00:00:35.660 We are anticipating testimony today before the House Oversight Committee from Devin Archer
00:00:39.960 that is expected to be bombshell testimony.
00:00:42.680 It is testimony that Joe Biden does not want Congress to hear.

00:00:49.500 And sadly, we have seen over the weekend the Biden Department of Justice
00:00:54.300 go after Devin Archer, issue an arrest warrant for Devin Archer.
00:00:58.420 They're trying to do everything they can to silence Devin Archer because his testimony is problematic.

00:01:07.080 Devin Archer was Hunter Biden's best friend.

00:01:14.200 Devin Archer was on the board of Burisma with Hunter Biden.
00:01:17.980 Devin Archer also co-founded the investment firm Rosemont Seneca alongside Hunter Biden and John Kerry's stepson, Christopher Hines.
00:01:30.480 Look, these were young boys trading on daddy, and it was good to be a corrupt Democrat.

00:01:38.520 So, Devin Archer is not some fringe character.
00:01:43.240 He was side-by-side with Hunter, side-by-side with Joe throughout all of this.

00:02:15.800 But one of the news we broke that virtually nobody was talking about until we laid it out was the massive change in narrative from Joe Biden in the White House

00:04:03.300 Now, the narrative, Joe Biden's never talked to Hunter about his business dealings, never talked to Hunter about his business dealings, never talked to Hunter about his business dealings, is expected to get blown to smithereens today when Devin Archer testifies to the House.
00:04:17.060 So last week, in anticipation of that testimony, testimony that we are expecting will be that Devin Archer will say that Joe talked dozens of times to Hunter, to Hunter's business partners.

00:04:33.160 It is expected that the testimony today will be miles away from I never talked to him, never talked to him, never talked to him.

00:05:36.480 And it's the fact that they changed it and they thought that no one would notice it.

00:05:42.280 They're admitting now that Joe Biden clearly talked with his son about business and all of the family members.
00:05:48.060 And they're they did that in anticipation of Devin Archer testifying today.
00:05:53.980 That's the only reason why they changed the narrative, because they're expecting that what he's going to say, if they can't stop him from testifying, is going to be, as you just described it.
00:06:02.980 So damning to the Biden crime family that there's no way they could sit up there at the White House that afternoon or the next day and say, no, they did not talk about business because there's overwhelming evidence now from the people that worked with the Bidens of them talking business and selling access to this government.
00:06:21.220 And to Joe Biden when he was in positions of power to make big decisions on behalf of the U.S. in those countries.
00:06:28.920 Well, and the Biden White House or the Biden Department of Justice know that Devin Archer's testimony today is a real problem, that he's very likely going to demonstrate or at least testify that Joe Biden and the Biden White House were lying repeatedly over and over and over again, that they were lying deliberately.
00:06:44.920 And that Joe Biden himself was directly involved in the corruption.
00:06:48.580 That is an enormous threat.
00:06:50.760 So what did they do this weekend on Saturday?
00:06:53.480 The Biden Department of Justice sent a letter.
00:06:57.340 They are trying to arrest Devin Archer, by the way, on Saturday, right before the testimony on Monday.
00:07:04.480 And so the U.S. attorney submitted to the court.
00:07:08.480 I'm going to read you what they submitted to the court.
00:07:10.260 In light of the foregoing, the government respectfully requests that the defendant, that would be Devin Archer, be ordered to surrender at a date and time determined by the court to a facility designated by the Bureau of Prisons to commence his term of imprisonment.
00:07:24.080 The government has confirmed with counsel for the defendant about this request and asked that counsel propose a date for the defendant's surrender.
00:07:31.620 Counsel responded with the following position, quote, Mr. Archer believes it is premature to set a report date in light of his anticipated continuing appeal, as well as the newly discovered sentencing error that the government has now conceded.
00:07:44.620 Counsel for Mr. Archer will put in a response to the government's request by Wednesday.
00:07:49.100 The government disagree with counsel's positions that a report date should not be set and respectfully request permission to respond to any arguments made by the defendant.
00:07:57.760 Now, this is what they're sending on Saturday, 48 hours before Devin Archer is going to go to Capitol Hill, raise his hand and testify.
00:08:06.760 And this can only be understood as an attempt by the Biden DOJ to intimidate, to threaten Devin Archer, to tell him, shut up.
00:08:17.140 We have the prosecutors.
00:08:19.860 And if you talk, the consequences will be severe.
00:08:23.780 This is on its face, I believe, witness intimidation.
00:08:27.860 And by the way, these are the same goons that when Matthew Taibbi was testifying before the House about the Biden administration being in bed with big tech to censor voices they don't like and political enemies of the White House.

