is a legal firearm, okay?
01:08:21.000I heard you guys go through some of that.
01:08:22.000You know, based on what you've seen on social, Jason, you know that if there's something that's not that you, oh my god!
01:08:29.000You know, the outrage police, not to say that we shouldn't be safe, but the outrage police, they'll find something that they can bitch about.
01:08:37.000100%. But this gun has a side folding stock.
01:08:40.000You can see it right there. So basically the stock folds up on the side of the gun.
01:08:43.000You can actually still fire this gun while the stock is folded.
01:08:48.000This is going to be illegal next week.
01:08:52.000So you can see this gun here is actually longer than the legal gun, right?
01:08:58.000So we're talking about short barreled rifles, making this a short barreled rifle.
01:09:02.000This is a full length barreled rifle with a folding stock.
01:09:05.000But if you really were trying to conceal it, the one with the folding stock actually folds up and is smaller.
01:09:10.000There are a ton of examples out there like that.
01:09:14.000The ATF is picking and choosing what they're going to make illegal.
01:09:20.000The reality of it is, this is a perfect vehicle for them.
01:09:24.000Arbitrarily changing how they're going to enforce SBR regulations is a perfect way to attack a ton of legal gun owners at one time.
01:09:36.000There are 5 to 10 million braces out there.
01:09:39.000Does that mean there are 5 to 10 million consumers that actually own them?
01:09:43.000Probably not. People like me own multiple.
01:09:47.000But the reality of it is, is this is an arbitrary law change, or not even a law change, arbitrary rule interpretation that they're going to enforce and make us criminals.
01:10:00.000You know, I know, you know, you did a thing on, you know, Field Ethos, for those of you who, you know, are following me, or, you know, primarily on Instagram, I guess, because, you know, on Twitter, it's not even worth it, you know, sort of unapologetic men's adventure lifestyle brand publication, a lot of focus on Second Amendment, focus on hunting, fishing, the outdoors, that adventure lifestyle, and again, unapologetic, because even those things have gone woke.
01:10:22.000But you did a post last week talking about some of the intricacies that we talked about tonight.
01:10:29.000And again, there's some of those like, oh my God, I can't believe you said X, Y, Z.
01:10:53.000But if you were anywhere within a thousand miles of DC on January 6th,
01:10:56.000you were looked at or you may still be in jail.
01:10:59.000So we just want people to be clear in that.
01:11:02.000But the haters will say it's a total infringement, it's a disaster, which I agree with.
01:11:07.000But it's just part of that's the reality of what we have to deal with.
01:11:10.000And I want to make sure people understand that and can make informed decisions themselves.
01:11:16.000Sure. So what I did last week was I showed a video of me actually registering one of these firearms that's going to be affected as a short barreled rifle on the form one that you guys talked about.
01:11:31.000But there are processes online that make this thing really quick.
01:11:34.000You can e-file with the ATF. So I filmed a video showing, okay, I'm going to turn this pistol-braced firearm into a legal SBR. Am I doing that with all of them?
01:11:44.000Absolutely not. Andrew Clyde, who was on earlier, Congressman Clyde, he explained that there is going to be a gap.
01:11:51.000And when they start enforcing this illegal SBR, Illegal regulation.
01:11:57.000And when he feels like his supporters in Congress will be able to shut this down.
01:12:04.000So basically what I was saying was either take the pistol brace off of the firearm or you can do what I'm doing with several of these that I wanted to SBR anyways.
01:12:13.000And here's the process on how to do that.
01:12:26.000I think you should exercise whatever option you feel comfortable exercising.
01:12:30.000If you want to be a felon for a couple weeks, look, I've got no problem with that.
01:12:35.000But what we were saying is, if you don't want to be a felon during this gap, or, you know, however long it takes to correct this issue, Take the pistol brace off, leave it away from the gun.
01:12:47.000I think some people have said even destroy the pistol brace.
