00:01:05.360 And this week, I wrote a letter to Pam Bondi, the Attorney General,
00:01:09.180 calling on the Department of Justice to systematically examine the evidence,
00:01:12.880 case by case, of what the direct involvement of the president was
00:01:16.860 in those pardons and commutations,
00:01:18.760 and calling on the Trump DOJ to challenge any pardons and commutations
00:01:22.720 that were not specifically approved by the president.
00:01:25.160 We'll break that down.
00:01:26.520 We're also going to talk about legislation I introduced this week
00:01:29.400 to protect Christians in Nigeria.
00:01:31.620 Nigeria has seen a persecution of Christians that has been staggering.
00:01:36.520 Just this week, over 60 people were murdered by jihadists,
00:01:41.600 by radical Islamists in northeastern Nigeria.
00:01:45.100 They executed soldiers.
00:01:46.880 They went house to house.
00:01:48.040 This pattern of targeting Christians, targeting Catholic priests,
00:01:51.860 targeting individual men, women, and children is horrific.
00:01:56.940 And my legislation would put real consequences on the government of Nigeria
00:02:02.580 and those who are facilitating this persecution,
00:02:05.440 put real consequences on them to change that.
00:02:08.620 All right, I want to take a moment to talk about personal safety.
00:02:11.660 You guys know I'm pro-Second Amendment.
00:02:13.240 You know that I've actually used my firearm to save my life

00:03:21.940 This is one of those instances where clearly these people are looking for an easy target.
00:03:26.220 The trick here is to make yourself a hard target.
00:03:28.960 Have a way to defend yourself to facilitate that escape.
00:03:32.300 And that's really where Burna comes in.

00:03:53.560 Depending on where you are, you may not even be able to carry a gun.
00:03:56.460 Or maybe coming from a private event where a gun may not be illegal as well.

00:04:03.740 you need to understand that there has to be a reasonable expectation that there's going to be death or serious bodily injury caused.
00:04:09.080 So you pull that gun too early, and you're likely the one to be going to jail.
00:04:12.860 So in this case, a less lethal tool is perfect.

00:04:17.420 It can be used early to prevent further harm because it's such a reduced amount of force.

00:05:25.060 Well, the numbers are staggering,
00:05:27.440 and I want to read to you from the letter that I sent to Attorney General Bondi this week.

00:05:32.640 Dear Attorney General Bondi,
00:05:34.500 On December 12, 2024,
00:05:36.180 the Biden administration commuted the sentences of roughly 1,500 inmates and pardoned 39 others.
00:05:42.560 And on January 17, 2025,
00:05:46.360 the administration issued 2,490 additional commutations,
00:05:52.440 more in a single day than any president had ever granted over an entire presidency.
00:06:02.640 Yeah, that's the wow moment, by the way.
00:06:04.860 The wow moment is there.
00:06:06.600 2,490 commutations,

