00:02:41.000 Given everything else we've seen, given every witch hunt, given all the nonsense they've thrown at me and my family, I have a feeling on June 1 they'd be knocking on my door.
00:02:49.000 So for me, that's the choice I'll probably make.
00:02:53.000 And I also have plenty of other stuff that they don't know about yet.
00:02:55.000 And whatever list I'd be on because of this, I promise you, I've been on that list.

00:03:49.000 For these weapons. They designed them and now they're changing the rules that they made, putting millions of people into jeopardy.
00:03:58.000 Gun owners who have stabilizing brace attachments on their firearms must register the device by May 31st.
00:04:05.000 Or... Face up to 10 years in prison and thousands of dollars in fines, okay?
00:04:11.000 Now, I get it. Many of you can go under the radar.
00:04:15.000 Many of you aren't out there, you know, vocally 2A. Many of you aren't on hundreds of very public pages shooting these weapons like I am.
00:04:23.000 So I get why you may not want to do it.
00:04:25.000 I also get that, I promise you...
00:04:28.000 I would have to serve out every last second of that ten years and every last dollar of the tens of thousands of dollars in fines on moment number one.
00:04:38.000 If you've been watching for the last six years, you understand that.
00:04:41.000 So please...
00:04:43.000 Don't hate on me for it, and I know I'll get plenty because there's the purists who I actually agree with who say we shouldn't be doing these things, we shouldn't do it, but I understand also why certain people would want to comply with the law, where the downside is not worth that risk, where people already know that you're shooting, where the reasons go on and on.
00:05:06.000 Remember, folks, if you will, Hunter Biden broke gun laws, and nothing happened to him.
00:05:13.000 Hopefully, Congress will do something about that.
00:05:15.000 Again, that's why we're going to talk to Rep.
00:05:17.000 Andrew Clyde about exactly what they're doing.
00:05:19.000 But Hunter lied on a gun background check by claiming he isn't a drug addict.
00:05:24.000 That carries a punishment of up to 10 years in prison as well.
00:05:27.000 But nothing will happen to him because he is above the law.
00:05:31.000 He doesn't own a stabilizing brace, and if he did, that would probably be fine.
00:05:36.000 But I think any conservative, any vocal Second Amendment supporter, anyone out there...
00:05:42.000 Who's, let's call it, on the conservative side of things, may not get the same treatment because there isn't equal justice under our laws.
00:05:51.000 What will this rule accomplish other than punish Americans that don't like the Biden administration?
00:05:56.000 Not much. Democrats aren't concerned about crime.
00:06:00.000 They're concerned about finding ways to gut the Second Amendment.
00:06:04.000 They want you to be weak.
00:06:06.000 They want you to not be able to defend yourself.
00:06:08.000 Just look at what they're trying to do around the country.
00:06:12.000 Okay? Whether it's Daniel Perry and the prosecution of a good Samaritan, because they want to make sure that no one else jumps in when you, a loved one, is perhaps a victim.
00:06:23.000 But for example, Philadelphia.
00:06:26.000 The Soros-funded district attorney there, Larry Krasner, refused to enforce gun possession laws against gang members.
00:06:34.000 Think about this, okay?
00:06:36.000 It's a shock to everyone, obviously, that the places with the strictest gun control laws also have the most amount of shootings, whether it's Philadelphia, whether it's Chicago, whether it's L.A., or all these other examples.
00:06:49.000 Look at this headline, For Reason Magazine, quoting...
00:06:56.000 Philadelphia's district attorney sees little value and much injustice in possession arrests.
00:07:03.000 Really? Seems they'd be all about that if it was on the other side of the political spectrum.
00:07:11.000 Democrats would rather politicize the issue and coddle criminals continually, again and again and again, than take the actual steps to make our city safer and give people the ability to defend themselves.
00:07:26.000 The point of this pistol-stabilizing brace ban is to punish the people with them.
00:07:31.000 They are largely America-loving patriots, not criminals.
00:07:36.000 Unfortunately for them, though, crime is the priority under Joe Biden.
00:07:42.000 Just not the crime that we'd normally care about.
00:07:44.000 If you were breaking the law, that's the crime they care about.
00:07:47.000 Even if you're a law-abiding citizen, even if you go about it right, even if you're just looking to defend yourselves and your freedom and your family...

00:07:57.000 Rape, murder, arson, looting like we saw during the Summer of Love 2020 riots?
00:08:03.000 That's different. And it's also a major overreach of rulemaking authority.

00:08:11.000 They want to do anything and everything they can to try and undermine the important Second Amendment rights we all love.