00:10:22.860 And I want you to hear how the media is trying, or at least members of Congress,
00:10:29.220 are trying to normalize what happened last week.
00:10:33.000 They understand now that the Biden crime family is at risk of really being exposed.
00:10:39.300 And once we learned what was in that agreement, which was immunity for all prosecutions,
00:10:45.740 that's what they were trying to sneak in there,
00:10:47.320 the judge clearly said, uh-uh.
00:10:49.880 And now there are members of Congress, Democrats, one of them, Congressman Dan Goldman,
00:10:55.500 who tried to normalize a judge stopping a plea agreement and going,
00:11:00.940 oh, this happens every day.
00:11:02.560 Oh, this is not a big deal.

00:11:05.960 I want to turn to the other major development this week involving Hunter Biden.
00:11:10.780 Were you surprised to see the judge in Delaware reject the plea deal?
00:11:15.120 Not reject it, but not accept it?
00:11:17.000 Well, right.
00:11:19.220 I think that there's been a lot of hay made of this.
00:11:23.260 But this is a fairly typical process that goes through.
00:11:27.180 This was an unusual agreement, in part because it's a 24-month agreement,
00:11:33.340 and there's the possibility that Donald Trump will be president.
00:11:36.940 And we know from his presidency how much he weaponized the Department of Justice
00:11:41.100 is to go after his enemies and to favor his associates.
00:11:44.820 And so Hunter Biden's lawyers are concerned that Donald Trump, if he were to get the presidency,
00:11:49.760 would weaponize the Department of Justice.
00:11:52.060 And so there is an added calculation to this.
00:11:55.260 But the fact of the matter is that this is a Trump-appointed U.S. attorney, a Trump-appointed judge.
00:12:01.620 This is a very independent and thorough investigation.
00:12:07.220 And I think that whatever happens in the Hunter Biden case,
00:12:10.380 we can rest assured that it was done based solely on the facts and the evidence
00:12:15.140 and that there was nothing else to it.
00:12:17.860 But you've kind of touched on why this was in there,
00:12:20.840 but the line in the plea agreement that is most important and most controversial is this one.
00:12:26.540 It says the United States agrees not to criminally prosecute Hunter Biden
00:12:31.440 outside of the terms of this agreement or for any federal crimes
00:12:36.300 encompassed by the attached statement of facts.
00:12:38.480 On the attached statement of facts goes into all of his foreign income that he received.
00:12:45.080 That's the center of what Republicans have been talking about from Russia, from China, from Romania.
00:12:51.160 Was that too broad?
00:12:52.380 I mean, to have basically a blanket immunity from anything related to all of that income?
00:12:58.720 No, because that's what they've been investigating for five years.
00:13:01.980 And they ultimately determined they could not charge him.
00:13:05.380 And for whatever reason, we don't know.
00:13:07.400 The House Republicans have no idea what the actual evidence is that David Weiss has.
00:13:12.980 And this was an exhaustive five-year investigation.
00:13:16.780 And so what Hunter Biden's lawyer wanted was some confirmation that they will not charge him
00:13:22.360 for any crimes related to the investigation that they underwent.
00:13:27.660 That's fairly typical.
00:13:29.300 And oftentimes prosecutors and defense lawyers go back and forth about what degree of immunity a defendant will get.
00:13:35.940 But let's remember, this is not as if it's a new investigation.
00:13:40.160 This is five years.
00:13:41.700 And we had testimony of foreign bank accounts, domestic bank accounts, search warrants,
00:13:46.880 hundreds of thousands of documents that they poured over.
00:13:49.820 And ultimately, they decided they could not charge Hunter Biden with it.
00:13:53.000 And that's how the process should work.
00:13:54.380 There's so many things he said in there, Senator, that are just absurd.
00:14:00.440 Go through it, because this is a Democrat that's just making stuff up as he goes.
00:14:05.500 Well, and let's start by who this is talking.
00:14:07.960 So this is Dan Goldman.
00:14:09.220 He's a newly elected Democrat congressman from New York.
00:14:12.880 What did Goldman do before he was elected to Congress as a Democrat?
00:14:17.200 He was the lead lawyer for the House Democrats in Donald Trump's impeachment.
00:14:22.940 So he was working for Adam Schiff.
00:14:24.980 He was Adam Schiff's attack dog.
00:14:27.420 And he brought – look, in many ways, Dan Goldman is intimately intertwined with the creation and birth of the Verdict Podcast,
00:14:35.100 because we launched the first night of the first impeachment when Goldman was bringing an utterly frivolous, abusive impeachment,
00:14:43.600 ironically, alleging quid pro quo concerning Burisma.
00:14:47.680 Everything that Goldman, on behalf of the House Democrats, alleged Donald Trump did,
00:14:53.940 the evidence is now overwhelming that Joe Biden, in fact, did.
00:14:58.620 Not only that, by the way, among other things, Goldman is also unbelievably wealthy.
00:15:04.300 He is an heir to the Levi Strauss fortune.
00:15:07.320 According to his financial disclosures, he's worth up to $250 million.
00:15:13.060 So he has massive money that he inherited.
00:15:16.120 And he now works as a Democrat as a partisan attack dog.
00:15:20.280 And look at what he started with.
00:15:22.780 He said, well, this was an unusual plea agreement.
00:15:26.240 Why?
00:15:26.720 Because he says, we all know that Trump weaponized the Department of Justice.
00:15:32.040 What utter and complete garbage.
00:15:35.100 One of the things to understand about the left, what they do, they will accuse you of doing.
00:15:43.160 These guys, Sigmund Freud, if he was drawing up projection, Dan Goldman would have been the picture that he drew
00:15:50.200 of exactly what the Democrats are guilty of.
00:15:53.820 He wants to allege, I know that the Democrats say the words, Trump weaponized the legal system.
00:16:00.740 What they can't point to is anyone who was prosecuted for political reasons, any of Trump's political enemies they went after,
00:16:09.880 any of Trump's political friends who got exonerated.
00:16:13.900 It is utterly false.
00:16:17.220 And in fact, what happened, the legal system not only was not weaponized in aid of Trump,
00:16:23.080 the hardcore career partisan liberals who had burrowed into the Department of Justice and the FBI and the CIA
00:16:31.000 and the alphabet soup of Washington waged war against Trump.
00:16:35.940 So it is exactly the opposite.
00:16:37.960 But his whole contention is, well, we had to have a special plea agreement here because, you know, Trump could get elected in two years.
00:16:45.880 And so we knew that Trump would weaponize the legal system.
00:16:49.540 Mind you, Goldman doesn't address the Democrats abusing the impeachment process twice.
00:16:54.300 It doesn't address the, what, 143 different indictments against Donald Trump.
00:16:59.060 It doesn't address the absolute double standard applied to Joe Biden, applied to Hunter Biden.