00:06:13.600 These clemencies were issued based on broad criteria,
00:06:16.820 rather than case-by-case evaluations,
00:06:19.220 and at least some of them were signed using an auto pen of then-President Biden's signature.
00:06:24.460 I write to support your ongoing investigations related to these actions
00:06:28.820 and to emphasize my commitment to providing whatever resources you require
00:06:32.200 to continue and deepen them.
00:06:35.280 And the letter goes on to say,
00:06:37.660 The fundamental question regarding the use of presidential pardon authority,
00:06:41.500 Article 2, Section 2,
00:06:43.400 is whether there is an unbroken line from the president to a pardon being granted.
00:06:48.980 Everyone involved in the process,
00:06:50.860 government officials purporting to issue a pardon,
00:06:53.060 the person to whom it is being granted,
00:06:55.300 judicial and law enforcement officials,
00:06:56.920 and most of all the American people,
00:06:58.900 should have absolute confidence a pardon was granted at the president's explicit direction.
00:07:04.360 And look, it's long been the Department of Justice's position
00:07:07.100 that you don't need the president to actually physically sign a pardon,
00:07:11.520 but it has to be the president who makes the decision.
00:07:14.100 It cannot be anyone else who makes the decision.
00:07:16.720 Let's just break that down even more so people understand how simplistic this is,
00:07:21.820 and it's easy to check this box.
00:07:24.580 What you're saying is,
00:07:26.320 somebody communicates,
00:07:27.640 I'll go back to our days in the administration,
00:07:30.560 President Bush, 41, 43, right?
00:07:33.440 They say, yes, I'm going to give that pardon to John Doe or Jane Doe,
00:07:39.200 and then it can be used with the auto pen because it's coming from the president.
00:07:43.560 What we're now witnessing is,
00:07:45.860 it's virtually impossible for this many conversations to have been had
00:07:49.760 in the final moments of Joe Biden's presidency,
00:07:53.160 especially with the cognitive decline,
00:07:54.840 which we now all know about,
00:07:56.680 and for him to have this many conversations about this many people,
00:08:01.360 that's where you're just saying red flags all over the place.
00:08:05.120 Is that a fair way of putting it?
00:08:06.500 Well, it's worse than that.
00:08:08.000 In the first year of the Biden presidency,
00:08:09.900 he signed virtually everything,
00:08:11.480 and as the years went on,
00:08:13.340 he signed less and less and less,
00:08:15.080 and so at the end,
00:08:16.320 they were auto penning virtually everything,
00:08:18.940 and that was contrary to the advice they got from the White House counsel,
00:08:21.740 And what I lay out is there are public reports that call into question
00:08:26.700 whether Joe Biden had any awareness about any of this.
00:08:31.700 And in particular,
00:08:34.680 the letter says,
00:08:35.560 Biden officials also say that past presidents have validly used auto pens
00:08:39.240 even for actions requiring a presidential signature,
00:08:42.260 such as bill signings.
00:08:43.720 The Department of Justice has long maintained
00:08:45.680 that the Constitution does not require a pardon to be signed,
00:08:48.780 and in 1929,
00:08:50.260 the U.S. Solicitor General issued a memo saying that,
00:08:53.140 quote,
00:08:53.220 neither the Constitution nor any statute
00:08:55.040 prescribes the method by which executive clemency shall be exercised.
00:08:59.740 They need not have the president's autograph.
00:09:01.860 So that was DOJ in 1929.
00:09:04.180 However,
00:09:04.880 even and especially in those cases,
00:09:07.700 there must be an absolute assurance
00:09:09.200 that everyone involved knows
00:09:10.800 there is an unbroken line from the president
00:09:12.640 to the pardon.
00:09:14.160 The 1929 OSG memo itself states
00:09:16.680 that when a pardon is signed
00:09:18.260 with the president's,
00:09:19.420 quote,
00:09:19.580 facsimile signature,
00:09:21.260 it should,
00:09:22.560 quote,
00:09:22.700 be certified by an official
00:09:24.380 having charge of the records
00:09:26.040 as having been issued by the president
00:09:28.780 or by his direction.
00:09:31.140 These are core constitutional requirements.
00:09:34.840 And leaked emails
00:09:36.640 further show that the Biden White House
00:09:39.200 implemented a process
00:09:40.180 that separated the president
00:09:41.980 from officials
00:09:42.820 responsible for signing pardons on his behalf.
00:09:45.860 They could not know
00:09:47.360 if they were doing so
00:09:48.700 at the president's direction,
00:09:49.920 either on a case-by-case basis
00:09:51.520 or by following criteria.
00:09:54.000 As a result,
00:09:54.800 emails show
00:09:55.640 officials across the administration
00:09:57.320 struggled to verify
00:09:58.540 that the president,
00:09:59.600 quote,
00:10:00.540 signed off on the specific documents,
00:10:03.400 that the people receiving commutations,

00:10:12.000 accurately reflect his decision,
00:10:13.920 or that the president,
00:10:15.780 quote,
00:10:16.180 agreed to the commutations,
00:10:18.380 the number of commutations,
00:10:20.440 and the date.
00:10:21.580 And these are emails
00:10:22.620 within the Biden White House.
00:10:24.780 In one email,
00:10:26.240 a Biden official stated
00:10:27.820 that the president,
00:10:28.800 quote,
00:10:29.800 doesn't review the warrants,
00:10:32.860 asking how to,
00:10:34.660 quote,
00:10:34.780 handle questions
00:10:36.000 about whether he approved them.
00:10:37.960 And here's what the New York Times
00:10:39.220 reported in July,
00:10:40.320 quote,
00:10:40.560 They also show
00:10:42.300 that the use of the auto pen
00:10:43.600 was managed by Mr. Biden's
00:10:45.020 White House Staff Secretary,
00:10:46.280 Ms. Feldman.
00:10:47.580 She wanted to receive
00:10:48.480 written accounts
00:10:49.160 confirming Mr. Biden's
00:10:50.380 oral instructions
00:10:51.160 in the meetings
00:10:51.820 before having it used
00:10:52.920 to produce the warrants
00:10:53.940 recording the clemency actions,
00:10:55.760 the emails show.
00:10:57.520 The aides referred
00:10:58.520 to those written accounts
00:10:59.720 of the meetings
00:11:00.260 at which Mr. Biden
00:11:01.320 delivered oral decisions
00:11:02.600 as blurbs,
00:11:04.300 quote,

00:11:50.780 of different possible criteria,

00:11:53.760 he wanted to use

00:11:55.880 which convicts