00:11:30.000 I know we had Anna Paulina Luna on here a couple of weeks ago, and she had the same thing, and they're going after her.
00:11:35.000 This is a woman Air Force veteran supporting the Second Amendment.
00:11:39.000 And, you know, I think that's what it's all about.
00:11:41.000 I mean, it's not about that.
00:11:42.000 It's about attacking our rights.
00:11:45.000 So, you know, talk about this, because so many Republicans and Second Amendment advocates and believers You know, what can we do about this?
00:11:55.000 What's going on in Congress?
00:11:56.000 Who are the people that are helping lead that charge to stop this overreach?
00:12:02.000 I mean, to me, this is a huge threat to the Second Amendment.
00:12:06.000 I know, you know, you have, you know, a detailed knowledge of this.

00:12:18.000 Talk a little bit about what's going on, because I feel like so often the Republicans say, well, we have a couple guys fighting, but no one's really taking it seriously.
00:12:26.000 They're going to walk all over and trample our rights.
00:12:28.000 What's going on, and how do we push back on this?
00:12:32.000 Well, thank you. Well, I'll tell you, it's a very, very serious thing.
00:12:36.000 You've got the Second Amendment of the Constitution has a supremacy clause, shall not be infringed.
00:12:41.000 And so we in Congress are responsible, our government is responsible for upholding the individual rights in the Bill of Rights in our Constitution for everyday citizens.
00:12:52.000 And the Second Amendment just happens to be one of my favorite ones.
00:12:57.000 Actually, after the First Amendment, it is the most important amendment, because the Second Amendment is the teeth behind the first.
00:13:04.000 If we didn't have the second, we wouldn't have the first for very long.
00:13:07.000 So I think it's so very important that we protect and defend the Second Amendment.
00:13:12.000 And that was one of the things I promised my district when I came to Congress, that that would be a priority for me.
00:13:18.000 So we're doing a number of things, three things actually that I can talk to you about.
00:13:23.000 First, we can do it through legislation.
00:13:26.000 The SHORT Act has been introduced already, and that means the SHORT stands for Stop Harassing Owners of Rifles Today.
00:13:35.000 And what that piece of legislation would do Is it would eliminate short-billed rifles, short-billed shotguns, and AOWs from the National Firearms Act in 1934, because those are the more restricted weapons under the NFA. And if we can eliminate those three categories of weapons and we can make this This issue of pistol braces being reclassified, redefined as a short barrel rifle, we can make it completely go away.
00:14:03.000 And we've got sponsors, many sponsors here in the House.
00:14:06.000 We've got sponsors in the Senate for that bill as well.
00:14:09.000 It has not moved yet, though, unlike the next piece of legislation I want to talk about, and that is a Congressional Review Act.
00:14:19.000 You know, when the ATF wrote their pistol brace rule, they overreached Their authority in the government.
00:14:30.000 I mean, you've got the three branches of government and ATF clearly did not stay within their branch, the executive branch.
00:14:38.000 They wanted to become, I guess, legislators.
00:14:40.000 They want to be members of Congress or something and write laws themselves.
00:14:44.000 And they can't do that.
00:14:45.000 That is a clear violation of the separation of powers in the Constitution.
00:14:50.000 And so, HJ Res 44 is the piece of legislation that can strike down this ATF rule and prevent the ATF from ever drafting another rule or a similar rule like it in the future.
00:15:05.000 So, that's a really important thing.
00:15:07.000 We've got 190 co-sponsors on that bill right now.
00:15:10.000 It takes 218 to pass in the House.
00:15:13.000 I'm speaking with leadership.
00:15:15.000 I've spoken with leadership already this week about bringing it to the floor before the 31st or by the 31st of May so we can send a strong signal, Don, to To the ATF and to the judicial system that Congress does not approve of this rule.
00:15:32.000 And you got to remember, this is a rule that ATF has created.
00:15:36.000 It's not actual law.
00:15:38.000 That's what people don't understand.
00:15:41.000 I mean, this is literally not not only is it a rule that ATF created, but it's something that they designed.
00:15:47.000 And so they came up with something, and like all things, like the people who put together the New York Safe Act, all of a sudden the next day, police officers were literally felons for committing the crime of going to work with their duty pistol because the people writing the laws didn't even understand them themselves.
00:16:06.000 They didn't know the difference between a trigger and a muzzle on a firearm, and yet they want to be the first to act, so we're going to check this box.
00:16:15.000 But, you know, I think people do want to see some action.
00:16:19.000 So, you know, if you have, you know, you don't have 218, so that means there's at least, you know, I guess you said, what, 198?
00:16:25.000 So there's 20 Republicans that have not yet signed on to that legislation.
00:16:30.000 Are there any Democrats that have signed on?
00:16:32.000 Are there any Democrats that, you know, would possibly sign on to this to actually do this?
00:16:36.000 Or is this just totally, you know, partisan at this point?
00:16:40.000 I think that's something that people do need to understand, which is that You know, the reality is that while we have the House, we barely have the House.
00:16:49.000 While we have the House, there's plenty of weak Republicans there.
00:16:53.000 And so, you know, I don't know that we can actually pass actual legislation.
00:16:57.000 How do we have some teeth behind this so that people see that something's actually getting done?
00:17:04.000 Well, I think we can pass HJRES-44.
00:17:07.000 I'm actually reasonably confident about it, you know, because this is truly not an actual gun bill itself.
00:17:13.000 What HJRES-44 would do would simply strike down the ATF rule.
00:17:17.000 I mean, you know, here, we've got a piece of plastic.
00:17:19.000 You know, this is a brace.
00:17:21.000 And this was designed for disabled veterans.
00:17:25.000 That was the whole point of this thing.
00:17:27.000 So H.J. Res 44 is truly, it's a government overreach piece of legislation, and it's a piece of legislation that protects and cares for our disabled veterans.
00:17:40.000 You know, we have a duty in the government to To take care of those who have sacrificed for our nation, especially those that have gotten the Purple Heart, that have lost a limb or something like that.