00:17:05.000 He's going to accuse the other side of weaponizing.

00:17:10.160 Well, as you just mentioned it, Senator, there with the facts don't seem to matter.

00:17:18.820 They are now starting to, I think, hedge their bets because they're starting to understand that this narrative is changing quickly.

00:17:29.000 She said that not only was the president talking business, but she also said this exclusively this week on Hannity.
00:17:38.120 Listen, you heard the White House spokeswoman Corrine Jean-Pierre yesterday has just changed the language.
00:17:45.260 She said, oh, I've said this a million times and the answer remains the same.
00:17:48.240 But the answer was completely different.
00:17:49.680 It's now it's the president is not in business with his son.
00:17:55.740 Very different from saying I know nothing about my son's overseas business dealings.
00:17:59.920 So I think that it's overwhelming the evidence already on the table and about to be told by Devin Archer that Joe Biden was meeting with Hunter Biden's overseas business partners.
00:18:11.600 And that, of course, was incredibly important to what Hunter Biden's business was, which was selling influence of his father, then the vice president.
00:18:21.580 In politics, Senator, when you're running for office, people give money, they do donations and they want to make sure that when they give money that you're going to win.
00:18:29.060 If you're a Democrat right now, you're concerned and there are people that are talking that maybe this is our exit ramp moment for Joe Biden.
00:18:38.400 I think that's part of what the media is trying to figure out now is, hey, it's still far enough ahead.
00:18:43.780 If Devin Archer comes out, connects all the cash, the big guy shows, the big guy was in business with Hunter Biden.
00:18:50.180 The plea deal now opens him up to a whole lot more that could come falling down now.
00:18:54.800 Is that part of the reason why you think the media is starting to, you know, change their tune, at least dip their toes in the water of this story?
00:19:02.580 Well, they're definitely getting nervous.
00:19:04.660 And in a minimum, I think they're looking for a plan B.
00:19:07.260 They're looking for a contingency plan.
00:19:09.480 I think their preferred path is still they believe Donald Trump will be the Republican nominee.
00:19:15.300 They believe if Trump is the Republican nominee, that they can nominate Joe Biden again, keep him completely hidden from everyone, lock him in the basement.
00:19:23.940 And they think running against Trump is enough to win in 2024.
00:19:27.820 That might be right.

00:19:29.580 But that's what they believe.
00:19:31.260 As the evidence keeps piling up of Joe Biden's corruption, I do think you are seeing partisan Democrats in the media getting a little more nervous.

00:23:24.700 this Department of Justice has demonstrated that it's perfectly willing

