00:00:45.500 on the eve of Hunter Biden's plea deal,
00:00:47.540 he's supposed to be in court at 9 o'clock,
00:00:50.100 and apparently there could be some people that are sanctioned
00:00:54.440 for misrepresenting to the court what they were doing with Hunter Biden.

00:01:02.160 Well, we have massive breaking news that broke last night.
00:01:05.420 So this morning at 9 a.m.,
00:01:08.740 Hunter Biden is scheduled to appear in federal court
00:01:11.500 and plead guilty to two misdemeanor charges
00:01:14.520 for failure to pay taxes in 2017 and 2018.
00:01:17.360 He is also expected to avoid prosecution
00:01:21.480 on a separate felony gun possession charge
00:01:24.760 of illegally possessing a firearm as a drug user.
00:01:29.240 All of that is scheduled to go down at 9,
00:01:31.600 and it's a plea deal that is designed to be a slap on the wrist
00:01:34.300 so that Hunter serves no jail time whatsoever
00:01:37.980 and that its real purpose, as we've discussed,
00:01:41.000 is to protect Joe Biden from any exposure
00:01:47.900 to Hunter's influence, selling, and corruption.
00:01:51.920 Well, last night, a bombshell went off,
00:01:55.380 which is the U.S. District Judge in Delaware,
00:01:57.900 Mary Ellen Norieka, issued an order,
00:02:01.760 and the order is directing Hunter Biden's lawyers
00:02:05.280 to show up at 9 a.m. this morning
00:02:06.940 and explain why they shouldn't be sanctioned
00:02:09.480 for lying to the court.
00:02:11.400 And let me explain what happened here,
00:02:12.720 because this is a big damn deal,
00:02:14.400 and to be honest, I've never seen anything remotely like it.
00:02:17.200 So, the plea hearing this morning,
00:02:20.580 Hunter's expected to come in and plead not guilty.
00:02:23.340 The judge could approve the plea deal today,
00:02:27.260 say, okay, plea deal's done, slap on the wrist,
00:02:29.540 all done, it could be over today.
00:02:31.860 Well, the House of Representatives is dismayed by that.
00:02:35.240 They've seen the hearings on all of the corruption,
00:02:37.720 the evidence that we've discussed at length on this podcast.
00:02:41.820 And so, the House of Representatives filed an amicus brief
00:02:44.880 with the court, laying out the evidence
00:02:47.880 against Hunter and Joe and the corruption,
00:02:50.200 and really making the case that a slap on the wrist
00:02:53.280 is not in the interest of justice.
00:02:55.340 That's pretty unusual.
00:02:56.800 It's not often that a criminal defendant
00:02:59.020 has the House of Representatives
00:03:00.520 of the United States Congress file a brief
00:03:02.600 opposing their sweetheart deal.
00:03:04.840 What happened next is extraordinary.
00:03:09.260 Apparently, Hunter Biden's lawyers picked up the phone
00:03:13.060 and called the clerk's office of the court
00:03:15.660 and pretended to be the lawyers
00:03:19.180 for the House of Representatives.
00:03:22.280 And Hunter Biden's lawyers apparently said,
00:03:25.580 hey, we're the lawyers for the House of Representatives.
00:03:27.440 We filed this amicus brief with attachments.
00:03:29.940 Could you withdraw that, please?
00:03:31.540 We didn't mean to file that.
00:03:32.860 And the clerk's office apparently did so,
00:03:37.160 said, okay, if you want to withdraw that filing, we will.
00:03:40.120 Well, it turns out that at least what the court believes right now
00:03:44.580 is they were lying.
00:03:45.400 And I want to read, because late last night,
00:03:47.920 the court issued a special order.
00:03:50.500 And it's a short order.
00:03:51.540 I'm going to read the order.
00:03:53.200 It's oral order.
00:03:54.560 The court is in receipt of the party's letters regarding the motion for leave
00:03:58.660 to file an amicus brief.
00:04:00.280 As an initial matter, defendant has not indicated what specific information
00:04:03.560 should be sealed or made any showing as required under a particular case.
00:04:09.780 In fact, defendant has not filed a formal request with the court to seal anything.
00:04:13.780 The court will temporarily place the document under seal until the close of business
00:04:17.360 on July 26th to afford defendant the opportunity to try to make the requisite showing.
00:04:22.580 Should the defendant fail to make that showing, the document will be unsealed in its entirety.
00:04:27.160 In addition, the court has reviewed the allegations in Mr. Catilla's letter,
00:04:30.720 that's the lawyer for the House, made to the clerk's office regarding the amicus materials.
00:04:36.160 Mr. Catilla asserts that an individual associated with the firm representing defendant Hunter Biden
00:04:43.500 called the clerk's office, pretending to be associated with Mr. Catilla
00:04:48.680 and requesting the amicus materials be removed from the docket, which the clerk's office did.
00:04:55.780 The response from defendant's counsel on this issue was that, quote,
00:04:59.920 as far as he was aware, the managing attorney from Latham called the clerk's office to note
00:05:04.200 that personal tax information of the defendant had been filed in a non-redacted manner
00:05:08.880 and to inquire regarding having the information sealed and that, quote,
00:05:13.040 the clerk took the filing down on their own accord.
00:05:17.080 Defendant's counsel also added that he hoped Mr. Catilla had, quote,
00:05:20.300 an affidavit from the clerk in support of his version of the events.
00:05:24.380 The court has discussed the matter with relevant individuals in the clerk's office
00:05:27.680 and has been informed that the caller, Ms. Jessica Bengals,
00:05:31.700 represented that she worked with Mr. Catilla, in other words, the House's lawyer,
00:05:38.380 and requested the amicus materials be taken down because they contain sensitive grand jury,
00:05:43.800 taxpayer, and Social Security information.
00:05:46.320 Here's the critical language from the court's order last night.
00:05:49.260 It appears that the caller misrepresented her identity and who she worked for
00:05:57.100 in an attempt to improperly convince the clerk's office to remove the amicus materials from the docket.
00:06:06.340 Therefore, it is hereby ordered that, on or before 9 p.m. today, on July 25th,
00:06:13.540 counsel for the defendant shall show cause as to why sanctions should not be considered
00:06:20.400 for misrepresentations to the court.
00:06:24.340 Now, Ben, I've got to say, I've practiced law a lot of years,
00:06:29.520 just about 30, nearly 30 years now.

