00:03:23.740There's very little new in this indictment that you couldn't get reading the pages of the Washington Post in the days after the 2020 election leading up to January 6th.
00:03:37.160Almost all of this has been covered in the newspapers.
00:03:40.500And essentially what this indictment does is take all the facts.
00:03:44.800And in particular, they really, really, really don't like that Donald Trump alleged that there was voter fraud in the 2020 election and that it changed the outcome.
00:03:55.360Now, I get that they don't like that, but not liking it is not the same as saying Trump saying that on Twitter, on any mountaintop from which you could say it, is somehow criminal conduct.
00:04:10.160And I think, you know, looking at this, I was surprised after all this investigation, after millions of dollars, after prosecutors with subpoena power putting people at risk of going to jail, I was surprised that there wasn't a smoking gun in here.
00:04:26.940There wasn't something that frankly breaks news.
00:04:30.400At this point, the only news is, aha, they indicted him and then they get to repeat everything they said for the last two years.
00:04:38.120This is a political indictment brought by a political prosecutor working for a political attorney general, working for a political president who does not want to risk losing to Donald Trump in November of 2024.
00:04:55.720And what Joe Biden, what Merrick Garland, what Jack Smith, what all the apparatchiks in the Biden Justice Department want is they want, number one, they want Trump to win the Republican nomination.
00:05:06.940And they've now figured out every time they indict Trump, his numbers go up in the primary.
00:05:15.680And then number two, their nirvana is to have multiple criminal trials against Donald Trump, all proceeding ideally in September and October of 2024.
00:05:27.380And they believe they'll throw so much mud on the wall that Trump will be unelectable.
00:05:35.600I understand why they have that political objective, but it's not the rule of law.
00:05:40.240It's not what the Department of Justice is supposed to be doing.
00:05:42.740My question for you and for so many Americans right now is how did we get to a point where this could even happen and how is it possible that there can be this clear in a sense transparency on the weaponization of the Department of Justice?
00:06:01.180Where it's like, OK, every single time there's bad news for the Biden crime family, immediately we indict Donald Trump, who is hands down the frontrunner now for the GOP nomination.
00:06:11.780Is this not political interference, the worst we've ever seen in American modern political history?
00:06:17.580And is there anyone that can stop them from doing this?
00:06:21.940It is almost at this point mind boggling where we are as a country in the United States of America in 2023.
00:06:29.160Well, unfortunately, we've entered banana republic territory in over two centuries of our nation's history.
00:06:35.400No president of the United States has ever been indicted.
00:06:39.280We now have a former president who, as you note, is the leading opposition candidate to be the next president who's been indicted not once, not twice, but three times.
00:06:49.160And in all likelihood, it will be four times.
00:06:51.940That is, we're almost numb to how unprecedented that is.
00:06:59.860If you look at this latest indictment, the circumstances of it are highly problematic.
00:07:07.260This indictment has been brought in D.C.
00:07:10.340The case was assigned to a federal district judge, a judge named Tanya Chutkin.
00:07:15.780Judge Chutkin was appointed to the D.C. District Court by Barack Obama.
00:07:23.280And she has a reputation for being far left, even by D.C. District Court standards.
00:07:30.240Judge Chutkin, for example, has set aside numerous federal death penalty cases.
00:07:35.680And she is the only federal judge in Washington, D.C., who has sentenced January 6th defendants to sentences longer than the government requested.
00:07:48.500So in terms of the judge, we can anticipate a judge who is going to be relentlessly hostile to Donald Trump, who is going to bend over backwards for the Biden DOJ, and who is going to make ruling after ruling after ruling against Trump.
00:08:07.640Now, to be clear, she doesn't want this to go to trial now.
00:08:09.740She doesn't want it to go to trial in a week.
00:08:11.100She doesn't want it to go to trial in a month.
00:08:13.800DOJ wants Trump to get the nomination, so this trial can't happen too quickly.
00:08:18.080They want it to happen after he's nominated, but before the general election.
00:08:21.800And I will tell you, if it goes to trial, you will have a jury that is drawn from the District of Columbia.
00:08:29.300The District of Columbia is the jurisdiction in the United States that is the most Democrat of any jurisdiction in the country in terms of a district or a state.
00:08:40.900Over 90 percent of the voters in D.C. vote Democrat, voted for Joe Biden, voted for Hillary Clinton, consistently vote Democrat.
00:09:03.960That's a big part of the reason why the Biden DOJ wants to bring this case in D.C.,
00:09:10.260which means with a far-left judge and a far-left jury, there is a very real possibility that Donald Trump ends up being convicted.
00:09:24.620Now, I think on appeal, that conviction will not stand.
00:09:31.340But it might stand in the D.C. Circuit.