00:23:33.060 to try to intimidate witnesses against testifying against Joe Biden.
00:23:37.640 And in this instance, it was an extraordinarily bad week,
00:23:41.160 but it wasn't just a bad week for Joe Biden and Hunter Biden.
00:23:44.540 It was a bad week for the Biden DOJ.
00:23:47.100 Look, the Biden DOJ came in with this sweetheart deal for Hunter Biden
00:23:51.260 designed to cover up not only Hunter's crimes,
00:23:54.860 but ensure that Joe is not investigated.
00:23:57.540 And the federal judge basically laughed at them
00:24:00.040 because they were trying to be very, very sneaky.
00:24:02.520 The agreement was memorialized in two different documents.
00:24:06.180 Number one, you had the plea agreement on the tax document,
00:24:08.700 on the tax crimes.
00:24:10.380 That was one document.
00:24:11.480 But where they were doing all of the work was in a second document they filed
00:24:16.920 that dealt with the gun crime in particular.
00:24:21.680 And they filed a diversion agreement on the gun crime.
00:24:26.240 So Hunter Biden agreed that he committed two misdemeanor tax crimes
00:24:30.200 and he agreed to pay a fine but not serve a day in jail.
00:24:33.400 That was the plea agreement.
00:24:34.900 There's a second agreement that was the diversion agreement.
00:24:37.540 The diversion agreement, Hunter Biden agreed that he possessed a firearm,
00:24:41.280 which was illegal because he is a drug user and drug addict.
00:24:45.360 And under federal law, it is illegal for a drug user and drug addict
00:24:48.100 to possess a firearm.
00:24:49.600 That normally carries jail time.
00:24:52.280 But he got a special diversion agreement,
00:24:55.140 which for 24 months, if he manages to stay out of jail
00:25:00.340 and not commit additional crimes, that crime will go away.
00:25:06.300 Now, buried within the diversion agreement
00:25:09.280 is a reference that tries to piggyback all of the other language
00:25:17.360 that was in the tax agreement.
00:25:20.600 And it was basically a very sneaky way
00:25:23.940 of trying to get the Department of Justice to promise
00:25:29.100 we will not prosecute Hunter Biden for anything else.
00:25:33.540 We won't prosecute him for any other tax crimes.
00:25:35.800 We won't prosecute him for being a foreign agent.
00:25:39.260 We won't prosecute him for corruption.
00:25:42.020 We won't prosecute him for bribery.
00:25:44.420 Everything that we discuss in the other document,
00:25:47.480 mind you, that's the plea agreement on the tax crimes,
00:25:49.800 is just incorporated by reference in the diversion agreement.
00:25:53.060 And what happened is the judge called him out on it.
00:25:57.040 And in particular, the judge in open court asked,
00:26:01.940 could the government bring a charge
00:26:04.020 under the Foreign Agents Registration Act?
00:26:06.800 Now, the prosecutor,
00:26:08.840 particularly after a month of everything that's been covered
00:26:11.640 about the testimony in the House
00:26:13.400 and everyone focusing on the efforts to protect Joe Biden
00:26:17.380 and to cover up Hunter Biden,
00:26:18.520 the prosecutor was embarrassed.
00:26:20.000 He didn't want to stand up and say,
00:26:21.260 oh, no, we're not going to prosecute that.
00:26:22.860 So the prosecutor says, yes.
00:26:25.860 And suddenly Hunter Biden's attorney says,
00:26:27.800 I don't agree.
00:26:29.340 And the whole thing got blown up
00:26:32.760 because they were trying to do it in secret
00:26:35.040 and hoping no one would notice.
00:26:36.580 Well, that's very bad for Hunter and Joe,