00:17:55.000 I mean, it's egregious that we don't put those people at the very top of our priorities.
00:18:02.000 And the ATF is definitely not doing that.
00:18:05.000 And so this particular bill is much more a veterans, a disabled veterans bill and a government overreach bill than it is a gun bill.
00:18:12.000 So I think we have a great opportunity and a great Potential to pass this bill either late this week or early next week before the 31st, before the ATF rule actually goes into effect.
00:18:27.000 Right now, it still has to pass the Senate, and we have great co-sponsors over there, Senator Marshall and Senator Kennedy, and they have a significant amount of support.
00:18:36.000 Don't know exactly where it would go in the Senate, and I really don't know that President Biden would actually sign it.
00:18:42.000 So it's a potential to do, but there's really a third area that Congress can work on.
00:18:52.000 And this is, I think, the most powerful and the most important.
00:18:55.000 And that's through the appropriations process.
00:18:58.000 And I'm very thankful that I am on the appropriations subcommittee that actually deals and has a vote on the budget of the Bureau of Alcohol, Tobacco, and Firearms.
00:19:08.000 Imagine that. Imagine a federal firearms licensee who has a say in what the DOJ and the FBI and the ATF's budget actually will be for 2024.
00:19:19.000 And so we are going to do what is called, and I've already submitted it to our subcommittee, a limitation amendment which will basically say that no money may be spent on either On implementing or enforcing this ATF rule.
00:19:37.000 Now, it won't go into effect until FY24 begins, which would be October 1st, all right?
00:19:44.000 So any prosecution of people, I think we can eliminate after October the 1st.
00:19:51.000 But we will send a strong message to the court system, and there's a number of court cases out there already, that Congress does not approve of this ATF rule.
00:20:00.000 Yeah, I mean, I think, you know, that's the problem.
00:20:02.000 You know, again, not controlling the Senate, not having, you know, enough of a majority to overrule a veto by Joe Biden.
00:20:10.000 Like, that's the reality, unfortunately.
00:20:12.000 This thing's going into effect.
00:20:14.000 You know, are you aware of any of the gun groups out there doing anything to, you know, challenge this legally or, you know, take it to the Supreme Court?
00:20:22.000 You sort of, you know, you hear a lot of noise, but who are the people actually doing anything from that perspective outside of Congress?
00:20:30.000 Oh, there are a number of them out there that are doing that.
00:20:32.000 I know gun owners of America are doing it.
00:20:34.000 I know that you've got National Association of Gun Rights is in that space as well.
00:20:43.000 I think there's also a few state organizations that are in that space.
00:20:47.000 I believe, from what I remember, there's about eight lawsuits right now that are Are moving forward on it.
00:20:57.000 So this thing I don't think will stand.
00:21:01.000 Not one little bit.
00:21:04.000 Although, like you said earlier, this rule is still treated as if it was a law.
00:21:11.000 And so people do have to take it very, very seriously.
00:21:14.000 And I'm really glad that what you're going to be doing in the next part of the program Is going through the actual Form 1 paperwork that's going to be required for folks if they want to register their pistol-braced firearm as a short-barreled rifle.
00:21:32.000 Yeah, I mean, I think, you know, again, for me, I know that there's gonna be people giving me all sorts of hell for even, you know, talking about the possibility of doing it.
00:21:40.000 I also know, based on, I don't know, seven years of experience and millions and millions and millions of dollars in legal fees, that again, I won't be treated like Hunter Biden.
00:21:50.000 It'll be different.
00:21:51.000 If I put a comma in the wrong spot, if there's a little smudge somewhere on the form, even
00:21:56.000 if everything else looks right, I'm probably going to jail for the 10 years, times umpteen
00:22:03.000 number of things.
00:22:04.000 So, I mean, I guess, you know, talk about that, you know, because while we're fighting
00:22:08.000 it, we may still have to deal with this for the time being.
00:22:12.000 They're not going to do it.
00:22:13.000 Weak people in courts are going to allow something to happen.
00:22:16.000 The injunction efforts hopefully prevail, because I want to make clear, I'm not a fan
00:22:20.000 of any of these things, but I also understand the consequences to people on our side.
00:22:25.000 I understand that we don't have equal justice under the law.
00:22:28.000 Talk about just how severe these consequences are to everyday gun owners.
00:22:33.000 I know from your perspective as a Class 3 owner, as a dealer yourself, you know that if you get one of these things wrong, You know, these are not minor consequences.
00:22:44.000 This isn't a slap on the wrist.
00:22:45.000 We're not getting the Hunter Biden treatment where he can fill out, you know, lying on a form and then throw a handgun in a garbage can outside of a high school.
00:22:52.000 It's a little different for us.
00:22:54.000 Oh, it's very, very different for us.
00:22:56.000 I mean, we're conservative. My name's on that list, too, Don.
00:23:00.000 I'm on every list at this point.
00:23:04.000 I'm on every list.
00:23:07.000 But it's serious consequences.
00:23:10.000 You've got 10 years and a $250,000 fine.
00:23:12.000 That's what the fine is.
00:23:14.000 So people do have to take this rule very seriously.
00:23:19.000 Whether you want to have a short-barreled rifle or not, whether you want to remove the pistol brace, In fact, when Director Dettelbach was in front of the Judiciary Committee here in Congress and Congressman Massey was questioning him about, you know, what were the consequences and what could people do?
00:23:38.000 You know, Dettelbach said that, well, you just take the brace.
00:23:42.000 If you don't want to register, you don't want to register.
00:23:43.000 You don't want to destroy it. You don't want to turn it in.
00:23:45.000 You know, just take the brace off of it.
00:23:47.000 And then Congressman Massey asked, well, what about, you know, constructive prosecution?
00:23:51.000 If you have the brace and you have the pistol and the two of them not together, but, you know, in the same household, can you be prosecuted for that?
00:24:00.000 And Dettelbach said, no, but yeah, I think ATF came out just a day or two ago and said, hey, you actually have to Destroy the brace, all right, for it not to be, you know, a constructive prosecution.

