00:00:39.320 There's an extremely important issue that's happening in Washington, D.C. right now

00:00:44.540 They actually led with your comments from this podcast on Fox News Sunday.

00:00:55.520 Think about the same-sex marriage bill, the Respect for Marriage Act,
00:00:59.220 that essentially has gotten through this first vote in the Senate.

00:01:04.000 But it essentially ensures that all 50 states will recognize same-sex marriages from other states.
00:01:08.700 Conservatives are warning, though, that the Biden administration could end up using this as a weapon.
00:01:12.600 Here's something that Senator Ted Cruz said on his podcast about it this week.

00:01:30.560 to persecute the churches and universities and schools and charities.
00:01:35.000 So Senator Mike Lee has offered...
00:01:36.720 First of all, let's make one thing clear.

00:01:39.700 One more time, Ted Cruz is 100% wrong.
00:01:44.260 Okay, let's talk about why.
00:01:45.020 On that statement.
00:01:46.140 You would not see, and one of the things that gained 12 Republican votes,
00:01:50.080 and I think more on Final Passage,
00:01:53.140 is there were greater protections for religious freedom put in.
00:01:55.940 And so you see the Mormon Church.
00:01:59.000 You see a number of mainstream Protestant denominations.
00:02:03.440 You see a series of other faith organizations actually support this marriage equality law.
00:02:10.320 And remember, this marriage equality law is not only about same-sex marriage,
00:02:14.080 but it also validates something that literally 60 years ago in my state of Virginia was illegal,
00:02:21.920 which was interracial marriage.
00:02:23.320 I think this is where the vast majority of Americans are at.
00:02:27.160 I think you will see the numbers even go up in the Senate.

00:02:30.960 As we get to the Final Passage, we saw 47 House members.
00:02:35.560 Mr. Cruz, one more time, saying stuff that has no basis in truth or fact.
00:02:40.440 That's just how we roll.
00:02:43.140 So hold it there.
00:02:45.220 All right, so if you look at that segment, I got to say Mark Warner,
00:02:48.840 he really typifies the Democrats because he calls me a liar
00:02:51.580 while not responding to one word of the substance of what I said.
00:02:56.740 And that really is the Democrat M.O.
00:03:00.480 Listen, this bill, let's talk about what this bill does accomplish and what it doesn't accomplish.
00:03:06.300 The Democrats are pitching this as a bill to protect the right to same-sex marriage
00:03:11.860 and to protect the right to interracial marriage.
00:03:14.480 Well, both of those are protected right now by existing law.
00:03:19.060 The U.S. Supreme Court has held that gay marriage is a right,
00:03:23.760 and it held many decades ago that interracial marriage is a right.
00:03:28.360 That ain't changing.
00:03:29.760 And it's important to note the Democrats pitched this entire bill based on a false premise,
00:03:34.820 which is they suggested there's some chance the Supreme Court might revisit the gay marriage ruling.
00:03:40.920 Well, the majority opinion in Dobbs, the decision overturning Roe v. Wade,
00:03:46.280 said not once, not twice, but three times they were not going to revisit that decision.
00:03:53.440 In fact, the third time, Justice Alito, writing for the majority, said,
00:03:56.640 I don't know how to say this anymore clearly.
00:03:58.780 We are not going back to that decision.
00:04:01.560 So all of this, this bill is based on a lie,
00:04:04.800 which is a bunch of Democrats and a bunch of folks in the media scaremongering
00:04:07.980 that the Supreme Court's going to overturn a decision that they told us three times
00:04:12.120 they're not going to overturn.
00:04:13.520 In other words, it's all political cover for them.
00:04:15.400 It is purely political cover.
00:04:17.500 And it's based on Justice Thomas wrote a concurrence
00:04:22.120 that was examining the legal basis for Roe v. Wade,
00:04:26.220 which is a legal doctrine called substantive due process.
00:04:28.620 And he pointed out that it had been the legal basis for other decisions
00:04:33.200 like the gay marriage decision.
00:04:34.960 But no other justice joined Clarence Thomas in that concurrence.
00:04:39.320 So unless you believe that Joe Biden is going to nominate
00:04:43.460 and the Senate is going to confirm four new justices to the court
00:04:47.600 who are to the right of Clarence Thomas,
00:04:50.980 the chances of the Supreme Court overturning that decision are 0.0%.
00:04:55.180 And Mark Warner knows that.
00:04:56.840 Every Democrat knows that.
00:04:58.100 But this is scaremongering.
00:04:59.720 So you say, OK, if the court's not going to overturn it,
00:05:02.900 what harm does this bill do?
00:05:04.960 Well, let me tell you, this bill does considerable harm
00:05:07.600 because you know what this fight really is about.
00:05:11.400 It is about the Biden administration being able to persecute people of faith,
00:05:18.720 being able to persecute churches, K-12 schools,
00:05:24.260 universities, and charities that believe...
00:05:28.820 Specifically, they're religious-based and Christian.
00:05:31.720 Christian, or for that matter, Jewish, or for that matter, Muslim,
00:05:35.460 any religious organization that believes marriage is the union of one man and one woman.
00:05:40.540 So whatever it might be.
00:05:42.480 And let me point out, this is not a hypothetical threat.
00:05:44.900 I want to read to you from the transcript at the Obergefell oral argument,
00:05:50.360 which was the gay marriage oral argument,
00:05:52.360 where the Solicitor General, Don Varelli, he was in the Obama Justice Department,
00:05:57.300 and Justice Alito asked whether the next step would be for universities opposed to same-sex marriage
00:06:07.560 to lose their tax-exempt status.
00:06:09.880 So this is in the oral argument, and here's what General Varelli replies,
00:06:13.180 quote,
00:06:13.820 It's certainly going to be an issue.
00:06:16.680 I don't deny that.
00:06:18.200 I don't deny that.
00:06:19.860 Justice Alito, it's going to be an issue.
00:06:23.760 That's what the Obama DOJ said.
00:06:26.200 And this bill is all about teeing up the Obama, or rather the Biden IRS,
00:06:32.840 to target Christian university, Christian schools, churches, and charities.
00:06:38.360 And by the way, this is also not hypothetical.
00:06:40.380 The city of Philadelphia went after and targeted Catholic charities
00:06:44.240 and said they're not allowed to engage in adoptions
00:06:48.100 because Catholic charities in Philadelphia won't provide an adoption for a same-sex couple.
00:06:53.780 Now, to be clear, same-sex couples can adopt kids in Philadelphia.
00:06:57.220 There are lots of adoption agencies they can use.
00:07:00.520 But the city of Philadelphia said, well, if Catholic charities won't participate,
00:07:04.160 you're out of the business.
00:07:05.060 This bill is all about setting up the IRS to start stripping tax-exempt status
00:07:12.280 from organizations they hate.

