00:00:27.700 But first, Senator, let's walk through this indictment.
00:00:31.640 This is a big nothing burger, in my opinion.
00:00:34.360 They've indicted him on the federal gun charges.
00:00:36.480 This insulates the president.
00:00:38.100 It protects the big guy.
00:00:39.540 It focuses on crimes that are completely limited to Hunter Biden and no one else.
00:00:44.440 And all the big crimes they could have charged him with.
00:00:46.840 Today, they still have not done it.
00:00:49.080 This is a fix. Do you agree?

00:00:52.020 And we predicted this over a year ago on this podcast.
00:00:55.520 We talked about how the investigation into the Bidens,
00:00:59.060 if at the end of the day, the indictment that came in
00:01:01.580 was a personal offense limited to Hunter Biden,
00:01:05.300 if it was a drug offense, if it was a gun offense,
00:01:09.980 if it was a personal tax offense that was limited to Hunter himself,
00:01:15.600 then that was by design.
00:01:18.300 That was by design to insulate Joe Biden.
00:01:22.100 It's worth underscoring.
00:01:23.840 We've said it before, but we cannot forget.
00:01:26.400 This is not about Hunter Biden.
00:01:29.200 If his name was Hunter Smith,
00:01:31.200 if he was just some poor sad sack dealing with addiction and substance abuse,
00:01:37.140 nobody would care.
00:01:38.160 It wouldn't be national news.
00:01:39.400 It wouldn't be a matter of public concern.
00:01:40.940 The reason this matters is because there's considerable evidence
00:01:47.020 that Hunter Biden solicited and received tens of millions of dollars
00:01:52.600 from corrupt foreign players in exchange for official favors from his dad,
00:01:59.660 Joe Biden, now the president of the United States.
00:02:02.800 That's what matters.
00:02:03.960 And so this indictment, we said a year ago,
00:02:05.720 if they just bring a gun crime,
00:02:08.260 they're covering up for Joe.
00:02:09.880 Now, there are three, three indictments.
00:02:12.000 There are three counts of the indictment.
00:02:14.200 Two counts are tied to Hunter Biden completing a form
00:02:18.020 indicating that he was not using illegal drugs
00:02:20.400 when he purchased a Colt Cobra revolver in October of 2018.
00:02:25.520 And the third count alleges that he possessed a firearm
00:02:29.060 while using a narcotic.
00:02:31.780 Now, those, those are crimes that I think Hunter clearly committed,
00:02:36.280 that there's very little material dispute that he is guilty of those crimes.
00:02:41.280 By the way, those indictments could have been brought years ago.
00:02:44.520 The evidence was there, has been there for years,
00:02:47.240 and DOJ delayed and delayed and delayed and delayed and delayed.
00:02:50.820 And this is all about insulating Joe Biden.
00:02:54.500 Joe Biden does not bear any liability for Hunter being on crack
00:02:59.100 while he illegally buys a gun.
00:03:00.460 That's a bad development for Hunter.
00:03:03.580 But the purpose of this is to insulate the White House
00:03:09.160 and to let the Biden DOJ say,
00:03:12.020 see, we indicted a Biden.
00:03:14.100 Aren't we tough?
00:03:15.580 And they're deliberately carving off and protecting Joe,
00:03:19.460 who is the reason that the public rightfully cares about this.
00:03:23.840 Well, let's talk about the compare and contrast to the plea deal.
00:03:28.060 This is what he was going to plead guilty to
00:03:30.700 that they're now charging him with.
00:03:33.200 How is this going to change?
00:03:34.860 I mean, is the fact that they've, it's not a plea deal
00:03:37.680 and they're going to, they've charged him
00:03:39.700 and died on this federal gun charge.
00:03:41.520 Does that change the chances he might actually go to prison
00:03:44.200 for any amount of time?
00:03:46.020 It probably does.
00:03:47.940 But if you look at it, we look at the evolution of this.
00:03:51.000 We now know, and we've covered in previous podcasts,
00:03:54.320 that the Biden DOJ was initially prepared to have a plea deal
00:03:58.280 where Hunter didn't have to plead guilty to anything.
00:04:01.900 He could just enter an agreement, get not even a slap on the wrist,
00:04:05.740 sort of a wave over the hand and everything goes away.
00:04:11.080 And without even pleading guilty to anything,
00:04:14.460 the Biden DOJ was prepared to give him complete and total immunity
00:04:18.360 for any and all criminal conduct, especially, especially, especially
00:04:22.460 the criminal conduct that implicated his father.
00:04:25.640 And that really, I believe, was the entire objective of this whole thing.
00:04:29.480 Now, what happened to derail that plan,
00:04:32.900 when they announced they were indicting Hunter, that was the plan.
00:04:36.120 The Biden Department of Justice was obstructing the investigation
00:04:39.640 that Merrick Garland had lied under oath to Congress.
00:04:42.640 And given that, the heat ratcheted up.
00:04:45.340 And they said, okay, you've got to plead guilty,
00:04:47.480 but we'll still make it a slap on the wrist.
00:04:50.420 Hunter, you still don't have to serve even a day, even a minute in jail.
00:04:55.560 We'll make it all magically go away.
00:04:57.460 And the critical piece that was added to this is,