00:06:32.220 I don't know another instance where a lawyer for one party calls the court

00:07:23.960 But the DOJ and Hunter Biden's lawyers were hoping this would be a quiet little plea hearing where we got a plea agreement.

00:07:34.360 Instead, the judge is saying, tell me why I should not sanction Hunter Biden's lawyer for lying to me and pretending to be the lawyer for the House of Representatives.

00:08:29.260 It is clear the Biden DOJ wants the plea deal taken because the plea deal is designed to, number one, make Hunter Biden the fall guy, but do it in a way that there's zero jail time, the most serious charges have gone away, and that's just a little slap on the wrist.
00:08:44.500 But, number two, most critically, this is designed to protect Joe Biden.
00:08:50.680 If this plea deal gets thrown out.

00:08:53.880 What happens next?
00:08:54.760 That was the question I was going to ask you is if he throws it out and says, no, I don't accept this, then what happens next in this case?
00:09:01.440 Does that mean that all the other things that they didn't have to deal with now all of a sudden become a reality in this?
00:09:08.040 No, what would happen if the plea deal is thrown out, so Hunter can withdraw his guilty plea because the guilty plea is based on a plea deal, and the judge could say, try your case.
00:09:18.620 You have brought charges against Hunter Biden.
00:09:21.080 We want to see you try your case, and we're going to impanel a jury and have a trial.
00:09:26.440 But then at the end of it, the judge can say, I'm going to sentence the defendant if he's found guilty, that I'm not going to take the plea deal, that I've determined this plea deal is not in the interest of justice.
00:09:37.420 If the judge determines that Hunter Biden's lawyers have lied to the court, have misrepresented, and this order says the judge thinks they have.
00:09:47.840 Now, the judge may be mistaken, but what the order says is she went and asked the clerk's office, hey, what did the lawyer who called you say?
00:09:57.060 And according to the order she entered, that's what made her enter the order to show cause why Hunter Biden's lawyer should not be sanctioned.
00:10:05.720 I have, in nearly 30 years of practicing law, never seen an order like this, and I got to say, if you're Hunter Biden's lawyers right now, you are freaking out, and if you're the Biden DOJ desperately wanting to protect the big guy, you're freaking out.
00:10:24.240 This is a major development.
00:10:25.480 Is it just one lawyer that would be sanctioned, the one that made the phone call, or is there a good chance that all the lawyers on the case that knew that this happened, are they going to be held accountable for this, basically, in essence, because it would be a strategy that they would have done as a legal team?

