00:00:38.420 There's also the leak coming out of the Biden campaign itself that they've begun polling Kamala Harris versus Donald Trump.
00:00:47.060 And we're going to talk about what it means that the internal team, the cabinet and the campaign, is turning on Joe Biden as this freefall continues.

00:01:02.480 which is yesterday on Capitol Hill, there was a big, big victory on Capitol Hill.
00:01:11.180 Y'all recall we had a prior podcast where we discussed this radical left-wing judge that Joe Biden nominated,
00:01:17.600 Sarah Netburn, a magistrate judge in New York, who is an extreme leftist.
00:01:23.220 She was handpicked by Chuck Schumer.
00:01:25.240 And among other things, she has this stunning decision where there was this six-foot-two guy who was a serial rapist,
00:01:34.400 a child rapist, who decided at age 52 that he was a woman.
00:01:39.040 And this judge ordered that he go to a woman's prison and be housed with women.
00:01:47.160 And she disregarded the rights of those women.
00:01:49.720 She disregarded common sense.
00:01:51.540 She disregarded sanity.
00:01:53.140 Well, I cross-examined her a number of weeks ago.
00:01:57.800 And Thursday morning, the Senate Judiciary Committee had the markup when we were voting on it.
00:02:02.580 And I spoke against the nomination, and we had a stunning victory.
00:02:09.360 We're going to get into that in just a moment.

00:02:12.980 This June marked two years since the overturn of Roe v. Wade.

00:03:45.780 but it is not going to be covered by the media.
00:03:48.540 And it's a very, very significant victory to stop this radical judge.
00:03:54.600 How did you get any Democrat to come along and to look at this woman's record
00:04:01.000 and realize this is not someone we should have on the court?
00:04:04.400 Well, I'm going to explain this, but I got to tell you, the victory was a surprise.
00:04:08.440 The Democrats were not expecting it.
00:04:10.140 The chairman of the committee, Dick Durbin, was not expecting for the good guys,
00:04:15.640 for common sense, for reality to prevail.
00:04:18.100 They were assuming they'd get a straight party line vote.
00:04:20.900 That's not what happened.
00:04:21.800 But before I walk through what happened, I want you to hear my remarks at the markup.
00:04:28.400 And this is a little bit lengthy, but this is what I said at the markup,
00:04:33.800 and then I'm going to tell you the results and how it produced a stunning victory.