00:09:06.540 this conviction about traditional marriage is his wording.

00:11:04.160 Now, what happened here with the Mormon Church,
00:11:07.200 because actually he goes on to repeat Mormon Church like 19 times.
00:11:10.420 Well, unfortunately, there is a senator who supports this bill from the state of Utah,
00:11:17.800 who's named Mitt Romney,
00:11:18.920 who happens to have some real juice within the Mormon Church.
00:11:22.860 He's kind of a big deal in Utah.
00:11:26.160 And Mitt Romney has pulled out all the stops lobbying his church,
00:11:30.020 and he convinced one senior figure in the church to put out a statement in favor of this bill.
00:11:36.000 That senior figure, I'm sorry to say, got terrible legal advice.
00:11:39.320 And if Mitt Romney weren't lobbying the heck out of it,
00:11:43.540 I assume they wouldn't have done the statement, but Mitt was able to get it done.
00:11:46.980 Now, what Shannon Bream there says is the provisions in the bill are toothless, and they are.
00:11:54.480 So what the bill is, the Democrats put into the bill language that says,
00:11:58.540 nothing in this bill shall be construed to deny tax-exempt status to anybody.
00:12:04.480 Now, this is, I'm going to explain something to you, and this is why people hate lawyers.
00:12:11.200 Nobody's suggesting the bill is going to deny tax-exempt status.
00:12:14.840 What's going to happen is after the bill passes,
00:12:18.060 the Biden IRS is going to deny tax-exempt status,
00:12:21.600 and they're going to say, you know what?
00:12:23.000 It's not the bill doing it.
00:12:24.280 It's us.

00:12:27.960 And so Mike Lee has drafted an amendment.
00:12:29.920 It's a strong amendment that prohibits the Biden IRS from stripping tax-exempt status

00:12:45.580 And it's not controversial.
00:12:46.880 What he's asking for is exactly what anyone would ask for in this scenario.
00:12:51.560 They're just terrified that you would take away the power of the IRS
00:12:54.180 to then literally destroy conservative Christian religious organizations.

00:13:00.720 So it is controversial because today's Democrats hate religious liberty.

00:13:10.160 Mike Lee's amendment would prevent them.
00:13:12.260 Now, you just heard Mark Warner say several times we offered him a vote.
00:13:16.900 And this is where actually verdict takes people inside the Senate in a way it's really hard
00:13:21.280 if you're not serving in the body to understand the games that are being played.

00:13:26.180 They did offer a vote, said we'll have a vote on the floor of the Senate

00:13:33.240 Now, here's what will happen if there's a vote on the Senate floor at a 50-vote threshold.

00:13:44.220 There are 50 of them.

00:13:46.120 And there are also 12 Republicans who are supporting this.

00:13:50.900 By the way, even if every Republican voted for Mike Lee's amendment.