00:26:42.000 but it's also very bad for the Biden Department of Justice.
00:26:45.340 When the Department of Justice is trying to play politics
00:26:48.820 and cover up corruption, that's a real problem.
00:26:51.700 And so what do they do?
00:26:52.820 They immediately turn around
00:26:54.240 and file yet another indictment against Donald Trump.
00:27:00.500 This one is what is called a superseding indictment.
00:27:04.200 A lot of people don't understand.
00:27:06.220 So it is essentially an updated indictment.
00:27:10.020 So it takes the old indictment and it updates it.
00:27:13.460 So it adds a couple of additional counts,
00:27:17.000 claims of criminal violations.
00:27:19.420 It also adds a new defendant.
00:27:21.100 So the new defendant is Carlos de Oliveira,
00:27:25.200 who worked at Mar-a-Lago.
00:27:27.480 And the new count is a obstruction conspiracy count
00:27:34.560 that focuses in particular on, quote,
00:27:39.500 attempting to delete security footage at Mar-a-Lago
00:27:42.800 to conceal information from the FBI and grand jury.
00:27:49.540 So the two pieces that are relevant are,
00:27:54.060 A, they added someone new, de Oliveira,
00:27:57.360 who along with Nauta, who's the other assistant to Donald Trump
00:28:01.920 who is indicted and being charged,
00:28:04.860 what they allege is that de Oliveira and Nauta, quote,
00:28:08.280 loaded several of Trump's boxes along with other items on aircraft
00:28:11.700 that flew Trump and his family north for the summer.
00:28:14.020 So de Oliveira is alleged to be part of hiding the classified documents.
00:28:19.400 Look, the addition of a new defendant,
00:28:23.580 that poses some risk because the standard approach for a prosecutor
00:28:28.740 is to try to focus on the little fish,
00:28:30.820 to put a lot of heat on the little fish,
00:28:32.780 get them scared out of their minds,
00:28:34.400 and get them to flip on the big guy.
00:28:36.680 By the way, just pause for a second and notice
00:28:39.620 that's exactly what they did not do with Hunter Biden and Joe Biden.
00:28:43.860 There was no effort to put pressure on Hunter Biden
00:28:46.420 and get him to flip on the big guy.
00:28:49.000 Rather, instead, according to the IRS whistleblowers,
00:28:51.700 the objective of DOJ was to prevent anyone from asking about the big guy.
00:28:56.160 They don't want to know about the big guy.
00:28:58.360 This is just about Hunter and his drugs.
00:29:00.160 It has nothing to do with the millions flowing to Joe Biden.
00:29:03.640 Well, the reason why de Oliveira being at it is potentially significant
00:29:09.200 is what DOJ is going to try to do is lean on him really hard
00:29:13.480 and cause him to flip against Donald Trump.
00:29:16.180 I don't know this fellow.
00:29:17.040 I don't know if he will or not, but that is the consequence of that.
00:29:21.340 And then the additional allegation that de Oliveira
00:29:28.200 attempted to delete security footage at Mar-a-Lago,
00:29:32.680 that's a new piece.
00:29:35.060 We don't know what the facts are behind that.
00:29:39.540 Deleting security footage to cover something up,
00:29:42.740 that allegation could be problematic.
00:29:46.380 We don't have enough details from the indictment to know
00:29:50.060 what was on that footage, why it was being deleted,
00:29:53.860 was it deleted, was the deletion routine,
00:29:56.740 what to the extent you are actively hiding evidence.
00:30:01.860 That's called obstruction of justice.
00:30:03.800 And so that's why it is charged as obstruction of justice.