00:10:46.000 The lawyer who's most directly on the hook is the lawyer who is accused of lying to the court, and each lawyer is an officer of the court, and you have an ethical obligation to the court, and so that lawyer is the one most directly at risk.
00:10:59.300 But if it turns out other lawyers on Hunter Biden's defense team knew about it, directed her to do this, were part of the decision to do this, they could all be sanctioned.

00:15:04.040 And Devin Archer, who was Hunter Biden's former best friend, he was his business partner.
00:15:08.280 They were both on the board of Burisma together.
00:15:11.520 Apparently, Devin Archer is going to testify, according to the report in The New York Post, that Hunter Biden would dial in his father, then Vice President Joe Biden, on speakerphone in the meetings with his overseas business partners, according to testimony expected before Congress this week from Devin Archer.

00:15:31.060 We are looking forward very much to hearing from Devin Archer about all the times he has witnessed Joe Biden meeting with Hunter Biden's overseas business partners when he was vice president, including on speakerphone.
00:15:40.760 One such meeting was in Dubai, late in the evening of Friday, December 4th, 2015, after a board meeting of the Ukrainian energy company Burisma, which was paying Hunter $83,000 a month as director.
00:15:52.960 Archer, who was also director, is expected to testify that after dinner with Burisma board at the Burjal Arab Hotel, he and Hunter traveled six miles north to the Four Seasons Resort Dubai at Jiraiya Beach to have drinks with Hunter's friends.
00:16:10.760 While they were sitting outside at the bar, Vadim Pozharsky, a senior Burisma executive, phoned to ask where they were because Burisma's owner, Mikhaila Zlochevsky, who we talked about a lot on Monday's pod, needed to speak to Hunter urgently.
00:16:26.380 Soon afterwards, the two Ukrainians joined Hunter and Archer at the Four Seasons bar, and Pozharsky asked Hunter, can you ring your dad?
00:16:35.100 At the time, it was early afternoon Friday in Washington, D.C.
00:16:37.720 Hunter then called his father, put him on speaker, placed the phone on the table, and introduced the Ukrainians to Joe Biden by names as Nikolai and Vadim.

00:16:55.500 Joe Biden greeted the Ukrainians, but spoke only in vague pleasantries, Archer is expected to testify.
00:17:00.240 They will note in context that three days after the speakerphone call, Joe Biden was due to fly to Kiev to address the Ukrainian parliament.
00:17:11.400 Ten weeks before the call, on September 24th, 2015, the U.S. ambassador had given a speech about corruption in Ukraine, in which he targeted Zlochevsky by name.
00:17:24.240 But by then, the Ukrainian prosecutor general, that's Viktor Shokin, who we talked about again at length on Monday's podcast.

00:21:48.720 There's a subsequent article came out in The Federalist that is entitled Joe Biden allegedly interacted with son's clients more than 200 times.
00:21:57.420 So you've got the story from The New York Post for Miranda Devine that Biden spoke with foreign businessmen and potential investors for Hunter at least 24 times.
00:22:11.380 But The Federalist reports that there are more than 180 other episodes where the president interacted with his son's business partners.
00:22:20.980 So, for example, then President Joe Biden reportedly met with Ukrainian, Russian and Kazakhstan business partners at Cafe Milano, which is a really shi-shi restaurant in Washington, D.C.
00:22:33.760 Vadim Pozharsky, an executive at Burisma, thanked Hunter in writing for the introduction to his father.
00:22:42.080 So here's an email that Pozharsky wrote, quote,
00:22:46.840 Dear Hunter, thank you for inviting me to D.C.
00:22:50.980 And giving me an opportunity to meet your father and spend some time together.
00:23:00.020 Now, by the way, Joe Biden says, nope, never talked to my son about business.
00:23:04.260 Pozharsky, the Ukrainian Burisma official, says, hey, thanks for introducing me to your dad.
00:23:08.200 Give me the opportunity to meet your father.
00:23:09.880 I mean, it is stunning.
00:23:14.580 Visitor's logs show that Hunter Biden's business associates visited the White House.