01:12:50.000Or you can go through a Form 1, the tax stamp $200 fee is waived right now, and you can turn it into a legal SBR. Now, here's the problem with having a legal SBR, and most people don't know this.
01:13:00.000If you actually do convert that gun, your pistol brace firearm, into a legal SBR, you can no longer travel outside of state lines with that firearm Is it ATF or local law enforcement?
01:13:27.000I believe it's ATF. And I asked an ATF agent about that, and he said, yes, this is ATF. You have to notify, but I don't know who you're supposed to notify.
01:13:36.000So he didn't know. Actually, George is sitting right here.
01:13:38.000Do you know this one? Because once it's registered and it's the SBR, to travel out of state with that gun, you have to notify.
01:14:05.000Yeah, basically. Basically the same people you're mailing the second copy of the form.
01:14:09.000If I'm coming to Palm Beach County, I'm going to let him know that I'm traveling to his county to hunt with a suppressor or a short bearer wife or whatever it is.
01:14:15.000Let them know ahead of time before you travel.
01:14:18.000You're just stating it. You're notifying them.
01:14:20.000Some counties have different terms you have to notify at X amount of days before.
01:14:25.000There may be some, I'm sure, probably in some of the more liberal areas where you actually have to get a response from them, get permission from them, but I've yet to run across that.
01:14:34.000So, listen, yeah, again, more nuance that we'll figure out, but, you know, it's an important thing, and I mean, you know, I imagine that's something that we want to think of.
01:14:44.000I've never—I've been to plenty of things.
01:14:46.000I've traveled with stuff like this all over the place, never been bothered, never been checked, never been—you know, but, again, that doesn't mean they won't start enforcement immediately, and I imagine they'll, you know, prosecute those very, very selectively, me being— I mean, there's so many just different things that you have to pay attention to regarding firearms laws from state to state.
01:15:11.000Hypothetically, I might have come to visit you in a state one time and accidentally had something in my truck, hypothetically, that I wasn't supposed to have, but it was completely okay here.
01:15:42.000If you don't want to be, you know, if you don't want to open yourself up to, you know, legal charges, that's the only thing you can do right now.
01:15:59.000Meaning if you're in transit, just like if I'm taking a gun on a plane, you know, when I'm going hunting somewhere, you can go in transit through without it.
01:16:06.000So it's really the destination. But I'm also seeing people do the, you know, register your gun so they can find you.
01:16:11.000It's like, again, For me, folks, I'm on a list.
01:16:15.000If you haven't been watching for the last six years, if you've commented on my podcast or anyone else's, you're probably on a list too.
01:16:24.000If you think that they're not already spying on you, you haven't been watching, you haven't seen the stuff that they've...
01:16:30.000You know, put out as it relates to the Patriot Act.
01:16:33.000You haven't seen the tens of thousands of people that they violated just this week where they were doing illegal sort of searches and whatever it may be on these things.
01:16:42.000You know, I don't think in this world of technology, unless you're literally totally off the grid, don't have a credit card because I know the banks told, you know, the FBI who charged anything.
01:16:53.000They offered it up. Bank of America certainly did it.
01:16:56.000They offered it up to the FBI. Well, these people were around D.C. that day.
01:17:27.000100%. But the reality is, what's really unfortunate right now is that you have an executive branch that is picking and choosing how they want law enforcement to do their jobs, right?
01:17:41.000So you have them basically telling Border Patrol to ignore the laws.
01:17:45.000And then you have them telling ATF to aggressively enforce rules that are not laws, right?
01:17:53.000So they are picking and choosing how they administer the law in this country from the executive branch.
01:18:00.000They're pressuring the brass to carry out their bidding.
01:18:03.000And it affects American people like me and you and my neighbors and Charlie here that works for me.
01:18:10.000It's crazy to think that if one of my friends from church decides not to take a brace off of his gun next week, that he's a felon.
