Verdict with Ted Cruz - BONUS POD： Trump Triumphs in Court as Grassley Blows Lid Off Deep State

00:00:00.000 This is an iHeart Podcast.

00:00:02.640 Guaranteed human.

00:00:04.840 The Democrats should just do a simple extension.

00:00:07.740 That's the best way.

00:00:08.880 The Democrats are holding it up.

00:00:10.620 They want $1.5 trillion for people that came out of prisons,

00:00:14.640 for illegal aliens to come into our country.

00:00:17.480 We don't want to do that because that will really hurt the health care that we have in our country.

00:00:22.280 And frankly, we'd like to see better health care, period.

00:00:25.540 You're listening to the 47 Morning Update with Ben Ferguson.

00:00:29.340 Good Tuesday morning.

00:00:30.540 It's nice to have you with us on the 47 Morning Update.

00:00:33.060 Ben Ferguson with you.

00:00:34.300 And here are the two big stories that are coming out of the White House this morning.

00:00:37.640 First up, there was a massive win for the president when it comes to deploying the National Guard,

00:00:43.280 this time coming from the 9th U.S. Circuit decision,

00:00:47.160 dealing with him doing exactly this in Portland.

00:00:51.060 And what does this mean for other cities around the country?

00:00:54.020 Also, a massive bombshell, this time coming from Senator Chuck Grassley,

00:00:58.340 saying he now has proof that Biden's Attorney General, Merrick Garland,

00:01:03.100 and Deputy Attorney General, Lisa Monaco,

00:01:05.900 plus the FBI Director, Christopher Wray,

00:01:08.920 all personally approved opening Arctic Frost

00:01:12.680 to go after Donald Trump and conservatives that were aiding and supporting him.

00:01:19.700 I'll have more details on that in a second.

00:01:21.960 But first, every so often something happens that reminds us just how fragile our freedoms are.

00:01:27.620 We can't afford to take our rights for granted.

00:01:30.840 We must draw a line in the sand.

00:01:33.280 And our friends at Patriot Mobile have been doing just that for more than 12 years.

00:01:38.600 The truth is, there is only one provider that boldly stands in the gap for Americans

00:01:43.760 who believe freedom is worth fighting for.

00:01:46.100 And that company is Patriot Mobile.

00:01:48.140 Not only are they leading the red economy,

00:01:50.960 they're also outpacing the competition in technology.

00:01:53.920 Patriot Mobile is one of the only carriers offering premium access

00:01:59.600 to all three major U.S. networks,

00:02:02.480 giving you nationwide coverage and service that you can count on day after day.

00:02:07.300 They also offer unlimited data plans,

00:02:10.100 mobile hotspots, international roaming,

00:02:12.820 internet backup, and so much more.

00:02:15.040 And switching has never been easier.

00:02:16.880 You can activate in minutes on your phone from your home or your office.

00:02:22.400 And you keep your same number you've got now,

00:02:24.100 keep your same phone, or upgrade to a new one.

00:02:26.740 And this is where the magic happens.

00:02:28.800 Every month, about 5% of your bill is given back to conservative causes

00:02:33.500 at no extra cost to you

00:02:35.180 that stand up for our First and our Second Amendment rights,

00:02:38.600 the rights of unborn children,

00:02:40.480 and our wounded warriors,

00:02:42.120 and those that have fought for our country and wear a badge.

00:02:45.320 So take a stand today.

00:02:47.380 Go to PatriotMobile.com slash Ben47

00:02:51.900 or call 972-PATRIOT.

00:02:55.860 And if you use the promo code Ben47,

00:02:58.940 you're going to get a free month of service.

00:03:02.940 That's PatriotMobile.com slash Ben47

00:03:06.700 or 972-PATRIOT and make the switch today.

00:03:11.920 It's the 47 Morning Update, and it starts right now.

00:03:16.120 Story number one.

00:03:17.560 The Ninth Circuit saying that President Trump can send the National Guard to Portland

00:03:21.660 is another massive win for law and order.

00:03:25.860 And if you think that the left is going to sit down and just say,

00:03:29.900 okay, fine, the president's going to be able to be the president,

00:03:33.220 and he has the authority to do this,

00:03:35.060 and he was elected to do it,

00:03:36.560 you're wrong. 0.83

00:03:37.720 MSNBC having a total meltdown

00:03:39.720 as Lisa Rubin had to read the Ninth Circuit decision 0.95

00:03:43.060 authorizing Trump to deploy the National Guard in Portland.