00:30:23.000 So you can choose for yourself, but for me, I mean, I filled out the form for literally,

00:30:34.000 The Form 1, which is what this would be, allows you to, you know, I guess...
00:30:39.000 What a Form 1 is basically, 5320.1 is a technical term.
00:30:42.000 It's called a Form 1. That's the application to manufacture a firearm.
00:30:47.000 What manufacture means is you buy it as a pistol, which in this case, as a manufacturer, we were allowed to build guns with barrels shorter than 16 inches and attach these arm braces to them.
00:30:59.000 That essentially kept this thing as a pistol.
00:31:02.000 Now, the Form 1 allows you to take that pistol and register it as a short barrel rifle.
00:31:08.000 We're going to use the term SBR, which is short barrel rifle.
00:31:10.000 And it allows you to do that, and that's basically when we talk about being in compliance, that's what you're going to do with a Form 1.
00:31:17.000 And we'll walk you through those steps today and kind of show you, you know, if you want to keep it as a pistol, what you have to do to remain compliant.
00:31:23.000 If you want to go the SBR route, We'll show you the benefits of that, what you have to do to that.
00:31:29.000 We can show you how to fill out the Form 1.
00:31:32.000 With guys like you and I, I mean, as much as we'd love to take the stand and say, you know what, this is where we're going to draw the line in the sand, I'm in the business, machine gun collector, manufacturer, you're a high profile guy, big, you know, big gun guy, hunter, shooter.

00:31:58.000 So, yeah, it's not a stretch to say, if they're using the FBI's HRT, the hostage rescue team, to do a search warrant on Mar-a-Lago, I'm probably getting a visit.

00:32:10.000 It doesn't mean I'm happy about it.
00:32:12.000 It does not mean that I'm thrilled.
00:32:14.000 It does not mean I agree with it.
00:32:16.000 It just means, you know, hey, I'm not going to jail for this knowing that I'm the first person that they'd love to make an example of if they can.