01:18:20.000Responsible people. I imagine that those will actually be enforced, unlike the laws against arson and looting and rioting and even insurrection, like when government buildings were taken over in Portland and Seattle during the Summer of Love.
01:18:34.000You know, it's just different, and those are the realities of the world.
01:18:43.000It's why we can't be passive about it.
01:18:45.000You know, people, you know, well, you know, we'll let Trump go take the hits.
01:18:48.000No, no, no, guys. Like, if one guy going out there by himself, they can cancel all of us.
01:18:52.000But, you know, 175 million Americans start saying this is bullshit and calling it out.
01:18:57.000It's different. I mean, we saw that space.
01:18:59.000I mean, that's how we sort of got together and created Field Ethos.
01:19:02.000I mean, even literally the hunting and outdoor space, which is where sort of the magazine started and then sort of spun off into just a general adventure lifestyle, even that sort of got taken over by the woke folks.
01:19:13.000And, you know, we can't talk about, you know, the...
01:19:15.000Killing an animal, even, like, you're selling hunting guns.
01:19:20.000I mean, talk a little bit about Field of Ethos so those of you who haven't seen it, who are just watching this and don't necessarily follow my Instagram, you know, can learn a little bit more about that and what started it.
01:19:29.000Yeah, it really started when you and I were hunting in Utah several years ago, and we were talking about how there wasn't really an outlet out there that didn't have some element of woke ideology bleeding into the pages of the magazine.
01:20:00.000And so we started Field Ethos to tell the unapologetic truth about who we are as sportsmen and adventurers and hunters and anglers and just men.
01:20:10.000So it's a men's lifestyle brand with a heavy-handed DNA of hunting and fishing, but really it's the global hunt for adventure, whether that's us riding motorcycles through Africa or hunting in Mongolia or spearfishing in Turkey, whatever that is.
01:20:26.000We tell it from our perspective, not that, you know, apologetic, washed-down version of what society tells men they ought to be now.
01:20:36.000So I would describe it, you know, at least in the print journal form, and I've got the most recent issue right here.
01:20:42.000It's kind of like National Geographic if all the editors Killed things and owned assault rifles.
01:20:48.000Um, and it is, it is just a, it's a lot of fun to be honest with you.
01:20:53.000Um, you know, it's, it's a passion project for me and you.
01:20:58.000We both love taking adventures and traveling the world and experiencing new cultures and meeting new people really is probably our favorite part, I would say.
01:21:05.000Um, and you and I have traveled quite a bit together and we make friends everywhere we go and it's, it's just something that we're passionate about and, and we wanted to do this our way.
01:21:14.000Um, And people have responded really well to it.
01:21:17.000There are a lot of men out there that feel like their lifestyle is being ripped away from them.
01:21:28.000Because it is being ripped away from them.
01:21:30.000Yeah. I mean, the things that we're seeing corporations do right now.
01:21:36.000If you would have suggested some of these things when you and I were 10, 11 years old, You'd have been laughed out of the room, right?
01:21:43.000Yeah, the only masculinity and testosterone that's permitted right now is in a woman injecting it into herself.
01:21:50.000That's fine, and that's wonderful, but actual masculinity, traditional red-blooded American men, that's a big faux pas.
01:21:57.000We can't do any of that. Yeah, I mean, honestly, I laugh about a lot of it until I think about the fact that, okay, my kids are going to inherit this, and that's not funny, you know?
01:22:08.000It's just, it's asinine, the direction our country is headed in.
01:22:13.000And we really feel the ethos is in response to that.
01:23:11.000Not that there's anything wrong with that.
01:23:13.000But look, there's nothing wrong with it.
01:23:16.000But there's some really funny stuff going on out there right now that I just can't believe.
01:23:21.000The Bud Light thing, we don't need to talk more about that.
01:23:24.000I mean, to be honest with you, I was telling somebody the other day that I'm pretty sure the top brass at Bud Light did not know that that was going to happen.
01:23:34.000Well, yeah, and I was sort of surprised that a band that traditionally wasn't...