00:09:34.440An appeal would go to the D.C. Circuit.
00:09:36.240It would depend what panel you get on the D.C. Circuit whether a conviction would stand.
00:09:41.000I think the ultimate outcome of any Donald Trump conviction on this indictment would be a reversal in all likelihood at the U.S. Supreme Court.
00:09:52.360I would note the last time Jack Smith played this game, the last time Jack Smith indicted a serious, credible Republican presidential candidate.
00:11:03.320That is a very dangerous scenario that is, I think, exceptionally bad, A, for the rule of law, but B, for democracy.
00:11:12.260Whether you want Donald Trump to be the next president or not, that question should not be answered by a corrupt Department of Justice weaponizing the legal system.
00:11:22.620I want to tell you about an incredible trip that we are going to be taking as Verdict listeners, and I want you to be a part of it.
00:11:30.120We are going to be heading to the Holy Land, to Israel.
00:11:33.860Israel is the cradle of Judaism, Christianity, and many of the principles that we hold dear as Americans.
00:11:42.080You're going to visit sites like the Armageddon Battlefield, Nazareth, Jericho, Jerusalem, Bethlehem, just to name a few.
00:11:49.960You're going to set sail on the Sea of Galilee and float on the Dead Sea.
00:11:55.080You'll walk up the steps of biblical figures like King David and Jesus Christ, and we'll do it all together with other listeners from around the country.
00:12:03.980I'm going to meet up with you in Jerusalem and experience with you the city's great sights like the Western Wall, the Temple Mount.
00:12:11.160This trip will deepen your understanding of the Bible and of Western civilization, and will leave you with friends and memories that will last a lifetime.
00:12:20.280Now, you've got plenty of time to plan for this trip.
00:12:22.880It is May the 6th through the 15th of 2024, next year.

00:13:31.640Listen to the Honest Talk podcast on iHeartRadio or wherever you listen to your podcasts.
00:13:37.380Senator, I want to ask you another question.
00:14:40.180Instead, he's using the favor of prosecutors, these type of conspiracy and obstruction claims.
00:14:46.380I mean, you hear Turley talk about that, Senator.
00:14:50.140And before we get to even just some of the timing aspects of this, the way he's describing it is this is an incredibly weak case to bring it forward.
00:14:59.900So is it not just to tie up Donald Trump from having to deal with this and to claim that he's, you know, under indictment and he's got a mugshot and that he could go to prison?
00:15:09.380You don't want that guy to be your president.
00:15:17.540You've got to understand this Department of Justice hates Donald Trump and they've given up any pretense of impartiality, of objectivity.
00:15:28.760We've seen it with their complete double standard when it comes to Hunter Biden and his pattern of criminal conduct.
00:15:34.920We've seen it with their repeated willingness to obstruct justice and cover up investigations into Joe Biden.
00:15:40.900For them, partisan politics has superseded the responsibility of fidelity to law.
00:15:50.500A major reason, I believe, for the timing of it is because the Devin Archer testimony was incredibly damaging to Joe Biden.
00:15:59.460And look, let's give a real and practical example.
00:16:03.380So this podcast is coming out Wednesday morning.
00:16:06.560You and I got online to record it Tuesday afternoon.
00:16:12.360We had an entire podcast planned on Devin Archer, on the testimony that was given that was highly significant, that should have led the podcast.
00:21:07.420It does not appear to have been a direct business tie.
00:21:10.400Because right now you don't see any conduct that's illegal, that there is regulation or law that's prohibiting it, even though it might be highly unethical.
00:21:17.960I don't see high crimes and misdemeanors.
00:21:51.780The media is lying to you like they would cover up for communists in China, for Vladimir Putin in Russia, and they're doing it all synchronized, just like that music, just like that montage.
00:22:06.320Now, we had something interesting that happened.
00:22:08.320When we do this podcast, I want to bring you behind the scenes for a moment, just so you understand.
00:22:17.000We both connect through this technology called Comrex.
00:22:19.320While we were taping, there looked to have been a power surge that blew out our piece of equipment, this Comrex, where the center is, and we did everything to try to get reconnection, couldn't do it.
00:22:32.160So this is the reason why you're not hearing a response right now from Senator Cruz, because, and look, we always try to just tell you how it works here on the show.
00:22:44.500I can promise you, Senator Cruz and I are not going to become engineers anytime soon in broadcasting.
00:22:49.200We did the best we could, but as we were taping this at midnight, this is where we are.
00:22:55.080So we will be back on Friday and continue this conversation, which is obviously very important, but I just wanted you to know what just happened, and that's why you're not hearing the senator's voice right now.
00:23:07.760So I promise you, we are going to continue this on Friday.