00:32:51.000 So let's maybe start with the guns, right?
00:32:52.000 You have sort of, again, you have the traditional, you know, this is just the pistol-braced AR-15.
00:32:59.000 So this is a 9mm carbine.
00:33:00.000 It's a little bit different than the standard.223, you know,.556, depending on which way you want to look at it.
00:33:05.000 But this is, you know, a go-to for me.
00:33:08.000 This is sort of my under-the-bed, and this is my truck gun, because it's even a little bit smaller and can fit in a backpack.
00:33:12.000 Absolutely, same as me. So talk about the differences in even then because, again, as many times as I filled out the Form 4, going through the Form 1, I'm like, oh, that's weird.
00:33:20.000 There's so many little things I could have made a mistake.
00:33:23.000 There's so many things that aren't quite that clear.
00:33:24.000 The duplicate copies, everything.
00:33:26.000 If you read the Form 1 cover to cover, it's 13 pages, and it might as well be written in Greek because I literally remember the first one I ever filled out.
00:33:34.000 We're talking 20-something years ago, and they've changed since then.
00:33:37.000 As a manufacturer we have to remain fluid even since the introduction of the pistol brace ruling.
00:33:44.000 We've had to remain fluid because in the beginning they told us we had X amount of days to liquidate all of our inventory that had pistol braces on it.
00:33:50.000 The very next day we got an email that says you can no longer sell that configuration so we were literally stuck with all these Inventory that we had to get compliant.
00:33:56.000 We couldn't move it. So we had to remain fluid.
00:33:59.000 But when you read these forms, like I said, they might as well be written in Greek.
00:34:02.000 So what we want to do today is walk you through and kind of show you, interpret some of that stuff.
00:34:06.000 And it comes down to little things.
00:34:07.000 Like, for instance, it asks you on here the length of the barrel.
00:34:11.000 Most people would look at this and throw a tape measure on this guy here and say, oh, it's about six inches.
00:34:15.000 The problem with that is it has to be a little more specific than that.
00:34:18.000 So we'll walk you through that part of it right now.
00:34:20.000 Obviously, the weapon's been cleared.
00:34:21.000 In order to measure the barrel length, we have to actually Essentially put the gun into battery, which we never do because we're safe gun people.
00:34:27.000 And by the way, just, hey guys, all of these have been opened, cleaned.
00:34:30.000 This one, because it's a folder, you actually can't open the chamber, you know, when it's in the folded position, so it's been cleared and all that stuff, because I know there's going to be someone in there, oh my god, muzzled is a triple!
00:34:43.000 You can save your bitching for later.
00:34:47.000 We don't need it here. We understand.
00:34:48.000 We all know the rules. So the first step we're going to do is show you how to actually measure the overall barrel.
00:34:52.000 Now, We're going to put the gun into battery.
00:34:54.000 Because that is one of the questions on the form.
00:34:55.000 It is. That is actually one of the major questions that you have to have.
00:34:58.000 They want to know because if it's over 16 inches, we're not even doing the form.
00:35:00.000 Correct. So what I do...
00:35:01.000 Yeah, this is for under 16 inches, pistol braced.
00:35:05.000 The law states that it's measured from the breech face, which is the bolt face, to the end of the muzzle threads, if this can be removed.
00:35:11.000 So if we spun this off, there would be threads that would stop right here.
00:35:14.000 Yeah. So what I do is I take a wooden dowel, Drop it in there, and then I take my pen, and I'll actually mark it where it ends, which is going to be right here, and then I will pull that out and measure from this point to this point, and that is literally the value that's going to go in on the barrel length section of the Form 1.
00:35:34.000 Now, if the muzzle brake for some of those who live maybe in the People's Republic of New York where you can't, I guess prior to the SAFE Bullshit Act, If the muzzle brake is pinned, that's different, because that then adds that extra length to the barrel.
00:35:50.000 Because I had a couple of guns like that where, I know you make a tanker, and I know I have one.
00:35:54.000 I was like, hey George, it's less than 16 to the brake, but if you include the brake, it's probably 17, 17 and a half inches.
00:36:01.000 But because it's pinned, it's actually okay, and it doesn't apply to this.
00:36:06.000 Absolutely. So anytime you...
00:36:07.000 Nobody knows about one more gun of mine.
00:36:09.000 When you permanently attach something to the end of the barrel by the proper pin and weld, I don't mean rock set it, JB weld it, whatever.
00:36:15.000 It has to be a pill, a pin, a drill.
00:36:18.000 Yeah, it's drilled, it's pinned, it's soldered over.
00:36:20.000 It's welded. I leave my welds obvious.
00:36:21.000 You'll notice it on the bottom of the tanker so they know that it's pinned and welded.
00:36:23.000 Once you do that, that becomes part of the overall length of the barrel.
00:36:26.000 So we would be measuring from the breech face to that point.
00:36:29.000 Now on a gun that has a 14.5 inch barrel, you can pin and weld a flash hider on it, have it professionally done, and then you don't have to file a Form 1.
00:36:35.000 What I've been doing a lot as well...
00:36:37.000 And by the way, for those of you who don't want to fill in anything, if you have something like that that's pushing those boundaries, you can do that, and then all of a sudden you're in compliance.
00:36:45.000 Now, theoretically, you're breaking the law from May 31st to when you actually get that done.
00:36:50.000 I imagine no one's coming to look for you, so it's a way to get legal, even if you're perhaps...
00:36:55.000 Semi-legal or illegal for, you know, the amount of time that it takes you to do that.
00:37:00.000 But it saves you having to even think about this if that's something you're willing to do.
00:37:04.000 And it's a pretty simple procedure.
00:37:05.000 Any competent gunsmith can do it in about, you know, five minutes.
00:37:09.000 Absolutely. And another option as well, say you have an 8-inch barrel 9mm and you have an extra 9mm silencer laying around, you pin and weld that to the barrel, that becomes part of the barrel.
00:37:18.000 You obviously already have your tack stamp on the suppressor and then you don't have to worry about SBR and it becomes a one-stamp gun.
00:37:23.000 So you don't have to fill out the form on it.
00:37:25.000 So that's something to think about as well.
00:37:27.000 Now I'm going to put this gun, I'm going to lock the bolt back because what I want to go over next is I want to actually go over the overall length.
00:37:32.000 And that's going to be another question. That's the next question on the form is the overall length of the weapon.
00:37:36.000 And that, there's so many different, if you go down the Google rabbit hole, there are so many different answers you can get for this.