00:05:00.240 and you get a get-out-of-jail-free card for all corrupt activity,
00:05:04.100 for bribery, for everything that was done,
00:05:06.900 selling access to daddy, selling favors from daddy.
00:05:09.520 All of that is exonerated when you sign on to this agreement with no jail time.
00:05:16.460 Now, what happened then is the whistleblowers came and testified before Congress.
00:05:21.780 And the global attention on this ratcheted up considerably.
00:05:27.240 And so suddenly they went before the federal district judge.
00:05:30.140 And the judge asked DOJ, so are you saying that everything else Hunter's done,
00:05:35.640 and mind you, the House of Representatives filed a brief with the district judge,
00:05:38.620 laying out all of the evidence of Hunter's potential other criminal conduct,
00:05:43.820 of Joe Biden's criminal conduct.
00:05:45.760 And the judge asked DOJ, are you saying you're not going to prosecute anything else
00:05:51.600 other than these counts on which you're giving him a slap on the wrist?
00:05:55.920 And DOJ got really nervous, and they said, no, no, no, we're not saying that.
00:05:59.260 And I think they just, they lost their nerve to give Hunter, and really to give Joe,
00:06:07.380 because Joe is always the beneficiary of this corruption, the get-out-of-jail-free pass.
00:06:13.480 That's what led to the plea agreement falling apart.
00:06:16.460 I think this is the third iteration.
00:06:18.020 And by the way, we predicted this third iteration, that they would come back and they would indict Hunter.
00:06:22.840 But again, it's on the personal crimes.
00:06:26.600 And if there's not a plea agreement, I think the odds are significantly higher that Hunter serves some jail time.
00:06:36.580 But I also think...
00:06:38.620 What does something look like?
00:06:39.200 I mean, are we talking a day or two days or three days or a month?
00:06:42.580 I mean, if they were willing to give him no jail time before, and now they charge him with this,
00:06:46.660 if he's found guilty, how much does that come to the discretion of the judge?
00:06:52.440 Or are there minimums or sentencing guidelines here?
00:06:55.160 I mean, how concerned is he tonight?
00:06:57.600 Okay, wow, I may actually spend real time in jail.
00:07:00.800 Look, DOJ wants to give him no jail time.
00:07:03.420 They wanted to give him a deal where he doesn't even plead guilty to anything.
00:07:06.460 So this is not a true adversarial proceeding.
00:07:10.280 This is not a prosecutor who is seeking to hold someone accountable.
00:07:14.160 The reason Merrick Garland appointed David Weiss as special prosecutor, as special counsel rather,
00:07:19.600 is that he'd already demonstrated that he was willing to obstruct justice and cover up Joe Biden.
00:07:27.280 That's the objective here.
00:07:29.400 And so the small level objective with this case,
00:07:35.140 I think this case probably gets resolved with the plea deal as well.
00:07:39.080 And the plea deal may require Hunter to serve six months in jail.
00:07:43.100 I think that's a real possibility.
00:07:45.460 And they may get nervous about having a commitment, we will not investigate anything else.
00:07:50.600 Now, mind you, they intend not to investigate anything else.
00:07:55.180 And it wouldn't surprise me at all to see DOJ say privately, look, wink, wink, nudge, nudge, we're not going to investigate anything else.
00:08:05.560 But we can't say that in open court because it makes us look like completely partisan, corrupted, compromised hacks.
00:08:13.080 And it may be that Biden's lawyers take that and that he serves some time in jail.
00:08:20.160 We do seem to have seen some movement among Democrats, among the press, where they've decided throw Hunter overboard a little bit in order to protect Joe.
00:08:32.260 It's why the last podcast on Wednesday, and by the way, if you did not listen to Wednesday's podcast, you should go back and listen to it.
00:08:39.640 It was really important explanation on the impeachment of Joe Biden, why the Democrats claim that there is no direct evidence of Joe's involvement as corruption is a flat out lie.
00:08:52.360 And we walk through it chapter and verse on Wednesday's podcast.
00:08:57.940 The fact that they have shifted their defense to saying there's no direct evidence of Joe's involvement indicates that they've collectively decided to cut bait and throw Hunter to some extent to the wolves.
00:09:10.720 Now, I suspect Joe is still not entirely comfortable with Hunter serving 10 years.
00:09:17.000 But at this point, I think the most likely outcome, absent enormous public pressure, is Hunter pleads guilty to these charges, serves some minimal jail time, six months to a year.
00:09:32.960 These charges go away and the investigation and everything else just quietly disappears.
00:09:38.800 DOJ doesn't admit in court they're not going to investigate it.
00:09:42.560 They simply say nothing else.
00:09:46.000 And actually, that then serves as a shield for DOJ when Merrick Garland or anyone else from the Department of Justice is brought before Congress.
00:09:55.860 Their response will be, when asked about Hunter, it's still an ongoing investigation.