00:03:46.600 Take a listen to how they spun it on MSNBC.

00:03:49.900 Yeah, and I want to just correct one thing

00:03:51.400 and then explain why functionally it is the same.

00:03:53.580 This is a stay of Judge Immigrant's opinion,

00:03:56.560 and that's why it reached the Ninth Circuit as soon as it did,

00:03:59.380 because this is an emergency motion to essentially pause her order.

00:04:03.100 But as a functional matter, you are absolutely correct.

00:04:06.140 It has the function of overturning her order 0.92

00:04:09.600 and thereby allowing the president to send the National Guard

00:04:12.600 back onto the streets of Portland.

00:04:15.380 And Katie, I want to read, if I can,

00:04:16.900 just from a little bit of the beginning of this 93-page opinion.

00:04:20.560 It says,

00:04:20.880 after considering the record,

00:04:22.560 and by the record they mean all the factual evidence

00:04:24.620 at this preliminary stage,

00:04:26.220 we conclude that it is likely that the president

00:04:28.580 lawfully exercised his statutory authority

00:04:31.600 under 10 U.S.C. section 12406.

00:04:35.380 That's the statute we've been referring to as Title 10

00:04:37.880 when we have conversations about the National Guard deployments,

00:04:40.760 which authorizes the federalization of the National Guard

00:04:43.120 when the president is unable,

00:04:45.620 with the regular forces,

00:04:46.620 to execute the laws of the United States.

00:04:48.680 And this is the important part.

00:04:50.080 The evidence the president relied on reflects,

00:04:52.640 quote,

00:04:53.280 a colorable assessment of the facts and law

00:04:55.580 within a range of honest judgment.

00:04:58.360 We thus conclude that defendants are likely to succeed

00:05:01.660 on the merits of their appeal.

00:05:03.640 Basically saying that when and if a court considers

00:05:06.520 all of the record in this matter is tried

00:05:09.420 and it gets back to an appellate court

00:05:11.380 through an ordinary process

00:05:12.680 where they have full briefing and full evidence,

00:05:14.980 that they still think Donald Trump is likely to prevail there

00:05:18.840 because he has the discretion to determine as the president

00:05:23.320 within a range of honest judgment

00:05:25.340 when it is reasonable to the political party.

00:05:26.720 This is what you and I were talking about last week.

00:05:29.380 It is very clear.

00:05:30.780 The left realizes now they're running out of ways

00:05:33.280 to stop President Trump from doing his job,

00:05:35.940 a job that he was elected by the American people to do.

00:05:39.320 And they're going to do everything they can

00:05:41.420 to continue to try to stop him.

00:05:43.500 But as we witness what is happening now in Portland

00:05:45.880 and the total number of arrests nationwide

00:05:48.460 in the last nine months

00:05:50.060 and law and order

00:05:51.420 that is also being restored to incredibly violent cities

00:05:56.080 like Portland, Washington, D.C., Memphis, Tennessee,

00:05:59.920 and many more to come, including Chicago,

00:06:02.980 what you're witnessing is a president

00:06:04.700 that is doing exactly what he promised he was going to do,

00:06:07.600 keep all Americans safe, no matter where you live.

00:06:12.060 Now, story number two.

00:06:13.260 It happened several years ago,

00:06:14.980 but we're now finally starting to get to the bottom

00:06:17.640 of the corruption at the deep state

00:06:19.800 under Joe Biden's leadership.

00:06:22.060 You may remember us talking about Arctic Frost,

00:06:25.780 and that was an FBI-DOJ investigation

00:06:28.860 that was opened in April of 2022

00:06:31.160 as a, quote, sensitive investigative matter.

00:06:35.160 It focused on efforts they claimed at the time

00:06:38.820 to overturn the 2020 election.

00:06:42.680 That's right.

00:06:43.800 They were saying that Donald Trump

00:06:45.960 was trying to overthrow the will of the people.

00:06:49.020 Multiple outlets and Senator Chuck Grassley's committee

00:06:52.500 are now describing it as a precursor

00:06:55.660 to Jack Smith's D.C. case against Donald Trump.