00:37:43.000 But the proper way as defined by the National Firearms Act of 1934 is you remove the buttstock, And you'll literally measure from the end of the barrel, which we now know is the muzzle and the threads, to the end of the buffer tube.
00:38:00.000 The exception to that is if you have a folder, like your Mark V folder over there, you'll actually measure that overall length.
00:38:06.000 So that's a little different. You'll measure that from in the folded position, from the rear of the receiver to the threads on that guy.
00:38:14.000 So that's the difference between the two, and that's why we have these two different specimens out here, so we can show you how to properly measure either way.
00:38:21.000 It's one of those things where I don't know if the ATF would even know that that gun's a folder.
00:38:25.000 I don't know if they would know that you got it wrong, but it's one of those things when they come knocking or they see you at the range or they see this, you want to have all of this perfect because it's one of those things that you don't want to be caught with your pants down.
00:38:35.000 Okay, so the way to do nothing about this.
00:38:37.000 If I wanted to do nothing about it and just be compliant as an AR pistol, what is it that I need to do?
00:38:44.000 Hand me that buffer tube over there.
00:38:45.000 I'll hold the weapon here. The buffer tube, obviously, is the rear part of the weapon that holds the buffer mechanism.
00:38:50.000 This is a pistol-only buffer tube.
00:38:52.000 The definition of that is it's a round tube and you cannot Attach any type of stock or device to it, okay?
00:39:00.000 So you would have to install that.
00:39:01.000 Simply by doing that, this gun is now a pistol.
00:39:04.000 However, as a pistol, you have to refrain from doing certain things.
00:39:09.000 One of the things you cannot do as a pistol is use a vertical grip.
00:39:12.000 You cannot put a vertical grip on it as to where if you did a Form 1 and SBR'd it, you can do a vertical grip.
00:39:16.000 So if you Form 1 it, you can put the vertical grip on it.
00:39:19.000 You're basically Theoretically, as much as we don't like it, but this is sort of a one-time, and again, before May 31st, it's free.
00:39:27.000 You can waive the tax stamp, the $200 thing.
00:39:31.000 So if you go the SBR route, you can have that vertical pistol grip.
00:39:35.000 You basically can do anything. No, just to make sure everybody's...
00:39:37.000 Once you receive the approved form back, you can go that route.
00:39:41.000 And you can also put a buttstock on it.
00:39:42.000 So you can go buttstock, vertical grip.
00:39:44.000 You essentially lift the restrictions or limitations on that weapon as far as barrel length are concerned.
00:39:48.000 Of modification. The irony of the whole thing is, now if we look back at the NFA Act of 1934, that was drawn up for pistols, to ban pistols, okay?
00:39:58.000 The SBRs and SPSs, SPS is a term for short barrel shotgun, the SBR, short barrel rifle, those were added to that for the sole purpose of preventing the circumvention of the pistol part of that ban.
00:40:09.000 Now here's the irony. The pistol was removed from that ban before it was actually published.
00:40:14.000 So the pistols weren't regulated under that act.
00:40:16.000 They actually slipped the SBR and the SBS on it, so you couldn't circumvent the pistol act of it, and then they removed the pistol from the actual law.
00:40:23.000 So if you read up on the 1934 NFA Act, it's going to blow your mind.
00:40:27.000 It's actually pretty interesting.
00:40:28.000 Interesting. So let's go through the form for those of us, because again, this is something that was sort of interesting.
00:40:34.000 You can go through the form, but there's a couple things you need.
00:40:36.000 What I noticed, because you're not just sending And it's two copies of this to the ATF, okay?
00:40:43.000 So whatever package you're putting, and we'll talk about how to even mail that so you can get it in, but you're gonna fill out two forms of this.
00:40:49.000 So you need two passport photos with that, but then you also need a third copy, okay, that you're gonna send to your local sheriff's office.
00:40:55.000 Yep, your Clio. Cleo, so look up who your sheriff is, you put it, and you're not asking for permission in that process.
00:41:02.000 That was the interesting thing that you said.
00:41:03.000 You're just, here it is.
00:41:05.000 So you actually need three passport photos for each one of these things, and you need one set of fingerprint cards.
00:41:11.000 So, exactly. One pair, actually.
00:41:13.000 Sorry, one pair of fingerprint cards.
00:41:15.000 They only go to the ATF. So you can go, where do you get those?
00:41:20.000 So you can go to UPS Store.
00:41:22.000 There's actually fingerprint outlets all over.
00:41:24.000 There's literally Google fingerprints.
00:41:28.000 It's the same form you use for a federal background track, your CCW permit.
00:41:33.000 So tell them it's just for NFA purposes.
00:41:36.000 But again, you need two of those sheets.
00:41:37.000 You can do it. I did it in about half an hour.
00:41:39.000 If you're one of those gun nuts that has, you know, say like 15 or 20 SBRs you have to register, you only need the pair of fingerprint cards if you send it in the same packet, but each form still has to have the 2x2 photo.
00:41:50.000 Correct, yeah, like I got, let's call it, you know, dozen plus in my package, but yes, it was only two fingerprint ID cards, and those don't need to go to your local law enforcement.
00:41:58.000 No, they do not. Those actually go right to the ATF, yeah.
00:42:01.000 Make a fourth copy for yourselves, guys.
00:42:02.000 You don't need the extra, obviously, passport photos, but make an extra copy because while it's in process of the form itself, both sides, print it on both sides because if you have that form and that copy, that's basically your license that you're in process because I imagine the ATF's going to be flooded with this.
00:42:20.000 I imagine we're not going to be seeing anything in return anytime soon.
00:42:23.000 But do it. I will comment on that.
00:42:26.000 For the e-file option, that's taken quite a while because that's the route everybody's going.
00:42:31.000 Paper filing, I'm seeing back before this ruling, I was seeing 12 to 18 months.
00:42:36.000 I've seen the last probably 10 packets I've sent in in Four to six weeks.
00:42:41.000 Okay. Including mailing, which is, and that's the paper form because everybody's e-filing.
00:42:45.000 When I print these out, I actually print, like you said, four copies.
00:42:48.000 The first two, I fill out, the first three I fill out the same exact way.
00:42:52.000 The two go to the ATF. The fourth one, definitely keeping your records.
00:42:54.000 That's great. If it takes a while, you can call them, give them the serial number, say, hey, what's going on?
00:42:58.000 But at least you have proof, hey, I filled it out.
00:43:00.000 I'm trying to be compliant.
00:43:02.000 That's definitely the route to go.
00:43:04.000 A couple of the things I want to go through on the form itself.