00:10:02.320 When they have, I believe, zero intention to investigate the claims of bribery and corrupt selling of official favors from Joe Biden because the Department of Justice wants to protect Joe Biden above all else.

00:12:08.620 This is what they had to say as they were breaking the news on the Hunter Biden indictment on the federal gun charge.
00:12:14.980 And they're trying to turn this into a very big deal.
00:12:17.700 While at the same time, the media then an hour later is trying to tell you that the case against Hunter Biden is actually really weak.
00:12:24.620 Breaking news now.
00:12:25.740 We have just learned and we just got the paperwork that Hunter Biden, the president's son, has been indicted for lying when buying a gun.
00:12:33.640 And I want to bring in NBC's Garrett Haake.
00:12:35.480 Garrett, what can you tell us?
00:12:37.120 Well, Chris, this indictment just unsealed in Delaware charges Hunter Biden with three counts all related to that gun purchase.
00:12:43.560 It describes two counts of knowingly making a false or fictitious statement when purchasing a gun,
00:12:49.840 basically accusing him of lying about being addicted to drugs at the time he was purchasing this weapon, a pistol, in October of 2018.
00:12:57.860 And the third count is that he did knowingly possess that same firearm while essentially while being addicted to a controlled substance.
00:13:07.620 So these are counts that were all thought to have been dealt with in that plea deal that fell apart a couple of months ago,
00:13:14.720 kicking things back to the U.S. attorney, now special counsel.
00:13:18.640 Weiss handling this in Delaware, a former U.S. attorney in the district of Delaware.
00:13:22.620 Again, this indictment on field dealing only with the gun and drug charges.
00:13:26.900 I think it's reasonable to presume we have not heard the last of charges against the president's son,
00:13:32.520 given the scope of what was originally in front of the U.S. attorney and then kind of fallen apart back to the drawing board to bring forward these counts now.
00:13:40.960 By the way, he said it fell apart.

00:13:43.720 And then MSNBC tries to tell you that they don't think we've heard the last of the indictments.
00:13:48.520 I don't believe that.

00:13:58.700 They want to say we indicted him.
00:14:00.660 They want to get a conviction, and I think the conviction is likely.

00:14:06.080 They may try to do some pretrial motions and some procedural delays, but I don't think they're going to want to take this to a jury.
00:14:12.580 So I think it's likely to be resolved with a plea deal.
00:14:15.820 And the plea deal in all likelihood will end up slightly stouter than the slap on the wrist that they tried the second time.
00:14:24.220 But the purpose of this, and we predicted this a year ago.
00:14:29.100 This is not new.
00:14:30.000 It's not surprising.
00:14:31.260 The purpose of this is to put to rest all of the allegations of corruption against Joe Biden because the Biden DOJ is looking to an election coming up November of next year.
00:14:44.200 And by the way, they're busy indicting Donald Trump, which is also looking to an election coming up next year.
00:14:50.840 And when it comes to election interference, we've never seen a Department of Justice behave like Merrick Garland and this profoundly politicized Department of Justice.
00:15:00.620 Now, this case, by the way, that they have brought against him, there's a lot of evidence that was from that laptop from hell and the forms and the pictures and the drug use.
00:15:12.580 I would argue it's probably a very strong case for there to be a conviction against Hunter Biden if you look at the evidence.
00:15:19.620 Yet, CNN, just barely an hour after this indictment comes out, they start carrying water for Hunter Biden.
00:15:29.060 And this is what they said, calling it a weak case.
00:15:32.680 ...of politics is right, often coming from the former president himself in terms of what they say is a two-tiered justice system.
00:15:40.480 But here you have it, as we noted, first time in U.S. history the son of a president has been charged by the Justice Department.