00:28:22.840 And it's something that you led on with the Strategic Oil Reserves, the Petroleum Reserves,
00:28:28.120 that have been raided by this administration to artificially drop the price of gas before
00:28:33.940 the midterm elections.
00:28:35.380 And they don't seem to be wanting to put oil back in our Strategic Oil Reserves as well.
00:28:41.200 That is a national security issue.
00:28:42.760 But you also did some other things.
00:28:44.560 Tell us about this victory.
00:28:46.240 Well, that's exactly right.
00:28:47.180 The Strategic Petroleum Reserve was established to protect our national security and our energy
00:28:52.840 security, that if we get at a time of warfare, if we get at a time of crisis, that we have
00:28:57.120 oil we could rely on, that we won't have our economy grind to a halt.
00:29:00.580 And it's there for emergencies.
00:29:02.360 It's not there to be a slush fund for Democrat presidents to try to cover their rear end in
00:29:07.540 an election.
00:29:08.680 Well, Joe Biden last year sold 180 million barrels of oil from the Strategic Petroleum
00:29:16.720 Reserves.
00:29:17.620 And the reason is he was trying to drive down gasoline prices right before the election,
00:29:21.600 not because he wants prices low.
00:29:23.360 Mind you, Biden wants prices higher and higher and higher.
00:29:26.080 He just wants them to dip right before an election.
00:29:28.400 So he thinks the voters won't notice that.
00:29:31.040 Now, the result of those sales is it pushed the levels in the Strategic Petroleum Reserve to
00:29:37.560 the lowest they've ever been in 40 years.
00:29:41.240 And last July, as part of selling 39 million barrels from the Strategic Petroleum Reserve,
00:29:49.060 the Biden administration sold 1 million barrels to Unipec America, which is a subsidiary of
00:29:57.320 China's Sinopec.
00:29:58.660 And I will point out also that Hunter Biden, our friend who knows how to monetize daddy,
00:30:06.460 has done business with the Chinese entities that are profiting off of daddy's sales of
00:30:13.560 oil to the Strategic Petroleum Reserve.
00:30:16.580 It is corrupt.
00:30:17.820 It's also stupid that we would take our oil there to keep our economy, our national security
00:30:23.540 safe and sell it to China, our enemy.
00:30:25.940 So I introduced an amendment to ban the United States government, to ban the Biden administration
00:30:33.100 from selling oil from the Strategic Petroleum Reserve to China, to Russia, to Iran, or to
00:30:41.460 North Korea.
00:30:42.720 Basic principle, let's not sell our oil that's here to keep us safe to our enemies that are
00:30:48.600 not there to keep us safe.
00:30:50.420 We forced a vote in the Senate last week.
00:30:53.460 This was an amendment that was authored by me and Joe Manchin.

00:32:11.820 The lead Democrat who opposed me is Chris Murphy,
00:32:14.320 very, very liberal senator from Connecticut.
00:32:16.540 And what's the reasoning for not just him,
00:32:18.840 but the other 14 to oppose this?
00:32:21.600 Well, let me give you their own reasoning.
00:32:23.180 So in the last Congress, I went to the Senate floor
00:32:25.420 and I tried to pass this by unanimous consent.
00:32:27.660 And one of the ways you get things passed in the Senate
00:32:29.760 is you can pass it by unanimous consent where you stand up
00:32:32.800 and if nobody objects, it passes.
00:32:34.360 And a lot of stuff gets passed that way.
00:32:36.360 So I went to the Senate floor.
00:32:37.820 I said, look, this is basic common sense.
00:32:39.440 No one should object.
00:32:40.220 Let's pass this.
00:32:41.480 Chris Murphy from Connecticut came and objected.
00:32:44.560 And one of the things I argued is I said, look,
00:32:47.180 there's a war waging in Ukraine right now.
00:32:50.480 We should not be selling oil to our enemies.
00:32:52.920 If anything, we should be selling to our friends
00:32:55.020 and not enriching our enemies.
00:32:57.860 Chris Murphy countered with Democrat legislation
00:33:00.440 that would prohibit all sales of oil and gas,
00:33:04.280 not just from the Strategic Petroleum Reserve,
00:33:06.200 but from any private entity in the United States
00:33:08.380 to any foreign nation.
00:33:11.520 And the two of us had a debate on the Senate floor
00:33:14.260 where I said, wait a second,
00:33:15.240 I'm standing up saying America should not send oil
00:33:18.160 to our enemies.
00:33:20.480 Yeah, makes sense.
00:33:21.620 I think it makes common sense.
00:33:22.120 This isn't crazy, right?
00:33:23.640 The Democrats are countering with,
00:33:26.600 we shouldn't sell oil to our friends.

00:34:26.580 precisely because they want to be

00:34:34.160 they are weakening America and helping China,
00:34:36.900 which is why the Senate overwhelmingly said,
00:34:39.780 stop doing that.
00:34:41.160 And I got to say,
00:34:41.820 it says a lot that Senate Democrats voted
00:34:43.600 to say, Joe Biden, stop doing that.

00:34:46.740 And that shouldn't be very controversial at all.