00:43:09.000 Yeah, so what I did is I actually put on the BTEUSA Instagram, so it's at BTEUSA, in the bio, there's a link right to the ATF website to the exact form you have to fill out.
00:43:20.000 It's a 5320.1 or Form 1, and you can fill it out.
00:43:23.000 What I do is I download it to my computer as a PDF, and I'll go through and fill out all the information, then I'll go through and change the make model serial number and then print it, you know, my forecast.
00:43:31.000 Especially if you're doing a bunch of these like George and I were, by doing that, saving the PDF, you can leave all of your information basically the same and change, you know, I have a bunch of George's guns, so I literally had to change serial number and...
00:43:47.000 Serial number, because it was basically a lot of duplicative guns, etc.
00:43:53.000 But by saving it there, you don't have to fill out your information each and every time.
00:43:57.000 You sort of fill it out once, save it, and then you can go through and just change the things.
00:44:02.000 You also have to sort of delete out in the PDF. They literally put a cross through your signature area on there.
00:44:07.000 Both front and back. You're going to sign this thing actually in two places.
00:44:10.000 You're going to sign as the applicant, and then name and title of authorized official is going to be you because you're the applicant.
00:44:15.000 You're going to date it for the day you submit it.
00:44:17.000 And on the back, signature of maker, because you're making this from a pistol into an SBR, you sign it there as well.
00:44:23.000 Yeah, so signature maker, I mean, yeah, you've got to remember, you're actually the maker of this now when you're going through this process.
00:44:29.000 And if you don't do that, that's going to be a reason they kick you back.
00:44:32.000 They will definitely kick you back. Who knows if they'll let you in.
00:44:33.000 So when you have one week, again, there's some nuance.
00:44:38.000 Once we did it, it was pretty simple.
00:44:39.000 But again, for me, having done the Form 4 hundreds of times, You know, to now see it this way, it's like I was even making little errors.
00:44:46.000 There were things that I was going to leave blank because I didn't assume I was the maker, but I am.
00:44:50.000 So, you know, this is why it's so important to pay attention.
00:44:53.000 And again, I got my fingerprint cards in about 45 minutes.
00:44:57.000 I was able to get the passport photos at CVS, but again, three per, you know, it's a lot.
00:45:04.000 So make sure you don't wait until the 31st.
00:45:07.000 You have a week. It's plenty of time to get it done, but you got to do it.
00:45:11.000 And there's a lot of sort of ministerial stuff.
00:45:13.000 It'll take you a little bit. I did actually call a friend at the NFA and I was able to get a straight answer.