00:15:49.620 Yeah, let's chat with CNN legal analyst Jennifer Rogers.
00:15:52.800 Jennifer, obviously, again, this is a historic moment, the first time DOJ has charged the son of a sitting president.
00:15:58.680 Your reaction to the news?
00:16:00.760 Well, Boris, I really think, you know, the first time we had a charge against a former president,
00:16:05.260 it was important that prosecutors really took their time and built strong cases based on compelling evidence.
00:16:11.180 And I'm afraid the prosecutors have not done that here.
00:16:14.560 I certainly, if I were making history, would not want to make it with this set of facts and these laws.
00:16:19.620 I think that this case is weak.
00:16:22.040 It's very, very rarely charged, this section on being an addict in possession of a weapon.
00:16:28.560 So I think they have a lot of problems, both on the factual side, which is why it's very rarely charged.
00:16:34.020 And on the legal side, you know, after the Supreme Court's decision in the Bruin case on the Second Amendment,
00:16:39.840 a lot of legal observers think that all these gun possession statutes are in jeopardy.
00:16:44.540 And we know that Hunter Biden's lawyers will fight vigorously on the legal front,
00:16:48.620 saying that that after the Supreme Court's decision that this conviction could not stand.
00:16:52.280 So I think they've got a lot of trouble here ahead and we'll see how it plays out.
00:16:57.680 But I think it's inadvisable.
00:16:59.980 Senator, when I heard this, I was dying to get your reaction because they're now telling you this case is so weak that this is a dumb case to even bring up,
00:17:06.620 even though they're willing to do a plea deal on the same case that got then blown up.
00:17:10.020 So which one is it?
00:17:11.340 Yeah, look, Hunter's already agreed to plead guilty to these counts.
00:17:14.020 So so oddly enough, CNN, you know, I don't know who that, quote, legal analyst is,
00:17:19.740 but you could have just called her a Democratic Party shill because she says, well, first of all,
00:17:24.600 the case against Donald Trump is incredibly strong.
00:17:27.540 It is meticulously researched.
00:17:29.060 It is oh, oh, so powerful.
00:17:31.040 What utter and complete garbage.
00:17:33.180 The case against Trump is a political hatchet job.
00:17:37.660 And they may get a conviction before a D.C. jury that is 90 plus percent Democrat.
00:17:43.240 But I think the chances of that conviction standing up on appeal are minuscule.
00:17:49.200 But but of course, CNN so-called legal analyst is not going to tell you that.
00:17:53.760 And as for the claim that that this this charge is weak.
00:17:57.980 OK, the critical elements are.
00:18:01.580 Did he buy a gun?
00:18:02.900 Yes.
00:18:03.340 As far as I know, there's no dispute about it.
00:18:06.140 Was he a drug addict?
00:18:08.240 Yes.
00:18:08.660 And I'm not aware of any meaningful dispute about it.
00:18:11.360 The guy was dishonorably discharged from the military for his drug addiction.
00:18:15.360 He's wrestled with drug addiction for years.
00:18:19.360 We have pictures and video of him using illegal drugs.
00:18:24.000 Did he lie on the form, which is a felony?
00:18:26.600 Again, there's no dispute about it.
00:18:29.580 He clearly checked the box lying on the form.
00:18:32.640 So to say the case is weak, I don't even know a factual claim, an element of the crime that
00:18:40.040 is in dispute.
00:18:40.960 And her final point, well, after the Bruin case, you know, any gun claim is is legally
00:18:48.140 dubious.
00:18:48.960 What nonsense?
00:18:49.940 No, it's not.
00:18:51.160 What is legally dubious is efforts from Democrats to restrict the right to keep and bear arms
00:18:57.400 of law-abiding citizens?
00:19:00.360 There are, she says, lots of legal scholars doubt this provision.
00:19:04.680 No, no, that's not true.
00:19:06.820 There have been laws on the books for a long time prohibiting felons from possessing firearms.
00:19:12.120 I don't know of a single legal scholar who doubts the validity of those provisions.
00:19:16.900 This is part of that same law that deals with people with serious drug addictions.
00:19:22.500 I, again, don't know of a legal scholar who challenges those provisions.
00:19:28.020 So her claim, look, it's the typical leftist claim that if a law-abiding citizen has a right
00:19:33.920 to keep and bear arms, well, that means everyone can possess weapons.
00:19:37.240 Let's just hand out guns to murderers in jail.
00:19:41.240 It's like, no, no, that's not what the Second Amendment says.
00:19:44.720 That's not what it's ever been understood to say.
00:19:47.180 What the Second Amendment says is that a law-abiding citizen can defend himself, can defend his
00:19:52.340 or her family, can keep and bear arms.
00:19:56.300 And so I got to say, listening to it, there literally is not a sentence in that so-called
00:20:02.100 legal analysis that isn't just laughably false.
00:20:06.360 Yeah, they love to make up stuff, and they do it every day.
00:20:10.040 And even on the biggest news days, they'll come in with the propaganda just hours afterwards
00:20:14.380 to try to spin this in favor of the Biden crime family.
00:20:17.760 I also want to move on to the other big issue.
00:20:19.640 And by the way, Ben, I want to make clear that when I talk about what laws are in dispute
00:20:26.440 or not, the first big seminal case from the Supreme Court establishing the individual right
00:20:35.700 to keep and bear arms was Heller v. District of Columbia.
00:20:39.280 I am very familiar with that case because I represented the state of Texas and 31 other states in that case.
00:20:47.820 I was part of the Supreme Court case that upheld the individual right to keep and bear arms.
00:20:53.800 And it was a fundamental, foundational case.
00:20:57.660 Justice Scalia wrote the majority opinion.
00:20:59.840 And I'll tell you what we said in our amicus brief on behalf of Texas and 31 other states.
00:21:05.260 We said, of course the laws prohibiting felons from being in possession of firearms are legal and constitutional.
00:21:12.520 What government cannot do is strip the right to keep and bear arms from law-abiding citizens.
00:21:18.660 So she claims lots of people dispute that with no apparent awareness of what actually is or are the underlying arguments concerning the constitutional right.