00:07:00.940 Grassley's office says agents issued hundreds of subpoenas,

00:07:05.780 conducted dozens of interviews,

00:07:07.960 and sought call records for eight Republican senators

00:07:11.280 and one House member

00:07:12.960 from January the 4th through the 7th of 2021.

00:07:16.860 We now know that list has expanded

00:07:19.080 and now includes Senator Ted Cruz.

00:07:21.800 We also know that not only were they spying

00:07:24.160 on elected members of Congress that were Republicans only,

00:07:27.240 they also targeted GOP-aligned organizations.

00:07:32.240 Notable actions linked to Arctic Frost

00:07:35.880 include the FBI's August 9th, 2022 seizure

00:07:40.100 of Representative Scott Perry's phone,

00:07:43.580 surveillance used to locate him,

00:07:45.920 and broader requests tied to alternate electors,

00:07:49.840 later elements fed into Special Counsel Jack Smith's work.

00:07:54.440 Which brings us to the new bombshell.

00:07:58.880 Chuck Grassley has now released documents.

00:08:01.760 He says show proof that the Attorney General Merrick Garland,

00:08:05.900 the Deputy Attorney General Lisa Monaco,

00:08:08.660 and FBI Director Christopher Wray

00:08:10.540 personally approved opening Arctic Frost in April of 2022.

00:08:16.480 Multiple write-ups cite the memo

00:08:18.380 and handwritten sign-offs.

00:08:20.360 And Grassley posted the claims publicly as well.

00:08:24.400 Now Grassley's characterization is simple.

00:08:27.380 He framed Arctic Frost as a sweeping,

00:08:30.160 partisan overreach

00:08:32.100 that weaponized law enforcement

00:08:34.400 and surveilled members of Congress.

00:08:37.900 He ties it to Smith's now-dismissed D.C. case.

00:08:41.800 And that's just the tip of the iceberg.

00:08:44.220 So let's break this down a little bit more.

00:08:46.440 The former Attorney General Merrick Garland

00:08:48.960 and former FBI Director Wray

00:08:50.760 decided to approve the sensitive matter.

00:08:54.180 And that led to the surveillance

00:08:55.660 of virtually every Republican

00:08:57.620 that we know of right now.

00:08:59.580 It helped spark a Special Counsel probe,

00:09:02.200 which was what it was designed to do

00:09:03.700 into Donald Trump's, quote,

00:09:05.580 efforts to overturn the 2020 election.

00:09:08.620 That obviously was a lie.

00:09:11.140 Grassley now signed the new documents

00:09:13.040 he received from the Department of Justice.

00:09:15.120 And Garland's approval

00:09:16.720 of the sensitive investigation matter

00:09:18.840 on April the 5th of 2022,

00:09:21.920 recommended by the Deputy Attorney General,

00:09:24.500 Lisa Monaco.

00:09:25.560 And what it did was authorize

00:09:27.620 the FBI's Washington Field Office

00:09:30.340 to launch a, quote,

00:09:32.380 full investigation

00:09:33.800 into what officials described

00:09:36.540 as a articutable factual basis

00:09:39.260 indicating the existence

00:09:40.540 of a federal crime, quote, unquote.

00:09:42.960 They said it involved Trump

00:09:44.920 and individuals closely associated

00:09:47.540 with Donald Trump,

00:09:48.680 which is exactly how they opened

00:09:50.160 the fishing expedition

00:09:51.600 to go after Trump

00:09:53.220 and to try to lock him up.

00:09:55.120 Now, the launch of Arctic Frost

00:09:56.740 and the investigation

00:09:57.800 would then lead to the appointment

00:09:59.900 of the Special Counsel Jack Smith

00:10:01.800 in November of 2022.

00:10:04.440 Quote, proof that Biden

00:10:06.140 Attorney General Merrick Garland,

00:10:07.780 Deputy Attorney General Lisa Monaco,

00:10:09.320 and FBI Director Wray,

00:10:11.120 all personally approved

00:10:12.720 opening Arctic Frost,

00:10:14.640 Grassley said in his statement.

00:10:16.400 This investigation

00:10:17.380 unleashed unchecked government power

00:10:19.920 at the highest levels.