00:49:35.000 There's nothing preventing you from changing it in time, but you've got to actually put a caliber in it.

00:49:44.000 And if you ever put a different caliber or barrel length on it, just retain the ability to put it back to the register configuration.

00:49:52.000 It's going to ask you the model. This one's going to be the Sub-9 because it takes the Glock magazines.
00:49:56.000 Barrel length, we showed you how to measure that, and you're going to be very accurate with that because you're going to go to Walmart or Hobby Bench or wherever and buy your wooden dowels and you're going to be spot on.

01:11:16.000 Sure. So what I did last week was I showed a video of me actually registering one of these firearms that's going to be affected as a short barreled rifle on the form one that you guys talked about.

01:11:31.000 But there are processes online that make this thing really quick.
01:11:34.000 You can e-file with the ATF. So I filmed a video showing, okay, I'm going to turn this pistol-braced firearm into a legal SBR. Am I doing that with all of them?
01:11:44.000 Absolutely not. Andrew Clyde, who was on earlier, Congressman Clyde, he explained that there is going to be a gap.
01:11:51.000 And when they start enforcing this illegal SBR, Illegal regulation.
01:11:57.000 And when he feels like his supporters in Congress will be able to shut this down.
01:12:04.000 So basically what I was saying was either take the pistol brace off of the firearm or you can do what I'm doing with several of these that I wanted to SBR anyways.
01:12:13.000 And here's the process on how to do that.
01:12:15.000 And people just went nuts.
01:12:17.000 You know, no, leave the pistol braces on.
01:12:20.000 Don't register anything with the ATF. And look, I'm...
01:12:24.000 I'm not disagreeing with them at all.
01:12:26.000 I think you should exercise whatever option you feel comfortable exercising.
01:12:30.000 If you want to be a felon for a couple weeks, look, I've got no problem with that.
01:12:35.000 But what we were saying is, if you don't want to be a felon during this gap, or, you know, however long it takes to correct this issue, Take the pistol brace off, leave it away from the gun.
01:12:47.000 I think some people have said even destroy the pistol brace.
01:12:50.000 Or you can go through a Form 1, the tax stamp $200 fee is waived right now, and you can turn it into a legal SBR. Now, here's the problem with having a legal SBR, and most people don't know this.
01:13:00.000 If you actually do convert that gun, your pistol brace firearm, into a legal SBR, you can no longer travel outside of state lines with that firearm Is it ATF or local law enforcement?
01:13:27.000 I believe it's ATF. And I asked an ATF agent about that, and he said, yes, this is ATF. You have to notify, but I don't know who you're supposed to notify.
01:13:36.000 So he didn't know. Actually, George is sitting right here.
01:13:38.000 Do you know this one? Because once it's registered and it's the SBR, to travel out of state with that gun, you have to notify.
01:13:46.000 What are the rules on that?
01:13:47.000 Because, again, we just want to make sure everyone knows everything.
01:13:50.000 So what you're going to do is you're actually going to want to notify the CLEO of the area you're traveling to.
01:13:55.000 Okay, so you're notifying the local law enforcement that you're doing.
01:13:58.000 Okay, so the sheriff or chief of police in that jurisdiction?

01:14:05.000 Yeah, basically. Basically the same people you're mailing the second copy of the form.
01:14:09.000 If I'm coming to Palm Beach County, I'm going to let him know that I'm traveling to his county to hunt with a suppressor or a short bearer wife or whatever it is.
01:14:15.000 Let them know ahead of time before you travel.
01:14:17.000 But you're not asking for permission.
01:14:18.000 You're just stating it. You're notifying them.
01:14:20.000 Some counties have different terms you have to notify at X amount of days before.
01:14:25.000 There may be some, I'm sure, probably in some of the more liberal areas where you actually have to get a response from them, get permission from them, but I've yet to run across that.
01:14:34.000 So, listen, yeah, again, more nuance that we'll figure out, but, you know, it's an important thing, and I mean, you know, I imagine that's something that we want to think of.
01:14:44.000 I've never—I've been to plenty of things.
01:14:46.000 I've traveled with stuff like this all over the place, never been bothered, never been checked, never been—you know, but, again, that doesn't mean they won't start enforcement immediately, and I imagine they'll, you know, prosecute those very, very selectively, me being— I mean, there's so many just different things that you have to pay attention to regarding firearms laws from state to state.
01:15:11.000 Hypothetically, I might have come to visit you in a state one time and accidentally had something in my truck, hypothetically, that I wasn't supposed to have, but it was completely okay here.

01:15:42.000 If you don't want to be, you know, if you don't want to open yourself up to, you know, legal charges, that's the only thing you can do right now.