00:22:09.580 If you don't know James Carville, I'll just remind you he's a—on the left, they would refer to him as a brilliant political mind, a mastermind behind the Bill Clinton days.
00:22:19.740 He is on TV a lot talking on MSNBC and other places about the Democratic Party.
00:22:26.440 He was on CNN, and he had this to say about the impeachment inquiry moving forward on the House side.

00:22:56.000 And the people in the House that are going to be on this committee, like Dan Goldman, Delgado Plaskett, I think is from Virgin Islands, Jamie Raskin, these are very smart people.
00:23:08.260 I don't think the White House needs to worry too much about this and let these congressional Democrats who are whip smart are just going to eat these people alive.

00:24:32.240 He's the person most famously associated with the phrase, it's the economy, stupid, which was right behind Bill Clinton beating George Herbert Walker Bush and getting elected president in the first place.
00:24:44.620 And so Carville's a smart guy, but I've got to say what he just said on CNN is shockingly foolish and demonstrably wrong.

00:27:29.640 But if we have hearings and hearings that the American people pay attention to, they will hear that evidence and things like over 100 suspicious activity reports, reports that banks filed about what appeared to be money laundering by the Biden family.

00:27:54.100 But the only purpose of them is to launder money.

00:28:35.560 That evidence, one after the other after the other, is compelling.

00:28:47.920 And so what Carville is doing, look, in Wednesday's podcast, we said the Democrat talking point is there's no evidence.
00:28:54.620 The more savvy people are saying no direct evidence, because everything I just cited is evidence, although most of that is circumstantial evidence.
00:29:01.000 Circumstantial evidence is powerful evidence on which people are convicted of crimes every single day of the year.
00:29:08.380 But as we discussed in Wednesday's podcast, there are at least two separate pieces of direct evidence.

00:29:20.660 And number two, Joe Biden admitting on tape that he held a billion dollars in U.S. loan guarantees hostage to force the Ukrainian government to fire the prosecutor who was investigating the corrupt Ukrainian oligarch.
00:29:39.300 That, too, is direct evidence of one of the critical elements of bribery.
00:29:43.320 And so I got to say, James Carville, be careful what you wish for, because if the American people hear this evidence, it stinks.

00:31:08.660 The White House had a very interesting response, and this is the third change now in the goalposts for Joe Biden's involvement with Hunter Biden's businesses.

00:31:32.940 Now, the White House's Ian Sams came out and moved the goalposts again when he said this.
00:31:38.960 One of the other allegations is the president was present at some of the meetings between Hunter Biden and his business associates.
00:31:45.900 Why was the president at those meetings on those phone calls?
00:31:50.320 Well, again, I think this is part of the right wing's misinformation machine to try to confuse people about what the truth is.
00:31:57.540 The truth is that the president, as he has said publicly for years, calls his family every day to check in.

00:32:05.920 He calls his other family members to check in to see how they're doing.