00:14:35.240 Those 12 are Susan Collins of Maine, Rob Portman of Ohio, Tom Tillis of North Carolina,
00:14:41.840 Mitt Romney of Utah, who's leading the charge on this, Lisa Murkowski of Alaska, Roy Blunt
00:14:47.360 of Missouri, Richard Burr of North Carolina, Shelley Moore Capito of West Virginia, Cynthia
00:14:52.080 Lummis of Wyoming, Dan Sullivan of Alaska, Todd Young of Indiana, Joni Ernst of Iowa.
00:14:57.860 Those are the 12.
00:14:59.920 Now, I'm going to set aside for a second that several of those are retiring.
00:15:04.040 Rob Portman's retiring.
00:15:06.100 Roy Blunt's retiring.
00:15:07.320 Richard Burr's retiring.
00:15:08.840 And I find it particularly noxious that retiring Republican senators run and embrace the left
00:15:14.760 on the way out in a way they would be very unlikely to do so if they actually had to face the voters

00:15:19.240 Had to run for your action, yeah.
00:15:20.260 But you know what?
00:15:21.160 This will be very popular on K Street when they're lobbyists.

00:15:29.740 If you want to prevent the Biden IRS from targeting and persecuting Christian churches, schools,
00:15:38.860 universities, and charities, three of these 12 need to say to the Democrats, either adopt
00:15:47.640 Mike Lee's amendment or we will vote no on cloture on Monday.
00:15:53.660 If three of the 12 grow one vertebrae of a spine.
00:16:01.540 And this is where, look, my frustration with Republicans.
00:16:05.700 This should not be a hard one, by the way.

00:16:09.920 There shouldn't even be 12 to start with.

00:16:20.200 And I'll tell you, I was talking with one of the Democrat leads last week in the cloakroom.
00:16:25.860 And that senator was saying, well, the Democrats won't accept Mike Lee's amendment.

00:16:33.760 If you don't accept the amendment, the answer ought to be your bill won't pass.

00:17:14.420 If the 12 Republicans declined to stand up to the Democrats and say, I will vote no on cloture unless Mike Lee's amendment is adopted, not a fake vote, not a pretend show vote.

00:17:30.120 If that doesn't happen, my prediction is in the next two years.

00:17:40.940 I'm going to bet you $100 that if the Republicans can't find a backbone, that in the next two years, the Biden IRS will go after Liberty University to strip their tax-exempt status.

00:17:58.220 And the Democrats are playing games trying to hide from it.
00:18:02.960 And they also see an opportunity here.

00:18:07.280 They understand that there are some senators that would traditionally say no to this, who are retiring, and they can get them to say yes to it now.

00:18:17.780 And by the way, it's designed so that this key vote is the Monday after Thanksgiving.

00:18:25.240 So it's scheduled for 5.30 p.m. on Monday.
00:18:27.220 So everyone flies in and you literally get off the airplane and come straight to vote.
00:18:31.100 So there's no discussion among Republicans and what they're counting on.
00:18:35.480 Look, I understand why these 12 Republicans voted for this.
00:18:41.140 There's no doubt public views on gay marriage have changed.
00:18:44.560 And there are now a significant percentage of Americans who support gay marriage.
00:18:49.740 And those numbers have changed dramatically.
00:18:51.540 Not too long ago, Barack Obama and Hillary Clinton pretended they opposed gay marriage.
00:18:56.980 So, I mean, there's no doubt the public opinion has changed significantly.
00:19:01.280 What I urged my colleagues, I said, listen, if you've decided as a political matter you want to say you support gay marriage, I got a suggestion for you.
00:19:09.800 Type up a press release.
00:19:11.300 And send it out.
00:19:12.080 That says, I, Senator, so-and-so embrace gay marriage and think it's awesome, hunky-dory cool.
00:19:17.200 That's all fine.
00:19:18.180 You want to do a press release?
00:19:19.300 Knock yourself out.
00:19:20.700 Make your own political determinations on that.
00:19:22.680 This is about empowering the Biden IRS to persecute the people they believe that are their enemies.
00:19:34.040 And it's not just the people they deny tax-exempt status to.
00:19:36.660 These abusive thugs that Biden employs are going to go to a hundred different schools and universities and charities and demand change your position, abandon what you believe your faith teaches.

00:20:04.220 To be clear, none of these universities or schools will be able to make it if they lose their tax-exempt status.
00:20:09.440 Just like many of the churches in the country, if they lost their tax-exempt status, they would no longer be able to afford even the property taxes of the church and where it is in their city.

00:20:19.420 It's you're ineligible for any government benefits.

00:20:24.120 So, what did the city of Philadelphia try to do?

00:20:29.100 Now, that got struck down in court, but this bill could change that.
00:20:32.400 That's what makes this so dangerous.
00:20:36.080 Look, you know, a university that refuses to knuckle under, this administration could say no student can get a Pell Grant to go to your university.

00:20:47.000 We're going to use the muscle of the federal government to persecute you.
00:20:52.740 And for the life of me, I don't understand why anyone, much less 12 Republicans, would be part and parcel of empowering the Biden IRS to persecute people of faith.