00:04:45.000 I have deep concerns about Judge Sarah Netburn's nomination,
00:04:48.300 and specifically about her radical rulings that endanger women by placing biological men in women's prisons.
00:04:55.960 And given the avalanche of letters this committee has received from women's groups and female inmates,
00:05:03.020 I'm not the only person with concerns.
00:05:04.640 In the case of J.J.S. v. W.S. Plyler, the prisoner, dubbed July Justine Shelby,
00:05:14.120 his real name is William McClain, was a serial rapist.
00:05:18.440 There's no other way to say it.
00:05:20.580 He was also a six-foot-two, fully intact biological man.
00:05:24.240 His past criminal offenses included child molestation of a nine-year-old boy,
00:05:32.040 rape of a 17-year-old girl,
00:05:35.320 and criminal deviant conduct.
00:05:37.640 No factual details are in the record, but the state defined the offense as, quote,
00:05:42.700 compelling with force or the threat of force, sexual conduct.
00:05:46.740 As a result of these offenses, Shelby was incarcerated for 18 years.
00:05:52.980 One year after being released on parole,
00:05:56.820 Shelby broke parole by circulating violent child pornography.
00:06:03.280 And so back in prison.
00:06:05.380 And at 51 years of age, Shelby decided that he was a woman.
00:06:09.380 And as a self-declared woman, he demanded to be jailed with biological woman.
00:06:14.400 And failing to lock him up with other women, he argued, was a violation of the Eighth Amendment.
00:06:20.360 Now, luckily for Shelby, his lawsuit ended up in front of Judge Netburn.
00:06:24.080 Putting political ideology over justice and reality,
00:06:28.040 Magistrate Judge Netburn recommended that Shelby, quote,
00:06:31.860 be transferred immediately to a woman's facility.
00:06:35.580 Despite a lifelong pattern of rape, sexual assault, and obvious sexually predatory instincts,
00:06:42.160 Magistrate Judge Netburn's opinion declared that, quote,
00:06:47.520 there are no signs that Petitioner is at risk of reoffending.
00:06:53.380 That defies words.
00:06:55.140 Magistrate Judge Netburn doubled down on her commitment to a radical political ideology in her opinion.
00:07:01.640 Casting aside any concerns for the female prisoners,
00:07:05.480 Judge Netburn wrote,
00:07:06.740 Quote, the BOP also posits that permitting Petitioner to live among women
00:07:11.460 will be traumatizing and possibly dangerous to them.
00:07:16.200 This concern is overblown.
00:07:19.040 Those are her words.
00:07:21.040 Netburn's opinion went on, quote,
00:07:22.780 The BOP's repeated refusal to transfer Petitioner to a woman's facility
00:07:26.900 to further her gender transition,
00:07:29.360 despite knowing the condition of Petitioner's physical and mental health,
00:07:33.220 violates the Petitioner's Eighth Amendment rights.
00:07:35.920 This judge's ruling the Constitution requires that biological men who wake up one day and say,
00:07:42.060 I'm a woman, have to be housed with female prisoners.
00:07:45.380 This judge also ruled, in effect, that female prisoners have no rights.
00:07:50.460 The Democrats on this committee like to say they support the rights of women.
00:07:55.500 But we're about to find out whether they do or not.
00:07:57.960 Because in this case, you're taking a six-foot-two man who is a serial rapist,
00:08:04.420 and this judge sent that man to Fort Worth, Texas.
00:08:09.560 I ask that judge, do the women in that prison have any right,
00:08:13.560 if it was your mother, if it was your daughter, if it was your wife,
00:08:17.100 how would you feel if your daughter was housed with a six-foot-two man who's a serial rapist?
00:08:23.180 Because political ideology matters more than sanity.
00:08:27.740 And by the way, the threat that this ideologue said is overblown is happening all over the country.
00:08:36.160 For example, in Judge Netburn's home state of New York in 2024,
00:08:40.340 a former prisoner at Rikers Island claimed that she was groped and raped
00:08:44.440 by a male inmate posing as a transgender woman.
00:08:48.720 There had also been a prior rape attempt at Rikers in 2021
00:08:52.800 by another transgender inmate against a biological female inmate.
00:08:57.680 In New Jersey, in 2022, a transgender inmate impregnated not one but two female inmates.
00:09:07.260 In California, a woman's group sued the Department of Corrections
00:09:11.540 after a transgender prisoner raped two women, impregnating one of them.
00:09:17.440 And in the chairman's home state of Illinois,
00:09:19.900 a female inmate sued the Department of Corrections
00:09:22.500 after she was raped by a transgender inmate.
00:09:25.760 This is happening over and over and over again,
00:09:28.480 and it's because of ideology being put ahead of common sense.
00:09:33.080 At her hearing, I asked Judge Netburn,
00:09:34.940 Do you regret your decision transferring a serial rapist,
00:09:39.220 a biological man, to a woman's prison?
00:09:41.940 Her answer was, quote,
00:09:43.680 No.
00:09:44.820 I faithfully applied the law to the facts.
00:09:47.300 That is not the law, and these are not the facts.
00:09:50.280 As I mentioned at the outset,
00:09:51.500 this committee has received letters from female prisoners
00:09:53.860 horrified at the prospect of being housed with a biological male,
00:09:58.620 fearing quite reasonably for their safety.
00:10:01.160 Interestingly, the chairman has not read to you
00:10:04.700 the letters those female inmates have sent to this committee
00:10:08.380 pleading on this committee to use some common sense.
00:10:12.940 I'm going to read a couple for you.
00:10:14.100 Alyssa Kay, a current inmate,
00:10:16.980 here's what she wrote to us, quote,
00:10:19.020 People are already getting raped, and nobody cares.
00:10:23.620 Honestly, someone in here is going to end up getting killed.
00:10:26.740 Having men here in prison with us disrupts any sense of rehabilitation,
00:10:31.160 we fear for our safety,
00:10:33.540 we have further loss of privacy as we are forced to share intimate spaces with a man.
00:10:40.420 We watch as some prisons are victims of abuse,
00:10:45.160 and others willingly engage in sexual acts in our shared space.
00:10:49.420 This isn't right.
00:10:51.480 This isn't fair.
00:10:53.140 Do any of our Democratic members care about Alyssa Kay's concerns?
00:10:56.980 How about Amy I, a former inmate?
00:10:59.160 Here's what she wrote to us to say, quote,
00:11:00.960 I urge the committee to watch my story
00:11:03.540 and the story of other female prisoners
00:11:05.940 and a brave, resigned lieutenant
00:11:08.180 who spoke out against this anti-woman policy.
00:11:13.180 Women, including incarcerated women,
00:11:15.300 just because a woman is in a prison doesn't mean she loses her rights.
00:11:18.440 That's me talking, not the letter.
00:11:19.760 I'll get back to the letter.
00:11:21.080 Women, including incarcerated women,
00:11:22.900 shouldn't be erased as a matter of law

