00:00:39.780 June 8th, Jack Smith indicted Trump in the Mar-a-Lago document case.
00:00:45.260 Fast forward to July the 26th, Hunter Biden goes to court and rejects this sweetheart plea
00:00:51.640 deal for the judge said uh-uh after it was revealed that the Biden Department of Justice
00:00:56.580 tried to give Hunter Biden blanket immunity from all future prosecutions.
00:01:02.420 The very next day after that sweetheart deal fell apart on July the 27th, Jack Smith added
00:01:09.320 more charges for Trump in the Mar-a-Lago case.
00:01:13.500 Move just a few days later to July the 31st, Hunter Biden's former business partner testifies
00:01:20.220 to Congress, Devin Archer, that Joe Biden was on over 20 calls with his son's business partners

00:01:53.640 This is straight-out election interference by the Biden Department of Justice.
00:01:57.620 We have talked at great length about how incredibly politicized the Department of Justice is.

00:02:03.380 Every time there's a bad development on evidence of corruption or criminal misconduct by Hunter Biden,
00:02:09.240 or in particular Joe Biden, the next day you see the Department of Justice try to change the narrative,

00:02:23.840 Because they desperately wanted to drive off of the news Devin Archer's testimony.
00:02:29.360 That was very bad for Joe Biden.
00:02:31.000 And the best way to do it is to count on the useful idiots in the media who will happily echo their latest charges against Donald Trump.
00:02:41.480 We are looking right now at three different indictments of Donald Trump, one state and two federal.
00:02:48.860 And in all likelihood we'll see a fourth indictment of Donald Trump in Atlanta from another state prosecutor.
00:02:56.160 This one was supposed to be the big enchilada.
00:03:00.240 This is the one that Democrats and the corporate media have been salivating for.
00:03:04.780 This was finally going to get him.
00:03:07.340 They are Captain Ahab and he is their Moby Dick and they want to get Donald Trump.
00:03:13.100 And I got to say, I sat down and read this indictment and my biggest sentiment was that it was thoroughly underwhelming.
00:03:21.680 There's very little there, there.
00:03:23.740 There's very little new in this indictment that you couldn't get reading the pages of the Washington Post in the days after the 2020 election leading up to January 6th.
00:03:37.160 Almost all of this has been covered in the newspapers.
00:03:40.500 And essentially what this indictment does is take all the facts.
00:03:44.800 And in particular, they really, really, really don't like that Donald Trump alleged that there was voter fraud in the 2020 election and that it changed the outcome.
00:03:55.360 Now, I get that they don't like that, but not liking it is not the same as saying Trump saying that on Twitter, on any mountaintop from which you could say it, is somehow criminal conduct.
00:04:10.160 And I think, you know, looking at this, I was surprised after all this investigation, after millions of dollars, after prosecutors with subpoena power putting people at risk of going to jail, I was surprised that there wasn't a smoking gun in here.
00:04:26.940 There wasn't something that frankly breaks news.
00:04:30.400 At this point, the only news is, aha, they indicted him and then they get to repeat everything they said for the last two years.
00:04:38.120 This is a political indictment brought by a political prosecutor working for a political attorney general, working for a political president who does not want to risk losing to Donald Trump in November of 2024.
00:04:55.720 And what Joe Biden, what Merrick Garland, what Jack Smith, what all the apparatchiks in the Biden Justice Department want is they want, number one, they want Trump to win the Republican nomination.
00:05:06.940 And they've now figured out every time they indict Trump, his numbers go up in the primary.
00:05:12.160 That makes them really happy.
00:05:14.120 They want Trump to be the nominee.
00:05:15.680 And then number two, their nirvana is to have multiple criminal trials against Donald Trump, all proceeding ideally in September and October of 2024.
00:05:27.380 And they believe they'll throw so much mud on the wall that Trump will be unelectable.
00:05:33.940 That's their political objective.
00:05:35.600 I understand why they have that political objective, but it's not the rule of law.
00:05:40.240 It's not what the Department of Justice is supposed to be doing.
00:05:42.740 My question for you and for so many Americans right now is how did we get to a point where this could even happen and how is it possible that there can be this clear in a sense transparency on the weaponization of the Department of Justice?
00:06:01.180 Where it's like, OK, every single time there's bad news for the Biden crime family, immediately we indict Donald Trump, who is hands down the frontrunner now for the GOP nomination.
00:06:11.780 Is this not political interference, the worst we've ever seen in American modern political history?
00:06:17.580 And is there anyone that can stop them from doing this?
00:06:21.940 It is almost at this point mind boggling where we are as a country in the United States of America in 2023.
00:06:29.160 Well, unfortunately, we've entered banana republic territory in over two centuries of our nation's history.
00:06:35.400 No president of the United States has ever been indicted.
00:06:39.280 We now have a former president who, as you note, is the leading opposition candidate to be the next president who's been indicted not once, not twice, but three times.
00:06:49.160 And in all likelihood, it will be four times.
00:06:51.940 That is, we're almost numb to how unprecedented that is.
00:06:59.860 If you look at this latest indictment, the circumstances of it are highly problematic.
00:07:07.260 This indictment has been brought in D.C.
00:07:10.340 The case was assigned to a federal district judge, a judge named Tanya Chutkin.
00:07:15.780 Judge Chutkin was appointed to the D.C. District Court by Barack Obama.
00:07:23.280 And she has a reputation for being far left, even by D.C. District Court standards.
00:07:30.240 Judge Chutkin, for example, has set aside numerous federal death penalty cases.
00:07:35.680 And she is the only federal judge in Washington, D.C., who has sentenced January 6th defendants to sentences longer than the government requested.
00:07:48.500 So in terms of the judge, we can anticipate a judge who is going to be relentlessly hostile to Donald Trump, who is going to bend over backwards for the Biden DOJ, and who is going to make ruling after ruling after ruling against Trump.
00:08:05.840 She wants this to go to trial.
00:08:07.640 Now, to be clear, she doesn't want this to go to trial now.
00:08:09.740 She doesn't want it to go to trial in a week.
00:08:11.100 She doesn't want it to go to trial in a month.
00:08:13.800 DOJ wants Trump to get the nomination, so this trial can't happen too quickly.
00:08:18.080 They want it to happen after he's nominated, but before the general election.
00:08:21.800 And I will tell you, if it goes to trial, you will have a jury that is drawn from the District of Columbia.
00:08:29.300 The District of Columbia is the jurisdiction in the United States that is the most Democrat of any jurisdiction in the country in terms of a district or a state.
00:08:40.900 Over 90 percent of the voters in D.C. vote Democrat, voted for Joe Biden, voted for Hillary Clinton, consistently vote Democrat.
00:08:50.400 They are not Donald Trump supporters.
00:08:53.400 The likelihood that a D.C. jury will vote to convict Donald Trump is exceptionally high, and the facts don't matter.
00:09:01.160 The laws don't matter.
00:09:02.580 They hate him.
00:09:03.960 That's a big part of the reason why the Biden DOJ wants to bring this case in D.C.,
00:09:10.260 which means with a far-left judge and a far-left jury, there is a very real possibility that Donald Trump ends up being convicted.
00:09:24.620 Now, I think on appeal, that conviction will not stand.
00:09:31.340 But it might stand in the D.C. Circuit.
00:09:34.440 An appeal would go to the D.C. Circuit.
00:09:36.240 It would depend what panel you get on the D.C. Circuit whether a conviction would stand.
00:09:41.000 I think the ultimate outcome of any Donald Trump conviction on this indictment would be a reversal in all likelihood at the U.S. Supreme Court.
00:09:52.360 I would note the last time Jack Smith played this game, the last time Jack Smith indicted a serious, credible Republican presidential candidate.