01:23:38.000I think I got crapped all over on that one, but I'm not shedding any tears for anyone that gets this sort of treatment for being insane.
01:23:46.000Here's the deal. I'm an investor in companies taking on that.
01:23:49.000I put actual money behind things like You know, whether it's, you know, Patriot Mobile, Public Square, I mean, that's a big one that I, like, I literally, I'm an investor in it, doing it.
01:24:02.000What was sort of amazing to me is, like, why has no one done this to Nike?
01:24:05.000Why has no one done this to Hollywood?
01:24:08.000Why has no one done this to all the guys jamming this shit down our throats for a moment, number one?
01:24:13.000Like, I'm sort of, I was like, well, this one, like, yeah, I'm not shedding any tears, but I'm sort of amazed it took that long for it to happen to anyone corporately.
01:24:21.000I think the way I felt about it was that the way that I felt about that one was like, okay, I'm pretty sure the top brass wouldn't have allowed this.
01:24:34.000And they did not respond to it in a way that a lot of us felt comfortable with.
01:24:39.000So we said goodbye to the brand forever.
01:24:41.000And they didn't triage that situation very well.
01:24:46.000What's even scarier, like I said, is now the doubling down from all these other companies that are, you know, just, ah, like, that was great.
01:24:52.000What's the worst? I'm like, wait a minute.
01:24:54.000Did you see? Like, and, you know, even, you know, with that in hindsight, they don't care enough, which to me is what's really scary, right?
01:25:02.000That you can see that kind of reaction and then be like, I want some of that, too, because I'm like, man, I don't know.
01:25:07.000I don't know that anyone should want some of that at this point.
01:25:10.000Yeah, I mean, lose $5 billion this quarter, that didn't scare these people off from doing it with their brands.
01:25:15.000You know, Bud Light has lost a ton of money this quarter.
01:25:18.000And the fact that people have kind of doubled down and continued along their path is...
01:25:23.000I don't know. I really can't even wrap my head around it.
01:26:05.000You can find, like, literally a directory of people that sign up, small businesses that sign up to say, these are our values, these are what we believe in.
01:26:13.000And when you look at sort of, again, the economic storm that's coming, the decisions that are being made, like, you can choose to put, like, their kids through, like, hockey practice or whatever, or you can keep supporting, like, you know, woke corporate America who doesn't give a shit about you.
01:26:27.000So, you know, go check those guys out.
01:27:08.000Just again, the stupid people making decisions because they put them in charge of trillions of dollars and your retirement because they check a couple of woke bullshit boxes rather than being competent.
01:27:17.000You saw what happened and the bank collapses.
01:27:38.000Learn how to protect yourself from that.
01:27:41.000You know, again, speaking of being prepared for that onslaught, Check out My Patriot Supply where you can stock up on everything you need for an emergency.
01:27:49.000My Patriot Supply, they're making that special offer I talked about earlier to be prepared for what's coming.
01:27:54.000A free water filtration system with that.
01:28:27.000Check it out. Learn how to take care of yourselves and family just in case it goes wrong, which, based on the idiots that they have in charge right now, are doing that.
01:28:35.000Guys, also make sure to hit the like button on this one.
01:28:37.000This is one of those, this is not an evergreen podcast, right?
01:28:41.000This one is one that basically, come May 31st, You can't do anything about it.
01:29:11.000Some of the time, you could probably do it in a good solid half a day and actually get through everything, even if you have a bunch of them, because the fingerprint cards, the two-pack of that that you need for ATF, the quick run to CVS for your passport photos.
01:29:24.000It can be done pretty quickly, but don't wait until the last day.
01:29:28.000Get it in the mail if you can a little bit earlier.
01:29:31.000The better. Get it in the mail if you're choosing to do that one.
01:29:34.000You know, priority so you have tracking but no signature.
01:29:37.000Remember that one. It'll get kicked back and you're up Schitt's Creek.