00:11:34.700 Evelyn V., a former inmate, she wrote to us and said, quote,
00:11:37.640 As a former inmate in the California state prison system,
00:11:41.620 I share your concern about how women's rights are being pushed aside
00:11:45.340 compared to the interests of men who are self-identifying at women
00:11:49.060 and gaining entry to facilities meant for women.
00:11:52.720 Now, at the hearing, Judge Netburn told us again she thinks concerns
00:11:56.860 of the risk of Shelby engaging in sexual re-offense are, quote,
00:12:01.640 overblown.
00:12:03.380 I strongly disagree, and as it happens, we now have facts.
00:12:08.520 Just yesterday, yesterday,
00:12:12.160 exquisite timing, by the way, on this markup,
00:12:14.640 yesterday, the Washington Free Beacon reported that Shelby,
00:12:18.960 who is housed at FMC Carswell in Fort Worth, Texas,
00:12:23.360 was placed in administrative segregation for exposing himself to female prisoners,
00:12:28.680 apparently joking that he was fully intact.
00:12:33.280 Congratulations, Judge Netburn.
00:12:34.820 That's what you're doing to the women in this prison.
00:12:37.640 You're subjecting them to victimization and assault.
00:12:41.840 If a guy on the subway did this,
00:12:44.180 whipping out his genitalia to you on the subway,
00:12:47.120 you'd deck the guy and arrest him for indecent exposure.
00:12:50.300 But this radical says he's got a constitutional right to be there and do this.
00:12:56.420 I have to say this is an issue everyone on this committee knows this isn't right.
00:13:02.960 Every one of us.
00:13:04.600 Every one of us would be horrified if a loved one
00:13:07.540 found out she was the cellmate of a six-foot-two man who was a serial rapist.
00:13:12.720 But in today's topsy-turvy political world,
00:13:17.340 the way you get nominated to be a judge is you demonstrate you're a radical.
00:13:21.560 I know people must be saying,
00:13:23.660 well, gosh, New York has 20 million people.
00:13:26.960 They couldn't find one person qualified to be a judge to give a lifetime appointment to?
00:13:31.720 And that's the point.
00:13:32.760 What they're looking for is show us you're a radical.
00:13:37.040 This is an opportunity for every senator to demonstrate
00:13:41.080 whether you'll stand up for the rights of women or not.
00:13:44.040 I sadly expect a party-line vote on this,

00:13:47.440 If we have a party-line vote, Mr. Chairman, I'm going to make a request.

00:13:54.220 to expedite a floor vote on this judge on the floor.