00:10:04.520 Merrick Garland and DOJ found, I think, the only guy on the planet, as far as I know,
00:10:09.180 who was previously indicted a leading candidate for president that was a Republican.
00:10:13.740 They brought him back and said, hey, you did that so well, would you do it again?
00:10:16.940 Again, the last time Jack Smith did that was Bob McDonnell, then the governor of Virginia.
00:10:23.500 He got a conviction and it went all the way to the Supreme Court and it was unanimously reversed.
00:10:30.420 But you know what?
00:10:31.340 If that happens in this case, that'll be two, three years from now.
00:10:35.480 That'll be after the election.
00:10:37.200 That will be with Bob McDonnell.
00:10:38.740 Jack Smith had done his job.
00:10:40.280 The job was not to put him in jail.
00:10:42.020 The job was to hurt him politically, to take him out, to destroy his career.

00:10:50.280 And what is dangerous about this particular indictment with a judge and a jury that are likely to be stacked against Donald Trump,

00:11:03.320 That is a very dangerous scenario that is, I think, exceptionally bad, A, for the rule of law, but B, for democracy.
00:11:12.260 Whether you want Donald Trump to be the next president or not, that question should not be answered by a corrupt Department of Justice weaponizing the legal system.

00:13:46.400 And Jonathan Turley also talked about the disinformation aspect, this indictment.

00:13:57.820 And one of the things I was looking for is I assumed that Smith had this type of aha moment,
00:14:03.740 that there's something in there that the January 6th committee didn't find, that supported.
00:14:09.740 We heard about witness tampering.
00:14:11.680 It's not in there.
00:14:12.840 I mean, everything in this indictment is basically what has been discussed in the news.
00:14:17.720 Now, by the way, the other thing that is not in here is conspiracy for incitement.
00:14:22.860 Not in here is a seditious conspiracy.
00:14:26.900 Those were the claims that Democrats used in the impeachment and said that the evidence was absolutely clear.
00:14:33.260 People like Schiff and others said that he's clearly guilty of those crimes.

00:14:40.180 Instead, he's using the favor of prosecutors, these type of conspiracy and obstruction claims.

00:14:50.140 And before we get to even just some of the timing aspects of this, the way he's describing it is this is an incredibly weak case to bring it forward.
00:14:59.900 So is it not just to tie up Donald Trump from having to deal with this and to claim that he's, you know, under indictment and he's got a mugshot and that he could go to prison?

00:16:25.240 But as we're sitting there preparing for the podcast to come out Wednesday morning,
00:16:29.600 we start getting over the phone information that Trump had tweeted out that he was going to be indicted at 5 p.m.

00:16:39.060 And we look at that and go, well, we can't record this if he's indicted at 5 p.m.
00:16:43.540 because the podcast will be ridiculous if it doesn't actually talk about that.