00:10:22.280 My oversight will continue,

00:10:24.460 Grassley says.

00:10:25.780 Grassley also announced

00:10:26.820 earlier this month

00:10:28.020 that at least nine Republican senators

00:10:30.600 now were targeted

00:10:31.640 by the FBI in this probe.

00:10:33.660 On October the 6th,

00:10:35.460 Grassley said FBI agents

00:10:37.020 conducted toll record analysis,

00:10:40.120 a form of communications

00:10:41.380 metadata review

00:10:42.580 on several GOP lawmakers,

00:10:45.300 including Senator Lindsey Graham

00:10:46.700 of South Carolina,

00:10:48.180 Joss Harley of Missouri,

00:10:49.660 Ron Johnson of Wisconsin,

00:10:51.380 and Marsha Blackburn of Tennessee.

00:10:53.540 The toll analysis of the phones

00:10:55.320 could have revealed

00:10:56.380 whom each lawmaker contacted

00:10:58.420 by call or text

00:11:00.100 in the days surrounding

00:11:01.100 the January the 6th,

00:11:03.180 2021 Capitol riot.

00:11:05.920 Grassley called this

00:11:07.000 worse than Watergate.

00:11:09.580 In addition,

00:11:10.660 92 Republican

00:11:11.940 or conservative-aligned groups

00:11:13.960 and individuals,

00:11:15.520 including Turning Point USA,

00:11:17.820 co-founded

00:11:18.420 by slain conservative leader

00:11:20.680 Charlie Kirk

00:11:21.420 were also targeted,

00:11:23.400 suggesting that Arctic Frost

00:11:25.180 was, quote,

00:11:26.000 much broader

00:11:26.740 than just an electoral matter,

00:11:29.560 Grassley said

00:11:30.200 during the briefing.

00:11:31.720 He said this shows now

00:11:33.480 that they were targeting

00:11:34.760 their political adversaries.

00:11:37.320 Arctic Frost wasn't just a case

00:11:39.160 to politically investigate Trump.

00:11:41.720 It was the vehicle

00:11:42.600 by which partisan GOP agents

00:11:45.260 and DOJ prosecutors

00:11:47.340 could achieve their partisan ends

00:11:50.360 and improperly investigate

00:11:52.180 the entire Republican political apparatus,

00:11:56.640 Grassley added.

00:11:57.440 FBI Director

00:11:59.140 Cash Patel

00:12:00.120 also coming out

00:12:01.640 vowing transparency

00:12:03.500 and accountability

00:12:05.020 following the revelations

00:12:07.040 after Grassley's announcement.

00:12:08.960 We terminated employees.

00:12:11.420 We abolished

00:12:11.960 the weaponized

00:12:12.840 CR-15 squad

00:12:14.880 and we initiated

00:12:16.200 an ongoing investigation

00:12:17.740 with more accountability

00:12:19.220 measures ahead,

00:12:20.400 Patel said.

00:12:21.720 CR-15

00:12:22.400 was the FBI's

00:12:23.980 Washington field office squad

00:12:25.840 focused on investigating

00:12:27.580 federal public corruption.

00:12:29.880 In reality,

00:12:30.440 it was just going

00:12:31.560 after conservatives.

00:12:33.420 In May,

00:12:34.060 the FBI quietly disbanded

00:12:35.880 CR-15

00:12:36.800 and reassigned its agents

00:12:38.980 as part of a broader

00:12:40.140 reorganization

00:12:41.160 and shift in priorities.

00:12:43.920 So here we are

00:12:45.100 with even more evidence

00:12:46.600 that the Biden administration

00:12:48.160 did everything they could

00:12:49.780 not only to go after

00:12:51.220 Donald Trump,

00:12:52.080 but to go after anyone

00:12:53.300 that supported

00:12:54.280 Donald Trump politically

00:12:55.680 and any up-and-coming

00:12:57.560 conservative

00:12:58.300 that they found a threat

00:12:59.920 was then put on their list

00:13:01.440 to be investigated.

00:13:03.400 Thank goodness

00:13:04.020 President Trump

00:13:04.800 is now in the Oval Office

00:13:06.100 and the people around him

00:13:07.740 are making sure

00:13:08.800 that this

00:13:09.400 never happens again.
