00:00:37.640 First up, there was a massive win for the president when it comes to deploying the National Guard,
00:00:43.280 this time coming from the 9th U.S. Circuit decision,
00:00:47.160 dealing with him doing exactly this in Portland.
00:00:51.060 And what does this mean for other cities around the country?
00:00:54.020 Also, a massive bombshell, this time coming from Senator Chuck Grassley,
00:00:58.340 saying he now has proof that Biden's Attorney General, Merrick Garland,
00:01:03.100 and Deputy Attorney General, Lisa Monaco,
00:01:05.900 plus the FBI Director, Christopher Wray,
00:01:08.920 all personally approved opening Arctic Frost
00:01:12.680 to go after Donald Trump and conservatives that were aiding and supporting him.

00:03:53.580 This is a stay of Judge Immigrant's opinion,
00:03:56.560 and that's why it reached the Ninth Circuit as soon as it did,
00:03:59.380 because this is an emergency motion to essentially pause her order.
00:04:03.100 But as a functional matter, you are absolutely correct.
00:04:06.140 It has the function of overturning her order
00:04:09.600 and thereby allowing the president to send the National Guard
00:04:12.600 back onto the streets of Portland.
00:04:15.380 And Katie, I want to read, if I can,
00:04:16.900 just from a little bit of the beginning of this 93-page opinion.

00:04:22.560 and by the record they mean all the factual evidence

00:04:26.220 we conclude that it is likely that the president
00:04:28.580 lawfully exercised his statutory authority

00:04:35.380 That's the statute we've been referring to as Title 10
00:04:37.880 when we have conversations about the National Guard deployments,
00:04:40.760 which authorizes the federalization of the National Guard
00:04:43.120 when the president is unable,
00:04:45.620 with the regular forces,
00:04:46.620 to execute the laws of the United States.
00:04:48.680 And this is the important part.
00:04:50.080 The evidence the president relied on reflects,
00:04:52.640 quote,
00:04:53.280 a colorable assessment of the facts and law
00:04:55.580 within a range of honest judgment.
00:04:58.360 We thus conclude that defendants are likely to succeed
00:05:01.660 on the merits of their appeal.
00:05:03.640 Basically saying that when and if a court considers
00:05:06.520 all of the record in this matter is tried
00:05:09.420 and it gets back to an appellate court
00:05:11.380 through an ordinary process
00:05:12.680 where they have full briefing and full evidence,
00:05:14.980 that they still think Donald Trump is likely to prevail there

00:06:25.780 and that was an FBI-DOJ investigation

00:06:35.160 It focused on efforts they claimed at the time
00:06:38.820 to overturn the 2020 election.

00:06:43.800 They were saying that Donald Trump
00:06:45.960 was trying to overthrow the will of the people.
00:06:49.020 Multiple outlets and Senator Chuck Grassley's committee
00:06:52.500 are now describing it as a precursor
00:06:55.660 to Jack Smith's D.C. case against Donald Trump.
00:07:00.940 Grassley's office says agents issued hundreds of subpoenas,
00:07:05.780 conducted dozens of interviews,
00:07:07.960 and sought call records for eight Republican senators

00:07:12.960 from January the 4th through the 7th of 2021.

00:07:19.080 and now includes Senator Ted Cruz.

00:07:24.160 on elected members of Congress that were Republicans only,

00:07:45.920 and broader requests tied to alternate electors,
00:07:49.840 later elements fed into Special Counsel Jack Smith's work.
00:07:54.440 Which brings us to the new bombshell.
00:07:58.880 Chuck Grassley has now released documents.
00:08:01.760 He says show proof that the Attorney General Merrick Garland,
00:08:05.900 the Deputy Attorney General Lisa Monaco,
00:08:08.660 and FBI Director Christopher Wray
00:08:10.540 personally approved opening Arctic Frost in April of 2022.
00:08:16.480 Multiple write-ups cite the memo
00:08:18.380 and handwritten sign-offs.
00:08:20.360 And Grassley posted the claims publicly as well.
00:08:24.400 Now Grassley's characterization is simple.
00:08:27.380 He framed Arctic Frost as a sweeping,
00:08:30.160 partisan overreach
00:08:32.100 that weaponized law enforcement
00:08:34.400 and surveilled members of Congress.
00:08:37.900 He ties it to Smith's now-dismissed D.C. case.
00:08:41.800 And that's just the tip of the iceberg.
00:08:44.220 So let's break this down a little bit more.
00:08:46.440 The former Attorney General Merrick Garland
00:08:48.960 and former FBI Director Wray
00:08:50.760 decided to approve the sensitive matter.
00:08:54.180 And that led to the surveillance
00:08:55.660 of virtually every Republican
00:08:57.620 that we know of right now.
00:08:59.580 It helped spark a Special Counsel probe,
00:09:02.200 which was what it was designed to do
00:09:03.700 into Donald Trump's, quote,
00:09:05.580 efforts to overturn the 2020 election.
00:09:08.620 That obviously was a lie.
00:09:11.140 Grassley now signed the new documents
00:09:13.040 he received from the Department of Justice.
00:09:15.120 And Garland's approval
00:09:16.720 of the sensitive investigation matter
00:09:18.840 on April the 5th of 2022,
00:09:21.920 recommended by the Deputy Attorney General,
00:09:24.500 Lisa Monaco.
00:09:25.560 And what it did was authorize
